Re: Designation of 716 N. Dubuque Street as a Historic Landmark
Background: The applicant, Ross Nusser, is requesting Historic Landmark designation for 716
N. Dubuque Street, a property in a High Density Multi -Family Residential (RM -44) zone.
Designation of the property as a landmark will require Historic Preservation Commission
approval of any significant changes to the exterior of the building. Landmark status will also
make the property eligible for certain zoning incentives.
This residential building was originally constructed to serve as a fraternity house and functioned
as such until late 1997 when it was purchased for use as an Assisted Group Living facility that
provides supportive services to individuals with mental illness. It is a three-story structure with
21 bedrooms, 2 kitchens (on the first floor and in basement level), shared bathrooms on the
second and third floors, laundry facilities in the basement, and large open living spaces on the
1st floor and basement level.
The property is non -conforming with regard to parking requirements. The building takes up a
large portion of the 6,500 square foot lot such that it can provide just two parking spaces.
Vehicle access is provided off an alley that runs along the north -side of house,- between
Dubuque and Linn Streets. The current parking requirement for assisted group living is 1 space
for every 3 beds, plus 1 space for each staff member determined by the maximum number of
staff present at any one time. For 21 residents and two staff people the parking requirement is 9
spaces. For this reason the property is allowed to convert to another use that requires 9 or
fewer spaces. For uses requiring more than 9 parking spaces a special exception is required.
Historic Preservation Commission Review: The Iowa City Historic Preservation Commission
met on February 11 and conducted a public hearing at which they reviewed and evaluated the
historic significance of 716 N. Dubuque Street. The Commission determined that the property
meets the requirements for a landmark and voted unanimously to recommend approval of the
designation as an Iowa City Historic Landmark.
The attached Iowa Site Inventory Form and photos provide evidence and a discussion of the
building's architecture and history. The building was constructed in 1931 as a fraternity house.
Following the rapid expansion of the University in the 1920's a number of Greek Houses were
constructed and remain as architectural evidence of the increased impact of the University
Community on the culture of Iowa City during this period. Typical of many Greek letter houses, it
was built in a revival style. It is a two and one-half story L-shaped Tudor Revival house that has
retained a high-level of historic integrity.
As noted, designation of the property as an Iowa City Historic Landmark will require Historic
Preservation Commission approval of any significant changes to the exterior of the building.
Landmark status will also make the property eligible for special exceptions (Section 14-26-8 of
the zoning code) that allow the Board of Adjustment to waive or modify certain zoning
requirements to help support the continued use of historic buildings.

Board of Adjustment Review: On February 17 the Board of Adjustment approved a special
exception for a historic preservation waiver of required parking to allow a fraternity with up to 21
residents, subject to the following conditions:
• The applicant must secure a Local Historic Landmark Designation from the City of Iowa
City.
• All changes to the properties exterior must meet Historic Preservation guidelines.
• The applicant must make those repairs and renovations to the exterior and foundation of
the structure as listed in this submittal (see attachment #7) as well as any repairs
deemed necessary by the Historic Preservation Commission.
• All aspects of the interior must meet code standard. Shared bathrooms must use
materials and fixtures of an institutional grade.
• In the area where there is currently a deck, the applicant must install moped parking
stalls equal to at least one half of the residential occupancy of the building. Design and
installation of moped parking to be approved by the Historic Preservation Specialist.
• The applicant must install interior bike storage on the ground floor level of the building
sufficient to store one bike per resident based on the maximum number of residents
allowed by the special exception. Staff will review proposed bike rack/storage and
access to the ground floor to ensure bike storage is easily accessible.
• All chapter meetings held by the fraternity must held at an off-site location.
• Three convictions for a disorderly house within an 18 -month period will result in the loss
of the special exception at which point the property will revert to 12 residents maximum.
Given the requirements of the code and the conditions placed on the special exception, the
applicant must secure landmark designation of the property prior to converting the building from
an Assisted Group Living facility to a fraternity.
Planning and Zoning Commission Review: Landmark Designation is a zoning overlay and
therefore requires a recommendation from the Planning and Zoning Commission to the City
Council. The Commission's role is to review the proposed designation based on its relation to
the Comprehensive Plan and proposed public improvements and plans for renewal of the area
involved. There are two specific areas of the Comprehensive Plan that appear to apply to this
proposal: the Central District Plan- pages 13-22 and the Historic Preservation Plan.
The Central Planning District Plan identifies this area of Dubuque Street as appropriate for higher
density housing. The plan encourages incentives for property improvement and rehabilitation of
the existing housing stock, both for homeowners and investment property owners.
The Historic Preservation element of the Comprehensive Plan contains two specific goals relating
to this proposal. Goal 3: Provide economic incentives to encourage the preservation of historic
buildings and neighborhoods. Under this goal the plan contemplates exemptions for zoning
standards, such as parking requirements, to encourage the reuse of historic buildings.
Goal 7: Establish and implement historic preservation objectives for the University of Iowa campus
and surrounding neighborhoods. Under this goal there is an objective to establish a fraternity and
sorority house stewardship program. The plan recognizes that as these historic structures age
they will require major rehabilitation. To fulfill the conditions of the special exception the owner will
need to present a plan for the rehabilitation of the property to the Historic Preservation
Commission for review and approval.

In essence the landmark designation sought by the applicant conforms with two goals of the
Comprehensive Plan - to provide relief from zoning requirements while also requiring investment
necessary to assure the long-term preservation of this historic building.
Staff Recommendation: Staff recommends that REZ16-00014 an application to designate 716
N. Dubuque Street as an Iowa City Historic Landmark be approved.

Re: 716 N. Dubuque Street — Phi Kappa Sigma Fraternity
Applicant Ross Nusser has requested that the property at 716 N. Dubuque Street be designated
as an Iowa City Historic Landmark. Designation of the property as a Landmark will require
Commission approval of any significant changes to the exterior of the building. Landmark status
will also make the property eligible for certain zoning incentives.
The enclosed Iowa Site Inventory Form, Property Characteristic Form, Evaluation Sheet, and
additional photos provide evidence and a discussion of the building's architecture and history.
The building was constructed in 1931 as a fraternity house. Typical of many Greek letter
houses, it was built in a revival style. It is a two and one-half story L-shaped Tudor Revival
house that has retained a high-level of historic integrity.
To qualify for designation as a Landmark, the subject property must meet approval criteria a.
and b. and at least one of approval criteria c., d., e., or f:
a. Significant to American and/or Iowa City history, architecture, archaeology and
culture;
b. Possesses integrity of location, design, setting, materials and workmanship;
c. Associated with events that have made a significant contribution to the broad
patterns of our history;
d. Associated with the lives of persons significant in our past;
e. Embodies the distinctive characteristics of a type, period, or method of construction;
or represents the work of a master; or possesses high artistic values; or represents a
significant and distinguishable entity whose components may lack individual
distinction;
f. Has yielded or may likely yield information important in prehistory or history.
Following the rapid expanse of the University in the 1920's a number of Greek Houses were
constructed and remain as architectural evidence of the increased impact of the University
Community in the culture of Iowa City during this period. 716 Dubuque Street meets criteria A
as a remaining representative of this important part of Iowa City's architectural history. The
property is located along North Dubuque Street in "fraternity row", was constructed of high
quality brick and stone materials, and remains intact with the exception of replacement windows
and a removed brick wall at the front entry and along the north alley. As such, this property
meets criteria B. In addition, the property is representative of the Tudor Revival style, one of the
revival styles common with the Greek Houses in the neighborhoods surrounding the University
during the property's period of significance, 1839-1946. As an intact and characteristic
representative of this Style, the property meets criteria E. Finally, in 1997, the property was
reviewed by the Iowa State Historic Preservation Officer who determined that the property
appeared to be eligible for listing on the National Register of Historic Places.

Based on the information provided in the Site Inventory Form, staff finds that the property meets
criteria a, b, and a and therefore qualifies as an Iowa City Historic Landmark.
Recommended Motion:

Iowa City Historic Landmark based on the following criteria for local designation: criteria a, b

This two and one—half story gable roof building (three and one—half on the north side) was
constructed in 1931 as a fraternity house. No architect has yet been identified. Like many other
Creek letter houses in Iowa City it was built in a popular revival style, in this case, Tudor Revival.
The exterior is of stone with stone surrounds at the doors and windows and quoined corners. A rear
wing was added at the second floor level and this is covered with the traditional half—timbering. A
small "garden gate" with stone surround is located to the left of the main entrance. The house
retains a high level of integrity. It may be individually eligible with further research, and is
definitely a contributing structure in the North Dubuque Conservation District.

In the 1920s and '30s fraternity and sorority houses were being built in various parts of Iowa City,
including the Clinton and Dubuque streets area. (There were eight built on North Dubuque alone
between 1920 and 1933.) These were often replacing houses that the Greek letter societies had
purchased or rented to provide housing for their members. The new houses appear to have been
architect designed and were primarily in various popular revival styles. This construction coincided
with a period of tremendous growth for the State University of Iowa. Enrollment grew from 5345
in 1920 to 8235 in 1930, and peaked near 10,000 a little later in that decade. There wer 33
new buildings constructed on the campus between 1916 and 1934, in addition to the construction of
almost two dozen fraternity and sorority houses. These houses exemplify the Development of the
University of Iowa context. While some may be individually eligible, all Greek letter houses in Iowa
City need to be surveyed and then re—evaluated as a sub—context of the University context. This
house may be individually eligible and is presently considered a contributing structure in the district.

solid state.

PUBLIC DISCUSSION OF ANY ITEM NOT ON THE AGENDA:

REZONING ITEM (REZ16-00001):
Discussion of an application submitted by Ross Nusser for a rezoning to designate the property
at 716 N. Dubuque Street as a Historic Landmark.
Miklo began the staff report showing a photograph of the property. The building was built in the
early 1930's as a fraternity house and was used as a fraternity house up until the late 1990's
when it became an assisted living facility. It was built with 21 bedrooms, 2 kitchens, and shared
bathrooms. When it changed from a fraternity to an assisted living use it lost its right to a
fraternity because of its lack of parking. The property only has two parking spaces. Miklo
explained that there is a provision in the zoning code that allows landmark properties to be
considered for special exceptions to allow a reduction in the parking requirements.
The Historic Preservation Commission has reviewed the property and determined the property is
eligible to be a landmark. The building maintains much of its original character with only the
windows and a few minor changes to the landscaping have been made to the exterior.
The Board of Adjustment also reviewed the request for the special exception and did approve the
request with a number of conditions designed to ensure that there is an investment in the
property in exchange for the reduction in the parking, which is a significant bonus. Allowing the
use of the property as a fraternity should serve as an incentive to make improvements to

preserve the property in the long-term as a landmark.
The Planning and Zoning Commission's role in this process is to determine whether the
landmark designation complies with the Comprehensive Plan. The Central District Plan
encourages restoration of historic properties. Staff feels that the historical landmark designation
would conform to the Comprehensive Plan.
Staff recommends that REZ16-00014 an application to designate 716 North Dubuque Street
as an Iowa City Historic Landmark be approved.
Parsons asked about the boundaries for the Northside Historic District. Miklo said that
district begins a few lots to the east of this property, as does the Brown Street Historic
District. Miklo showed a map of the area.
Eastham asked about the Board of Adjustment's conditions imposed on the granting of
special exception, and asked if the Planning and Zoning Commission had any review over
those conditions. Hektoen replied that they do not.
Freerks opened the public discussion.
Ross Nusser (applicant) came forward to answer any questions from the Commission.
Hensch noted the concern about lack of parking and how that will be addressed. Nusser
explained that was addressed at the Board of Adjustment meeting. They have provided a
couple different parking solutions, one they will provide moped parking (one space for every
two occupants) in the area where the deck is now (the deck will be removed). They will also
provide indoor bicycle parking, and since this property is less than one mile from campus
they feel many will walk.
Freerks closed the public discussion.
Hensch moved to approve REZ16-00014 an application to designate 716 North
Dubuque Street as an Iowa City Historic Landmark.
Parsons seconded the motion.
Parsons believes this building has historical merits and is close in proximity to other
historical buildings.
Freerks noted there was discussion a few years back about where fraternities and sororities
could place themselves in the community and this appears to be a well thought out solution
to a number of issues. This is a path to stabilize and restore this building. She also noted
her agreement with the points outlined by the Board of Adjustment. She noted that it
provides for a revocation if there are problems such as a disorderly house. She encouraged
the owner to educate the students that live there that this is a special use that they have
been granted. A lot of people have worked toward making this possible. They have an
opportunity for a stable environment to live and enjoy community. That this can continue for
many years if well managed. She appreciated the applicant addressing the bicycle and
moped parking needs and encourage the owner to educate that students about how difficult

it would be to have a car here.
Eastham agreed that this building is an important structure along one of the gateways into
the city and it is a great way to have a plan to maintain its historic appearance for a use that
will be economically viable over the years. He commented on the conditions regarding
fraternity chapter meetings being held off-site and disorderly house convictions leading to the
loss of the special exception. He suspects that the owner will pay attention to them as the
project moves forward.
A vote was taken and the motion carried 7-0.
CONSIDERATION OF MEETING MINUTES: FEBRUARY 18, 2016
Hensch moved to approve the meeting minutes of February 18, 2016 with one change
noting that the link to Ed McMahon's talk should be forwarded to Council.
Martin seconded the motion.
A vote was taken and the motion passed 7-0.
ELECTION OF OFFICERS:
Martin nominated to elect Freerks as Chair of the Planning and Zoning Commission.
Theobald seconded that motion.
Freerks noted that two member's terms were expiring. Dyer can reapply for a second
term but Eastham has already served two full terms.
Theobald nominated Hensch for Vice Chair.
Martin seconded that motion.
Dyer nominated Parsons to be secretary.

A vote was taken and the motions carried 7-0.
PLANNING AND ZONING INFORMATION:
Miklo noted a national Planning and Zoning Commissioners meeting that is in Phoenix
Arizona, only one Commissioner can attend and if interested to let Miklo know.
Theobald mentioned she had gone to the Iowa State Shade Tree Short Course last week
and the key note speaker was from Germany and she went to several different
workshops that were community related; community tree plans, community tree
inventory, preserving trees in developments, and enacting municipal tree and street

Landmark Designation for 716 North Dubuque Street.
Miklo said this property is located on North Dubuque Street, just west of the North Side Historic
District. He stated that the applicant, Ross Nusser, is requesting that the property be
designated as an Iowa City Landmark, which is a zoning overlay, similar to a historic district.
Miklo said that the designation of the property as a landmark would require Commission
approval of any significant changes to the exterior of the property over time. He said that it
would also provide for some zoning incentives for possible State and federal tax credit
possibilities in the future. Miklo said the zoning incentives in this case would be a possible
reduction in parking requirements that the Board of Adjustment will consider.
Miklo said the application includes information about the property from the Iowa Site Inventory
forms done as part of the North Side original town survey completed a number of years ago. He
said that the survey of the broader neighborhood identified the fraternities and sororities along
Dubuque Street and also on the west side of the river as important historic resources reflecting
the University's impact on the growth of the community, especially in the 1920s and 1930s,
when many of these buildings were constructed.
Miklo stated that the buildings were generally built in a revival style. He said that the building in
question is in the Tudor revival style.
To decide if the property is a landmark, Miklo said the Commission must determine that it meets
criterion A and B from the lists contained in the code plus one of the other criteria. He said that,

based on the information submitted, staff finds that the building does meet criterion A - that it is
significant in Iowa City history, architecture, and archaeology. Miklo said that is because it is
reflective of the University's growth and the important role the Greek communities had in the
early part of the 20th century.
Miklo said the next criterion is that it possesses integrity of location, design, setting, materials,
and workmanship. He pointed out that the historic photographs and today's photographs show
that the building is pretty much intact in terms of its major components. Miklo said there have
been some alterations, including the removal of a decorative brick wall from the front and the
replacement of the windows with vinyl windows, but otherwise the building is pretty much intact.
Miklo said that if this is approved by the Board of Adjustment, the applicant will be required to
have a plan as to how he will repair the outside of the building. He said staff will look at that in
the future, and it will have to come back before the Historic Preservation Commission for review.
In terms of location, design, setting, and materials, Miklo said this is pretty much as it was built.
He said staff thinks it clearly meets criterion B.
Miklo said staff finds that it meets criterion E in terms of being of a distinct example of revival
style and has characteristic of the period that is reflected in the Tudor style that is common
among Greek houses.
Miklo said, based on those aspects, staff feels this does meet the criteria necessary to
designate this building as a landmark, which would make it available for the incentives as
mentioned earlier.
Michaud said she is glad the Commission is entertaining this idea. She said that the building
next door to this one is very similar and asked if there is any possibility that it could be tagged
on to this.
Miklo responded that in this case, someone representing the property owner has applied for the
designation. He said that in order to designate the neighboring property, there would be a
process to go through, including meeting with the owner. Miklo said that at this point the answer
is therefore no, it could not be added to this application.
Nusser, the applicant, said he was available to answer any questions.
Corcoran asked if the building is being rented out as apartments. Nusser responded that at
present, the building is being used as an assisted group living facility. He said there are 21
units/rooms in the building being rented out, and he is now applying for a special exception.
Nusser said that is what makes the historic preservation landmark status necessary.
Nusser said that the special exception he is seeking involves the fraternity or rooming house
status. Miklo said it would basically allow for a reduction in the parking requirement. He said
that the building has two parking spaces, but the fraternity use would require significantly more
parking.
Michaud asked if that means 21 people would live here or could it potentially mean 42. Nusser
responded that it would come to whatever the Board of Adjustment deems necessary. He said
that right now, to get the parking exception, the building must go through the historic
preservation landmark designation. Nusser said that in order to change the use of the property

from what it is now, he must make a commitment to historic preservation that he will be
improving the infrastructure, that he will be improving the building, and that he will have a
commitment to that building.

MOTION: Corcoran moved to approve the designation of 716 North Dubuque Street, the
former Phi Kappa Sigma Fraternity house, as an Iowa City Historic Landmark, based on
the following criteria for local designation: criteria A, B, and E. Clore seconded the
motion. The motion carried on a vote of 9-0 (Agran absent).
Corcoran mentioned that during the recent Historic Preservation Awards ceremony, one of the
recipients was the Phi Delta Theta Fraternity, which is on the west side of the river to the north
and west of this house. She said that she spoke to members of the fraternity and its housing
board director, who is an alumnus, about research that has been done to get some kind of
protection in terms of historic preservation for all of the fraternity and sorority houses. Corcoran
said that the director of the housing board seemed very open to that.

Bristow said this application was for a door replacement in a studio. She showed a photograph
with the door to be replaced by a fiberglass, two -panel door with a single pane above it. Bristow
said staff approved this.

Bristow said this project came through in October. She said that staff and the chair approved
the final drawings recently.
Bristow said this property is in the Brown Street Historic District on the corner of Gilbert and
Brown Streets. She showed views of the house.
Bristow presented the site plan showing the addition to be on the back of the house. She said it
would be styled, to a point, like a porch. Bristow said the addition is all of the single story to the
back of the house on the right-hand side. She said that a railing would be added to the roof of
the porch in the front as well.
Bristow stated that, because this house is brick and there is really no siding on it, there had to
be a way to introduce wood siding in a way that would be more like a porch, because there was
not going to be a way to match the brick. She said it was done very much like the one on the

unanimous votes. Due to the time restrictions that the historical designation puts on this project, time is of the
utmost importance. The unanimous votes that this project as received and the support that it has gotten over the
past few months, should be an indication that we are in-line with the Cities vision. By waiting for all of the
Council meetings, this project will start to run out of time to be completed on the date requested (August 1 st). I
hope that you can see the merit in this project and also see the time crunch that i am facing with every day that
goes by.. This is a wonderful building and no doubt has a place on North Dubuque St.
