RESOLUTION NO. 16-209
RESOLUTION ACCEPTING THE WORK FOR THE 2016 FOREST GLEN
STORM SEWER REPAIR PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of the
2016 Forest Glen Storm Sewer Repair Project, as included in a contract between the City of Iowa
City and Bockenstedt Excavating of Iowa City, Iowa, dated April 21st, 2016, be accepted; and
WHEREAS, the Engineer's Report and the performance and payment bond have been filed in the
City Engineering office; and
WHEREAS, funds for this project are available in the Stormwater account # 77770110; and
WHEREAS, the final contract price is $45,481.70
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa.

The project was bid as a unit price contract and the final contract price is $45,481.70
There were a total of zero (0) change or extra work orders for the project.
I recommend that the above -referenced improvements be accepted by the City of Iowa City.

RESOLUTION NO. 16-210
RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND
BETWEEN THE CITY OF IOWA CITY AND MMS CONSULTANTS, INC. TO
PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE HEBL AVENUE
IMPROVEMENTS PROJECT.
WHEREAS, the City of Iowa City desires to improve traffic safety and longevity of Hebl Avenue,
from IWV Road to the landfill entrance; and
WHEREAS, the City of Iowa City desires to reconstruct the asphalt and chipseal composite
roadway of Hebl Avenue to a new PCC street surface with rock base and drainage system, and
WHEREAS, the City desires the services of a consulting firm to prepare preliminary and final
design for construction of the Hebl Avenue Improvements Project; and
WHEREAS, the City of Iowa City has negotiated an Agreement for said consulting services with
MMS Consultants, Inc., to provide said services; and
WHEREAS, it is in the public interest to enter into said Consultant Agreement with MMS
Consultants, Inc.; and
WHEREAS, funds for this project are available in the Hebl Avenue Improvements account
#L3322.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The Consultant's Agreement attached hereto is in the public interest, and is approved as
to form and content.
2. The Mayor and City Clerk are hereby authorized and directed to execute the attached
Consultant's Agreement,
3. The City Manager is authorized to execute amendments to this contract as they may
become necessary.

CONSULTANT AGREEMENT
THIS AGREEMENT, made and entered into this 5th day of July
2016, by and between the City of Iowa City, a municipal corporation, hereinafter referred to as the
City, and MMS Consultants, Inc., of Iowa City, IA, hereinafter referred to as the Consultant.
WHEREAS, the City of Iowa City desires to improve traffic safety and longevity of Hebl Avenue,
from WV Road to the landfill entrance, and
WHEREAS, the City of Iowa City desires to reconstruct the asphalt and chipseal composite
roadway of Hebl Avenue to a new PCC street surface with rock base and drainage system; and
WHEREAS, the City of Iowa City desires the services of a design consultant to prepare
preliminary and final designs for the Hebl Avenue Improvements 2017 Project, and
WHEREAS, the City requested proposals from firms that are qualified to perform said engineering
design services; and
WHEREAS, the City of Iowa City has negotiated an Agreement for said consulting services with
MMS Consultants, Inc.; and
WHEREAS, it is in the public interest to enter into said Consultant Agreement with MMS
Consultants, Inc.; and
WHEREAS, funds for this project are available in the account No. 1-33221
NOW THEREFORE, it is agreed by and between the parties hereto that the City does now
contract with the Consultant to provide services as set forth herein.
I. SCOPE OF SERVICES
Consultant agrees to perform the following services for the City, and to do so in a timely and
satisfactory manner.
A. Topographic survey and easement plat preparation:
1 Review topographic survey of the project corridor from IWV Road to the landfill
entrance that was previously performed by city staff and will be provided by the
City of Iowa City.
2. Collect additional topographic data as required to match city survey.
3. Research boundary information in the project corridor to allow preparation of
temporary easement plats.
4. Prepare temporary easement plats, as required (4-5 plats estimated). The City of
Iowa City does not anticipate the need for fee title right of way acquisition and
permanent easements.
B. Preliminary and final design:
1. Kickoff meeting: Review project and preliminary design with City Public Works
and Transportation and Resources Management departments.

2. Review geotechnical report and pavement thickness recommendations
previously completed by Braun Intertec.
3. Coordinate with private utilities. Contact ONE -CALL for utility information and
make contact with utility companies.
4. Complete wetlands investigation. Prepare wetland delineation plan, if wetlands
are present. Prepare permit applications for impacts to be covered under
nationwide permit. A wetlands mitigation plan is not anticipated to be required
and shall be negotiated separately, if required.
5. All plan preparation shall be in AutoCAD format. Specifications shall be prepared
in Microsoft Word format.
6. Prepare preliminary plan and cost estimate for review. Submit three sets of 50
percent complete plans and preliminary cost estimate. All plans shall be
prepared on 11x17 -inch plan sheets. Preliminary plans shall include preliminary
box culvert sizing and preliminary storm sewer and drainage plan. Also included
is a preliminary access and staging plan.
7. Review preliminary plan with City Public Works and Transportation and
Resources Management departments.
8. Critical design features include the reinforced concrete box culvert , as well as
maintaining traffic to the landfill during construction. Prepare plan for these
critical features to be included with check plan set.
9. Prepare check plan set. Submit three copies of the 90 percent complete check
plan set. Prepare preliminary specifications to be submitted with the check plan
set.
10. Review check plans and preliminary specifications with City Public Works and
Transportation and Resources Management departments.
11. Prepare and submit NPDES permit application on behalf of the City of Iowa City.
12. Prepare final plans necessary for project.
13. The plans shall be prepared in Iowa DOT format for sheet layout and numbering,
and shall reference City of Iowa City standard specifications and details, along
with Iowa DOT and SUDAS specifications and details.
14. Submit three original hard copies of final plans, specifications and final
construction cost estimate. Electronic copies of each also shall be submitted.
15. Present to City Council, as requested.
C. Bid letting and construction services, Phase 1:
1. Assist with contractor questions during bidding.
2. Prepare addenda, as required.
3. Attend pre -construction meeting.
4. Assist with contractor questions during construction.
5. Review submittals, as required.
6. Additional construction administration services are available at MMS Consultants'
standard hourly rates, which are attached hereto and incorporated herein. No
additional services shall be performed, however, without prior written approval by
the City.
II. TIME OF COMPLETION
The Consultant shall complete the following phases of the Project in accordance with the
schedule shown.

III. GENERAL TERMS

A. The Consultant shall not commit any of the following employment practices and
agrees to prohibit the following practices in any subcontracts.
To discharge or refuse to hire any individual because of their race, color,
religion, sex, national origin, disability, age, marital status, gender identity,
or sexual orientation.
2. To discriminate against any individual in terms, conditions, or privileges of
employment because of their race, color, religion, sex, national origin,
disability, age, marital status, gender identity, or sexual orientation.
B. Should the City terminate this Agreement, the Consultant shall be paid for all work
and services performed up to the time of termination. However, such sums shall
not be greater than the "lump sum" amount listed in Section IV. The City may
terminate this Agreement upon seven (7) calendar days' written notice to the
Consultant.
C. This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be without the written consent of all
Parties to said Agreement.
D. It is understood and agreed that the retention of the Consultant by the City for the
purpose of the Project shall be as an independent contractor and shall be
exclusive, but the Consultant shall have the right to employ such assistance as
may be required for the performance of the Project.
E. It is agreed by the City that all records and files pertaining to information needed by
the Consultant for the project shall be available by said City upon reasonable
request to the Consultant. The City agrees to furnish all reasonable assistance in
the use of these records and files.
It is further agreed that no Party to this Agreement shall perform contrary to any
state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa.
G. At the request of the City, the Consultant shall attend meetings of the City Council
relative to the work set forth in this Agreement. Any requests made by the City
shall be given with reasonable notice to the Consultant to assure attendance.
H. The Consultant agrees to furnish, upon termination of this Agreement and upon
demand by the City, copies of all basic notes and sketches, charts, computations,
and any other data prepared or obtained by the Consultant pursuant to this
Agreement without cost, and without restrictions or limitation as to the use relative
to specific projects covered under this Agreement. In such event, the Consultant
shall not be liable for the City's use of such documents on other projects.

The Consultant agrees to furnish all reports, specifications, and drawings, with the
seal of a professional engineer affixed thereto or such seal as required by Iowa
law.
J. The City agrees to tender the Consultant all fees in a timely manner, excepting,
however, that failure of the Consultant to satisfactorily perform in accordance with
this Agreement shall constitute grounds for the City to withhold payment of the
amount sufficient to properly complete the Project in accordance with this
Agreement.
K_ Should any section of this Agreement be found invalid, it is agreed that the
remaining portion shall be deemed severable from the invalid portion and continue
in full force and effect
L. Original contract drawings shall become the property of the City. The Consultant
shall be allowed to keep reproducible copies for the Consultant's own filing use.
M. Fees paid for securing approval of authorities having jurisdiction over the Project
will be paid by the City.
N. Upon signing this agreement, Consultant acknowledged that Section 362.5 of the
Iowa Code prohibits a City officer or employee from having an interest in a contract
with the City, and certifies that no employee or officer of the City, which includes
members of the City Council and City boards and commissions, has an interest,
either direct or indirect, in this agreement, that does not fall within the exceptions to
said statutory provision enumerated in Section 362.5.
O. The Consultant agrees at all times material to this Agreement to have and maintain
professional liability insurance covering the Consultant's liability for the
Consultant's negligent acts, errors and omissions to the City in the sum of
$1,000,000.
IV. COMPENSATION FOR SERVICES
Hourly, not to exceed* $76,000
* See MMS Consultants' 2016 hourly rate sheet, incorporated herein as Attachment A.
V. MISCELLANEOUS
A. All provisions of the Agreement shall be reconciled in accordance with the generally
accepted standards of the Engineering Profession.
B. It is further agreed that there are no other considerations or monies contingent upon
or resulting from the execution of this Agreement, that it is the entire Agreement, and
that no other monies or considerations have been solicited.
C. This Agreement shall be interpreted and enforced in accordance with the laws of the
State of Iowa. Any legal proceeding instituted with respect to this Agreement shall be

brought in a court of competent jurisdiction in Johnson County, Iowa. The parties
hereto hereby submit to personal jurisdiction therein and irrevocably waive any
objection as to venue therein, including any argument that such proceeding has been
brought in an inconvenient forum.

Re: Hebl Avenue Improvements Project
Introduction
The Project includes reconstruction of Hebl Avenue from IWV road to the Landfill and Recycling Center
entrance.
History/Background
Hebl Avenue currently serves as the entrance road to the Landfill and Recycling Center and the majority of traffic is
heavy refuse trucks. The current roadway is a 22' wide rural chip and sealcoat roadway with roadway ditches on
either side for managing storm water runoff. In addition, the existing creek culvert under Hebl Avenue is in need
of repair.
Discussion of Solutions
The reconstruction of Hebl Avenue will include improving the roadway to full depth PCC with rock base and partial
curb to improve the drainage system. A new roadway culvert will be installed for the creek with new guard rails to
improve safety.
Financial Impact
Staff has negotiated an hourly not -to -exceed consultant contract of $76,000 with MMS Consultants, Inc. The
Engineer's estimate of construction costs is $850,000. The project will be funded by landfill revenues and
funding for this project is available in the budget for fund number L3322.
Recommendation
Staff recommends authorizing the consultant services contract with MMS Consultants, Inc. to proceed with
the Hebl Avenue Improvements Project

RESOLUTION NO. 16-211
RESOLUTION AMENDING BUDGETED POSITIONS IN THE ENGINEERING DIVISION OF
THE PUBLIC WORKS DEPARTMENT AND THE ADMINISTRATIVE PAY PLAN BY
DELETING THE POSITION OF ARCHITECTURAL SERVICES/ENERGY COORDINATOR,
ADMINISTRATIVE GRADE 27, AND ADDING ONE FULL-TIME CIVIL ENGINEER, AFSCME
GRADE 15.
WHEREAS, Resolution No. 16-59, adopted by the City Council on March 1, 2016 authorized
budgeted positions in the Engineering Division of the Public Works Department for Fiscal Year
2017; and
WHEREAS, Resolution No. 15-96, adopted by the City Council on April 7, 2015, established a
classification/compensation plan for Administrative employees; and
WHEREAS, the Engineering Division has one full-time Architectural Services/Energy
Coordinator position vacant; and
WHEREAS, the Engineering Division administers the projects included in the Capital
Improvements Program (CIP) and other public improvement projects; and
WHEREAS, after evaluating anticipated workloads for the Engineering Division it has been
determined an additional Civil Engineer is needed to better manage the current and anticipated
CIP projects and other related workload; and
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT:
The budgeted positions in the Engineering Division of the Public Works Department be
amended by:
1. Deleting one full-time Architectural Services/Energy Coordinator, Administrative grade
27.
2. Adding one full-time Civil Engineer, AFSCME grade 15.
The Administrative pay plan be amended by deleting the position of Architectural
Services/Energy Coordinator, grade 27.

RE: Civil Engineer Position
Introduction:
The Engineering Division has been evaluating staff levels, as well as current and anticipated
future workload demands. In an effort to create an efficient project team, the Engineering
Division proposes the elimination of an Architectural Services/Energy Coordinator position and
creation of a new Civil Engineer position.
History/Backs round:
Recently, the Architectural Services/Energy Coordinator position within the Engineering Division
became vacant. At that time, the utilization and needs of the position, and the Division, were
evaluated. During the evaluation process, it was determined the requirements of the position
had changed over time, and a change in job classification for the position could better serve the
Engineering Division and the City.
Discussion of Solutions:
The Engineering Division has a vacant Architectural Services/Energy Coordinator position
included within the approved FY17 budget. Eliminating the vacant position, and creating a new
Civil Engineer position, allows the Engineering Division to better meet evolving workload
demands in an efficient and economical manner. It is anticipated the duties previously
performed by the Architectural Services/Energy Coordinator would continue to be performed by
the Engineering Division, with the majority being included in the scope of duties performed by
the new Civil Engineer position.
Financial Impact:
This resolution eliminates an Architectural Services/Energy Coordinator position (Administrative
Paygrade 27) and creates a Civil Engineer position (AFSCME Paygrade 15). The changes in
position classifications result in an estimated increase of $3,961.42 for the first year the position
is filled, assuming the positions would be filled at Step 1 of each paygrade. However, the top
end of Administrative Paygrade 27 exceeds the top end of AFSCME Paygrade 15. Therefore, it
is anticipated the annual budget impact would improve over the life of the position.
Recommendation:
Staff recommends proceeding with eliminating the Architectural Services/Energy Coordinator
position and creating a Civil Engineer position within the Engineering Division.

RESOLUTION NO. 16-212
RESOLUTION APPROVING AN AMENDMENT TO THE AGREEMENT
BETWEEN THE STATE OF IOWA FLOOD MITIGATION BOARD AND
THE CITY FOR THE USE OF SALES TAX REVENUES FOR THE STATE
OF IOWA FLOOD MITIGATION PROGRAM FOR THE WASTEWATER
TREATMENT PLANT RELOCATION PROJECT.
WHEREAS, the North Wastewater Treatment Plant was impacted by the floods of 2008; and,
WHEREAS, the City of Iowa City prioritized decommissioning the North Waste Water Treatment
Plant and moving operations to the South Waste Treatment Plant; and,
WHEREAS, the City of Iowa City entered into an Agreement with the State of Iowa Flood
Mitigation Board and was awarded $8,497,249 in sales tax increment funds to demolish the North
Wastewater Treatment Plant, create a wetland, and stabilize the stream banks along Ralston Creek
and the Iowa River next to the North Wastewater Treatment Plant; and,
WHEREAS, a mercury contamination issue that turned into an approximately $2.4 million
cleanup and abatement project caused a delay in the overall North Waste Water Treatment Plant
Flood Mitigation project; and,
WHEREAS, re-creating these natural systems is a complex endeavor, particularly in a high
density urban area, and a fairly extensive public planning process to determine the best long-
term plan for this public open space has also caused a delay in the overall North Waste Water
Treatment Plant Flood Mitigation project; and,
WHEREAS, due to delays in the overall North Waste Water Treatment Plant Flood Mitigation
project, the City requested an amendment to the project completion date to January 31, 2018;
and,
WHEREAS, on June 20, 2016, the State of Iowa Flood Mitigation Board approved the
amendment extending the project completion date to January 31, 2018; and,
WHEREAS, the City Council needs to approve an amendment to the Agreement with the State of
Iowa Flood Mitigation Board extending the North Waste Water Treatment Plant Flood Mitigation
project completion date to January 31, 2018.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
The amendment to the Agreement with the State of Iowa Flood Mitigation Board for the North
Waste Water Treatment Plant Flood Mitigation project is approved, and the City Manager is
authorized to sign said amendment and future amendments.

Attached is the City of Iowa City's Semi -Annual Progress Report for the Period November 2015
— April 2016, submitted to the State of Iowa Flood Mitigation Board. This report also served as a
request to amend the Agreement with the State of Iowa Flood Mitigation Board by extending the
project completion deadline from December 31, 2016 to January 31, 2018. The State of Iowa
Flood Mitigation Board approved this amendment on June 20, 2016. State of Iowa staff is
requesting the City Council approve the amendment by resolution.

Re: Iowa Flood Mitigation Program (FMP) — City of Iowa City Semi -Annual Progress Report for
the Period November 2015 — April 2016.
The City of Iowa City remains committed to converting the site of the North Wastewater Treatment plant
to green space and restoring the floodplain to its natural function. The plan is to create a 5 -acre wetland to
manage and filter storm water prior to entering the creek and the Iowa River and to mitigate future
flooding, and to restore and stabilize the Ralston Creek riparian corridor to a more natural state. In
addition, the City of Iowa City will create a regional riverfront park which will help catalyze economic
development in the Riverfront Crossings area immediately south of downtown Iowa City and the
University of Iowa campus.
As stated in the November 2015 — April 2016 Iowa City Semi -Annual Progress report, our project status
is delayed. One factor causing the delay was a mercury contamination issue that turned into an
approximately $2.4 million cleanup and abatement project. The source of the mercury was from
equipment that was originally installed in 1934. The mercury had leaked into the bottom of four trickling
filter basins and required an extensive abatement project prior to bidding the demolition project. Asbestos
and other hazardous materials from the entire site were also abated as part of pre -demolition site work.
As re-creating these natural systems is a complex endeavor, particularly in a high density urban area, the
City is negotiating a separate contract for the engineering and design of the wetland area and Ralston
Creek improvements, after a fairly extensive public planning process to determine the best long-term plan
for this public open space. While this has caused some delay in the schedule, we believe that this careful
planning will result in best management practices with regard to developing and managing this floodplain
park. Once this contract is awarded and the engineering and design are completed, the City of Iowa City
can better determine the timeline for the completion of the project. The City of Iowa City has combined
the Milestones for the Wetland Development and Ralston Creek Improvements. These Milestones will be
bid and awarded as a single project. As a result, the anticipated Application Work Schedule (Milestones)

WHEREAS, this sale would provide affordable housing in a designated area surrounding the
University of Iowa; and
WHEREAS, this sale is conditioned on the family securing adequate financing for the purchase
of the home.

allow properties located therein to be rezoned to a Riverfront Crossings Form Based Code zoning
classification; and
WHEREAS, the Planning and Zoning Commission has reviewed this amendment and determined that
circumstances in this neighborhood have changed to the extent that an amendment to the Comprehensive
Plan is warranted and the Commission has recommended inclusion of the proposed Orchard District in the
Downtown and Riverfront Crossings Master Plan.

The Orchard District is fully developed with duplexes along
Orchard Street, small multi -family buildings around the cul-
de-sac and a few single family dwellings. Three of the single
family homes were moved onto Orchard Court and have no
paved street frontage (the only access is via an unpaved drive
from Benton Street). There currently is an abrupt change
from the larger scale multi-famity and mixed commercial
development east of Orchard Street to the residential on the
west side of the street. Redevelopment at a higher density
than exists today will provide an incentive to create a better
transition and a more pleasant neighborhood. Development
should be restricted to building lypologies, such as cottage
clusters, townhomes, live -work lownhomes and multi -dwelling
buildings that are designed and scaled in a manner that is
complementary to the rhythm and scale of the single family

WHEREAS, The Riverfront Crossings Affordable Housing Requirement set forth in Iowa City
Code of Ordinances 14-2G-8 establishes an affordable housing requirement for certain projects,
which may be met by providing on-site owner -occupied housing, on-site affordable rental housing,
or by providing a fee -in -lieu contribution to an affordable housing fund to be established by the
City; and
WHEREAS, in accordance with 14 -2G -8F, the in -lieu contribution per dwelling unit shall be
determined biennially by resolution of the City Council based on a formula that analyzes the
difference between renting a market rate unit and renting a dwelling unit affordable to an
income -qualified household; and
WHEREAS, with assistance from the National Development Council, staff has developed a
formula that analyzes the difference in project value comparing a market -rate project to a
project with a 10% affordability requirement, and used this formula to determine a per-unit fee
developers may opt to pay in lieu of providing affordable housing dwelling units; and
WHEREAS, The formula takes into account local market conditions such as rents, vacancy
rate, capitalization rate, Fair Market Rents, and unit mix; and
WHEREAS, using this formula the fee is $80,872 per unit.

RE: Inclusionary Zoning — Fee in Lieu Model
At your request, the National Development Council (NDC) has worked with staff to develop a
methodology for calculating a Fee in Lieu (FIL) that would be paid by developers in lieu of including
affordable housing in new Riverfront Crossings developments that are subject to Inclusionary
Zoning. A description of that process and methodology appears below.
It was determined that the most appropriate methodology for arriving at a FIL was to compare the
value of a fully Market Rate development option to the value of a 10% Affordable development
option. The difference between these two values would be the FIL since, under the ordinance,
developers would be required to either provide the units on-site or pay the FIL. Thus the economic
impact to the developer would be the same whether the developer opted to provide an affordable
unit at their own property or pay the FIL to help create that affordable unit elsewhere.
To make this computation it was determined to use the standard process for valuing rental
properties that is employed by the Real Estate and Financial industries. But to do so, impartial,
third party data would be required. Therefore Cook Appraisal, Commercial Valuation Research
Group was commissioned to prepare a Multifamily Housing and Development study for the Iowa
City Market. This study, completed on December 18, 2015, now serves as the basis for the FIL
calculation described herein.
The Cook report divides Iowa City into Zones (sub -markets) and presents data for each zone
including:
• Numbers of units by bedroom/unit type (efficiency, one bedroom etc.)
• Rents and vacancy levels by unit type
• Trending for rents and vacancy levels
• Operating Expense information and ratios
This data was then analyzed for applicability to the City's Inclusionary Zoning and concluded that:
Data presented for Zone 1 was most applicable to the Riverfront Crossings redevelopment
area. Zone 1 is defined in the study as "The portion of Iowa City located generally within
one mile of the Iowa Avenue Bridge."
Additional information was required and subsequently provided by Cook Appraisal:

o Cook clarified that rents presented in the study assumed tenants paid all utilities
and had been adjusted to exclude all utilities from the rents
o The Capitalization Rate (Cap Rate) appropriate for Zone 1 was needed and
identified by Cook to be 7%.
This third party information could now be used to determine the projected value of a fully Market
Rate property, but additional information was required to make the comparison with the 10%
Affordable development option. Given the City's historic involvement in Affordable Housing efforts,
the following additional information was gleaned from internal sources:
• Affordable rents used under HOME and Low -Income Housing Tax Credit programs
• Utility Allowance data used to adjust affordable rents to account for tenant paid utilities
With this information in hand, the net operating income for both the fully Market Rate and 10%
Affordable property options was calculated using the following assumptions:
• A typical Riverfront Crossings development would have 40 units
• The development would have the same mix of efficiency, one, two and three bedroom
apartments as exists currently in Zone 1
• The distribution of affordable units would be proportional across all unit types (10% each of
efficiencies, one, two and three bedroom units)
• All rents on both the fully Market Rate and 10% Affordable development options would be
net of utilities — assuming all utilities would be paid by tenants
• The Zone 1 overall market vacancy rate would be applied to both the fully Market Rate and
10% Affordable development options
• Since a range of expense ratios was presented in the Cook Appraisal study, it was
determined that:
o The fully Market Rate development option would utilize the average of the range of
ratios presented in the study
o The 10% Affordable development option would utilize the expense ratio at the high
end of the range to account for additional costs to the developer of complying with
Affordability requirements over the 10 year affordability period. These
requirements include marketing to attract income qualified tenants, tenant income
qualification and certification, tracking and implementing allowable rent increases,
documentation and record keeping and annual compliance reporting.
• The Zone 1 market cap rate supplied by Cook Appraisal would be used in calculating fair
market values under both the fully Market Rate and 10% Affordable development options
Utilizing the above assumptions and third party data, the FIL is calculated at $80,872 per affordable
unit, meaning that any developer opting out of providing a required affordable unit within their
own development would contribute $80,872 toward the development of that unit at another
location in the community.

The preliminary and final plat of Pine Grove is in general compliance with the approved Planned
Development Overlay Plan and the subdivision regulations. Legal papers and construction plans
are currently being reviewed by staff. It is anticipated that these documents will be approved prior
to the July 5'" Council Meeting.
Environmentally Sensitive Areas: The development has been designed to preserve
approximately an acre of woodland on Outlot A, which will be maintained by a homeowners'
association as private open space for the use of the residents of lots 1 and 2. Groves of trees
are located along the west side of Hummingbird Lane, the south property lines of lots 3 - 6, and
along the rear lot lines of proposed lots 7 - 12. The eastern portion of the subdivision has been
designed with larger single family lots to allow many of these trees to be preserved, although
some will need to be removed to allow for Pine Grove Lane and driveways to individual lots.
The final plat includes conservation easements to provide for the long-term protection of trees.
A tree protection plan is also being reviewed by the City Forester.
Neighborhood Open Space: A subdivision of this size requires the dedication of 15,280
square feet of neighborhood open space or fees in lieu of. The Parks and Recreation
Department has determined that fees are appropriate in lieu of open space dedication. The fee
will be equivalent to the value of 15,280 square feet of property. This requirement will need to
be addressed in the legal papers.
Infrastructure fees include $435 per acre for water main extension fees. Payment of these fees
should be addressed in the legal papers.
STAFF RECOMMENDATION:
Staff recommends approval of SUB16-00006; the preliminary and final plat of Pine Grove, a 12 -
lot, 9.33 -acre residential subdivision located south of Lower West Branch Road between Scott
Boulevard and Hummingbird Lane provided that legal papers have been approved by the City
Attorney, construction plans have been approved by the City Engineer and the tree protection
plan has been approved by the City Forester. It is anticipated that these documents will be

RESOLUTION NO. 16-218
RESOLUTION AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME
LOCATED AT 1109 5T" AVENUE.
WHEREAS, the City constructed a modular house at 1109 5t' Avenue and sold the property as
an affordable home pursuant to the Consolidated Plan for Housing, Jobs, and Services (CITY
STEPS); and
WHEREAS, the City provided the previous owner with a $30,000 loan to help keep the home
affordable; and
WHEREAS, the previous owner was facing foreclosure, so the City bought the home back
through a short sale; and
WHEREAS, the home needed extensive rehabilitation, but is now ready to sell; and
WHEREAS, the City has received an offer to ,purchase the home, which it has accepted
contingent on Council approval; and
WHEREAS, the amount of the sale will be $149,500 and the new buyer must be below 80%
Area Median Income and agree to keep the property owner -occupied for twenty years; and
WHEREAS, on June 21, 2016, the City Council adopted a Resolution proposing to convey its
interest in 1109 5th Avenue, authorizing public notice of the proposed conveyance, and setting
the date and time for the public hearing; and
WHEREAS, following the public hearing on the proposed conveyance, the City Council finds
that the conveyance is in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, that:
1. Upon the direction of the City Attorney, the Mayor and the City Clerk are authorized to
execute a warranty deed conveying the City's interest in 1109 5t Avenue, legally
described as Parcel "G", Plat of Survey of Lot 1, and the east half of Lot 2, Block 44, Iowa
City, Iowa.
2. The City Attorney is hereby authorized to deliver said warranty deed and to carry out any
actions necessary to consummate the conveyance required by law.
