ORDINANCE REZONING APPROXIMATELY 26.98 ACRES LOCATED ON CAMP CARDINAL ROAD FROM INTERIM DEVELOPMENT SINGLE FAMILY RESIDENTIAL (ID -RS) TO�LANNED DEVELOPMENT OVERLAY (OPD -8) ZONE AND APPROVING A SEN TIVE AREAS DEVT PLAN FOR THE NEPOLA SUBDIVISION A 170 UNIT SENIOR HOU NG DEVELOPMEW (REZ16- 00003) WHEREAS, the appli nt, Ryan Companies US, Inc., has request! a rezoning of property located on Camp Cardinal Road from terim Development Single Family Re Planned I (ID -RS) to Planned Development Oveday (OPD -8 ) and appr val of a Sensitive Areas Development (Oft) Plan for Nepola Subdivision, a residential subdivision with 17 senior housing units and an outlot for p eservation of sensitive areas and for future development restricted to he density allowed for 3.75 Acres; arp WHEREAS, the planned deJ apartments to be clustered on a preservation of wooded slopes and and WHEREAS, the Comprehensive environmentally sensitive areas such as Sensitive Areas Development Plan; and mt rezoning and the s ivision will allow the senior living n of the property, whit reserving a portion of the land for development restricted o density allowed for 3.75 Acres; Pla 's environmen goals encourage the preservation of I teep slope and woodlands located on Outlot A of the WHEREAS, the Comprehensive Plan future lay use map indicates that this area of the city is appropriate for residential development at a density welling units per acre; and WHEREAS, the proposed OPD -8 zone woul alloP&an; imum of 8 dwelling units per acre, which is within the range contemplated by the Compreh sive d WHEREAS, the Planning and Zoning Commission revs the proposed rezoning and has recommended approval of this application. SECTION II. ZONING MAP. The Building Inspector is hereby authorized and directed to change the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval and publication of this ordinance by law. -Ordinance No. Page 2 SECTION III. CERTIFICATION AND RECORDING. Upon passage and approval of the Ordinance, the City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the same, at the office of the County Recorder of Johnson County, Iowa, at the owner's expense, all as provided by law. SECTION IV. REPEALER. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION V. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and publication, as pro 'deed by law. Passed and approve 'this day of / 20_.
