Resolutions and Motions: ITEM2d(1) DOWNTOWN DISTRICT TEMPORARY ALCOHOL SALES - RESOLUTION APPROVING AGREEMENT BETWEEN THE CITY OF 16, --,�3y IOWA CITY AND IOWA CITY DOWNTOWN SELF -SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF ALCOHOL ON 100 BLOCK OF N. LINN STREET DURING "HARVEST DINNER" EVENT Comment: Section 4-5-3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right-of-way, or other public ground, excluding public buildings, pursuant to written agreement. The agreement, which is attached to the resolution, allows the Iowa City Downtown District to sell alcohol and persons to possess alcohol in the 100 block of N. Linn Street in the late afternoon and early evening of August 18 during the Harvest Dinner event. ITEM 2d(2) INDUSTRIAL PARK REALTOR EXTENSION - RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN A ONE-YEAR EXTENSION OF THE LISTING AGREEMENT WITH LEPIC-KROEGER REALTORS FOR THE 420TH STREET INDUSTRIAL PARK. Comment: The 420TH Street Industrial Park is a 173 -acre shovel -ready industrial use site. In 2015, the City entered into a one-year listing/marketing agreement with Lepic-Kroeger Realtors. The designated broker is Jeff Edberg, and the sales commission is 6% of the final sale price. This resolution approves a one-year extension of the agreement. Comment: See Engineer's Report. August 2, 2016 City of Iowa City Page 3 ITEM 2d(4) /� -,)-3W SENIOR CENTER GRANT AGREEMENT WITH JOHNSON COUNTY - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A GRANT AGREEMENT WITH JOHNSON COUNTY FOR FUNDS TO SUPPORT THE IOWA CITY /JOHNSON COUNTY SENIOR CENTER. Comment: This resolution approves a one-year grant agreement for $59,224 from Johnson County to assist with the operating expenses of the Center for FY17. As in the past, the funds will be used to support operations, such as community outreach programming, Senior Center Television, and senior nutrition by hosting a five day -a -week congregate meal program. This is the same amount provided by the County for FY14, FY15, and FY16. The grant agreement is attached to the resolution. ITEM 2d(5) MORMON TREK 4 -LANE TO 3 -LANE CONVERSION - RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE MORMON TREK 4 -LANE �P TO 3 -LANE CONVERSION PROJECT. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easement to construct the Mormon Trek 4 -lane to 3 -lane Conversion Project. The project generally includes new pavement markings, traffic signal replacement at three intersections, replacement of non -ADA compliant sidewalk ramps, incorporation of on -street bike accommodations and the addition of a right -turn lane on Mormon Trek at Benton Street. The project will be funded by an Iowa Department of Transportation Traffic Safety Improvement Grant and General Obligation bond proceeds. ITEM 2d(6) REZONING 3055 PRAIRIE DU CHIEN ROAD - RECOMMENDATION TO JOHNSON COUNTY APPROVING REZONING (CZ16-00002) Comment: At its July 21 meeting by a vote of 5-0 (Martin and Hensch absent) the Planning and Zoning Commission recommended forwarding a letter to the Johnson Planning and Zoning Commission recommending approval a rezoning from County Agricultural (A) to County Residential (R) for 9.75 -acres of property located at 3055 Prairie Du Chien Road N.E. in Area A of the Iowa City/Johnson County Fringe Area. The proposed rezoning is consistent with the Johnson County Land Use Plan. August 2, 2016 City of Iowa City Page 4 ITEM 2e. Setting Public Hearings: ITEM 2e(1) REZONING 2114-2118 S. RIVERSIDE DRIVE AND 103 COMMERCIAL DRIVE — MOTION SETTING A PUBLIC HEARING FOR AUGUST 16 ON AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 36, 416 SQUARE FEET OF PROPERTY FROM GENERAL INDUSTRIAL (I- 1) ZONE TO INTENSIVE COMMERCIAL (CI -1) ZONE LOCATED AT 2114-2118 S. RIVERSIDE DRIVE AND 103 COMMERCIAL DRIVE. (REZ16-00004) ITEM 2e(2) Comment: At its July 21 meeting, by a vote of 4-1 (Signs voting no, Martin and Hensch absent), the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement specifying that vehicle sales will be limited to the west side of the building at 2114-18 S. Riverside Drive. Approval will allow this property to be used for intensive commercial uses including car repair and sales. CONVEYANCE OF COTTONWOOD AVENUE - RESOLUTION OF INTENT TO CONSIDER THE PROPOSED CONVEYANCE OF A PORTION OF COTTONWOOD AVENUE EAST OF YEWELL STREET TO LAURA CROSSETT AND SETTING A PUBLIC HEARING ON SAID PROPOSAL FOR AUGUST 16, 2016. Comment: Laura Crossett has requested that the City vacate and convey via quit claim deed that portion of Cottonwood Avenue east of Yewell Street to facilitate an addition to her house. She has offered to pay the City fair market value for this land, as determined by an appraisal, in the amount of $15,000. The owner of the other adjacent property has indicated he is not interested in purchasing any portion of this right-of-way. ITEM 2f. (REZ16-00005) Comment: At its July 7 meeting, by a vote of 5-0 (Freerks absent; Hensch abstained), the Planning and Zoning Commission recommended approval of this rezoning. Approval of the rezoning acknowledges the ownership and use of the property for public purposes. The subject property, along with an abutting property are being developed with a new building that will consolidate the Johnson County Ambulance Center, Medical Examiner's facility, and provide storage for the Auditor's Office. 1. (VAC16-00001) (SECOND CONSIDERATION) Comment: At its June 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this vacation subject to any necessary utility easements. Approval will allow the property to be added to the adjacent residential lot. The vacation has been requested to allow an addition to the house at 1420 Yewell Street. NEWSPAPER BOXES IN PUBLIC RIGHT-OF-WAY - ORDINANCE AMENDING TITLE 16 OF THE CITY CODE, ENTITLED "PUBLIC WORKS," CHAPTER 1, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC RIGHT OF WAY," TO ESTABLISH A PERMIT SYSTEM FOR USE OF NEWSPAPER BOXES IN PUBLIC RIGHT-OF-WAY. (FIRST CONSIDERATION) Comment: The City has received complaints over the years regarding poorly maintained and seemingly abandoned newspaper boxes (referred to as "publishers' boxes' in the ordinance) located on the ped mall and sidewalks. To ensure that the boxes are maintained and do not obstruct pedestrian traffic, the ordinance requires that boxes have a permit and that the permit policy be established by resolution. The resolution will be considered at the same meeting as the passage of the ordinance. Staff intends to propose that the permit policy not require a fee to be paid, but that the location will be somewhat restricted (e.g., placement of the box must allow at least 5 feet of unobstructed walkway) and the box must be kept in good repair.
