Mayor Throgmorton & Council members:
I am writing to strongly encourage you to adopt the proposed road diet plans for Morman Trek Avenue and First
Avenue.
I drive motor vehicles and I ride bicycles, so have both perspectives. It seems clear from other streets in Iowa City where
center turning lanes have been installed that this is a much more efficient method for moving motor vehicle traffic, not
to mention that it lessens accidents. With respect to bicycling it would be particularly helpful for those of us living near
1st Avenue to have a less complicated and safer way to ride to our destinations in that area. And while I do not travel
Mormon Trek as often, I have had the experience of finding the current 4 lane set-up to be not easy to negotiate by bike
and not as efficient for making turns by car.

Dear City Council members:
I am sure you hear a lot about issues with traffic related to the Gateway construction project on Dubuque Street.
I live on Ridge Road, a street that is experiencing a significant increase in through traffic as drivers seek a way
out of the long delays on Dubuque.
Unfortunately, the two other streets that can provide outlets to get off Dubuque (at Brown Street and Kimball
Road) are both currently closed due to the construction, shunting all those frustrated drivers up Ridge Road as
the only alternative out of the line-up on Dubuque.
The volume of vehicles is an issue on a road like Ridge, which is a steep incline with a hairpin turn, but the real
factor is the speed. I totally understand drivers' frustration trying to escape that bottleneck on Dubuque that
must feel interminable at commute times, but the speed people take on Ridge is dangerous --to other drivers, to
pedestrians, cyclists, pets and the abundant wildlife that frequent our neighborhood. (Our area is heavily
wooded and backs up to Bur Oak Land Trust conservation land to the north and east.) Ridge Road is relatively
narrow with no sidewalk or shoulder on the steepest parts. Cars also occasionally park on one side of the street,
narrowing the passage even more.
This issue needs addressing, particularly since the Gateway construction will continue for two years, and the
Brown Street and Kimball Road alternatives are not scheduled to reopen until mid-September.
I assess Ridge Road with its steep incline and hairpin turn is the most dangerous, but I know the volume and
speed of vehicles continues as Ridge turns into Whiting Avenue and drivers continue through neighborhood
streets trying to connect back to a main road (likely Dodge Street). As a way to help mitigate this dangerous
situation, would you please consider installing speed bumps along Ridge Road and possibly Whiting Avenue,
perhaps permanently, but at least until the Gateway construction is complete?

Dear City Council Members,
There is a huge increase in traffic on Ridge Road with the Gateway Project lane reduction on Dubuque Street
that now includes closures to both Kimball Road and Brown Street. The traffic on Dubuque is horrible anyway,
and this morning the inbound traffic was backed up as far as I could see both north and south. The outbound
traffic jam yesterday evening forced many drivers to take Ridge Road to avoid the standstill traffic on Dubuque.
There is a significant turnover of residents on Ridge Road and the surrounding neighborhood the past few
years, and there are now many new small children living in the area. As I'm sure you are also aware, there is a
large wildlife population in this area unaccustomed to high volume traffic. Additionally, there is an ongoing
resurfacing project on Whiting A venue, at times reducing traffic on Whiting to a single lane. The volume and
speed of the traffic on Ridge Road is untenable, especially with the construction on the Gateway Project is
slated to continue for the next two years; the Kimball Road and Brown Street accesses are not scheduled to
resume until mid-September. Therefore, we request that the city council act to install either permanent or
temporary speed bumps at intervals along Ridge Road until the Gateway Project is complete. Thank you for

I have contacted Marcia Bollinger and talked to Officers Kelsey and Neeld. I was going to call you after I
talked to Kelsey, but we had a family emergency and I was out of town. I have contacted the police department
several times in the last month. We have groups of 15 to 30 kids causing disturbances at Wetherby Park again.
This is directly behind one duplex I own. One night a group of these kids went down into Briar Circle and tried
breaking into cars. I saw them trying to open several car doors. They were also having fun ringing doorbells and
running and hiding. At least one resident called police beside me. One night a group of high schoolers were
throwing rocks at cars at the corner of Taylor and Bums. I called police that night too. I run up at the park on
Monday and Wednesday evenings sometimes. I had a group of about eight males threaten me. One took his
shirt off and raised his fist threatening to punch me. I did not say a word to any of them. They were blocking the
bike path so I was forced to go another way. It is disgusting that I have to put up with this crap in the
neighborhood I have lived in since 1981. I have rental property in this area as you know. We met at a meeting at
Jerry's duplex right next to the park. I hope that within the next 5 years, I will have sold all my property and
moved out of this neighborhood. I have all but given up and am tired of this. This racist crap goes both ways. I
treat everyone with respect, but am singled out by the black youth. When I visit my son in Chicago, I don't have
to put up with this garbage. Why here in my neighborhood?

though our community is also served by the University of Iowa Department of Public Safety and the Johnson

places essentially murdered two black men. This is not the first time this has happened and it is not expected to

Good morning, Mr. Mennenga.
I'm sorry to hear that you were negatively impacted by Wednesday night's storms. We are sympathetic to all of our
residents who need extra time and assistance in getting their properties cleared after such a weather event.
Unfortunately, the City is unable to help all of our residents with the cleanup of their private property, as staff is busy
clearing storm debris from public areas, as well as carrying on their normal work duties to keep our waste and recycling
services running on time and smoothly as our residents expect. We are running extra yard waste routes as staff
resources become available.
We recommend that residents who need help with cleanup of large items that are not suitable for the yard waste
program reach out to private contractors for assistance.

I have been told that storm debris can be taken to the landfill for no charge. That is as it should be but I have no way of
doing that nor do my neighbors. Cutting the debris into three feet sections and then bundling it takes a lot of time. Why
not declare a special pickup and have residents pile it at the curb as is. With each storm this issue seems more
important. My taxes should be paying for a better response.

My name is Deb Starr and I have lived in Iowa City for 38 years. I came to this community right after graduating with my Nursing
Degree from Morningside College and began working at the UIHC. I use to love this community and have always felt safe in Iowa
City, no matter where I would go. That is no longer true. We purchased a home on Esther Court 28 years ago. We chose the area as
it was close to elementary and junior high schools, close to the park- Mercer and Aquatic Center. It was a quiet cul de sac and we
raised our daughter here. Again, we never felt threatened and all our neighbors were respectful of everyone. I have slowly watched
over the past 5 years, this neighborhood change and it started when low income properties were established in and around our
neighborhood. But the past year has been terrible. The police are called to our quiet Esther Ct at least 2-3 times a month. They are
usually called for fights that happen in our street or for loud parties with underage drinking, or robbery. There have been numerous
robbery's the past year on both Esther Street and Esther Court. You can not be in the park at dusk or later- it is not safe. You can't
even walk in the neighbor hood when it cools down in the summer after dark for fear of getting assaulted or robbed. Right now on
Esther Court, there is one family dwelling that has been the cause of many issues this past year. —they moved in July 2015. They
are African —American but I don't care what color they are- I would feel the same way whether they are white, black, Hispanic,
Indian, etc. They are completely disrespectful to everyone around them. I won't go in to the specifics but we have complained
about un -kept lawns and weeds, littering in the yard and the street, tearing down street signs, old cars in the street etc. The
children are unsupervised and we are yelled at and sworn at constantly by certain kids and the mother. Now- all of us on Esther
Court and Esther Street aren't even safe in our own area- there was a shooting Wednesday night and I was one of the people that
were outside when it happened. You have NO clue how devastating this is to us!! This happened at 7pm when people were walking
their dogs, outside with their children playing and the park was full of people enjoying the evening with family. The mother of those
involved says her kids where in the house when this kid from cedar rapids confronted them- not true. They were in the street, on
their bikes, blocking the street as they like to do and the fight started on the street. It was a blessing that no one was killed! He
fired 5 shots directly at the kids in the area as they were running. One of the shots imbedded in the duplex right next to my home.
This is totally unacceptablel! 16 year olds with guns - and I am sorry to say this- but these kids have no role model and they are
always unsupervised. But there is always an excuse and we always have to find things for these kids to do and keep them off the
street...... until these kids have better role models and supervision , nothing will help. I see it every day in my neighborhood. Iowa
City was lucky this time- no one was killed in this shooting. But it will happen ...... an innocent person will be in the way of these
bullets and will die. It is just a matter of time. I think one of things that bothers me the most is this- It truly seems that those who
"run" this city are only concerned about the beautification of downtown Iowa City, the penthouse apartments, the riverfront.......
And are closing their eyes to what is really happening in the wonderful neighborhoods of Iowa City. You are placing these low
income duplexes/apartments in quiet, middle class family neighborhoods and neighborhoods are no longer safe for anyone.
Landlords are not being responsible for their tenants- rental units are falling apart and yards are un -kept. The police were wonderful
Wednesday evening. They are trying their best in these neighborhoods but rely on us to call when we see anything suspicious. We
have been doing that but then we are called "racist" from the people involved in the behavior and have been spit at and called
numerous names that I won't mention- the entire neighborhood is tired of all this behavior and disrespect! If this continues, we will
never be able to sell our home- does the city of Iowa City want to buy it from us at our asking price!!!! 11! So many people that feel
the same way I do. I am sure you have heard from some of them. Its so sad.... To see this happen all over the city. With the exception
of your wealthy neighborhoods..... because I am sure you do not place low income housing In these areas .......... I predict in the next
5-10 years that Iowa City will be like Waterloo/Davenport and Cedar Rapids. Shootings will happen daily- people will be killed.
Innocent people will be hurt or killed. Gangs will pop up all over and no one will want to leave their homes. I hope I am exaggerating
but I don't think so. Speaking for a majority of the homeowners on Esther Court. Deb Starr

On July 8th 2016, I met with Diane, Broek, the landlord for the residence in which I live. She came to the house
to do some things concerning her mother. While there, as we stood in the basement, she told me the plumber

again. Before we left, she repeated the same date. Then, she told me, I only had a few months left before the
house would be sold.
However, on July 12th 2016, someone came to the house at about 9am. Mrs. Broek left a note asking me to call
her. I called her from a phone at a nearby church. I did not use my phone because I do not have a lot of
minutes on the phone and have to watch how much I spend as I have been working for less than 2 weeks
now. Also, though I know Mrs. Broek needs to have my number to contact me by phone, she uses it to
gangstalk me.
I have never mentioned this before, but Mrs. Broek is a participant of this new age Cointelpro system. She has
done a lot for me. She brought me from South Florida on her dime and she has allowed me to stay in her house
without paying rent because I don't have the money to afford rent or utilities bills. However, she is only
allowed to help me if she uses gangstalking tactics while doing so. This is house this new age Stasi works.
I have never mentioned her name because she has been so helpful and I have not wanted to upset her in any
way, but I try to minimize the amount of stalking she does as described below.
As I have mentioned in letters before, Mrs. Broek made it very clear to me that I was the only person who had a
key to the house. When I came home to find that someone had some into the house and left the lights on, Mrs
Broek played it off as if she knew nothing about it. She even suggested that the plumber may have been in the
house. Why would she assume the plumber had been in the house, when she knew the door was locked? At
that moment, Mrs. Broek was taunting me because she knew the role the plumber was playing to intimidate me
with the presence of a male in the house. She was attempting to add insult to injury.
She is also guilty of harassing me by phone. Because the listening devices and cameras in the house track my
movements, she was being instructed to call me as soon as I got out of bed. She also sends me messages with
the time reflecting 911 which is a very popular signal for Cointelpro. In one day, I received text messages from
her at 11:09 and at 11:49. So, I decided to change my number and not give it to her. On another occasion, she
came by the house, shortly after the Tulip Festival. While speaking with Mrs. Vanderhill (as I described in the
letter dated June7th 2016), Mrs. Vanderhill told me she only takes home $200 from the store where she
volunteers as we talked about many things. When Diane came to the house the following week, she brought me
$200.
I had absolutely no money, so I asked her for a loan to pay my bills. She brought the money, but before she
gave it to me, she took me out for dinner where she carefully selected the table in the middle of the restaurant
close to a family already enjoying dinner. At that moment, she went off on me and made it seem as if I was
taking advantage of her, but I wasn't. She knew I had nothing and I told her I would pay her back, but then she
said, "That's not going to happen." Why was she so sure I was not going to be able to do so? Because she
knew as a targeted individual what my life would be like in Orange City. I did not suspect Diane at this point
and I understood very clearly from where she was coming. I do not know her financial standings and I know I
am not her family. Whatever help she gave me, was more than I could have hoped for. Though I felt the goal
was to humiliate me in public, I accepted it because she has been better to me than my own family in this
regard. The next week, I was hired at Pioneer Memorial Home. I was given the job because of what had
transpired with Mrs. Broek. You are rewarded only if you suffer some kind of humiliation. I knew Mr. Netten
knew me before I walked by his behavior in the interview which really wasn't much of an interview. All the
other employees knew as well and they were prepared to make life difficult for me. It didn't matter how hard a
worked or well I did my job. I was under mental and physical attack and there was nothing I was going to be
able to do about it. Though I gathered Mrs. Brock wasn't being informed about everything, I knew she was
being told some things. On a Sunday, as I was approaching the house from work, she and her husband were just
pulling up to house. It was so calculated. The night before, I kept burning the rice and didn't have very much
left. Guess what Diane left for me in the mailbox on that day? A bag of rice only.
Moving to the present, I called Diane today, July 13th 2016. She wanted to know why I didn't answer. I told
her that she told me that the date to expect the plumber was August 12th 2016. She refuted that by saying that
she told me it was next week. Then, she went on to say that she tried her key, but it wouldn't work. When I
tried to explain to her, she shut me down like she always has. Though she is helping me in a grand way, she
has always treated as if I have no voice - the way you would treat a child. She's very dehumanizing, but I never
complained because as I have written before, I never wanted to upset her as I know people who are members of
Cointelpro will help you as well as abandon you in the same breath. Because Mrs Brock uses Cointelpro tactics
to harass me by phone, I changed my number again. She wanted to give me more money, in order to recharge
my phone, but I told her I did not want her money because I have taken enough of it and I often leave my phone
inactive to stop the harassing phone calls not only from her but from other people as well. Lately I have been
getting calls from a number that reads 0000000000 which to me is a death threat. Our conversation ended with
Mrs. Broek saying, "We're done."
a.) First of all, she made a point to ingrain August 12th in my mind and because the attempt failed to mentally
disturb me, then my head has been put on the chopping block. Any time Mrs. Broek has given me the correct
time to be at the house to let someone in, I have always been there.
b.) What key did she try, if she said I had the only one?
Mrs. Broek told me in early July the water usage in the house was industrial. If that was the case, why has it
taken more than a month to have someone come out to fix this problem.
The goal of showing up on July the 12th was to take me off guard because that coupled with a male presence in
the house was to upset me somehow.
Here's the thing, that house belongs to Mrs. Broek. So, she can come in whenever she wants to. I am not
intimidated by the presence of a male where it's just the both of us, but when it's being done to intentionally
bring me harm in some way, I am going to speak out about it.
While Mrs. Broek is helping me, she's also doing things to bring me mental harm as a member of
Cointelpro. Though I know she is a member, in her presence I have always shown her respect and have always
told her thank you for helping me, but when I have said it, she brushes it off as if I haven't said anything. Any
time I have told her that I feel she has a good HEART, she always dismisses it and responds by saying that she
will not be getting into heaven. Even when she has said it, I always tell her that regardless of what she does, if
her HEART is good, then she should not be so easy to dismiss the possibility of forgiveness. But that does not
mean I agree with what she's doing and that I won't fight for my rights to be treated like a human
being. Helping me and gangstalking me is no good, because it could ultimately lead to my suicide, which I
would never do, but she doesn't know that.
Every effort is being taken to keep me from staying in Orange City. I have been blacklisted from good paying
jobs, but recently, I was hired as a part time worker. The police have made their presence known there and
people like Mr. Bill Minnick (a member of Cointelpro and a Northwestern College employee) have come in to
make their presence known as gangstalkers as well.
Anyone reading this would say that Mrs. Broek as done a lot for me and they would be correct, but what does
that mean, when she could possibly doing mental damage. I would leave, if I had the money to do so, but right
now, it's the only place I have to go. Does it mean I should allow her to mentally or verbally abuse me?

In the e-mail I sent before this one, I mentioned receiving harassing phone calls, some of which come from
phone numbers marked in all zeros as such, 0000000000. Attached is a picture of those missed phone
calls. The calls came in at 11:53am on June 2nd 2016, 12:29pm on July 1st 2016, and 12:37pm on July 12th
2016. These calls did not start appearing until I started to make comments on Ms.Connie Marshall's posts.
Ms. Marshall has been a targeted individual for more than two decades and is one of the few TIs who has been
able to get her case heard in court. She makes many posts of her harassment on Youtube. She posted a video

conversation with someone inside. The person noticed that someone was standing very close to window staring
inside while talking on the phone. When I turned around to look, he stared at me with intent and I returned the
stare.
When I left, they all turned their attention to me as I walked away. I got home and returned to give them
information on Organized Stalking and to let them know that their scare tactic had been wasted. I tried to find
them, but because they left shortly after I did, they were nowhere in sight.
There were two people who looked like teenagers, one male and one female, sitting outside talking. I did not
actually see how many there were of them and what they looked like, so I asked the two people sitting
there. They told me they saw 4 Latina males, but could not be sure if they were all Latino males. I asked them
if they noticed how one of them got up from his seat to stand next to the window and the young man agreed he
thought it looked very suspicious.
No doubt, this was in response to all that has transpired in the past two days.

I am interested in the rules the ICHA is currently using in considering denying or terminating rental assistance

Core Principles of a Just Development
1. Preserve our Community: Space for ALL Current Residents
The residents of Forest View are a tight -knit community. Many of us have lived there for
years. We take care of each other, and we believe a just development must give all current
residents the option to stay. There is a severe housing crisis in Iowa City; forcing any
number of residents out leaves them at risk of homelessness.
2. Housing Structures that are Safe & Sustainable for the Future
The trailers in Forest View are our homes. We bought them, invested money in maintaining
them, raised our families in them, and had expected to stay in them. But they are also very
old, do not comply with modern safety codes, and are in no shape to be moved. Dragging
1960's trailers to new sites is not a sustainable plan.
If our community must be relocated as part of a new multi-million dollar development, the
end result should include safe and sustainable homes that can last. We would particularly
like to explore the possibility of developing a complex of small houses, with financing that
current residents could afford. This could provide a sustainable alternative for low-income
housing in our area, and would be a step toward addressing Iowa City s housing crisis.
3. New Housing Costs Comparable to Current Costs
Many residents at Forest View survive on very low incomes. In spite of our hard work in
area factories, restaurants, hotels, and construction sites, our wages are simply not enough
to allow us provide for our families while paying more than we currently pay in lot rent.
4. Compensation for Relocation Costs and Loss of Property
Whether a resident chooses to relocate to other housing in the area, or decides to live in the
new Forest View development, the resident should receive compensation to cover the cost
of the unexpected move (for example: cost of moving trucks, lost time from their jobs,
temporary housing). Residents should also be compensated for the loss of their trailers.
5. Adequate Time to Prepare for Relocation
The relocation plan is far from finalized, which makes it very difficult for residents to make
any decisions about our future. A just relocation plan will give us plenty of time, ideally a
year, to consider our options, decide what is best for our family and prepare for the move.
6. Right to Organize without Intimidation or Retaliation
The Forest View redevelopment will have a huge impact on residents' lives. We have a
moral and legal right to organize our tenants' association, to openly discuss our ideas and
concerns, and raise views that may not be the same as the developers without retaliation.

I find it disturbing that an Iowa City council member who was elected by the people of Iowa City to serve the people of
Iowa City is openly supporting a candidate for the school board who is defending and promoting policies that will only
hurt the students of Iowa City. Mr. Cole says that he supports the vision of a candidate who wants to re -do the FMP and
keep the current boundary scenario that definitely does not benefit the students of Iowa City. Nothing in that vision
benefits our older neighborhoods, our most disadvantaged neighborhoods, and the future growth of our city.
Mr. Cole was elected to serve the citizens of this community. He was not elected to the school board which must serve
all of the citizens of the district. That is not his job. I seriously doubt if elected officials in the other municipalities that
are in this school district are supporting a candidate who is openly advocating for policies that could disadvantage their
communities in the same ways for years to come.
The tax dollars of Iowa City residents have funded a very large portion of the new building and improvements in the
district and most especially in other communities. When many have fought so hard for years - including past city
councils - for some equity and balance in facilities, student demographics, and curricular and extra -curricular
programming in the schools located within iowa City's boundaries, it is disheartening in the least to see a member of
our city council standing side by side with a candidate who agrees with three of our current school board members
who have undone and abandoned long range planning and boundary decisions in a cavalier manner.
There are many who are asking why Mr. Cole is so willing to abandon the long range plans that were so carefully crafted
after so much consensus building and input from parents, our community, our municipalities, and our district?
Why is Mr. Cole not fighting for equity and balance in all of our schools?
Why is Mr. Cole siding with a candidate who has openly said he hasn't really been paying attention to these issues for
the past years but he knows better than anyone what should be done on almost every issue that comes up in forums
and in conversation?
Why is Mr. Cole more vocal for one school and one group of parents to the disadvantage of all others? Why is he
supporting a PAC in our school board elections? What will he do if every school that has an issue forms a PAC? Will he
join them all?
I and many others are stunned that someone on our city council has such disregard for our city and its future. When
many finally woke up and recognized the disadvantages our children faced because no one seemed to have been paying
attention to our schools for decades, we went to work for our kids. We spent hundreds if not thousands of collective
hours talking about the issues, doing our research, and participating in the process. To have finally come out on the
other end of this - it has been a process since 2001- and to have one of our own out working to elect a board member
who essentially wants to dismantle everything is painful. It is disheartening. It is depressing. It is unacceptable.

I appreciate your client Derma Carters disability and concern for laying a sidewalk outside her home. Othe ,
like myself also have disabilities. I'm a person with a physical disability that requires me to use a power
wheelchair. If I needed to be on her street, I would appreciate having a sidewalk which makes for a more

I've been pleased to see the steps the Council has taken lately on inclusionary zoning, and I'm glad the situation
at Rose Oaks is on the Council's radar. But we cannot simply pass laws. We also have to help people. As you
know (probably better than I do) the city also has extremely low vacancy rates in rental units, and very, very
few of those are affordable, and more and more of them are being torn down. For instance, while the planned
condos off Riverside and Benton that were recently approved as part of the Riverfront Crossings district look
lovely, they are displacing rental property, not replacing it.
We may deplore ugly old rental units, and many of them are in need of updates (or even of condemnation). But
until we commit fully to making sure that affordable rental units are available in our city, the least we can do is
to assist those displaced in the name of progress.

Re: CWJ Support of Mass Dislocation Funds for Rose Oaks Residents
We are writing in support of Council Member Rockne Cole's proposal to set aside
a $50,000 fund to provide direct financial support for residents impacted by the
mass dislocation at Rose Oaks apartment complex from March through August of
this year. Our conversations with residents demonstrate clearly that the Rose Oaks
redevelopment has had a serious impact on over 100 area residents and families,
who are still struggling today with the financial and human costs of their
dislocation.
Relocation assistance for large-scale displacement of tenants is a commonly -
accepted principle in many cities across the nation; in Iowa, we are familiar with
flood assistance, which is a comparable program for residents facing unforeseen
crisis. Rose Oaks residents we have spoken with have stressed that even a modest
financial assistance package would help to ease at least some short-term financial
pressures resulting from their dislocation. It is also clear from talking to residents
that they have absorbed widely varying costs as a result of the dislocation, and that
restricting funding to a narrow set of expenses will only help a fraction of
residents.
Background:
Since March, the Center for Worker Justice has organized home visits, phone calls,
events, and meetings with Rose Oaks residents impacted by the mass dislocation
caused by College Fund Property's purchase and redevelopment of one of thol
city's largest low-income housing complexes. Based on past and curre

conversations with residents, it is clear to us that this dislocation caused a large-
scale, unforeseen crisis for residents, and its direct consequences are far from QVQr,
Most obviously, over 100 residents and their families had very little time to try to
find similarly -priced housing in a city with notoriously high-priced rental units and
a miniscule vacancy rate. But narrowly focusing on the difficult search for new
affordable housing understates the full impact. Many residents lack cars and relied
on their ability to walk to industrial and retail jobs near Rose Oaks; these residents
face an even more limited housing search, or higher transportation costs, or job
loss. Residents have repeatedly reported that the insect infestations at Rose Oaks
destroyed their furniture and forced them to replace at least some of their furniture
in the move, rather than introduce insect infestations into new housing. Many
residents have kids — relocation can mean the loss of affordable child care
alternatives and transportation expenses to continue participating in extra-
curricular activities.
CWJ was proud to join with Rose Oaks residents to demand a more just
redevelopment process, and to win a small but important concession — pushing
back the moving date until August 1 st for tenants whose leases expired before then.
Shelter House, Crisis Center, and other agencies have also contributed important
resources and information that have assisted some residents with their relocation.
Last week, volunteers from the Center for Worker Justice made dozens of calls and
had long discussions with 12 Rose Oaks residents impacted by the dislocation
(some still at Rose Oaks, some who have left). Perhaps the most disturbing finding
is that four of the twelve residents we spoke with experienced homelessness as a
result of the move, and three of these are still staying in temporary housing
arrangements on friends or family members' couches to avoid being out on the i L L

Summary of CWJ discussions with Rose Oaks residents:
Resident 1: Applied for Shelter House funds 1 %i months ago, but never received a
response. Difficulty finding housing here, moved to Arkansas. Had significant
moving expenses, and still struggling to recover.
Resident 2: Evicted for late payment, didn't receive security deposit or $500 "buy
out" from Rose Oaks. Received security deposit and partial I't month rent from
Shelter House, along with an application fee. Living in temporary housing until
apartment becomes available, struggling to pay for moving costs, furniture (had
been rented, now returned to store), and I' month's rent.
Resident 3: Left in April, still living on relative's couch without a long-term home.
Continued difficulty finding affordable housing option, or funding to pay for it.
Did not apply for Shelter House funding because some of her neighbors said they
applied and did not qualify, so she thought she wouldn't either. Plans to apply for
Shelter House funding now; along with additional funding, this could help her
move into more stable housing.
Resident 4: Moved, but still struggling financially from the costs of the unexpected
move. Only learned about the Shelter House funding a few weeks ago. Has gone to
the office several times, but it is always closed when he isn't working. Will try
again to contact someone from Shelter House, and could also use any additional
funding possible to get back on his feet.
Resident 5: As a result of dislocation from Rose Oaks, moved to Colorado, then
homeless in Iowa City, then Waterloo. Applied for Shelter House funding for
security deposit and 0 month's rent in Waterloo, but told he doesnifq i�y`.. l_
because he moved out of Iowa City.

Resident 6: Still at Rose Oaks, moves August 1. Received Shelter House assistance
with V month's rent and moving costs. Says Shelter House application was
simple, but she had to show ID, copy of Social Security card, and tax statement as
part of application process, which she knows some residents don't have. Won't get
the $500 Rose Oaks "buy out" because she stayed through the end of her lease.
Struggling with cost of move.
Resident 7: Still lives at Rose Oaks, says it's "like a refugee camp" now. Frequent
interruptions in water supply, often at different times than the notices had
indicated. She had to get rid of most of her furniture and belongings because of
water seepage, insects, mold. No air conditioning, Crisis Center brought fans. The
security officers are harassing anyone who comes to Rose Oaks to visit tenants.
Applied for Shelter House funding, and waiting to hear whether she was approved.
Resident 8: Evicted for late payment, didn't receive security deposit or $500 "buy
out" from Rose Oaks. Family is homeless, staying in temporary situations with
family, but haven't been approved for a new apartment. Understands that Shelter
House will pay up to $600 for hotel, maximum.
Resident 9: Found a new home but the rent, electric bill, and water bill are more
expensive, and there are things that need to be fixed in the home that cost money.
Received funds for the security deposit and water bill from Shelter House, but still
struggling since wages are the same and new housing costs are higher. Said a few
hundred dollars may not seem like a lot to city officials, but it's a lot for residents.
Also said the Shelter House program is challenging for many people because of its
eligibility criteria— you need proof of income, the new home has to be approved,
you have to show social security number, and some people haven't had enough
time to find new homes because Rose Oaks stopped accepting partial payments
every two weeks and started evicting tenants.
Resident 10: Still at Rose Oaks, having a very difficult time finding a new home
for his family. Has filled out an application for Shelter House funds, but has not
received an answer.
Resident 11: Moved to a new apartment with higher rent and water bill. Received a
partial payment toward rent and a water deposit from Shelter House, as well as use
of a moving truck. Did not receive $500 "buy out" from Rose Oaks. Continues to
struggle with new costs associated with the move. Knows people who did not
apply for Shelter House funds because of lack of Social Security number.
Resident 12: Still lives in Rose Oaks. Has another place to live beginning Sept 1,
and trying to find a way to stay until then. Has not applied for Shelter House funds,
because he isn't the lease holder in the new house, and thinks he won't qualify for
any assistance. Won't receive the $500 "buy out" because his lease expired at the
end of June. Will apply for Shelter House funds, and really needs assistance. Lost
his job due to the relocation. The new home will also cost at least $50 per month
more in rent, plus the water bill that he didn't used to have to pay. He says the
security officers are really harassing people. His roommates have been stopped by
security, who demanded to see their ID when they were just walking to their
apartment. If a family member comes to visit Rose Oaks residents, the security
guards stop them, demand IDs and tell them only tenants can be on the property.

business, other than storage, should be conducted at this site, and hours of operation would be limited to
7AM to 6PM on weekdays and 7AM to 12PM on Saturdays to reduce potential disturbance that the
movement of heavy equipment may have on the nearby manufactured home park.

Rittenmeyer Trucking Co. has submitted an application to the Johnson County Board of Adjustment to
renew a Conditional Use Permit to allow the continuation of a truck and equipment storage business as a
home business at 4525 Taft Ave SE. A Conditional Use permit to allow the establishment of this business
was originally granted by the Johnson County Board of Adjustment in 2011. The County placed a 5 year
limitation on the Conditional Use Permit to allow the business to establish a track record for a period to
assess its compatibility with adjacent land uses.
The property is located on the west side of Taft Ave SE approximately 3000 feet south of its intersection
with Highway 6 in Scott Township, outside of the City's growth boundary but within Fringe Area B of the
Fringe Area Policy Agreement. The Johnson County Ordinance requires that cities be allowed to review
Conditional Use Permits within their extraterritorial jurisdiction. Conditional Use Permits in Johnson
County require a 4/5 majority vote of the Board of Adjustment to approve if the use is opposed by a vote
of the City Council.
The current zoning of the site is Agricultural (A). To the south, west, and north of the property is
agricultural zoning. Also to the north and to the east of the site is residential zoning, with a nearby
manufactured home park and RV storage.
The applicant stores his businesses' three dump trucks, three earthmovers, a Bobcat tractor and a dirt
pulverizer on site. The equipment is generally stored within metal buildings located on the property.
Hours of business operation are be limited to 7AM until 5PM on weekdays and 7AM until 12PM on
Saturdays to reduce potential disturbance that the movement of heavy equipment may have on the
nearby manufactured home park. Two non -family employees work from this site and pick up the dump
trucks and other equipment for transport to job sites. No business, other than storage, is conducted at
this location.
As noted above, the proposed site is outside of the Iowa City growth boundary and is therefore unlikely to
have negative impacts on existing or planned development within Iowa City in the near future. However,
the future land use of the area is uncertain and as the city expands into growth areas it is important to
ensure compatible land uses. If the County chooses to approve the Conditional Use Permit, staff
recommends that it be limited for a term of 15 years. At the end of the 15 year term the status of
development within the area could be reassessed. If it is determined that the city is not growing in that
direction the County could then consider reapproving a Conditional Use Permit, however if growth
patterns indicate that the trucking business has become incompatible with development in the area, the
County could choose to not extend the permit.
Staff Recommendation
Staff recommends that the City forward a letter to the Johnson County Board of Adjustment
recommending that if a Conditional Use Permit is granted to allow a truck equipment and storage
business at 4525 Taft Avenue, it be limited to a period of 15 years with the possibility of future renewals.

sensitive features that are in that ravine. Amelon also addressed the buffer from the interstate
noting it is something that the developer is conscious of and wants to make sure that there is a
good buffer. The site itself does have a natural buffer from the interstate, the site is about 25
feet higher than the interstate. Hencsh asked how many feet it would be from the back of the
lots to Highway 218. Amelon feels it is between 200 to 250 feet.
Hensch also addressed the water quality issue, and asked if it was a radon issue with the water.
Amelon said another subdivision has some issues with their water quality with radionuclides
being borderline lower than what is acceptable by the DNR. This proposed subdivision will have
two separate wells and two separate homeowners associations so each well will be considered
private. That will allow for in-home treatments to deal with the radionuclides (water softner, iron
removal, etc.) that will make it acceptable to the standards. If it were to be a public system the
DNR does not allow in-home treatments.
Hensch asked if the County will require any monitoring of the radionuclide levels. Amelon was
unsure of the answer and would have to ask the County.
Miklo stated to clarify that it is approximately 180 feet from the edge of the interstate pavement
to the property line, and then another 60 feet to the closest house. He said the City subdivision
regulations measure from the edge of the highway right-of-way, not the pavement. He also
noted that City Standards to do state that the 300 foot buffer can be reduced if there is a natural
buffer that results in a noise level of less the 60 dBA. He said that due to the topography that
may be the case here, but because the regulation does not apply no measurements were taken.
Hensch closed the public discussion.
Signs noted for the record that he is acquainted with the developer, he is an agent in the same
office as Signs, but Signs has no financial or business interests with the developer or this
development.
Martin moved to approve SUB16-00007 an application submitted by Hochstedler Building
and Development for a preliminary plat of Glenwood Springs, a 13 -lot, 22.31 acre
residential subdivision located at Dane Road SW and Highway 218 subject to the final
plat addressing 1) dedication of Dane Road right-of-way and 2) an easement to allow
access to Palisades Place if the adjacent property develops for a residential subdivision
in the future.
Parsons seconded the motion.

approval by the County so that this could be reassessed in terms of its compatibility with current
development within the County. Iowa City had recommended a 10 -year period for
reassessment. So the proposal is to renewal the conditional use permit to allow a trucking
business to store their equipment on this property. Miklo noted this area is not one the City
anticipates being annexed into the City any time soon and therefore is comfortable
recommending renewal of this permit for a period of 15 years. After the 15 years, the City and
the County can then reassess to see if there is residential growth.

Mike Rittenmeyer (4529 Taft Avenue SE) is the owner of Rittenmeyer Trucking and stated he is
happy with the Staff recommendation.
Signs asked what the road is constructed of. Rittenmeyer said it is chip -seal. He had to add the
chip -seal and is also required by the County to maintain it from the south edge of Breckenridge
to his property.
