APRIL 19, 2016
Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor
Throgmorton presiding. Council Members present: Botchway, Cole, Dickens, Mims,
Taylor, Thomas, Throgmorton. Absent: None. Staff members present: Fruin, Dilkes,
Andrew, Karr, Yapp, Korpel, O'Brien, Seydell-Johnson, Knoche, Bockenstedt, Kelsay.
The Mayor proclaimed: Our Veterans — Now and Forever — April;
Bicycle Month — May, Bob Opplinger, Bicyclists of Iowa City (BIC) Education Advocate,
accepting; Arbor Day — April 29, Julie Seydell-Johnson, Parks and Recreation Dir.,
accepting.
The Mayor announced that Item No. 18 Ordinance for Transportation Network
companies will be moved up after Item No. 6.
UISG Council Liaison Nicole Neal was presented a certificate of appreciation for
serving in that capacity the past year.
The Mayor presented Student Leadership Awards to Longfellow Elementary
students: Addison Hackbarth, Emmitt Hansen, and Yamro Seabold.

time of the hearing.
Charlie Eastham, 953 Canton St., appeared reported on the Rose Oaks tenant
association and center for workerjustice press conference held earlier in the day and
urged Council to continue to pursue alternatives available to tenants. Brandon Ross,
requested Council consider banning pesticides and herbicides. Becky Ross and Deb
Schoelerman, 100 Grannies, encouraged Council to ban plastic bags. Roger Knight, Jr.,
320 E. Washington St., requested assistance in enforcing Ecumenical Towers parking;
repaid and accessibility of downtown sidewalks; Rose Oaks and affordable housing.
Moved by Mims, seconded by Botchway, that ORD. 16-4661, VACATING AN
APPROXIMATELY 15 -FOOT -WIDE PORTION OF HERBERT HOOVER HIGHWAY
LOCATED ADJACENT TO CHURCHILL MEADOWS — PART ONE (VAC15-00008), be
passed and adopted.
A public hearing was held on a resolution conveying vacated right-of-way along
Herbert Hoover Highway, adjacent to Lots 10, 11, and 17, Churchill Meadows
Subdivision, Iowa City, Iowa, to CBD, L.L.C. No one appeared.
Moved by Botchway, seconded by Mims, to adopt RES. 16-102, APPROVING THE
CONVEYANCE OF VACATED RIGHT-OF-WAY ALONG HERBERT HOOVER
HIGHWAY, ADJACENT TO LOTS 10, 11, AND 17, CHURCHILL MEADOWS
SUBDIVISION, IOWA CITY, IOWA, TO CBD, L.L.C.
Moved by Mims, seconded by Botchway, to defer to May 17 an ordinance vacating
the Waterfront Drive public right-of-way (VAC15-0007).
Moved by Mims, seconded by Botchway, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 16-4662, REZONING PROPERTY LOCATED AT 716 NORTH
DUBUQUE STREET FROM HIGH DENSITY MULTI -FAMILY (RM -44) ZONE TO
HISTORIC DISTRICT OVERLAY/ HIGH DENSITY MULTI -FAMILY (OHD / RM44)
ZONE, be voted on for final passage at this time. Moved by Mims, seconded by Dickens,
that the ordinance be finally adopted at this time.

Network Companies, for consideration at this time.
Moved by Mims, seconded by Botchway, that ORD. 16-4663, AMENDING TITLE 5,
ENTITLED `BUSINESS AND LICENSE REGULATIONS," BY ADDING A NEW
CHAPTER 3, ENTITLED "TRANSPORTATION NETWORK COMPANIES', be passed
and adopted. The following individuals appeared: Roger Knight, Jr., 320 E. Washington
St.; Seth Wallace; Christina Herrin; Dustin Mazgaj, Yellow Cab driver; Lynn Williams,

Moved by Mims, seconded by Dickens, to adopt RES. 16-103, APPROVING
PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR
THE CONSTRUCTION OF THE IOWA RIVER RAW WATER MAIN CONVERSION
PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH
BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING
TIME AND PLACE FOR RECEIPT OF BIDS. Individual Council Members expressed
their views.
A public hearing was held on a resolution approving plans, specifications, form of
contract, and estimate of cost for the construction of the Highlander Development
Fourth Addition - Part 1 Project, establishing amount of bid security to accompany each
bid, directing City Clerk to publish notice to bidders, and fixing time and place for receipt
of bids. Interim City Manager Fruin stated the developer has decided not to proceed
with this project and are looking into 2017 construction; no action taken at this time.
A public hearing was held on a resolution instituting proceedings to take additional
action for the issuance of not to exceed $9,000,000 General Obligation Bonds. Finance
Dir. Bockenstedt presented information.
Moved by Mims, seconded by Botchway, to adopt RES. 16-104, INSTITUTING
PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO
EXCEED $9,000,000 GENERAL OBLIGATION BONDS.
A public hearing was held on a resolution instituting proceedings to take additional
action for the issuance of not to exceed $200,000 General Obligation Bonds. Finance
Dir. Bockenstedt presented information.

Moved by Mims, seconded by Dickens, to appoint Jim Walker, 54 Lindemann Drive, to
the Board of Appeals for an unexpired five-year term January 1, 2014 - December 31,
2018; for a HVAC or building design professional or qualified by experience and
training.
The Mayor noted that no applications were received for the following Boards and
Commissions and all will be readvertised: Airport Zoning Commission for a six-year
term January 1, 2016 — December 31, 2021; Airport Zoning Brd of Adjustment for a
five-year term January 1, 2016 - December 31, 2020; Airport Zoning Brd. of Adjustment
— One vacancy to fill a five-year term January 1, 2014 — December 31, 2018. Applicants
MUST reside in Iowa City and be 18 years of age unless specific qualifications are
stated. [Staff will not publish additional notices after a period of six publications; but will
continue to advertise vacancies with postings and on the Council agenda. However, no
additional publication costs will be incurred.]
The Mayor noted the previously announced vacancies to Boards and Commissions:
Historic Preservation Commission for a Jefferson St. representative to fill three-year
term, March 29, 2016 — March 29, 2019 (New District formed); Housing and
Community Development Commission for an unexpired term — September 1, 2016;
Human Rights Commission for an unexpired three-year term upon appointment —
January 1, 2017. Applications must be received by 5:00 p.m., Wednesday, April 27,
2016. Housing and Community Development Commission for an unexpired term —
September 1, 2016. Applications must be received by 5:00 p.m., Wednesday, May 11,
2016.
Jim Knapp appeared regarding the procedure to apply for City Boards and
Commissions, and Council directed them to the City Clerk's office or the City website;
questioned the illegality of individuals being allowed to have parking lots in the Central
Business District; future of the TIF program; 50th anniversary of the Ron Lipsius
unresolved murder; low-cost housing and possible utilizing of the Hoover Elementary.

Council Member Taylor noted that she and Council Member Thomas would be
hosting a listening post at the Old Capitol Center on April 20 and encouraged people to
stop by.
Council Member Thomas announced a symposium would be held in the Pappajohn
Business Building on April 22 on building a foundation for criminal justice reform in
Iowa.
Council Member Mims stated she would be participating electronically in the May 3
Council meetings so she could attend CIT training in San Antonio.
Mayor Pro tem Botchway reported on his participation at the University Pow Wow
the previous week -end; stated he was unable to attend the LLS waffle breakfast
fundraiser; participated earlier that day in the sexual assault prevention summit; and
encouraged everyone read the Hunger Task Force report.
Council Member Cole stated he was excited on County efforts in terms of local
foods; noted his support for the school district reviewing their herbicide / pesticide
policy; stated his interest to attend a conference in late September in Madison
"Collaborative Cities", and Mayor Throgmorton stated they would discuss the request
during the work session; and noted Earth Day events coming from University of Iowa
Office of Sustainability.
Interim City Manager Fruin outlined Earth Day activities planned; and announced
that Dan Parolek, author of the "Missing Middle", would be offering a public presentation
on May 24; and offered a big "thank you" to the Convention and Visitors Bureau,
Downtown Association, and the University of Iowa for the successful Olympics trails.
Asst. to the City Manager Andrew reminded everyone that Farmer's Market season
starts Wednesday. May 4.
Council Member Cole reminded everyone of the Bill Nesper, League of American
Bicyclists, presentation on May 9.

QUESTIONS FROM COUNCIL REGARDING AGENDA ITEMS
1. (Consent Calendar item # 4f(5) — Correspondence ... Rose Oaks and IP 5 .....) Mayor
Throgmorton noted the memo in the Information Packet and correspondence received
concerning Rose Oaks. Interim City Manager Fruin, Neighborhood Development
Services Dir. Boothroy, and City Atty. Dilkes, presented information. The following
individuals appeared: Kyle Smith, Rose Oak Management representative; and Crissy
Canganelli, Shelter House.
ACTION: NDS staff will provide another update in the 4/14 information packet. (Fruin)

2. (Consent Calendar item # 4d(8) — Freedom from Domestic Violence ... resolution ...)
City Clerk Karr noted the item should be removed for separate consideration at the
request of the Law Clinic.
3. (Agenda item # 7 - Asphalt Resurfacing Project 2016 ...) Interim City Manager Fruin
reported that Public Works Dir. Knoche would be sharing a map of the streets at the
hearing.
4. (Agenda item # 8 — Traffic Calming .... 8a Langenberg Ave .... 8b Seventh Ave...)
Interim City Manager Fruin provided a brief overview of the program, noting the staff
recommendation was to approve the Langenberg Ave. speed bumps and not the
Seventh Ave.; and asked Council to go ahead with the approval of Langenberg but defer
indefinitely the Seventh Ave. request to allow more time to talk with the neighborhood
and review the traffic calming program. Council Member Thomas requested staff
explore speed tables as options.
5. (Agenda item # 9 — Transportation Network Companies (LIBER) .... Ordinance) Council
Member Cole noted concerns about chauffeur's license not being required for UBER
drivers. Mayor Throgmorton requested the item be discussed at the formal meeting.

6. (Consent Calendar item # 4f(2) — Sally Scott: Affordable Housing ...) In response to
Mayor Throgmorton, Interim City Manager Fruin stated staff will present Council with a
preliminary framework of an affordable housing action plan at the second work session
in June.
Mayor Throgmorton reviewed his memo on the two new Council Committees. After discussion
a majority agreed not to pursue creation of the two additional subcommittees; and reserved the
ability to schedule special work sessions if such meeting were necessary.
ACTION: None at this time.

1. (IP # 2 — Information form Council Member Botchway... Cedar Rapids Ranked 3rd in
Nation for Minority -Owned Business) Mayor Pro tem Botchway noted information on the
recognition received by Cedar Rapids and stated his interest for Iowa City do a better
job. Interim City Manager Fruin stated more information would be released shortly.
2. (IP # 5 — Community Event: The Impact of Racial Injustice On Youth) Council Member
Mims noted the upcoming April 280 event and encouraged the Council and community
to attend.
3. (IP # 4 — Lunch and Learn for City Boards and Commission Members) Mayor
Throgmorton noted the training session, stated he couldn't attend, but hoped a Council
Member might be able to attend.

1. (IP # 5 - ... Rose Oaks Project) Mayor Throgmorton noted previous discussion that
evening on the matter.
2. (IP # 11 - Housing and Community Development Commission ... minutes) Council
Member Cole noted discussion on funding recommendations, and Council's ability to
modify the recommendations. Neighborhood Services Coordinator Hightshoe outlined
the procedure, noting the a ranking process is used, and confirmed Council may modify
recommendations.

on April 1 at Pheasant Ridge attended by about 25 people, and a summary of the topics

people in similar situation as Rose Oaks who lose their housing or are displaced.
3. Council Member Cole recommended a follow up to issues raised at the listening posts.

MEETING SCHEDULE
Mayor Throgmorton noted the Economic Development Committee meeting scheduled April
12th; and encouraged Council Members to let City Clerk Karr know of any summer absences to
allow preparation of a summer meeting schedule. Council Member Cole noted he would be
unavailable June 22-26. In response to Council Member Dickens, City Clerk Karr stated a KXIC
radio schedule will be discussed at the next meeting.

PRELIMINARY PLAT OF SOUTHGATE ADDITION, PART TWO, IOWA CITY, IA.

contract, and estimate of cost for the construction of the Asphalt Resurfacing Project

The Mayor noted the current vacancies: Housing and Community Development

Council Member Dickens noted Mission Creek events were underway, with the final
event Saturday night.
Council Member Thomas announced that Jay Walljasper will be speaking in Iowa
City on April 13, one on "the notion of the Commons, All that we Share" and the second
on "25 Ways to Create Strong Community".
Council Member Taylor noted the annual Workers Memorial Day event on April 28 at
12:30 on the Ped Mall.
Mayor Throgmorton mentioned the Johnson County Liveable for all event on
Saturday, April 16; and reported on the March 29th performance at the Englert by the
Lone Bellow.
