HomeMy WebLinkAbout2016-05-03 Correspondence_07=^ 4f(1) April 13, 2016 To the City Council of the City of Iowa City: I am writing to call to your attention the dangerous condition of the brick paving on the pedestrian mall. The ped mall enjoys considerable foot traffic, as intended, but those of us who walk there can't help but observe that there is hardly a single smooth and undisturbed area. Bricks have heaved, bricks are missing, bricks are up -ended. A walker, particularly an older one, as I am, must have her eye fixed on scanning the area ahead to avoid an accident. I am still recovering from a fall five months ago in which I dislocated my shoulder; a friend stumbled and broke bones in her foot which took months to heal. We are all aware that the bricks are dangerously slippery when wet, not to mention when icy. I live downtown because I enjoy walking more than driving for shopping and activities. Isn't this what the Downtown District seeks to encourage? But beyond the pleasantness of downtown, isn't this a public health issue? When will the Council act to schedule and fund the repaving of this centrally important area? I wasn't able to attend, but I did want to voice my support for something I have been thinking about and discussing with colleagues: a citywide Styrofoam ban. A Styrofoam ban would cut down on the amount of waste going to our landfill, and instead would support recycling and composting. Please consider joining the dozens of other cities around the country and world, such as Seattle, Washington, and Minneapolis, Minnesota, in banning Styrofoam and requiring the use of recyclable or compostable materials for all take-out containers in Iowa City. I also would love to see glass recycling as part of the Ped Mall recycling stations, instead of glass being included with the trash. I frequently walk to the town area going north from my work at 315 E Prentiss ST. It is unbelievable the conditions that exist under the road bridge on Gilbert st., crossing the creek just North of Prentiss st and the walking bridge just west of there. The garbage and trash that the homeless are leaving under these bridges is mounting. When a large rain comes, it washes it all down stream. It is a very bad environment. I ask that you stop by to take a look for yourself. This has been getting steadily worse for a couple of years now. You would have to be a blind person not to be effected by the trash and I am sure the other bodily secretions that exist there. I do not live in this community but I do work here and am concerned about this problem. There are garbage dumpsters with in yards of these sites but this seems to be one of the sources for the trash not the solution. Therefore, I would like to express my support of, and urge you also to support, passing an inclusionary zoning act. By doing this, our community ensures places to live for lower income households. This is so important for keeping men, women and children off the streets, from sleeping in their cars and out of homeless shelters. I work very closely with elementary, middle and high schools in the Iowa City school district. Consistent and affordable housing provides stability in a child's life and allows them to focus on their education. Stable housing also provides a feeling of security. Affordable housing not only helps ensure the academic success of our community's students, it allows lower income households to spend their money on healthier foods, clothing and school supplies for their children. The recent events regarding the Rose Oaks apartment complexes are repercussions of Iowa City's lack of inclusionary zoning. Many of the families that do not have Section 8 housing have found affordable housing units in the Rose Oaks apartments, however, because the ownership has changed and the new ownership is free to renovate these apartments and increase rent prices, many families have been uprooted. This sudden demand of families to move interrupts the school year for students, the work schedules of adults and it creates turmoil in our community. This turmoil would be so eased if there was plentiful affordable housing in other areas of the city for these households to relocate to, but there is not; and so the implications for these families are huge. This is a clear example of why an inclusionary zoning act should be passed. That said, I would like to express my support of the use of TIF funds to incentivize the Rose Oaks management to make sure a certain percentage of their complexes are affordable. This allows some of the families to return to Rose Oaks and alleviates the pressure of the uprooted families on community resources such as homeless shelters and food banks. I urge the council to consider making the percentage of affordable housing at Rose Oaks closer to the percentage of children on free or reduced lunch programs in the schools (approx. 35.8% based on an average taken from schools in the Iowa City district; Des Moines Register 2016). This would more accurately provide housing for the amount of families that need it. As a member of this community I am very proud of the way this city advocates for equality among class, race, age and gender. There will always be more work to do, and I understand that where you give in one place, you take from another. Still, providing an increased amount of affordable housing in Iowa City is something that would give back tenfold to our community in the way it can impact families and students. The project will be funded with stormwater revenues. `t J�(II ) Through the arbitrary and irrational distinction between TNCs and taxicab companies, full implementation of this ordinance would violate the 14" amendment rights of local businesses. A TNC provides a service in exchange for payment, the same as a taxicab, thus participating in intrastate commerce. Who has regulatory authority and why are we ignoring state and federal law and warnings from the insurance industry? USER is also involved in an anti-trust lawsuit that could end their anti-competitive and price fixing behaviors. We shouldn't squander this opportunity to learn from cities across the country that are finished with their "trial period" with TNC's and are revising their ordinances. A level playing field is achieved through fair competition, similar regulations, and equal enforcement of all laws. 1. Section 1. Definitions & Section2. "Not a ... vehicle for hire." How can TNC drivers give rides for money and not be considered a vehicle or ride for hire? In an equal protection case in Boston, U.S. District Judge Nathanial Gorton says TNCs are no different than taxicabs. Why do insurance companies refer to "Ride for Hire" coverage? This language must be modified or removed. UBER is simply exploiting the false notion that they are part of the pier to pier economy. More taxicabs are using apps, and TNCs sometimes contract services to taxicabs. Treating the two groups differently should be considered irrational or arbitrary. Vehicle or ride for hire language is arbitrary. 2. Section 3 (a). Is the application date still Maylst? There are UBER drivers in Johnson County currently operating without TNC licenses. Raises the question of enforcement. 3. Section 3 (b) (3) Background check accreditation does not equal effectiveness. There have been countless cases of UBER's system missing felony criminal records of sex offenders and murders. This has been the issue in numerous Class Action Suits. Why no police review? 4. Section 3 (1). Suspension for violating any part of state or federal law. As the Iowa City Police officer stated at the council meetings, we have no way of knowing if a vehicle is being used as a TNC vehicle (Section S. Identification). This again raises the question of enforceability. The argument has been made that parts of UBER's business model violate the law, including The Sherman Act, The Donnelly Act, The 14" amendment, and general business law. 5. Section 4 (b) Dynamic Pricing —Surge Pricing (up to 10x): This could happen any day or time the passenger to driver ratio is greater than 1:1. What determines "normal market demand?" This is the issue in an Anti -Trust lawsuit against USER. They are being accused of price fixing through collusion and manipulation of free markets. In UBER's own language in a FAQ for drivers, they say giving riders estimates is "not a good idea." Special event pricing does not even come close to leveling the playing field with regards to this topic. 6. Section S. Identification. All driver and vehicle ID is in the app, and consists of a picture of the driver, the license plate number, and make and model. What happens if a license plate gets switched to a similar vehicle? Why is there nothing on or in the vehicle to verify the TNC driver or car? How do you enforce Section 3? 7. Section 7. Insurance. Local insurance companies have sent out warning letters to policy holders notifying customers that they will not be covered in the event of an accident if they are driving for a TNC. It appears there is a need for three levels of insurance: Base line polity, logged into the app, and a level that UBER provides while a paying passenger is in the vehicle. Again I raise concerns over enforceability and plausible deniability. The language "while providing service" is misleading. Drivers must be logged into the app for the service to work. This is how pricing and availability are determined. Or through illegal market manipulation, drivers may be asked to log off to engage Surge Pricing and reduce insurance liability. 8. Section 9. Driver Requirements. Why is there no police review? Who has authority in this market? City, DOT..? 9. Section 10. Vehicle Requirements. Iowa Code 321.20? Who enforces this? How? When? 10. Section 11 & 12 No Street Hails and No Cash. Many drivers eventually work outside the app and develop special business relationships with customers, by exchanging phone numbers and money, or a driver could use a personal Square device for credit cards. This is the equivalent of a Gypsy cab. Again I ask, how does this get enforced? Equivalent to a free for all. 11. Section 13. No Discrimination & Accessibility Policy. UBER has a searchable legal record of discrimination and not granting access to persons with disabilities. The feedback system enables and encourages discrimination, both from the drivers �Qn�td ass�PPe ers. These issues have been the subject of many Class Action lawsuits. A %alecl&WcBttAt! INBER has a track record of refusing to turn over records, citing trade secrets. (Date) The following is a side-by-side comparison of the regulations taxicabs and TCN's must follow the Iowa City area. This list is an attempt to compile all items a driver and a company must comply with. It should be noted that there are Equal Protection cases, Anti -Trust cases, and Class Action suits we should look at for recommendations and guidance while we consider a level playing field. In Boston, "U.S. District Judge Nathanial Gorton... allowed claims that their (taxicab companies') equal protection rights had been violated to move forward, saying ride -hailing services are no different than taxis." UBER has agreed to pay up to $100 million to settle a class-action lawsuit concerning the classification of its drivers. UBER has also been forced to refund customers for misleading statements about quality and safety, with regards to their ineffective background checks. There is an Anti -Trust lawsuit stating that UBER's business plan, "generates profit through price fixing." With regards to Dynamic or Surge Pricing(up to 10x base rates): by granting UBER the ability to violate the basic consumer protections against price gouging and enabling them the ability to price fix, this ordinance does not ensure a level playing field and is dangerous to consumers. This illegal, anticompetitive practice of price fixing, and manipulation of free markets has UBER before a US District Court in New York. As we can see from the list below, traditional taxicab drivers and companies have more rigorous and thorough safety standards to comply when compared with TNCs. It appears that every part of UBER's business is under legal scrutiny, suggesting to me that we ought to proceed with caution. We need to pay attention to these and other cases while we consider how to regulate our local transportation companies. Cities across the country, including Boston, Chicago and Austin are revising their ordinances. I think the taxpayers and rent payers of Iowa City need to know some of the reasons why it is so expensive to live in Iowa City, Respectfully submitted James C (Jim) Knapp (319) 325 2443 Dear Ms. McBride & Ms. Hart; 1 am remiss in not replying promptly. My complaint goes beyond the favoritism the City of Iowa City has shown the Moen Group. It dates back to the turn of the century in 1999 and maybe longer. The first TIF given to Marc Moen was what enabled him to build the Plaza Towers. Was an underhanded act of favoritism with collusion of a woman Karin Franklin and a former employee Monica Moen? Ms. Moen worked in the same office on the staff of the Community Development Commission for 20 years. The land was accurately appraised at $1,750.000.00 and the City had an offer for $1,750,000.00. Mr. Moen did not have anywhere near the cash to build the Tower so he was sold the land for &250.000.00 saying that he would help with more cash over time. This has never happened and the City did have an offer for the appraised amount $1,750,000.00 butsubsequent the City Assessor gave Moen a 33% roll back in his property evaluations. Prior to the sale of the library parking lot the woman in charge of Community Development (Karin Franklin) came to the City Council with a memorandum '9 have two developers interested in Parcel 64-1A. The 2 developers it turned out were Marc and Monica Moen. Monica, who was Marc's wife, had worked in the same office with Karin Franklin for 20 years. The council authorized RFPs to 3 other developers and one of their requirements was that the developers present Audited Financial Statements, the statements given by Moen his brother and Monica were not audited, in fact they were poor false documents not audited. 1 asked to see them and Marc Moen sued the City to suppress them and lost in the suit. So, 1 picked up a copy. They were poorly subscribed, unaudited and inaccurate documents which violated the requirement of the RFP. When the decision of the Community Development board, which held their meetings behind closed doors, was presented to the City Council the vote was 3 - 3 until Ross Wilburn voted to accept Moen's proposal. Councilor Wilburn had previously recused himself from any votes that involved CDBG funding as he worked for an agency that received Community Development Block Grant Funds (CDBG) funds. The proceeds from this sale of land by the City were to go to CDBG funds. Again the City held closed door meetings in violation of the Open Meetings Laws. The most recent favor the City is granting Marc is to rezone a piece of property outside of the rectangular Central Business District to become CDB so that Moen again can erect another of his towers to Avarice and Greed. We now have a City Council which will stop TIF's in the future and 1 believe that this property use should be put on the November ballot. If so I believe it would fail by an 85% margin or greater. The people of Iowa City deserve more than giving Marc whatever he wants. There is a strong need now for low to moderate income here and now. Some property built in 1965 will be failing to the wrecker ball and these people will have nowhere to go. They were enticed here from Cabrini Green offering them low cost housing and they have become established and should be respected., 1 have roughly 2000 pages of Iowa City documents that will eventually become a book exposing the heinous way the past councils have acted in collusion with city employees. Also the fact that the City has allowed Moen to keep a parking lot which is illegal for an individual to have a parking lot in the Central Business District. I have required from the people in the city government and no one can or will give a legitimate reason why Moen is so favored. Although it has changed ownership many times over its past 50+ years, these changes have not previously resulted in displacement of residents. Residents were therefore shocked to receive letters in mid-March informing them that the property had been sold, leases would not be renewed, the buildings would soon be a chaotic construction site with possible sewage disruptions, and all residents were being asked to move ,as soon as possible." This unexpected dislocation has created a crisis for many Rose Oaks residents and their families. Affordable apartments are extremely rare in Iowa City. Many residents don't have cars, which makes it difficult to shop for apartments, and places theirjobs in jeopardy because many Rose Oaks residents walk to work in factories across the street. Children are dislocated from their schools and networks of support. Moving is expensive, and residents haven't had time to save for the cost of apartment applications ($25-$30 each), security deposits, 1st month's rent, truck rentals, and possibly storage units. Residents also report that, because of Rose Oak's long history of bug infestations, they have to either buy new furniture or bring cockroaches to their new homes. Since March, residents have joined together to form a tenants' association, with assistance from the Center for Worker Justice and the Black Voices Project, to put forward their collective concerns and meet with the new owners to try to reach a community impact agreement. Talks between Rose Oaks Tenants Association and College Fund Properties II Rose Oaks residents are currently making three proposals to College Fund Properties II, to mitigate the serious impact of this relocation on residents, and in recognition that this redevelopment is exacerbating the affordable housing crisis in our community. 1. Give all residents whose leases are set to expire before then until August 1, 2016 to relocate. In a March 30 meeting, several residents were terrified - they had been told they could not renew their leases and would be evicted if they didn't leave April 1, but they had not had time to secure other housing. After 70 people gathered at the office, the company agreed to allow these residents to move to a temporary month-to-month arrangement, but without a clear timeline. Last week, after several more meetings, the company agreed to allow all residents to stay until August 1, or the expiration of their current lease, whichever is later. 2. Provide $1000 moving expenses to all residents who move or have moved between March 1 and August 1, 2016 (or 1 month free rent if a tenant chooses this option) Many Rose Oaks residents would like to move and leave all the chaos, uncertainty, and disruption this sale has caused in their lives. However, they cannot afford the nearly $3000 per person they have estimated it costs to move. Others have already left because the letters from the company indicated that they had no options, but remain homeless as a result. $1000 is a fraction of the cost of this unexpected dislocation in residents' lives, and a small recognition that over 100 of our neighbors will face a long-term increase in their housing costs and our community will have fewer affordable options as a direct result of this redevelopment. College Fund Properties II is refusing to provide any across-the-board compensation for dislocated residents. The $500 "buy out" they have offered only applies to a fraction of residents whose leases expire after June, and who are able to leave early. The donation to Shelter House only covers certain eligible residents; considering that a security deposit and 15, month's rent typically cost over $1500, even $30-$40K could only assist a fraction of residents. Residents believe that a meaningful relocation package can allow everyone to move forward — giving residents the choice to leave and allowing the company to proceed with construction. 3. 20%of renovated units should remain affordable with current tenants having first option of rental. The new owners have indicated to residents that rents will rise when the redevelopment is completed, and none of them will be offered the option to renew their leases. They have indicated that they may seek city funds to build a new affordable housing development. While talks between the Rose Oaks Tenants' Association and College Fund Properties II have been able to relieve the artificial crisis caused by an extremely short initial timeline, they have not produced any meaningful relocation compensation for residents facing unexpected dislocation. We are calling on community members and City leaders to let College Fund Properties II management know that we support residents' modest proposals to mitigate the harm caused to people dislocated in this development.
