environment against bulling, harassment, and discrimination. The Mayor Pro tem
declared the motion carried unanimously, 6/0, Throgmorton absent.
A public hearing was held on an ordinance conditionally rezoning property from
Intensive Commercial (Cli-1) Zone and Public (P-1) to Riverfront Crossings — South
Gilbert District (RFC -SG) Zone for approximately 8.52 acres located at 1225 S. Gilbert
Street, 1301 S. Gilbert Street, and 1201 S. Gilbert Street. NDS Planner Karen Howard
presented a power point. Individual Council Members expressed their views.
Moved by Thomas, seconded by Dickens, that the ordinance conditionally rezoning
property from Intensive Commercial (Cli-1) Zone and Public (P-1) to Riverfront
Crossings — South Gilbert District (RFC -SG) Zone for approximately 8.52 acres located
at 1225 S. Gilbert Street, 1301 S. Gilbert Street, and 1201 S. Gilbert Street (REZ16-
00002), be given first vote. The Mayor Pro tem request Council Members report any ex
parte communications and none were reported. Individual Council Members expressed
their views.
Moved by Mims, seconded by Dickens, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 16-4685, AMENDING TITLE 14, ZONING CODE, SECTION 2G,
FORM -BASED DEVELOPMENT STANDARDS; SECTION 5B, SIGN REGULATIONS;
SECTION 3C, DESIGN REVIEW; AND SECTION 9C, SIGN DEFINITIONS be voted on
for final passage at this time. Moved by Mims, seconded by Dickens, that the ordinance
be finally adopted at this time.
A public hearing was held on a resolution authorizing conveyance of a single family
home located at 924 East Bloomington Street.
Moved by Taylor, seconded by Dickens, to adopt RES. 16-317, AUTHORIZING
CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 924 EAST
BLOOMINGTON STREET.
Moved by Mims, seconded by Thomas, to adopt RES. 16-318, APPROVING,
AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK
TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND
GENUS LANDSCAPE ARCHITECTS, PC, OF DES MOINES, IOWA TO PROVIDE
CONSULTANT SERVICES FOR THE PEDESTRIAN MALL IMPROVEMENT
PROJECT. Sr. Civil Engineer Scott Sovers presented a power point.
Moved by Mims, seconded by Dickens, to adopt RES. 16-319, AMENDING
BUDGETED POSITIONS IN THE POLICE DEPARTMENT BY TEMPORARILY
ADDING TWO FULL-TIME POLICE OFFICER POSITIONS. Individual Council
Members expressed their views.
Moved by Taylor, seconded by Dickens, to combine Items 10 — 13 assessing
tobacco penalties. The Mayor Pro tem declared the motion carried unanimously by
voice vote. Hearings were held on resolutions assessing a $300.00 civil penalties
against Almost Paradise, Deli -Mart, #2, Deli -Mart, Creekside Market. Asst. Johnson
County Attorney Andy Chappell appeared.

$300.00 CIVIL PENALTY AGAINST ALMOST PARADISE; RES. 16-321, ASSESSING

The Mayor Pro tem stated that no hearings are necessary for Items 14, 15, 16 as the
establishments have waived the hearing and paid the fines. Moved by Dickens,
seconded by Thomas, to adopt RES. 16-324, ACCEPTING A WAIVER OF RIGHT TO
HEARING AND PAYMENT OF A $1500.00 CIVIL PENALTY FROM JOHN'S
GROCERY; RES. 16-325, ACCEPTING A WAIVER OF RIGHT TO HEARING AND
PAYMENT OF A $1500 CIVIL PENALTY FROM WALGREEN; RES. 16-326,
ACCEPTING A WAIVER OF RIGHT TO HEARING, PAYMENT OF $1500 AND
SERVICE OF A THIRTY DAY PERMIT SUSPENSION FROM NORTH DODGE

The Mayor Pro tem stated Item 17 (Tobacco penalty for The Den) has been deleted
from the agenda and no action is necessary.
The Mayor noted that no applications were received for the following Boards and
Commissions and all will be readvertised: Airport Zoning Commission for an unexpired
term, upon appointment — December 21, 2021; Airport Zoning Brd of Adjustment for an
unexpired term, upon appointment - December 21, 2020; Airport Zoning Brd. of
Adjustment for an unexpired term, upon appointment - December 31, 2018 (Formerly
advertised); Historic Preservation Commission for a Jefferson St. representative to fill a
three-year term, March 29, 2016 — July 1, 2019 (New District formed); Senior Center
Commission for an unexpired term, upon appointment — December 21, 2018.
Applicants MUST reside in Iowa City and be 18 years of age unless specific
qualifications are stated. [Staff will not publish additional notices after a period of six

The Mayor noted the previously announced vacancies: Appeals, Board of, for a five-

January 1, 2017 — January 1, 2020; Parks and Recreation Commission for two

Council Member Taylor reported on the Council Listening Post she attended with
Council Member Mims earlier that day at the Senior Center.
Council Member Thomas reported that he attended the groundbreaking for the
Prairie Hill co -housing project in the Miller Orchard neighborhood.
Council Member Dickens stated he will be attending the Paratransit meeting and will
report back at next meeting.
Council Member Cole commented on the importance of a Council endorsement of a
resolution or proclamation denouncing discrimination and hate crimes referred to in the
Mayor Pro tem's opening statement. Majority directed staff to follow up with the Mayor
for the December 6 agenda.
Mayor Pro tem Botchway noted comments made earlier in the evening supporting
our Police Department and urged people not to judge the Police Department based on
one incident; reported on attending the Joe Lavono Quintet Hancher performance; and
attending the ICCA Celebration of the Arts., and presenting the "Reaching Out Award"

to two outstanding programs - Summer of the Arts and the Oaknoll Retirement
Community.
Assistant to the City Manager Simon Andrew welcomed Ashley Monroe who will be
starting as Assistant City Manager on December 6t'.
Council Member Taylor reported she attended the dedication ceremony of the Stead
Family Children's Hospital; and wished her granddaughter a happy birthday. .

Mayor Throgmorton noted that Council Member Dickens wished to remove an item from the
Formal meeting (Consent Calendar) agenda.
DISCUSS NORTH DISTRICT PLAN GOALS FOR THE N. DUBUQUE ST. / PENINSULA
AREA [IP # 3 of 10/27 packet]
Neighborhood Services Development Coordinator Yapp presented a power point outlining the
existing Comprehensive Plan and Strategic Plan goals for the North District. City Manager
Fruin stated the discussion provided Council with an opportunity to reinforce, or disagree with,
the content of the Plans; and to provide guidance to the applicant before they submit an
application. The City Council discussed elements of the North District Plan and City Strategic
Plan, including policies of the North District Plan, and the Strategic Plan goal of seeking
opportunities to develop interstate entranceways in a way that can achieve other goals such as
affordable housing, sensitive areas ordinance, and promoting neighborhood commercial areas
that serve surrounding neighborhoods.
ACTION: None at this time.

City Manager Fruin and City Attorney reviewed their memos. Individual Council Members
expressed their views on the options outlined in the City Manager memo. City Manager Fruin
and City Attorney Dilkes responded to questions. After discussion a majority agreed that
conversations will carry over into the economic development incentive policy discussion already
underway; and that further consideration of the options such as a form -based code will be
considered after the studies (parking historic structures, housing, etc.) that are already in the
works have been completed.

DISCUSS CLIMATE CHANGE TASK FORCE [IP # 6 of 10/27 packet]
City Manager Fruin and Sustainability Coordinator Nations presented information and
responded to questions. After discussion a majority directed staff to work on a RFP for a
consultant and prepare a resolution with recommended City carbon emission reduction goal that
will be targeted in the plan.
ACTION: Proceed as outlined. (Nations)
DISCUSS FOOD VENDING TRUCK PROVISIONS [IP # 7 of 10/27 packet]
Asst. to the City Manager Andrew reviewed his memo and provided background. After
discussion Council directed staff to initiate a code change that would provide a food truck pilot in
the spring of 2017.
ACTION: City Manager Office will lead the effort and work with NDS staff and external
stakeholders to move forward. (Andrew)

1. (IP8 Pending Work Session Items) Mayor Throgmorton noted that the November 1 work
session would include discussion of the Airport Master Plan and Legislative Priorities.
City Manager Fruin stated the Legislative Priorities discussion would provide an
opportunity to discuss additions, and staff would then schedule for action on the
December 6 agenda. The City Manager also stated Council should consider how they
wish to engage with their elected officials, whether as a body, committee, or Mayor only.
Mayor Throgmorton noted he would be absent from the November 15 meeting but
preferred the whole body meeting the legislative delegation; and reminded Council of the
legislative priorities identified by the School Board at the last joint meeting.

for including a summary.
3. (IP17 Listening Post) Mayor Throgmorton noted the November 15 Listening Post

Council Member Taylor reported on Council Member Thomas and her attending the
award ceremony with City staff recognizing the City as a Healthy State Initiative
Founder; and that four signs will be provided to the City for posting
Council Member Thomas added comments on the keynote speaker and statistics
provide don the impact of a healthy City; and noted the message reinforced the
message from Jeff Speck on a walkable community
Mayor Pro tem Botchway noted the upcoming election and encouraged everyone to
vote; stated his excitement for the Witching Hour Festival on November 4-5; reported he

had a lot of fun on his son's first Halloween; and acknowledged upcoming Veteran Day
events.
Council Member Dickens echoed comments on voting, and stated it was one of our
greatest responsibilities; stated he found Jeff Speck a very impressive speaker and
shared he walked form downtown Chicago to Wrigley Field the previous week and
watched neighborhoods change and the blend of 14 story buildings in the middle of a
row of brownstones; and reported he was one of the first to text City Manager Fruin
when his face appeared in the Cubs crowd on Sunday evening.
Council Member Cole stated he and Council Member Mims would be attending the
induction ceremony in Des Moines for Iowa City Police Community Service Officer
Henry Harper on November 4; encouraged people to view the Jeff Speck presentation
on City Channel 4; and stated he would be attending the dance gala at the University of
Iowa Space Place Theater.
Mayor Throgmorton mentioned he would be meeting with Coralville Mayor Lundell
and North Liberty Mayor Nielsen on November 9; he and City Manager Fruin would be
meeting with Cedar Rapids Mayor Corbett and City Manager Pomeranz on November
10; he and Council Member Mims is arranging a meeting with School Board Members
Lynch and Deloach and other Board Members; and stated he would be introducing five
recipients of the Hawkeye Distinguished Veterans Award on Tuesday, November 8.
Asst. to the City Manager Andrew reported he appreciated attending the Healthy
Hometown event mentioned by Council Members Taylor and Thomas, and stated the
City was well represented by Parks & Recreation Dir. Seydell-Johnson and
Neighborhood Services Neighborhood Coordinator Hightshoe.
Moved by Mims, seconded by Botchway, to adjourn regular meeting back to the
work session 8:35 p.m.
