ITEM 5. NEWSPAPER BOXES IN PUBLIC RIGHT-OF-WAY - ORDINANCE AMENDING
TITLE 16 OF THE CITY CODE, ENTITLED "PUBLIC WORKS," CHAPTER 1,
ENTITLED, "STREETS, SIDEWALKS AND PUBLIC RIGHT OF WAY," TO
ESTABLISH A PERMIT SYSTEM FOR USE OF NEWSPAPER BOXES IN PUBLIC
RIGHT-OF-WAY. (FIRST CONSIDERATION)
Comment: The City has received complaints over the years regarding poorly
maintained and seemingly abandoned newspaper boxes (referred to as "publishers'
boxes' in the ordinance) located on the ped mall and sidewalks. To ensure that the
boxes are maintained and do not obstruct pedestrian traffic, the ordinance requires
that boxes have a permit and that the permit policy be established by resolution. The
resolution will be considered at the same meeting as the passage of the ordinance.
Staff intends to propose that the permit policy not require a fee to be paid, but that
the location will be somewhat restricted (e.g., placement of the box must allow at
least 5 feet of unobstructed walkway) and the box must be kept in good repair.
