Re: Recommendation for Reform to Signatory Requirements to Citizen Petitions
Dear Council Members,
This letter is written on behalf of the Hawkeye Chapter of the ACLU of Iowa. We would
like to welcome you to the City Council. We look forward to working with you as you take
on your important work on behalf of Iowa City residents in your role as councilpersons.
As you begin -to set priorities for the coming year, we would like draw your attention to an
issue of critical importance impacting civic participation and democratic engagement here in
Iowa City. As you may know, as part of the scheduled Review of the Iowa City Charter
("Charter"), the outgoing Iowa City Council made an important change toward this end by
fixing the requirement for signatories on citizen initiative and referendum petitions to allow
all eligible voters to take part—not just those already registered.
However, the City Council simultaneously raised the number of required signatures on
petitions. That change was harmful to the ability of Iowa City residents to directly
participate in local government. Such participation is an important organizing principle of
our local government, and the reason for which Iowa City has the unique initiative and
referendum process that it does.
Iowa law also supports lowering the number of signatures required. Iowa Code § 362.4
provides:
362.4 Petition of eligible electors.
If a petition of the voters is authorized by the city code, the
petition is valid if signed by eligible electors of the city equal
in number to ten percent of the persons who voted at the
last preceding regular city election, but not less than ten
persons, unless otherwise provided by state law. The petition
shall include the signatures of the petitioners, a statement of
their place of residence, and the date on which they signed the
petition. The petition shall be examined before it is accepted
for filing. If the petition appears valid on its face it shall be
accepted for filing. If it lacks the required number of
signatures it shall be returned to the petitioner. Petitions which
have been accepted for filing are valid unless written
objections are filed with the city clerk within five working
days after the petition is received. The objection process in
section 44.8 shall be followed.
Id. (emphasis added.) Currently, the Charter requires signatures equal or greater to 25
percent of the person who voted in the preceding city election, significantly higher than the
number required for validity under the Iowa Code.
Accordingly, we urge the Council to replace the signature requirements of Section 7.03(A)
of the Charter with the language used by Iowa Code § 362.4 as follows:
Section 7.03. Petitions; Revocation Of Signatures.
A. Number Of Signatures. Initiative and referendum petitions must be signed by
eligible electors equal in number to at least ten percent of
the number of persons who voted in the last regular city election, but such signatures
of eligible electors shall be no fewer than three thousand six hung.a ten.
Amending the Charter to comply with the state law would reaffirm the new Council's
commitment to the interests of the Iowa City community at large by allowing its citizens to
feel that the City government has not placed an unreasonable hurdle in the way of their
access to the democratic process locally.

homeless in Iowa was an extremely wonderful life in Mount Vernon the last four years ....but time to 'get back to work'

The 100Grannies for a Livable Future wish to respond to your desire for suggestions for making Iowa City a better place
to live. We were pleased to read the article by the Mayor in the Press Citizen and began to assemble this list.
They are not in any particular order of importance to us. We think they are all important and some are much easier to
accomplish than others.
1 --Elimination of single -use plastic bags and styfrofoam products.
2 --Elimination of pesticides and fertilizers from all public spaces; intensive education of private home owners
3 --Recycling available at all apartment buildings currently not serviced
4 --Curbside composting
5 --Carbon neutrality in all new buildings; transition to renewable energy
6 --Expansion of public transportation rather than expansion of roads and highways
7 --Opportunities to discuss items before council before the council has already made up its mind.
8 --Careful use of TIF funding; review of existing procedures.
If we can help with any of these items, we stand ready. We also know that we are not the only citizens who support these
action items.

At our December meeting, .the Board, of Adjustment approved a motion to recommend that the
City_ Council consider;a policy to require, landlords to disclose to tenants when residential rental
property -is located in .the floodplain,
There are two .aspects to .such . disclosure. The first is whether landlords are aware that a
particular rental property is located, in, the floodplain, While most property „owners may know this
based on the additional insurance required for properties in the floodplain, it is possible that''a
property manager may not. For this reason, the Board recommends that this information be
requested as part of the rental permit process. This would compel anyone applying for a rental
permit to determine whether the property they manage is in the floodplain.
The second aspect is disclosure by the landlord to the tenant who will occupy a property. This
could be as simple as including an acknowledgement on the City's information and disclosure
form—a document that accompanies all residential leases.
This issue came to the attention of the Board in October, when we voted to approve the
establishment of residential units above ground floor commercial for a property located in the
Community Commercial (CC -2) zone. The property in question is located in the 500 -year
floodplain. The particular dwelling units approved by the BOA will be located many feet above
the floodplain elevation such that property damage is.not tot likely an issue. However, it possible
that during a flood, residents may be ,unable to access their apartments for some time. As a
condition of the approved special exception, the applicant is required to disclose to tenants that
the property. is, located, in the floodplain'.
While: the zoning code .requires all new buildings and additions to be constructed to floodplain
standards, that does not alleviate all risk.to renters. While flooding on the creeks is brief, floods
along the; Iowa, River.may take weeks or even more than a month to subside. Again, while this
may not put personal property at risk, it may present more than an inconvenience.
This motion by the Board recommending that City Council consider a policy requiring landlords
to disclose to tenants whether a property is located in the floodplain was passed by unanimous
(5-0) vote. We encourage you to consider a proposal implementing such a policy to ensure that
renters have the opportunity to weigh the potential risks that come with renting in the floodplain.

Re: Requiring landlords to disclose to tenants when residential rental properties are
located in the floodplain.
The Board of Adjustment is recommending that the City Council consider a policy to require
landlords to disclose to tenants when residential rental property is located in the floodplain.
While this request appears to be feasible there are multiple components that come into play with
the recommendation. For example the language for the Informational Disclosure and
Acknowledge Form is dictated by the Housing Code and would require an amendment to
include the new floodplain disclosure.
The development of the Iowa City Zoning map as a GIS base map is nearly complete. This
change coupled with a GIS floodplain overlay should assist in the ability to quickly disseminate
this information out to property owners and managers. Neighborhood Services staff will
research these items and return with a more formal response in the coming weeks.

Good afternoon Jessie,
Thank you for your e-mail regarding various parking amnesty programs across the country. Typical programs include
waiving of late fees, $1 off per item donated, waiving of certain types of citations, etc. We have investigated these types
of programs in the past but decided on a different path. Several years ago we implemented a change to our citation
practices where we issued a $0 citation for the first expired meter citation issued per year. This has resulted in the
issuance of over 169,000 $0 citation since FY2011. In addition, 2 years ago, we implemented our First Hour Free
Program. This charges all users within our gated parking facilities $0 for the first 60 minutes. That program has resulted
in over 2.3 million hours of free parking over the first two fiscal years. We will continue to look at programs to
implement that will make improvements to how we operate and will continue to evaluate programs similar to the
seasonal amnesty program that you mention. Once again, I want to thank you for taking the time to reach out to us
with your thoughts on ways to improve our system. Please feel free to contact me if you wish to discuss this or other
thoughts you have in more detail.

Hello,
Several towns, including Cedar Rapids, have created "food for fines" programs that allow certain fines to be
waived or forgiven in exchange for donations of food or supplies to designated charities. I have spoken with
many other fellow residents here in Iowa City who would support a similar program here. I have also been in
contact with Alex Kline, the marketing assistant for the Cedar Rapids parking authority, who created and
implemented a food drive there. She said that she would be more than willing to answer any questions about
how her program was started and how it has been a success. Her email is aklineAa parkcedarrapids.com
