UISG City Council Liaison Simpson introduced new UISG City Council Alternate Ben Nelson. The Mayor announced that the applicant had withdrawn an application and no further action is necessary for the resolution rezoning approximately 26.98 acres of land located northeast of Camp Cardinal Road from Interim Development Single Family (ID-RSs) Zone to Planned Development Overlay (OPD -8) Zone (REZ16-00003). Moved by Botchway, seconded by Dickens, to accept correspondence from Dave and Suzy Heck, Maria Lukas and Culver Boldt. A public hearing was held on the resolution amending the Comprehensive Plan to change the land use designation of property located north of Melrose Avenue and east of Camp Cardinal Boulevard from Residential 2-8 dwelling units per acre to Office Commercial (CPA16-00001). Development Services Coordinator Yapp presented a power point. Moved by Botchway, seconded by Dickens to adopt RES. 16-129 AMENDING THE COMPREHENSIVE PLAN TO CHANGE THE LAND USE DESIGNATION FROM RESIDENTIAL 2-8 DWELLING UNITS PER ACRE TO OFFICE COMMERCIAL FOR PROPERTY LOCATED NORTH OF MELROSE AVENUE AND EAST OF CAMP CARDINAL BOULEVARD (CPA16-00001). The Mayor stated that the applicant had withdrawn an application and no further action is necessary on the ordinance conditionally rezoning approximately 7.98 acres of property located east of Mormon Trek Boulevard between Grace Drive and Eagle View Drive from Commercial Office (CO -1) to Intensive Commercial (CI -1) Zone (REZ15-00021). A public hearing was held on the resolution authorizing conveyance of a single family home located at 1807 Lower Muscatine Road. No one appeared. Moved by Dickens, seconded by Botchway, to adopt RES. 16-137, APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN ENGAGEMENT AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND THE BROWN WINICK LAW FIRM TO PROVIDE LEGAL SERVICES IN THE MATTER OF MCC IOWA LLC B/B/A MEDIACOM V. CITY OF IOWA CITY AND IMON COMMUNICATIONS, LLC. Moved by Thomas, seconded by Botchway, to appoint Christine Kay Harms, 2503 Aster Avenue to the Housing and Community Development Commission for an unexpired term — September 1, 2016; appoint Karol Krotz, 1229 Shannon Drive #212, to the Human Rights Commission for an unexpired three-year term upon appointment — January 1, 2017. The Mayor noted that no applications were received the following vacancy and will be readvertised: Historic Preservation Commission for a Jefferson St. representative to fill three- year term, March 29, 2016 — March 29, 2019 (New District formed). Moved by Botchway, seconded by Dickens, to accept correspondence from Vero Rose Smith, Harry Olmstead. Applicants MUST reside in Iowa City and be 18 years of age unless specific qualifications are stated. [Staff will not publish additional notices after a period of six publications; but will continue to advertise vacancies with postings and on the Council agenda. However, no additional publication costs will be incurred.] The Mayor noted the previously announced vacancies: Airport Zoning Commission for a six-year term January 1, 2016 — December 31, 2021; Airport Zoning Brd of Adjustment for a five-year term January 1, 2016 - December 31, 2020; Airport Zoning Brd. of Adjustment for a five-year term January 1, 2014 — December 31, 2018 (Formerly advertised); Housing and Complete Description May 3, 2016 Page 5 Community Development Commission for an unexpired term — September 1, 2016. Applications must be received by 5:00 p.m., Wednesday, May 11, 2016. Council Member Mims stated she was attending CIT training in San Antonio and summarized activities during the visit; and stated she would be providing more information at a future meeting. Council Member Thomas noted the house moving party at College Green Park on May 4 from 10:30 to 2:00. Council Member Taylor reported on the listening post she attended with Council Member Thomas at the Capitol Center on April 20. Mayor Throgmorton thanked UISG Liaison Nicole Neal for suggesting the site and helping arrange the event, Council Member Cole thanked staff for the response (in the information packet) to the issues raised at the listening post he attended with Council Member Mims at Pheasant Ridge; complimented staff on the new entrepreneurship program starting soon and asked if more notice could be given in the future; noted Bike to Work events coming up; and the Bill Nesper, Program Director League of American Bicyclists presentation at Mercer Park on May 9th. Council Member Dickens reminded everyone of the Friday Night Consent Series starting later in the month downtown; the opening of Farmers Market on Wednesday, May 4; noted the article quoting Roger Bradley from Yellow Cab that there was not a significant drop in calls since Uber arrived; and stated he would be out of the country attending his daughter's wedding and would not be attending the May 17 Council meeting. Mayor Pro tem Botchway announced the Flyover Fashion Fest scheduled for May 7 and tickets were still available; noted Mother's Day on May 8; and stated he would be participating in the Celebrity Mile on May 15 for Get Moving for Healthy Kids. Mayor Throgmorton noted events for Bike to Work Week, May 16-20,included a Mayor's Bike Ride in City Park on May 15 from 3:00-5:00 PM.; and the Human Right Youth awards scheduled for 7:00 PM, May 10, at the Englert. Interim City Manager Fruin announced that Moody's had reaffirmed the Aaa rating for Iowa City and congratulated the Finance Department on their hard work and Council on prudent budgeting. QUESTIONS FROM COUNCIL REGARDING AGENDA ITEMS Mayor Throgmorton announced that Council Member Cole would be arriving 15-20 minutes due to a court appearance. (Agenda item # 18 — Transportation Network Companies) In response to Mayor Throgmorton, Asst. to the City Manager Andrew briefed Council on recent State legislation passed by both the Senate and the House and was currently awaiting the Governor's signature. The legislation would regulate TNC's effective January 1, 2017 so that would be 7 months before that legislation would go into effect, and recommended proceeding with final passage of the TNC ordinance on the agenda. He noted that the legislation also takes away some home rule authority for traditional taxi companies and staff would meet with taxi companies on proposed changes and the recent State legislation, and present additional information to Council for the May meeting. Majority agreed to move up consideration of this item prior to item 7 on the agenda. COUNCIL APPOINTMENTS [agenda item # 201 Board of Appeals — appoint Jim Walker Police Chief Hargadine introduced Dr. Chris Barnum, Program Dir. for Masters in Criminal Justice and Criminal Justice Professor for St. Ambrose University. Handouts distributed: • Memo from Police Chief: St. Ambrose Study on ICPD Traffic Stops • ICPD Traffic Stop Analysis (power point presentation) • Summary of Results ICPD Traffic Study 2105 Dr. Barnum presented a power point and data and results for 2015. After discussion Council directed staff as follows: 1. Police to work with Dr. Barnum to provide supplemental logistical regression information to the Council (disproportionality figures when controlling for certain variables such as reason for stop / arrest). Information will be forwarded to Council when available. Council Work Session April 19, 2016 Page 2 2. Police will discuss Council's desire to set a goal to reduce disproportionality of stops and outcomes. Staff will develop a recommended goal and present that to Council at a later date. 3. Police will continue to work with Dr. Barnum to refine data collection in an effort to provide more clarity to his analysis. Specific attention should be given to how officers record consent searches for purposes of the study. 4. Communications and Police will add Dr. Barnum's presentation slides, written summary, and a video of the presentation to the City website. INFORMATION PACKET DISCUSSION (APRIL 7,141 ➢ April 1. (IP # 4 — Listening Post summary report — April) Council Members Cole and Moms summarized concerns. Cole requested a follow up be scheduled with responses to concerns. Staff is preparing responses and a memo included in a future information packet. 2. Council Member Cole commending staff for the creation of a program developing small business opportunities and questioned when it would be announced. Interim City Manager Fruin stated a press release had been issued and a copy would be included in the next information packet. 3. (IP # 5 — Joint Meeting Agenda Items) Council Members requested the following items be included: Rose Oaks Update Affordable Housing Update School District boundaries Pesticides and Herbicides on School Grounds CIT (Crisis Intervention Training) JC Hunger Task Force Report Minimum Wage Update The Mayor will work with the City Clerk on the agenda. 4. (IP8 — Coffee With A Cop ....) Mayor Pro tem Botchway requested an update, feedback and numbers on the events. Interim City Manager Fruin stated he would provide information. Council Work Session April 19, 2016 Page 3 ➢ April 14 1. (IP # 9 - Diversity Implementation Update and Status on Racial Equity and Diversity Initiative... ) Mayor Pro tem Botchway thanked staff for the report and initiatives. 2. (IP # 6 - Regional Assessment ... Iowa's Creative Corridor) Council Member Mims responded to questions on the report and stated it reflected a compilation of a lot of input and the process would be continuing into the fall. 3. (IP # 4 — Update on Rose Oaks Development) Interim City Manager Fruin updated Council on additional information stating the building permit application had been received and could take several days or weeks to review; in addition five demolition permits have been received and those demolition permits will not be approved until the site plan is approved. Development Services Coordinator Yapp present for discussion. Mayor Throgmorton acknowledged the owners met with tenants on April 11 and was pleased to see a counter -proposal prepared by the Rose Oaks Tenant Association. [Break 6:45 p.m. - Discussion continued after the formal meeting] COUNCIL TIME Council Member Cole stated he would like to attend a National League of Cities conference "Collaboration divides the task and multiples the success" in Madison, and request City funding. After discussion a majority agreed. 2. Council Member Dickens raised concerns regarding people addressing Council multiple times on the same topic, and suggested limiting one appearance per issue. Council Member Mims agreed and also noted that if there were large numbers waiting to speak the Mayor should limit the presentation time to 3-4 minutes rather than the traditional 5 minutes. 3. Council Member Mims raised questions when the plastic bag ban would be scheduled for discussion. Interim City Manager Fruin stated that staff will provide a more comprehensive waste minimization strategy presentation at the June 7 meeting. Council requested that copies of sample plastic bag ordinances or strategies from other communities be included with materials for that work session. 4. Interim City Manager Fruin stated staff was preparing a downtown streetscape master plan presentation and discussion for the May 3 work session. 5. Mayor Throgmorton reported on a number of events: ➢ Met with Chamber of Commerce Government Affairs Committee on April 14 with Interim City Manager Fruin, and Public Works Dir. Knoche. ➢ Economic Development Committee met on April 12 and agreed to more frequent meetings and suggested moving the next few meeting to Harvat Hall and televising them. Council Member Mims stated sh'e would be preparing a memo as Chair of the EC Committee regarding minutes and addressing some other issues for an upcoming information packet. Staff will relocate future meeting to Harvat Hall and record and broadcast meetings. In response to Council Member Cole, Interim City Manager Fruin said staff would place affordable housing amendment to TIF policy on May 3rd agenda.
