Public Works recommend rejecting the bid. January 3, 2017 City of Iowa City Page 3 ITEM 3d(4) DERWEN DRIVE PAVEMENT REHABILITATION AND DRAINAGE TILE INSTALLATION - RESOLUTION ACCEPTING THE WORK FOR THE 2016 DERWEN DRIVE PAVEMENT REHABILITATION AND 1-7 DRAINAGE TILE INSTALLATION PROJECT. Comment: The project has been completed by All American Concrete, Inc. of West Liberty, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 110,000.00 Project Bid Received: $ 91,798.00 4• Project Actual Cost: $ 147,498.10 ITEM 3d(5) RIVERSIDE DRIVE PEDESTRIAN TUNNEL AND MYRTLE AVENUE INTERSECTION IMPROVEMENTS - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND 7 THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND FOTH INFRASTRUCTURE AND ENVIRONMENT LLC, OF CEDAR RAPIDS, IOWA TO PROVIDE CONSULTANT SERVICES FOR THE RIVERSIDE DRIVE PEDESTRIAN TUNNEL AND MYRTLE AVENUE INTERSECTION IMPROVEMENTS PROJECT. Comment: This agreement authorizes Foth Infrastructure and Environment LLC to provide consultant services including design development, preparation of construction documents, bid phase services and limited construction administration services for the Riverside Drive Pedestrian Tunnel and Myrtle Avenue Intersection Improvements Project. The project generally includes the installation of sidewalk on the west side of Riverside Drive from the south side of Iowa Interstate Rail to Myrtle Avenue, a pedestrian tunnel under the Iowa Interstate Railroad and signalization of the Riverside Drive and Myrtle Avenue Intersection. The total cost of the services is $207,564.00 and will be funded by General Obligation Bonds. ITEM 3d(6) WATER DISTRIBUTION SYSTEM FUTURE GROWTH STUDY - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE /-7-4, 7_ MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND HDR ENGINEERING, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE WATER DISTRIBUTION SYSTEM FUTURE GROWTH STUDY. Comment: This agreement authorizes HDR Engineering, Inc. to provide consultant services including evaluation of the existing water distribution system, identification of operational improvements and the preparation of a 20 -year capital improvement program. The total cost of the services is $149,550 and will be funded by the Water Operating Budget. January 3, 2017 City of Iowa City Page 4 ITEM 3d(7) PARKING GARAGE MAINTENANCE PROGRAM 2015-2018 - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE 1-7-7 MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND THP LIMITED, INC. TO PROVIDE CONSULTANT SERVICES FOR THE PARKING GARAGE MAINTENANCE PROGRAM AND BRIDGE REPAIR 2017 PROJECT. Comment: The City and THP Limited signed an agreement in 2015 to provide consultant services for the maintenance of the City's five (5) public parking garages and three (3) bridges that serve the downtown business, hotel/convention, cultural and entertainment districts. This initial term of the agreement was for one (1) year and it provided for three, 1 -year renewals by mutual agreement. This will be the third year of the renewable agreement. The total cost of services is not to exceed $56,500 and will be funded with Parking revenues and Road Use tax proceeds. ITEM 3d(8) WELLMARK FOUNDATION GRANT AGREEMENT - RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT % BETWEEN THE CITY AND THE WELLMARK FOUNDATION OUTLINING TERMS AND CONDITIONS FOR A MATCHING GRANT TO FUND A MULTI -USE SPORTS COURT IN WETHERBY PARK Comment: In May 2016, Neighborhood Services staff applied for a Wellmark Foundation Matching Assets to Community Health (MATCH) Grant to fund the installation of a multi -use sports court in Wetherby Park. The Wellmark Foundation approved the application in August providing $75,000 match to a $75,000 FY17 Community Development Block Grant (CDBG) set-aside identified for "Neighborhood Improvement". The project will be completed by June, 2017. This resolution authorizes the City Manager to execute the grant agreement outlining the terms and conditions of the matching grant funds. Plans and specifications for the sports court were approved by the City Council at their December 6, 2016 meeting. ITEM 3d(9) REVENUE REFUNDING BONDS - RESOLUTION REGARDING THE ISSUANCE OF NOT TO EXCEED $30,000,000 IN AGGREGATE PRINCIPALREVENUE REFUNDING 1 % — 9 PROJECT) SER ES 01O7FOF THE CITY OF IOWA CITBONDS CT, INC. IOWA. Comment: American College Testing (ACT) Incorporated has asked the City to sponsor a $30 million conduit bond issue. ACT will use the proceeds from the new bond issue to refinance their 2001 conduit bond issue. This conduit bond transaction is not an obligation of the City, and will not impact the City's finances. Setting Public Hearings: ITEM 3e(1) HICKORY HILL PARK TRAIL BRIDGE REPLACEMENT - RESOLUTION SETTING A PUBLIC HEARING ON JANUARY 17, 2017 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE HICKORY HILL PARK TRAIL BRIDGE REPLACEMENT PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The Hickory Hilt Park Trail Bridge Replacement Project includes removing a damaged wooden pedestrian bridge in Hickory Hill Park and constructing a new pre-engineered steel pedestrian bridge in its place. This project also includes streambank stabilization and trail repairs. The estimated cost of construction is $153,000.00 and will be funded with $14,762.63 of FEMA funds and the remaining balance with General Obligation bond proceeds. ITEM 3e(2) COMPREHENSIVE PLAN AMENDMENT CAMP CARDINAL ROAD - MOTION SETTING A PUBLIC HEARING FOR JANUARY 17 ON A RESOLUTION APPROVING AN AMENDMENT TO THE COMPREHENSIVE PLAN TO CHANGE THE LAND USE DESIGNATION FROM RESIDENTIAL 2 TO 8 DWELLING UNITS PER ACRE TO RESIDENTIAL 8 TO 16 UNITS PER ACRE FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF CAMP CARDINAL ROAD AND CAMP CARDINAL BOULEVARD. (CPA16-00003) Comment: At its December 1 meeting, by a vote of 5-0-1 (Martin absent, Signs abstained), the Planning and Zoning Commission recommended approval of this amendment. Approval will allow the development of multi- family housing on this property. Comment: Staff has recently become aware that the environmental review has not been completed on the project, which is a requirement for the CDBG funding. CITY PARK CABINS RESTORATION PROJECT 2017 — RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF AGREEMENT, AND 7 ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CABIN PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO POST NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The project involves renovations for structural and architectural improvements to the two state historically registered City Park Cabin structures located in upper City Park. The project is partially funded by a Historic Resource Development Program, private donations and GO Bonds; the grant is to restore the roofs of both cabins. The project will be bid with six separate line items prioritizing the repairs in the project. a. PUBLIC HEARING Action: b. FOOD TRUCK VENDING - ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," TO ESTABLISH A PILOT PROGRAM FOR FOOD TRUCK VENDING IN THE DOWNTOWN. (FIRST CONSIDERATION) Comment: In 2015 the City established a food truck vending permit system to allow vendors to operate on City streets except in certain restricted areas such as the downtown area, residential areas, and within 150 feet of any restaurant. Vendors have requested to be allowed to vend during the late evening and early morning hours in the downtown. At the direction of Council, this ordinance allows the City Manager to establish a pilot program to allow vending during the late evening and �early ymorning hours in the downtown. ITEM 8. WASTEWATER TREATMENT CITY CODE — ORDINANCE AMENDING TITLE 16, ENTITLED "PUBLIC WORKS", CHAPTER 3, "CITY UTILITIES", ARTICLE D, "WASTEWATER TREATMENT WORKS USERS", TO ESTABLISH UPDATED INFLUENT LIMITATIONS AND TO ESTABLISH MAINTENANCE RESPONSIBILITIES. (FIRST CONSIDERATION) Comment: With the expansion of the South Wastewater Treatment Plant and demolition of the North Wastewater Treatment Plant, it necessary to amend the City Code. These amendments will eliminate the references to the South Plant and North Plant and replace them with Treatment Plant. The amendment will also establish the limitations on the composition of the influent to the Treatment Plant. These amendments have been approved by the Iowa Department of Natural Resources after providing for a 45 day comment period and receiving no comments Action: ITEM 9. DEFINING "DOWNTOWN" IN THE PERMIT YSTEM - ORDINANCE AMENDING TITLE 16, ENTITLED "PUBLIC WORKS," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE H, ENTITLED "SOLID WASTE," BY DEFINING "DOWNTOWN" IN THE PERMIT SYSTEM ADOPTED BY RESOLUTION AND AUTHORIZING ADMINISTRATIVE RULES. (FIRST CONSIDERATION) Comment: Currently the City Code provides that solid waste containers (aka, dumpsters) cannot be placed in a public alley in the "downtown" without a permit, and downtown is defined as the CB -10 zone. Staff proposes to expand this to include the public alleys in the "northside." This ordinance deletes the definition of downtown and provides that it should be defined in the permit system adopted by resolution. The proposed northside area is bordered by Gilbert St. to the east, Bloomington St. to the north, Dubuque St. to the west, and Jefferson St. to the south. Should this ordinance pass its first two considerations, a resolution January 3, 2017 City of Iowa City Page 9 adopting a new permit system will be on the same agenda as the third reading. The ordinance also authorizes the City Manager to establish a inistrative rules. Action: O ITEM 10. The City passed Ord. No. 16-4663 in April 2016 to allow companies such as uber to operate in Iowa City. Cities no longer have home rule authority to regulate ride -sharing companies, and these companies now must obtain a license to operate from the State of Iowa. 7).1o Mord. As part of its application, the developer needs a resolution by the local governmental subdivision supporting the application and committing at least $1,000 per dwelling unit to this project (at least $54,000 for 54 assisted housing units).
