DECEMBER 6, 2016
Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Throgmorton
presiding. Council Members present: Botchway, Cole, Dickens, Mims, Taylor, Thomas,
Throgmorton. Absent: None. Staff members present: Fruin, Monroe, Dilkes, Voparil,
Boothroy, Hightshoe, Sovers, Havel, Knoche, Nations.
The Mayor presented Student Leadership Awards to Longfellow Elementary
students: Fiona Arnold, Ian Weaver, and Jack Kahle.
Tracey Achenbach and members of the Johnson County Housing Trust Fund Board
of Directors presented a plaque to the City honoring the City's commitment to Affordable
Housing. The Mayor presented Henri Harper with a certificate of recognition honoring
his Induction into Iowa African American Hall of Fame.

Judy Nyren, Lucas Farms Neighborhood, and Lorraine Bowans, Longfellow
Neighborhood thanked city staff and Neighborhood Outreach Planner Bollinger for
her involvement in neighborhood associations and supporting PIN grants.
Sustainability Coordinator Nations introduced the AmeriCorps team: Aren Calton,
Kai Hedstrom, Emily Mueller and Michael Delp. AmeriCorps Delp, spoke regarding
city energy audits of publicly owned housing properties. Brandon Ross read a quote
from Henry Giroux regarding government and public versus private interests and the
Flint , Michigan water situation.
Moved by Mims, seconded by Thomas, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 16-4686, CONDITIONALLY REZONING PROPERTY FROM
INTENSIVE COMMERCIAL (CI -1) ZONE AND PUBLIC (P-1) TO RIVERFRONT
CROSSINGS — SOUTH GILBERT DISTRICT (RFC -SG) ZONE FOR
APPROXIMATELY 8.52 ACRES LOCATED AT 1225 S. GILBERT STREET, 1301 S.
GILBERT STREET, AND 1201 S. GILBERT STREET (REZ16-00002), be voted on for
final passage at this time. The Mayor requested Council Members disclose any exparte
communications and none were reported. Moved by Mims, seconded by Dickens, that
the ordinance be finally adopted at this time.
A public hearing was held on a resolution approving plans, specifications, form of
contract, and estimate of cost for the construction of the Frauenholtz-Miller Park Project
2016, establishing amount of bid security to accompany each bid, directing City Clerk to
publish notice to bidders, and fixing time and place for receipt of bids. Parks and
Recreation Dir. Seydell-Johnson presented a power point.
Moved by Dickens, seconded by Mims, to adopt RES. 16-346, APPROVING
PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR
THE CONSTRUCTION OF THE FRAUENHOLTZ-MILLER PARK PROJECT 2016,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,
DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME
AND PLACE FOR RECEIPT OF BIDS.

THE LOCATION FOR PROPOSED SIDEWALKS AS NECESSARY TO COMMENCE

The Mayor noted the previously announced vacancies: Airport Zoning Commission —
for an unexpired term, upon appointment — December 21, 2021; Airport Zoning Brd of
Adjustment for an unexpired term, upon appointment - December 21, 2020; Airport
Zoning Brd. of Adjustment for an unexpired term, upon appointment - December 31,
2018 (Formerly advertised); Historic Preservation Commission for a Jefferson St.
representative to fill a three-year term, March 29, 2016 — July 1, 2019 (New District
formed); Senior Center Commission for an unexpired term, upon appointment —
December 31, 2018. Applications must be received by 5:00 p.m., Wednesday,
December 28, 2016.
Mayor Throgmorton stated he would like to sign a Mayor's Pledge against LGBT
discrimination, and a majority of Council agreed; and noted the request from Hunter
Gillespie to ban conversion therapy would be discussed at the next work session.
Council Member Taylor noted the upcoming Holiday with the Hounds Event the
Animal Shelter on Saturday, 12/10.
Council Member Thomas suggested forming a commission or committee within the
Parks and Recreation Department to further initiatives of urban forestry; and
encouraged individuals to attend the upcoming Parks and Recreation master plan
workshop on Saturday, 12/10.
Council Member Mims encouraged staff to get the word out to students regarding
snow emergency procedures and encouraged individuals to sign up for email notices.
Council Member Dickens expressed gratitude to retiring City Clerk Marian Karr.

Mayor Pro tem Botchway read a statement announcing that the Airport Commission is present
and meeting with the Council on the Airport Master Plan which is an item on the work session
agenda. Airport Commission: Odegaard, Gardiner, Ogren. Operations Specialist Tharp
presented a power point presentation.
ACTION: None at this time.
DETERMINE 2017 LEGISLATIVE PRIORITIES IIP # 4 of 11/10 packetl
Assistant to the City Manager Andrew presented an overview of issues facing cities, and
reviewed last year's Council legislative priorities and the current League of Cities. City Manager
Fruin reported on Metropolitan Coalition issued discussed at a meeting earlier in the day. After
discussion a majority directed staff to prepare a resolution for consideration at the December 6
meeting incorporating the following issues:
• Protection of the state property tax backfill
• Reinforcement of Home Rule authority with particular emphases on residential
occupancy, franchise fees, minimum wage and municipal regulation of marijuana
• Water quality related infrastructure funding
• Protection of worker rights
• Support for education funding (K-12 and higher education)
• Support of the League of Cities and Metro Coalition priorities
ACTION: Prepare a resolution for December 6 meeting. (City Manager's Office)
CLARIFICATION OF AGENDA ITEMS
1) City Clerk Karr noted additions to consent calendar and removing Item 4d(4).
2) Council Members were impressed with Southeast Junior High student letters regarding
recycling. City Clerk will follow up with teacher on responses to the students and
suggested a possible staff conversation with the students on the correspondence.

3) Mayor Pro tem Botchway stated that items regarding tobacco penalties would be
combined. He suggested items 10-14 be combined, hearings opened and closed, and
then resolutions adopted; he noted that items 15 and 16 have waived their hearings and
paid the fines and those resolutions would be combined and adopted.
4) Mayor Pro tem Botchway stated that after Consent Calendar he would be moving
directly into Public Comment period in order for persons to speak.

1) (IP3 — Information from Council Member Thomas regarding Urban Trees) Council
Member Mims thanked Council Member Thomas for sharing the article. Council
Member Dickens raised concerns about protecting urban trees with the deer. Asst. to
the City Manager Andrew reported the DNR would be conducting a deer count this year
and combine the information with traffic collision data to make a decision on culling the
deer herd.
2) (IP4 — Memo from Housing Adm..... Fiscal Year 2016 Section Eight ... rating for ...
Housing Authority) Council Member Mims noted the good rating on Section 8 and
expressed gratitude to Housing Authority staff for their work.
3) (IP7 — I.C. Better Bridges Institute) Council Member Mims noted the two day event in
partnership with the City, the Downtown Association and the University of Iowa in
January, and encouraged people to take a look at attending.

1) (IP8 - Memo from Equity Dir.... 2015 Report on Racial Equity) Mayor Pro tem Botchway
raised questions regarding the Equity Report Council Members directed staff to
schedule a review of the Equity Report in relation to Council's strategic plan goals next
February with the new Police Chief present. In response to Mayor Pro tem Botchway,
City Manager Fruin stated his intent was to have the Police Chief confirmation on the
December 6 agenda.
City Clerk Karr noted the late handout regarding Park System Master Plan and invitation to
attend meeting on December 1' at the Rec Center 7:30 to 10:30 a.m. Council should notify
Karr if they are interested in attending.

SINCLAIR.
The Mayor Pro tem stated Item 17 (Tobacco penalty for The Den) has been deleted
from the agenda and no action is necessary.
The Mayor noted that no applications were received for the following Boards and
Commissions and all will be readvertised: Airport Zoning Commission for an unexpired
term, upon appointment — December 21, 2021; Airport Zoning Brd of Adjustment for an
unexpired term, upon appointment - December 21, 2020; Airport Zoning Brd. of
Adjustment for an unexpired term, upon appointment - December 31, 2018 (Formerly
advertised); Historic Preservation Commission for a Jefferson St. representative to fill a
three-year term, March 29, 2016 — July 1, 2019 (New District formed); Senior Center
Commission for an unexpired term, upon appointment — December 21, 2018.
Applicants MUST reside in Iowa City and be 18 years of age unless specific
qualifications are stated. [Staff will not publish additional notices after a period of six
publications; but will continue to advertise vacancies with postings and on the Council
agenda. However, no additional publication costs will be incurred. More information

The Mayor noted the previously announced vacancies: Appeals, Board of, for a five-
year term January 1, 2017- December 31, 2021; Board of Adjustment for a five-year
term January 1, 2017 — January 1, 2022; Human Rights Commission for I a three year
January 1, 2017 — January 1, 2020; Parks and Recreation Commission for two
vacancies to fill four year terms January 1, 2017 — January 1, 2021; Public Art Advisory
Committee — Two vacancies to fill three-year terms, January 1, 2017 — January 1, 2020.
(Term expires for William Nusser and Brent Westpahl); Senior Center Commission for
two vacancies to fill three-year terms, January 1, 2017 — December 21, 2020;
Telecommunications Commission for an unexpired term, upon appointment — July 1,
2017. Applications must be received by 5:00 p.m., Wednesday, November 30, 2016
Council Member Taylor reported on the Council Listening Post she attended with
Council Member Mims earlier that day at the Senior Center.
Council Member Thomas reported that he attended the groundbreaking for the
Prairie Hill co -housing project in the Miller Orchard neighborhood.
Council Member Dickens stated he will be attending the Paratransit meeting and will
report back at next meeting.
Council Member Cole commented on the importance of a Council endorsement of a
resolution or proclamation denouncing discrimination and hate crimes referred to in the
Mayor Pro tem's opening statement. Majority directed staff to follow up with the Mayor
for the December 6 agenda.
Mayor Pro tem Botchway noted comments made earlier in the evening supporting
our Police Department and urged people not to judge the Police Department based on
one incident; reported on attending the Joe Lavono Quintet Hancher performance; and
attending the ICCA Celebration of the Arts., and presenting the "Reaching Out Award"

to two outstanding programs - Summer of the Arts and the Oaknoll Retirement
Community.
Assistant to the City Manager Simon Andrew welcomed Ashley Monroe who will be
starting as Assistant City Manager on December 6th.
Council Member Taylor reported she attended the dedication ceremony of the Stead
Family Children's Hospital; and wished her granddaughter a happy birthday. .
