RESOLUTION NO. 16-258
RESOLUTION AUTHORIZING AND DIRECTING THE JOHNSON COUNTY AUDITOR TO
PLACE A PROPOSED AMENDMENT TO THE CITY'S HOME RULE CHARTER TO AMEND
SECTION 7.03(A)(NUMBER OF SIGNATURES) OF ARTICLE VII (INITIATIVE AND
REFERENDUM) TO CHANGE THE NUMBER OF SIGNATURES REQUIRED ON INITIATIVE
AND REFERENDUM PETITIONS BEFORE THE QUALIFIED ELECTORS OF THE CITY OF
IOWA CITY, IOWA AT A SPECIAL CITY ELECTION ON NOVEMBER 8, 2016.
WHEREAS, a petition pursuant to Article VIII of the Home Rule Charter of Iowa City and section
372.11 of the Code of Iowa proposing to amend the City's Home Rule Charter to amend Section
7.03(A) to change the number of signatures required on initiative and referendum petitions from
eligible electors equal in number to at least twenty-five percent (25%) of the number of persons
who voted at the last regular city election, but not less than three thousand six hundred (3,600),
to eligible electors equal in number to at least ten percent (10%) of the number of persons who
voted at the last regular city election, but not less than ten (10); and,
WHEREAS, said petition is valid under the provisions of Section 362.4 of the Iowa Code, and
therefore, the Council must submit the proposed amendment to the voters at a special city
election; and,
WHEREAS, by Resolution No. 16-256 the Council directed that the question be placed on the
ballot in language identical to the petitioners' language, but it was subsequently determined that
the strikethroughs used therein are incompatible with the election software that converts the
language to an ADA accessible presentation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. Resolution No. 16-256 is hereby repealed.
2. The Johnson County Auditor is hereby authorized and directed to place the following
question before the qualified electors of the City of Iowa City, Iowa at a special city election on
November 8, 2016.
Shall the following public measure be adopted? _ Yes _ No
AMENDMENT. Section 7.03(A) of Article VII (Initiative and Referendum) of the Iowa City Charter
shall be amended to comply with Iowa Code §362.4 by:
Replacing the following language:
A. Number of Signatures. Initiative and referendum petitions must be signed by eligible electors
equal in number to at least twenty five percent (25%) of the number of persons who voted in the last
regular city election, but such signatures of eligible electors shall be no fewer than three thousand
six hundred.
with the following language:
A. Number of Signatures. Initiative and referendum petitions must be signed by eligible electors
equal in number to at least ten percent (10%) of the number of persons who voted in the last regular
city election, but such signatures of eligible electors shall be no fewer than ten.
