BACKGROUND INFORMATION:
The applicant, Judith H.W. Crossett is applying for a vacation of the Cottonwood Avenue public right-of-
way east of Yewell Street, a 7,441 square feet area located immediately south of 1420 Yewell Street.
The applicant is requesting this vacation to release the right-of-way designation from the area, to allow it
to be acquired.
The applicant discovered this area was right-of-way when planning for an addition to the house at 1420
Yewell Street. The right-of-way is unimproved, and appears to have functioned as a shared driveway for
the properties at 1420 and 1502 Yewell Street for decades.

This portion of the Cottonwood Avenue public right-of-way appears to have been designated as such to
allow for future extension through to Franklin Street. However, directly to the east, the Highlander
Development Addition subdivision plat, submitted in 1953, does not include a right-of-way to allow for
the extension of Cottonwood Avenue. An aerial map sent by the property owner at 1502 Yewell Street
shows a shared driveway in the right-of-way area, providing access to rear garages at both abutting
properties.
The dead-end right-of-way area requested to be vacated currently includes a gravel drive that provides
access to the property at 1502 Yewell St. and the applicant's property.
ANALYSIS:
a) Vehicular and pedestrian circulation and access to private property:
The right-of-way has never been developed and does not currently allow vehicular traffic, as it
currently dead -ends at the rear parcel line for 1421 Franklin Street and is not used for general traffic
or pedestrian circulation. As a result, it has been determined that the right-of-way is not required for
current or future vehicular circulation.
b) Emergency and utility and service access:
Emergency, utility, and service access to this right-of-way will not be impacted by the vacation. The
right-of-way does not currently provide access to any parcels or properties that cannot be directly
accessed from a street.
Staff has contacted private utility companies for their easement needs. To date, private utility
companies have not responded. Staff will recommend easements for any private utilities in the right-
of-way. It appears MidAmerican Energy (electric utility) occupies a portion of the right-of-way.
c) Impact on access of adjacent private properties
The Cottonwood Avenue right-of-way provides access to the adjacent private properties at 1420 and
1502 Yewell Street. It appears residents 1502 Yewell Street and 1420 Yewell Street are utilizing the
right-of-way area as a shared driveway and for parking.
Persons associated with 1502 and 1420 Yewell Street have expressed interest in acquiring this
segment of the Cottonwood Avenue right-of-way. It has been the City's practice that if both abutting
property owners are interested, half of the right-of-way be offered to each abutting property owner
(pending City Council approval of a purchase offer).
d) Desirability of right of way for access or circulation needs
The right-of-way was likely designated as such for future extension of Cottonwood Avenue to connect to
Franklin Street, which never came to fruition. Since the existing property at 1421 Franklin Street would
prevent a future connection to Franklin street, this section of the Cottonwood Avenue right-of-way has
little desirability, and since the right-of-way does not provide any public access or circulation, the right-of-
way designation is not necessary.
e) Location of utilities and other easements or restrictions on the property
Letters have been sent to private utility providers to determine any easement needs. Property owners
have reported a utility pole existing in the right-of-way.
STAFF RECOMMENDATION: Staff recommends approval of VAC16-00001, a vacation of the
Cottonwood Avenue public right-of-way, 7,741 square feet east of Yewell Street, subject to an access
easement being created for the shared driveway, and creation of any necessary utility easements.

Signs asked if they are anticipating these to be owner -occupied units. Seabold confirmed that is
their intent for the townhomes, the back building may be some rental.
Ken Raw (302 West Benton Street) questions why this neighborhood needs to be so changed to
make it more owner -occupied, it has been fine for 40 years and has been largely the same as it is
now. Raw acknowledged the new concept has some improvements but just does seethe need for
this development.
Freerks closed the public hearing.
Hensch moved to approve an amendment to the Comprehensive Plan for property located
north of Benton Street and west of Orchard Street to be included in the Downtown and
Riverfront Crossings Master Plan.
Martin seconded the motion.
Freerks noted her appreciation that the comments and concerns from the Commission and public
were taken by the applicant and incorporated into an improved concept. She feels this could be
good for the neighborhood and appreciates the set back of the third story. This concept will be a
nice transition from the projects along Riverside Drive to the neighborhood to the west.
Parsons agreed and likes that the parking was moved underground so there will be more green
space and less parking lot lighting.
Martin likes this and the opportunity for future projects it will allow.
Theobald feels the concept shows some very positive changes, but does fear that the units won't
be owner -occupied but purchased and then rented.
Signs said he is struggling with this application. He appreciates the changes the applicant
incorporated since hearing from the public and Commission, but is not convinced this project
belongs at this location. It is a great urban look which is what the Riverfront Crossing District is
about, but rather than building this project in Riverfront Crossings, we are moving Riverfront
Crossings District to this project. He is concerned about scale with the houses that sit nearby. The
proposed buildings still appear to be quite large.
Hensch said he likes the idea of expanding the Riverfront Crossings District to include this area
and hopes this will bring more stability to the area with owner -occupied homes.
Hektoen noted that in light of the recommendation that the Commission made at the last meeting
with regards to affordable housing in the Riverfront Crossings Zone that would then apply to this
area if the amendment is approved by City Council.
A vote was taken and the motion passed 6-1 (Signs voting no).

Wolf began the staff report stating the Judith and Laura Crossett applied for a building permit at
1420 Yewell Street with plans for an addition. Through that process they realized that the property
was abutting this portion of Cottonwood Avenue right-of-way. Therefore they are applying for a
vacation to lift the right-of-way designation. This right-of-way has functioned as a shared driveway,
maintained by both owners, and is the only off-street parking that is provided for both those
properties. This portion of the Cottonwood Avenue public right-of-way appears to have been
designated as such to allow for future extension through to Franklin Street. However, directly to the
east, the Highlander Development Addition subdivision plat, submitted in 1953, does not include a
right-of-way to allow for the extension of Cottonwood Avenue. The right-of-way has never been
developed and does not currently allow vehicular traffic, as it currently dead -ends at the rear
parcel line for 1421 Franklin Street and is not used for general traffic or pedestrian circulation.
There is a Mid -American pole that runs east -west on the property, and they will let the City know
what utility easement they will need. The area of the lot is 60 feet and the addition at most would
need 20 feet, so there will be area for the utility easement. Wolf explained that both abutting
property owners have been willing to discuss a purchase offer as long as the utility easement
doesn't span the rest of the area. There would also need to be a shared access easement so the
abutting property owner still has the gravel parking area.
Staff recommends approval of VAC16-00001, a vacation of the Cottonwood Avenue public right-of-
way, 7,741 square feet east of Yewell Street, subject to an access easement being created for the
shared driveway, and creation of any necessary utility easements.
Miklo added that it will be likely that the right-of-way would be split in half with the southern
property owner buying the southern half and the applicant buying the northern half.
Freerks opened the public hearing.
Judith Crossett (1504 Grand Avenue) stated she currently lives in University Heights and it is her
daughter's property at 1420 Yewell, but this is a joint project so she speaks for both of them. What
they want to do is add a bedroom and bathroom to the south end of the house where she will move
into. It will not be a grandiose addition and they definitely don't want anyone to lose their driveway
access, and they will conform to paving the end of the driveway that is required.
Peter Hendlev (1502 Yewell Street) lives to the south and is concerned about maintaining the off-
street parking.
Freerks closed the public hearing.
Parsons moved to approve VAC16-00001 a vacation of the Cottonwood Avenue public right-
of-way east of Yewell Street, a 7,441 square foot area located immediately south of 1420
Yewell Street subject to an access easement being created for the shared driveway, and
creation of any necessary utility easements.
Martin seconded the motion.
Freerks feels this will not cause any issues and the right-of-way will still function for the needs of
the abutting property owners.
A vote was taken and the motion carried 7-0.

NOTICE OF PUBLIC HEARING TO CONSIDER APPROVAL OF
A PROPOSED AMENDMENT TO THE CITY-UNIVERSITY
PROJECT I URBAN RENEWAL PLAN IN THE CITY OF IOWA
CITY, IOWA
The City Council of the City of Iowa City, Iowa will hold a public hearing at its meeting on
July 19, 2016 which commences at 7:00 P.M. in the Emma J. Harvat Hall, City Hall, Iowa City,
Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted
by the City Clerk to consider adoption of the City-University Project I Urban Renewal Plan,
Amendment No. 14 (the "Plan") which adds land to the area.
A copy of the plan is on file for public inspection in the office of the City Clerk, City Hall,
Iowa City, Iowa.
The City of Iowa City, Iowa is the local agency which, if such Plan is approved, shall
undertake the urban renewal activities described in such Plan.
The general scope of the urban renewal activities under consideration in the Plan is to
assist qualified industries and businesses in the Urban Renewal Area through various public
purpose and special financing activities outlined in the Plan. To accomplish the objectives of
the Plan, and to encourage the further development of the Urban Renewal Area, the plan
provides that such special financing activities may include, but not be limited to, the making of
loans or grants of public funds to private entities under Chapter 15A of the Code of Iowa. The
City also may install, construct and reconstruct streets, parking facilities, open space areas and
other substantial public improvement, and may acquire and make land available for
development or redevelopment by private enterprise as authorized by law. The Plan provides
that the City may issue bonds or use available funds for such purposes and that tax increment
reimbursement of such costs will be sought if and to the extent incurred by the City.
Any person or organization desired to be heard shall be afforded an opportunity to be
heard at such hearing.

Re: Public Hearing on City -University Project 1; Amendment #14
Introduction
State Code requires an Urban Renewal Plan be amended to include any project for which the
City Council may wish to use TIF financing or consider entering into a development agreement
as financial partner. Amendment #14 adds land to the Urban Renewal Area but does not add a
specific project. The additional land is the one block area bordered by Gilbert St., Washington
St., Van Buren St., and Iowa Avenue. The addition of this land to the Urban Renewal Plan is
necessary to consider a future project on the block that may require tax increment financing.
History/background
The original City -University Project I Urban Renewal Area was established in 1969 and has
been amended thirteen times to accomplish various urban renewal projects.
Amendment #14 would allow the City Council to consider a project in the block on which City
Hall and the former Unitarian Universalist Church are located. It is unknown if TIF will be
needed to facilitate the possible private or public improvements at this location in the future.
This action simply provides the City the ability to contemplate such a project.
Discussion of Solution
The following paragraphs document the procedural requirements completed for amending an
Urban Renewal Plan:
a) Resolution of Necessity
A Resolution of Necessity to consider Amendment #14 to the City University Urban Renewal
Plan was adopted by the City Council (#16-184) on June 6, 2016.
b) Consultation with Taxing Entities
Notice of a consultation between the City of Iowa City and the affected taxing entities (the
school district and the County) concerning the proposed Amendment #14 to the City -University
Urban Renewal Area was sent with individual letters of invitation to the meeting. The
consultation was held on June 23, 2016, at 11:30 a.m. in the City Manager's Conference Room
in City Hall. There were no representatives present from the affected taxing entities. State law
requires that, if desired, the taxing entities must submit any written recommendations for
modification of the proposed division of revenue within 7 days after the consultation. There were
no submissions received.

c) Notice of Public Hearing
On July 7, 2016, a Notice of the Public Hearing on July 19, 2016 regarding Amendment #14 to
the City -University Project 1 Urban Renewal Plan was published in the Iowa City Press Citizen,
meeting the requirement that the notice be published between 4 and 20 days prior to the public
hearing.
Recommendation
It is important to reiterate that this amendment simply provides the flexibility for the City to add a
project at a future date should the need for one be identified. Any project details and financing
would be contemplated separately.
All procedural steps have been completed and staff recommends adoption of the City -University
Project 1 Amendment #14.

WHEREAS, the City of Iowa City has adopted a omprehensive plan for the
physical development of the municipality as a whole, giv' g due regard to the environs
and metropolitan surroundings, the current planI cally known as the IC2030
Comprehensive Plan; and

proposed Amendment No. 14 to h affected taxing entities, along with a notice of
consultation to be held /ommendat

the public hearing; and

in the City Manager's e Room City Hall. No representatives from the
affected taxing entitiesent at sai time and place, and no taxing entities
submitted any written ions for defecation of the proposed division of
revenue within 7 days asultation; an

the proposed Amen
ment No. 14 to the City-Univer (ty Project 1 Urban Renewal Plan
was held after dye and proper notice of said pubk hearing was given by timely
publication on J y 7, 2016, in the Iowa City Press Citizen, a newspaper having
general circulate n in the Iowa City area.
NOW/THEREFORE, BE IT RESOLVED, BY THE C TY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:
Section 1. This Council finds that the City -University Project 1 Urban Ikanewal
Plan and all amendments thereto, including Amendment No. 14, conforrrf3o the
general plan for the development of the City as a whole; will not result in the
displacement of families, and do not contain open land to be acquired by the C6
Section 2. That the Amendment No. 14 is hereby approved and adopted as the
"Amendment No. 14 to the City -University Project 1 Urban Renewal Plan for the City -
University Project 1 Urban Renewal Area"; and the City Clerk is hereby directed to file
a certified copy of said Amendment No. 14 with the proceedings of this meeting.

INTRODUCTION
The City -University Project 1 Urban Renewal Plan ("Plan") for the City -University
Project 1 Urban Renewal Area ("Area" or "Urban Renewal Area"), adopted in 1969 and
amended thirteen times since, is being further amended with this Amendment #14 to
add additional land to the Urban Renewal Area ("Amendment #14" or "Amendment").
The "base valuation" of a Original Area and each of the amend ent areas will remain
unchanged by this Amen ment. The overall base value of the rban Renewal Area,
after adoption of this A ndment, will be determined by a ing all of the base
valuations of the subareas to ether.
Except as modified by this A ndment, the provisions of th original City University
Project 1 Urban Renewal Plan, a previously amended, are ereby ratified, confirmed,
and approved and shall remain in ull force and effect as p ovided herein. In case of
any conflict or uncertainty, the terms f this Amendment sh I control.
DESCRIPTION OFT URBAN REN AL AREA
The legal description of the property being dded tot City University Project 1 Urban
Renewal Area is attached hereto as Exhibi "A." map of the entire City University
Project 1 Urban Renewal Area, as amended, i alta ed hereto as Exhibit "B."
The Area added as the Amendment is a eco mic development distrijet that i6
appropriate for new commercial and residen ' I Bevel ment.

allows for the contemplation of a ublic/private partnelving all nr part of
amended area for the potential pre rvation of a historic expansion of the fire
station, municipal offices, parking f cilities, and residentiaercial uses. The City
anticipates further amending the Ian to add an urban rendetailing how this
objective may be reached at su time as such activities articularly identified.
DEBT
This Amendment No. 14oes not impact the amount of debt the City proposes to incur
on projects in the Are , as amended. The July 1, 2015 constitutional debt limit is
$247,527,890. The Ci 's outstanding general obligation debt is $71,803,152.

The City University Project 1 Urban Renewal Plan may be amended from time to time
for a variety of reasons, including but not limited to, adding or deleting land, adding
urban renewal projects, or to modify goals or types of renewal activities. The City
