Resolutions and Motions: ITEM4d(1) SOLID WASTE CONTAINERS - RESOLUTION AMENDING THE PERMIT SYSTEM FOR SOLID WASTE CONTAINERS IN THE �� 7 DOWNTOWN ALLEYS BY EXTENDING THE TERM OF THE PERMITS TO MARCH 31, 2017. Comment: Under the current permit system for solid waste containers (aka, dumpsters), any hauler may place a container in a downtown public alley upon obtaining a permit from the City. Staff has issued an RFP to limit the number of haulers in the downtown alleys but has not selected a hauler. Because staff had anticipated that the single hauler would begin Jan. 1, 2017, the permits under the current system expire Dec. 31. Staff anticipates that a permitting system for the single hauler will be on Council's agenda in January. This resolution extends the terms of all current permits to March 31 with no additional fee. ITEM 4d(2) SIDEWALK CAFES - RESOLUTION ADOPTING A POLICY FOR USE OF PUBLIC RIGHT-OF-WAY FOR SIDEWALK CAFES AND RESCINDING RESOLUTION NO. 12-435. 3 e Comment: As a result of the streetscape project, staff recommends that cafes on Washington Street be reconfigured necessitating two changes to the sidewalk cafe policy. One, because the new sidewalks are wider, the cafes on Washington Street should be detached from the building face to promote a better retail environment and to provide consistency in travel path currently. The current policy requires cafes to be located no closer than 3 feet from the curb, and this should be decreased to 2 feet, except for unique circumstances. Two, to avoid drilling holes into the new concrete, cafes on Washington Street should not be allowed to anchor their fencing into the concrete in 2017. The primary reason for the current policy that requires anchored fencing is to prevent "cafe creep." If the non -anchored fencing proves unsuccessful in 2017, staff may require the Washington Street cafes to be anchored beginning in the 2018 season. No other changes are being made to the policy. December 6, 2016 City of Iowa City Page 3 ITEM 4d(3) ECONOMIC DEVELOPMENT ADVISEMENT - RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A ONE YEAR EXTENSION OF THE AGREEMENT BETWEEN THE CITY AND NATIONAL DEVELOPMENT COUNCIL REGARDING COMMUNITY <<' ' AND ECONOMIC DEVELOPMENT ADVISEMENT Comment: Since 2010, the City has entered into agreements with National Development Council (NDC) to facilitate negotiations and pursue financing packages to assist in the redevelopment of key areas including Towncrest and Riverfront Crossing. The current agreement, which expires on Jan. 19, 2017, provides for a one-year extension with a fee increase up to 5%. This resolution authorizes a one-year extension along the same terms except for a 5% fee increase to $6,961.50 per month. ITEM 4d(4) SEPTEMBER DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $14,437,957.49 FOR THE PERIOD OF SEPTEMBER 1 THROUGH SEPTEMBER 30, 2016, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 4d(5) ELECTION ABSTRACT - MOTION APPROVING ABSTRACT OF VOTERS FOR THE NOVEMBER 8, 2016 SPECIAL CITY COUNCIL ELECTION FOR PUBLIC MEASURE C HELD CONCURRENTLY TO GENERAL ELECTION. Comment: Iowa City had a public measure concerning a proposed amendment to the City's Home Rule Charter to amend Section 7.03(a)(number of signatures) of Article VII (initiative and referendum) to change the number of signatures. ITEM 4d(6) VEGETATION MANAGEMENT PLAN - RESOLUTION APPROVING IOWA CITY INTEGRATED ROADSIDE VEGETATION MANAGEMENT PLAN. _33() Comment: This resolution approves the Iowa City Integrated Roadside Vegetation Management Plan. This plan formalizes efforts to plant roadside areas with sustainable plantings which require less maintenance and support broader sustainability efforts. Plan approval is a requirement for funding from the Integrated Roadside Vegetation Management programs. ITEM 4d(7) GRANT AGREEMENT - RESOLUTION APPROVING IOWA CITY INTEGRATED ROADSIDE VEGETATION FUNDING AND AUTHORIZING CITY MANAGER TO SIGN GRANT AGREEMENT. Comment: This resolution approves grant agreement with Iowa Department of Transportation Integrated Roadside Vegetation Management fund for purchase of hydroseeder. Grant to provide $23,848 with $5,962 in matching funds from CIP Project R4226, Sustainable Roadway Vegetation Management Program. Comment: See Engineer's Report. ITEM 4d(10) SYCAMORE STREET, CITY LIMITS TO SOUTH GILBERT STREET, PHASE 1 - RESOLUTION ACCEPTING THE WORK FOR THE L/ 7 SYCAMORE PHASE 1 PROJECT. STREET - CITY LIMITS TO SOUTH GILBERT STREET, Comment: The project has been completed by Metro Pavers, Inc. of Iowa City, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. Project Estimated Cost: $ 3,200,000.00 Project Bid Received: $ 2,471,978.89 Project Actual Cost: $ 2,440,363.33 ITEM 4d(11) 2016 RALSTON CREEK IMPROVEMENTS - RESOLUTION ACCEPTING THE WORK FOR THE 2016 RALSTON CREEK IMPROVEMENTS PROJECT. �35 Comment: The project has been completed by CAJ Enterprises, Inc. of West Branch, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Project Estimated Cost: $ 44,250.00 Project Bid Received: $ 43,638.00 Project Actual Cost: $ 112,044.47 December 6, 2016 City of Iowa City Page 5 ITEM 4d(12) AMENDMENT NO. 2 TO COURT/LINN DEVELOPMENT AGREEMENT - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE SECOND AMENDMENT TO AGREEMENT »� FOR PRIVATE REDEVELOPMENT BETWEEN THE CITY OF IOWA CITY AND CA STUDENT LIVING IOWA CITY, LLC, THE ASSIGNEE OF CASL HOLDINGS, LLC. Comment: On July 27, 2015 the City entered into a Development Agreement with CASL Holdings, LLC for the sale of city property at the corner of Court and Linn Streets and development thereon of a mixed-use project consisting of 2 buildings housing a hotel, office space, retail and apartments with a construction cost of approximately $74 million. The First Amendment to the Development Agreement extended the dates for closing and start of construction. The sale closed on June 1, 2016 and demolition has begun. Because the property has been submitted to a horizontal property regime (condominiums) and there will be separate owners and lenders for the 15 -story Residential Building and the 14 -story Hotel Building, the Developer has requested this Second Amendment in order to allocate the responsibilities of the Agreement to either the residential Owner or the Hotel Owner. The Amendment also approves a slight variation to the unit mix and clarifies that while the 33 affordable units must be one bedroom units the remainder of the 125 "one -bedroom" units may be one bedroom or studio apartments at the Developer's discretion. ITEM 4d(13) HUMAN RIGHTS BY-LAWS — RESOLUTION APPROVING THE BY- LAWS OF THE IOWA CITY HUMAN RIGHTS COMMISSION. Comment: The Rules Committee met on November 30 and recommended approval of the by-law changes attached to the resolution. ITEM 4d(14) EVENT MANAGEMENT SERVICES - RESOLUTION AUTHORIZING TWO ONE-YEAR RENEWALS OF THE CONTRACT FOR EVENT MANAGEMENT SERVICES FOR THE CITY'S PARK AND RECREATION DEPARTMENT. Comment: In June of 2013, the City issued a request for proposal for Event Management Services for a one (1) year contract, with the option to renew for 4 additional one (1) year periods. One proposal was received, evaluated and scored by staff who determined that the proposal submitted by The Avacentre best met the needs of the City. The contract with The Avacentre is approaching its final two years. This Resolution authorizes the City to exercise the option to renew the contract for the final two years of the contract and authorizes the City Manager to effectuate the renewals. ITEM 4d(15) FINANCIAL ADVISORY SERVICES — RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SPEER FINANCIAL FOR FINANCIAL ADVISORY SERVICES. Comment: The proposed resolution will approve a three (3) year contract for financial advisory services with Speer Financial. Financial advisory services include assistance with the issuance of general obligation and revenue bonds, utility fund cash flow analysis, complying with continuing disclosure obligations, and other related services. December 6, 2016 City of Iowa City Page 6 ITEM 4d(16) PURCHASING MANUAL -RESOLUTION APPROVING AND ADOPTING THE NEW PURCHASING MANUAL FOR CITY PROCUREMENT Comment: This Resolution will approve and adopt a new Purchasing Manual for City Procurement for use by City staff in the procurement of goods and services for the City. The new Purchasing Manual has been modified to include the previously adopted Wage Theft Policy (Resolution No. 15-364, November 10, 2015), signature authority for insurance related documents (Resolution 15-301, October 6, 2015), as well as a new section for policies and procedures for Public Improvements. ITEM 4d(17) INTERIM MUNICIPAL DESIGN STANDARDS AND CONSTRUCTION SPECIFICATIONS - RESOLUTION REVISING AND ADOPTING THE IOWA CITY INTERIM MUNICIPAL DESIGN STANDARDS PART 7 (WATER DISTRIBUTION SYSTEM) AND CONSTRUCTION SPECIFICATIONS SECTION 02660 (WATER DISTRIBUTION). Comment: The Iowa City Interim Municipal Design Standards Part 7 - Water Distribution System and Construction Specification Section 02660 Water Distribution have been revised to meet current standards and regulations. These specifications are used for water main work within the City. ITEM 4d(18) LIGHT DUTY BUS PROCUREMENT - RESOLUTION AUTHORIZING THE PROCUREMENT OF (4) 176" LIGHT DUTY BUSES FOR THE TRANSPORTATION SERVICES DEPARTMENT FROM HOGLUND BUS COMPANY, INC. Comment: These light duty buses are to be purchased off of a state contract through the Iowa Department of Transportation and involves the purchase of four (4) light duty buses to serve as replacements for buses currently in our paratransit fleet. Each vehicle costs $97,104 for a total contract of $388,416. The Transportation and Resource Management Department received Federal Transit Administration grant funds for the purchase of these vehicles. One of the vehicles received 80% grant funding while the other three received 85% grant funding. The local match provided by the Transportation and Resource Management Department is $63,118 and will come from the bus re ITEM 4d(19) HEAVY DUTY BUS PROCUREMENT - RESOLUTION AUTHORIZING THE PURCHASE OF THREE(3) HEAVY DUTY BUSES FOR THE /6,-,-3q3 TRANSPORTATION & RESOURCE MANAGEMENT DEPARTMENT FROM GILLIG LLC. Comment: These heavy duty buses are to be purchased off of a state contract through the Iowa Department of Transportation and will result in the purchase of three (3) heavy duty buses to serve as replacements for buses currently in our transit fleet. Each vehicle costs $444,987 for a total contract of $1,334,961. The Transportation Services Department received Federal Transit Administration grant funds for the purchase of these vehicles. These grant funds cover an estimated 83% of the cost of the heavy duty buses. DOUGLASS STREET AND DOUGLASS COURT WATER MAIN REPLACEMENT PROJECT - RESOLUTION ESTABLISHING THE LOCATION FOR PROPOSED SIDEWALKS AS NECESSARY TO COMMENCE FINAL DESIGN SERVICES FOR THE DOUGLASS STREET AND DOUGLASS COURT WATER MAIN REPLACEMENT PROJECT. Comment: Considering the impact that the proposed water main replacement would have on the neighborhood, the adopted complete streets policy and Council's strategic plan priority to foster healthy neighborhoods, the City desires to incorporate sidewalks with the project. City Council is being asked to establish the proposed locations. Staff is recommending sidewalks on the north side of Douglass Street and the inside (generally the north side) of Douglass Court. WORKFORCE HOUSING TAX CREDITS - RESOLUTION IN UPPORT OF THE APPLICATION OF MONARK, LLC FOR WORKFORCE HOUSING TAX INCENTIVES PROGRAM FROM THE IOWA ECONOMIC DEVELOPMENT AUTHORITY TO CONSTRUCT RESIDENTIAL HOUSING AT 7 S. LINN STREET AND COMMITTING LOCAL FUNDS TO THE PROJECT. Comment: Monark, LLC is applying for Workforce Housing Tax Incentives from the Iowa Economic Development Authority to assist financing the construction of residential housing that will include up to 36 dwelling units. The applicant anticipates that all the residential housing will qualify for this program. As part of its application, the developer needs a resolution by the local governmental subdivision supporting the application and committing at least $1,000 per dwelling unit to this project (at least $36,000 for 36 assisted housing units). This resolution also authorizes the City Manager to enter into a funding agreement with Monark, LLC. Action: ITEM 10. APPROVING CONSULTANT SERVICES FIOR A FORM -BASED CODE ANALYSIS, CONCEPT PLANS AND A PARKING IMPACT STUDY - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND OPTICOS DESIGN, INC. TO PROVIDE CONSULTANT SERVICES FOR THE CITY OF IOWA CITY FORM -BASED CODE ANALYSIS AND PARKING IMPACT STUDY. Comment: This Resolution approves and authorizes the execution of an agreement for Opticos Design, Inc. to provide Form -based code consultant services related to the South District and Northside neighborhood areas and a parking impact study for the near downtown areas.
