TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT
BY AND BETWEEN BRAUN INTERTEC OF CEDAR RAPIDS, IA AND
T 1 THE CITY OF IOWA CITY FOR GEOTECHNICAL AND MATERIAL
TESTING AND SPECIAL INSPECTION SERVICES DURING
CONSTRUCTION OF THE IOWA CITY GATEWAY PROJECT [HDP -
3715(652) --71-52].
Comment: The Iowa City Gateway Project will require geotechnical
and construction material testing, monitoring and inspection services
during construction. The City received proposals and has negotiated an
Agreement with Braun Intertec of Cedar Rapids, IA to provide said
services for $249,250.00. The project will be funded with Local Option
Sales Tax Revenue and General Obligation bond proceeds.
ITEM 3d(4) EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) -
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST AN INTERLOCAL AGREEMENT BETWEEN THE
CITY OF IOWA CITY AND JOHNSON COUNTY, IOWA, FOR THE
APPLICATION AND ADMINISTRATION OF ANY AWARDED EDWARD
BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM
AWARDS.
Comment: The Iowa City Police Department, in partnership with the
Johnson County Sheriff's Office, is making application for the 2016 Edward
Byrne Memorial Justice Assistance Grant (JAG) program administered by
the U.S. Department of Justice. The Departments were notified that they
were eligible for a total of $28,453.00. In accordance with past practice
and the application process, the parties have agreed to split the award
52% for Iowa City ($14,795.65) and 48% to Johnson County
($13,657.44), and that the City of Iowa City will take responsibility for the
application and management of this grant under the terms of the interlocal
agreement.
ITEM 3d(5) BODY WORK AND REPAIR SERVICES - RESOLUTION
AUTHORIZING THE RENEWAL OF THE CONTRACT FOR
9G BODY WORK AND REPAIR SERVICES FOR THE CITY'S
6 EQUIPMENT DIVISION.
Comment: In May of 2012, the City issued a request for proposal for
Body Work and Repair Services for a one (1) year contract, with the option
to renew for 4 additional one (1) year periods. Five proposals were
received, evaluated and scored by staff who determined that the proposal
submitted by Premier Automotive best met the needs of the City. The
contract with Premier Automotive is approaching its final year for renewal.
This resolution authorizes the renewal of the contract and authorizes the
City Manager to effectuate the renewal.

ITEM 3d(6) KIRKWOOD AVENUE AND SUMMIT STREET INTERSECTION
TRAFFIC CONTROL — RESOLUTION RESCINDING RESOLUTION 93-
�� 91 ESTABLISHING THE EXISTING TRAFFIC CONTROL AT THE
q KIRKWOOD AVENUE / SUMMIT STREET INTERSECTION
Comment: This resolution will rescind Resolution 93-91 establishing the
existing stop control configuration (where only southbound motorists stop)
at the Kirkwood Avenue / Summit Street intersection. We now know that
establishing the existing stop control had unintended consequences for
intersection safety — particularly for bicyclists and pedestrians.
Rescinding Resolution 93-91 will allow for subsequent consideration of an
all -way stop to be established at this location. Consideration of additional
stop signage for east and westbound motorists is included in a memo to
be accepted by Council on the consent calendar. Project cost is
estimated to be less than $500.
ITEM 3d(7) AIRPORT COMMISSION BY-LAWS - RESOLUTION APPROVING THE

Comment: At Council orientation in November 2015 staff outlined a
process for individuals to apply for multiple Boards and Commissions at

appointments be made twice a year. In order to group vacancies to
provide for appointments twice a year it is necessary to modify terms of 5
current Boards and Commissions. The Rules Committee met on June 15

Comment: The Iowa City Housing Authority entered into a 28E
Agreement with the DIA on November 17, 2006. This 28E Agreement with
the DIA authorizes the performance of HCV / Public Housing
investigations of the Iowa City Housing Authority by the DIA. The existing
28E Agreement has expired and requires renewal. The terms of the 28E
Agreement remain the same, with the exception that the hourly rate
increased from $52.50/hour to $68.25/hour.

SINGLE FAMILY HOME LOCATED AT 1109 5T" AVENUE.
j (P — a D L0 Comment: The City constructed a modular house at 1109 5" Avenue and
sold the property as an affordable home pursuant to the Consolidated Plan
for Housing, Jobs and Services (CITY STEPS). The City provided the
previous owner a $30,000 loan to help keep the home affordable. The
previous owner was facing foreclosure, so the City bought the home back
through a short sale. The home needed extensive rehabilitation, but is now
ready to sell. The City has received an offer to purchase the home, which it
has accepted contingent on Council approval. The amount of the sale will
be $149,500. The buyer must be below 80% Area Median Income and
agree the keep the property owner -occupied for twenty years.

Comment: At its June 2 meeting, by a vote of 6-1 (Signs voting no), the
Planning and Zoning Commission recommended approval of this
amendment. Approval will allow consideration of future rezoning

RECOMMENDATION TO THE JOHNSON COUNTY PLANNING AND
ZONING COMMISSION REGARDING A REZONING FROM COUNTY
RESIDENTIAL (R) TO COUNTY COMMERCIAL (C) FOR

Comment: At its June 2 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended that the County consider rezoning this
property to Agri -Business (C -AG) Zone rather than Commercial (C). In a
memorandum dated May 20, Staff recommended that the requested
rezoning from Residential to Commercial be approved only if it is found to
be consistent with the County Land Use Plan and conditions are placed on
the rezoning to ensure that potential commercial uses do not have negative
effects on adjacent residential and agricultural uses. Correspondence
from Josh Busard, Director of Johnson County Planning, Development
and Sustainability, outlines County Staff's rationale for recommending
approval of Commercial (C) rather than Agri -Business (C -AG) for this

Comment: This project consists of expanding the existing landfill gas collection
system to cover recently constructed landfill cells along with improving the system to

The estimated base construction cost is $840,000 with possible alternate costs of
$245,000 for a possible total cost of $1,085,000 and it will be funded by landfill
revenues.

CHAPTER 5, ENTITLED "HOUSING CODE," TO EXCLUDE CRIME VICTIMS
FROM RENTAL PERMIT SANCTIONS. (FIRST CONSIDERATION)
Comment: Section 17-5-16C provides for rental permit sanctions if the tenant, owner,
or guest commits certain crimes on the rental property and/or fails to address
repeated nuisances. Iowa House File 493 that goes into effect on July 1, 2016,
prohibits cities from imposing a penalty on a tenant who summons law enforcement
or other emergency assistance. Although no provision in the City Code penalizes a
tenant for summoning law enforcement, the rental permit sanction provision arguably
impacts a tenant, as well as an owner, who is a victim of a crime committed in the
rental unit. This ordinance excludes crime victims from the rental permit sanction
provision consistent with the new state law.

OF NEW ZONE LOCATION - ORDINANCE AMENDING SECTION 9, ENTITLED
"MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE
ROAD," SECTION 6, ENTITLED "SPEED RESTRICTIONS', SUBSECTION C,
ENTITLED "SCHOOL SPEED ZONES' TO EXPAND THE HOURS DURING
WHICH REDUCED SPEED (20 MPH) IS IN EFFECT IN ALL SCHOOL SPEED
ZONES AND TO CREATE A 20 MPH SCHOOL SPEED CONE FOR ALEXANDER
ELEMENTARY SCHOOL. (SECOND CONSIDERATION)
Comment: Iowa City Code Section 9-3-6(c) defines school speed zone limits and
does not establish a zone for Alexander School. A reference to "Sycamore Street'
from Lehman Avenue to a point 600 feet north of Daniel Place should be added to
ensure consistency in the application of school speed limit zones on arterial streets
adjacent to elementary schools. Title 9-3-6(c) also defines school speed zone limits
(20 MPH) and the hours during which they are in effect. Currently the code specifies
reduced speeds to be in effect from 8:00 AM until 5:00 PM, Monday through Friday.
Beginning in August, elementary schools will be in session from 7:55 until 2:55 PM. If
adopted the ordinance would expand the hours that School Speed Zones are in
effect to 7:00 AM to 5:00 PM. All speed zone signage will be updated to reflect this
change. Staff requests expedited action to allow work to be completed before the A_ /1J
start of the 2017 school year. '
