Re: Renewal of MidAmerican Franchise
BACKGROUND
The current ordinances granting the electric and gas franchises to MidAmerican Energy
were effective December 4, 2007 and are codified at Chapters 1 and 2, respectively, of
Title 12 of the City Code. Both include the following identical language:
The city may continue this franchise by resolution adopted more than
one, but less than two (2) years prior to the tenth anniversary of the
effective date hereof. In the event the city council does not adopt
such a resolution, this franchise will terminate on the tenth
anniversary of the effective date. The city may continue this franchise
by resolution adopted more than one, but less than two (2) years prior
to the twentieth anniversary of the effective date hereof. In the event
the city council does not adopt such a resolution, this franchise will
terminate on the twentieth anniversary of the effective date. If both
such resolutions are adopted, this franchise will terminate on the
twenty fifth anniversary of the effective date. (Sections 12-1-2 and 12-

The current agreements were approved by the City Council after a public power initiative
was defeated in a November 2005 election (67% to 33%) and more than a year of
negotiation by a City team consisting of staff and two Council members. The maximum
franchise term allowed by the state code is twenty-five years. The duration terms of the
ordinances provided to Council for the initial October 2, 2007 public hearing stated as
follows:
The City may terminate this franchise by resolution adopted more than
one, but less than two years prior to the tenth anniversary of the effective
date of this Ordinance. In the event the City Council does adopt such a
resolution, this franchise will terminate on the tenth anniversary of the
effective date. In the event such a resolution is not adopted the City may
terminate this franchise only by resolution adopted more than one but
less than two years prior to the twentieth anniversary of the effective date
of this Ordinance. In the event the City Council does adopt such a
resolution, this franchise will terminate on the twentieth anniversary of the
effective date. If neither such resolution is adopted this franchise will
terminate on the twenty-fifth anniversary of the effective date.
At the October 2, 2007 hearing a member of the public and the earlier public power
initiative, Karen Kubby, proposed a language change that would substitute the "may
terminate" language with the "may continue" language, stating:

And so I want to make two very concrete suggestions that even though
the agreement would not be agreeable to me, um, if these two things
were made, but it would make the agreement more livable to me. And the
first one is to change the language that at those
benchmark times, that the City "may continue" the agreement, versus the
current language which is "may terminate." And here's why I think that's
better government. With the language "may terminate," it can be a very
passive approach to continue the relationship....
But, uh, if you have the words "may continue" it creates a very conscious
relationship between the utility and the city, to decide whether or not
you're going to go forward, and whether or not certain sections of the
agreement should be changed, and we heard during the public power
campaign that the utility had some big concerns about the ever, the
quickly changing landscape around energy issues, and could a new
player come in and deal with those issues. Well, I think the same is true
for long-term entities in those issues who aren't used to the new
landscape. It's an ever-changing thing, and so having that shorter term,
um, uh, or having that positive proactive yes we want to continue, versus
a passive well, there's no reason to terminate so we'll keep going.

The 10/2/2007 public hearing was continued to 10/16/2007 and at that meeting the
Council amended the ordinances to include the "may continue" language and
subsequently adopted them in that form.
PROCEDURE FOR CONTINUATION/RENEWAL
Section 364.2(4) of the state code states that a "franchise may be granted, amended,
extended or renewed" only by ordinance after a public hearing. It is not clear on the face
of the ordinances whether the continuation option qualifies as an "extension" or "renewal"
of the franchise for purposes of Section 364.2(4) of the Iowa Code. As a result, in
accordance with basic principles of statutory construction, a review of the legislative
history of the language is appropriate. When reviewing that history it becomes clear that
the intent of the language was to provide for an initial ten year franchise which could be
continued upon the affirmative action of the Council, rather than a twenty-five year term in
the absence of Council termination. This language change was made in furtherance of
Council's interest in not locking the City in to a term longer than 10 years in the absence
of a review by Council prior to an extension. With this context it is my opinion that
Council's continuance of the franchise is in the nature of an extension or renewal and
subject to the provisions of Section 364.2(4), which requires a public hearing to be held on
the extension/renewal and the franchise to be extended/renewed by ordinance.
At the September 20 City Council meeting you will simply be setting the public hearing for
October 4. It is my understanding that the City Manager is recommending that the
franchise be renewed and will provide details regarding that recommendation prior to the
public hearing and your first consideration of the ordinance on October 4.

Sunday transportation service
Hello:
I'm writing on behalf of my Uncle (Steve Meggitt) who lives with us. Uncle Steve was born with Pervasive
Developmental Disorder in 1947. He will be 70 in May, and cannot drive. Steve lives with us on Newport Road and bikes
into town every morning at 5:30 a.m. (You may know Uncle Steve as'The Weather Man'...he's an Iowa City personality
known by many long time locals for his propensity to give free weather reports.)
Uncle Steve wants you to know that Sunday's are very difficult for him, especially as the weather grows colder. Steve's
daily routine involves biking from our home on Newport Road, heading down Prairie du Chien Road and catching a bus
on Caroline Drive. He mounts his bike on the bus and finishes his commute to Iowa City on your City busses. On Sunday
this is not an option for Steve because there is no public transportation offered. Uncle Steve really suffers around this
and plans to write you to request a modest bus schedule on Sundays. He is compelled to bike all the way into town on
Sundays and it can be brutal in the winter. Steve comes to IOwa City every single day and spends his entire day
downtown. In fact, Uncle Steve has never missed a day in Iowa City! He's lived with us since 2001 after an apartment
fire,and has literally biked to town every day single since then. (Before that he was living downtown and did not rely as
much on transportation systems.)
Your willingness to consider a modest Sunday transportation schedule will greatly improve the quality of life for
residents like Uncle Steve who are aging, have disabilities, don't have a car, or simply can't drive.

Mayor Jim Throgmorten and City Council Members:
In November 2007, the Iowa City Council approved 25 -year electric and natural gas franchises
with MidAmerican Energy Company. During this time, MidAmerican Energy has been
privileged to support the community with reliable and competitively priced energy services. We
are excited about continuing our partnership with Iowa City as we move into the next 10 -year
time frame of the franchise agreements.
Our core concept of providing reliable and competitively priced energy and natural gas service to
Iowa City's industries, businesses and residential customers has not changed. We want to be
your next generation energy company. As part of this forward looking vision, MidAmerican
Energy has a dream of eventually generating 100% of our customers' annual energy needs from
renewables.
As part of this dream, we recently asked for and received approval from the Iowa Utilities Board
on our Wind XI project, and expect to start construction in early 2017. The wind generation
project will add up to 2,000 megawatts of renewable generation in Iowa. The $3.6 billion project
is the largest wind project the company has ever undertaken and when operational, MidAmerican
Energy will generate 85% of customers' annual energy from renewables. Notably, in order to
build, operate and maintain Wind XI, we did not ask for an increase in customer rates or for
financial assistance from the state to pay for it.
Wind XI is a giant step toward realizing MidAmerican Energy's vision of 100% renewable
gn�for Iowa City residents and other customers in the state. Wind energy helps us keep
prices stable and more affordable for customers, provides jobs and economic benefits for Iowa
communities and the state, and contributes to a cleaner environment for everyone.
Since 2004, MidAmerican Energy has invested $6.6 billion to create 3,450 megawatts of wind
energy, all with minimal impact on customer rates. With the addition of Wind XI we are
projecting to be able to provide continued rate stability for our customers through 2029. Rate
stability is and has been a hallmark of our business operations for more than 20 years.
A few other key points we want to share with you:
• Enhanced streetli¢ht initiative: MidAmerican Energy is upgrading more than 100,000
of its streetlights across the state, including the company-owned ones in Iowa City, to
Light Emitting Diode (LED) units, at no cost to the community. We project the
conversion will save approximately 32 million kilowatts -hours of electricity which
represents a reduction on an estimated 22,000 tons of carbon dioxide emissions.

Service reliability: Since the franchises were approved in 2007, the company has made a
significant investment in equipment upgrades throughout Iowa City. That work includes:
replacing more than 20 overhead distribution switches (helps reduce outage time);
reducing the number of failed underground cable faults through replacement of
underground primary cable; and the company is entering the final phases of upgrading
existing 4-kv lines in the north and east downtown areas to 13-kv lines. Our investment
of more than $2 million for that work will help lessen voltage and reliability concerns for
customers in those regions.
Energy efficiency: MidAmerican Energy offers numerous energy -efficiency programs to
help business and residential customers improve their energy efficiency, reduce their
carbon footprints and save money. In the past four years, more than 940 homes and
almost 100 businesses in Iowa City have taken advantage of the company's energy
efficiency programs. For the same time period, residents and businesses in the city have
garnered more than $8.8 million in energy efficiency benefits. Additionally,
MidAmerican Energy has completed energy audits for all city buildings. This provided
additional opportunities for cost savings. We want to continue partnering on energy-
efficient options that can benefit the city's and citizens' bottom line.
Proposed Green Label Program: MidAmerican Energy will be launching the program
this year and will share more information about its Green Label initiative. Part of the
program keys on MidAmerican Energy's 100% renewable generation vision. This
initiative allows customers to take credit for the renewable energy they are using, thus
reducing reliance on power generated from fossil fuels.
Coal Reliance Reduction: With the recent approval of MidAmerican Energy's Wind XI
project there are mechanisms MidAmerican Energy will put in place to depreciate its coal
assets more quickly than without wind generation.
Annual Iowa City-MidAmerican Energy Report: Since 2007, MidAmerican Energy
has provided an annual report to the Iowa City Council, summarizing financial and
community contributions and our involvement within the Iowa City community. We have
80 employees working and living in the Iowa City area. We appreciate the opportunity to
share our story with you.
We are excited about continuing the long-standing partnership MidAmerican Energy has in
serving our Iowa City customers through the extension of the franchises. We look forward to

I write the Catholic church and whole bunch other churches with crosses and bibles and religious leaders that I
will stay out of the public and out sight from people until get section 8 housing apartment as they wait all day as
never get phone call or letter or email or visit in person. Churches listed in yellow pages have always violated
my privacy rights to practice their communist government religious beliefs as the United States government
never enforces laws of harassment against those people whom I never talk about or write as best off when only
send postage stamp letters and have phone or internet and borrow others and use a pay phone.

Never attending public speeches in person with political parties or government as not changing my life as never
educators in person at all and all government and religious leaders and their employees.
Never attended attended church dinners or church services at any churches listed in yellow pages of telephone
book as never did and never will as my ex husband Alan Lauver of Indianola Iowa as we do not speak to one
another or see other in person as our divorce is not like bill Gates of Microsoft Corporations that I will never
meet in person or speak to as a quiet life I lead staying away from and rarely talking to other people about their
church or personal beliefs. Mennonite religious beliefs of my fathers parents that US Government or State of
Iowa government refuses to L us practice with horse and buggy and no modem conveniences.
So the only way to practice my church with cross and Bible is in hiding and secrecy from US government
employees and corporate businesses like WalMart as rarely am I on their property at all as well other stores as
trying get a section 8 housing in counties where retailers and virtually no government and no education
buildings in the county at all.

virtually talk to no one at homeless people or employees at homeless shelters.

Don't attend high school reunions as on do not call list and do not mail list as no ever did phone call and never
even receive a letter from alumni as parted ways or seperatef from all if them in 1981 so never return as they try
gain control over my human body. Whole entire family has been shut out of communication with society and so
raised at home that way by parents Paul and Marcia Odell with what is called Parent Alieniation.

I am at WalMart as purchased an ice tea and fruit as sitting at Subway. Because do not eat out at restaurants that
much at all as never did before as while married to Alan Donald Lauver in Indianola Iowa only two times per
week or two meals per week at restaurants as never paid cash just check or card as hundred a week for food
family of four people as 19 meals a week I could cook at home in my own kitchen as why that is illegal by US
Government employees as no company or visitors. I refuse with men who are not baptized the same religious
beliefs or be where located as hate my country so don't things American citizens.

believe), using my home to advertise for customers!
This weekend, a neighbor of mine asked me if I was renting my house out on Craigslist. I said no—and she
showed me pictures of my home, and a description that I wrote when I WAS IN FACT, renting my home out on
Craigslist for football games 2 years ago!
Somehow RLAC accessed that advertisement & photos from 2 years ago, and is still using it. My friend
pretended to be a potential renter and responded to the ad with my homes' picture --- RLAC replied that my
home was not available that weekend, but that they had many other homes, what were they interested in?, etc.
I believe this is called Bait and Switch, in the industry. What can I do about it?! I have screen shots of all the
evidence, --such as ad and e-mails, that I will be happy to provide when requested.

Introduction
The Johnson County Affordable Housing Coalition appreciates the opportunity to
comment on the Affordable Housing Action Plan presented by City Staff to City Council
on June 21, 2016. This is a groundbreaking and realistic plan that will make a
measurable difference in the shortage of affordable housing in Iowa City. Already, the
adoption of an Inclusionary Zoning ordinance for Riverfront Crossings (#2) and the
approval of code amendments to enable FUSE Housing First use in the community (#3)
are remarkable achievements.
Priorities
Given the number of recommended actions in the plan, we would like to suggest
priorities in implementing the plan.
1) Acquiring Land for Affordable Housing
A major barrier to constructing new affordable housing in Iowa City is the high cost of
land. Therefore we recommend prioritizing actions that will make more land available to
affordable housing developers throughout Iowa City, not only in the urban core.
For actions #4 and #5, we support:
• Aiming for $1 million a year dedicated to affordable housing.
• Ensuring that at least 50% of these funds can be used outside the urban core.
• Dividing these funds as follows: 50% to the Johnson County Housing Trust Fund,
40% for land banking (with a cap of 10% of those funds being used for emergent
situations), and 10% for Low Income Housing Tax Credit support or supplemental
funds for HOME.
We recognize that the funds allocated for land banking could take a while to accumulate
and result in a development project. Therefore we encourage City staff to identify
mechanisms that could utilize land banking funds to leverage other dollars, so that the
City can purchase meaningful amounts of land sooner rather than later.
2) Integrating Affordable and Market -Rate Housing
A second priority, which is supported by actions #7, #8, #9, #12 and #13, is integrating
affordable and market -rate housing. We recognize the importance of private
developers in creating more affordable housing throughout the community.
Therefore we support:
• Creating affordable housing in new developments, whether in the urban core,
annexed areas (#7), or elsewhere. A tax abatement program (#12) could
contribute significantly to the number of affordable units.
• Using Tax Increment financing (#8) to support residential development and
annexation, and to capture the required set-aside for affordable housing
throughout the community.
• Changing City codes (#9) to make a variety of affordable housing types less costly
for developers to build. Form -based codes (#10) should not contain
requirements that make buildings more costly or less accessible.
• Exempting the areas mentioned from the Affordable Housing Location Model
(#13), and making modifications to the Model that will reduce the size of
restricted areas, and take neighborhood densities into account.
3) Preserving Existing Affordable Housing and Protecting Tenants
While we understand that Iowa's Tenant -Landlord law limits the City's options in
addressing tenant concerns, we support:
• Doing all that is possible to protect existing affordable housing that is safe and
decent, and giving the City Council the opportunity to weigh in before major
redevelopment projects occur. Good neighbor meetings should have City staff in
attendance as well as the developer concerned.
An active rent abatement program (#15) would require extensive outreach to
tenants, to make sure they do not put themselves at risk of eviction. Outreach
would work best as a county -wide effort in which the City would participate.
Conclusion: Measurable Goals
We hope that Iowa City and neighboring jurisdictions will identify quantitative
affordable housing goals, such as three-year averages of the net gain of units. By setting
goals and measuring outcomes, we will know the extent to which we are making
progress, and where we need to improve.

directed my Patrol supervisors to have each of their watches monitor the area and conduct directed enforcement as
other calls -for -service allow. Iowa City Police officers are able to conduct enforcement of traffic laws on state highways
within the city. That said, my goal is to reduce speeds and make the road safer, not to generate income; I think that is a
slippery slope.
I am hopeful that some visible enforcement will at least temporarily slow everyone.

As directed by Title 9, Chapter 1, Section 3B of the City Code, this is to advise the City Council
of the following action.
Action:
Pursuant to Section 9-1-3A (10); Install NO PARKING ANY TIME signs on the east and west
sides of Naples Avenue between Hwy 1 and the south municipal boundary.
Comment:
This action is being taken to prohibit parking on Naples Avenue to relieve congestion caused by
vehicles parked on -street in this commercial zone.

Comments to City Council re: Student Housing

Hello, Jacob Simpson from the University of Iowa Student Government.
During tonight's work session, the draft Affordable Housing Action Plan was discussed. I raised
student concerns with the plan, including our hesitation regarding the recommendation to exempt
the Downtown and the University Impact Area from the Affordable Housing Location Model.
Other points of the plan have a potential to affect student housing, specifically the recommendation
to review the multi -family design standards and the recommendation to develop more tax
abatements. These recommendations have a direct impact on student housing, but it is an oversight
to think that the other recommendations or any development policy do not have an effect on student
housing. They are not just interconnected, they are interdependent and interreliant; so to speak of
one without the others in mind leaves us in the sort of ignorance that allows for long-term negative
consequences.
My comments to follow are not limited to the Affordable Housing Action Plan—they are relevant
to past policy discussions and those of the future.
In this room and in the community, there is and has been a disregard for the University student
when discussing housing policy. For example, this summer, support for and innovative
development in Downtown was denied, in part, for the possibility that students may have been
able to become residents. Additionally, we can look back to 2012 when the City Council passed
an ordinance that restricted to three the maximum number of bedrooms in high-density multi-
family developments. Past studies intended to research the housing situation in Iowa City
effectively left out student housing as an interest. In discussions about affordable housing by the
Council and City staff, the mention of students is largely void. When community members speak
at this podium, they express disappointment in the concentration of students near Downtown. From
the student's viewpoint, this kind of talk and action is too prevalent for comfort
I read ordinances that cite student housing demand as a barrier to demographically diverse
populations. The reasoning makes sense: multi -family developments built for students rather than
families are consumed by students rather than families. And this reasoning reveals the misnomer
that continues to puzzle me: multi -family developments in the University Impact Area are not
intended for families, they are intended for students. I think of the misnomer as a symbolic
representation of our City Code not being equipped to handle the special housing demands of a
city that is home to a world class university. We must recognize student demand is not going away,
and it is a faulty solution to implement blanket policies in the University Impact Area that treat
student housing as multi -family housing. We need prodevelopment policies, and we need buildings
with higher densities and greater heights.
There also seems to be a derisive sentiment that student housing demand is a burden, that Iowa
City would be better off without students, that students are not residents of the community. We
can agree that Iowa City and the University could not exist with their same phenomenal identities
if they never existed together. And the students are as much the University as the faculty and staff,
and I would argue the students are actually the necessary component: without students, the
University would better resemble a private research firm. And with regard to the University's
benefits to the community, I will focus on finances. In 2015, students contributed $377.8 million
in tuition and fees to the University, and the contribution rises every year. Portions of the money
are given to community organizations, including the Iowa City Downtown District, the Johnson
County Crisis Center, and the Rape Victim Advocacy Program. Students bring hundreds of
thousands of dollars to the local economy every semester. You know the long list of the
University's contributions to the community better than I do, which strengthens my resolve in the
belief that students significantly benefit Iowa City in a way that is incongruent with how we are
treated in housing policy.
In addition, to think that students can afford the housing prices in this market is a false assumption.
The greatest annual expense for the undergraduate at the University is room and board, with $9,728
being spent on average, and for context, that expense is 20% greater than the annual expense of
tuition and fees. In 2015, of the undergraduates who graduated, 56% graduated with debt, and the
average debt load was $27, 415. It is hard for me to believe that the 25% of each freshman class
who do not reach graduation day do not drop out in large part because of inability to pay for living
in Iowa City. And the people who drop out are not white affluent males from the Chicago suburbs,
they are typically underrepresented minorities, first -generation students, or from backgrounds of
low socioeconomic status. This loss of opportunity is surely on the University to solve, but it
cannot be solved solely by the University—Iowa City must recognize its role in the bigger picture.
The 25% need help.
To restate my previous point, the City Code must accommodate and encourage housing
development for students. Concern for students must be in housing policy discussions alongside
all other concerns. There is no way to serve the citizens of Iowa City better.
