Resolutions and Motions: ITEM 4d(1) SUBORDINATION AGREEMENT - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO 7-/ 8 ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY UNIVERSITY OF IOWA COMMUNITY CREDIT UNION, NORTH LIBERTY, IOWA FOR PROPERTY LOCATED AT 437 S. GOVERNOR STREET, IOWA CITY, IOWA. Comment: UICCU has requested that the City approve a Subordination Agreement for property at 437 S. Governor St. The owners purchased the house from the City through the UniverCity Program. Due to the nature of the UniverCity Program (the value does not reflect all the rehab dollars), the City will not be fully secured if subordinated. Similarly, the City was not fully secured when it conveyed the property. In the UniverCity Program, the City's loans are forgiven after five years, which will be in July 2017. Because of the nature of the UniverCity Program and because the loans will be forgiven in 7 months, staff recommends subordination. January 17, 2017 ITEM 4d(2) ITEM 4d(3) 17-.)-0 ITEM 4d(4) 1-7-2/ ITEM 4d(5) / -7 - a:) - City of Iowa City Page 3 ICAD FUNDING - RESOLUTION OF INTENT TO BUDGET $70,000 IN ANNUAL FUNDING FOR IOWA CITY AREA DEVELOPMENT GROUP FOR THE FOUR FISCAL YEARS 18-21 AND UP TO AN ADDITIONAL $100,000 IN SUPPORT OF THE MERGE INNOVATION SPACE AND RESCINDING RESOLUTION 16-270. Comment: This resolution is for the approval of four fiscal years of continuing annual financial assistance of $70,000 per year and approval of the City Manager's authority to disburse additional funding up to $100,000, if necessary, for establishing the new MERGE Innovation Space. This resolution rescinds the adoption of Resolution 16-270 because it too narrowly defined the expenses associated with establishing the MERGE Innovation Space. DEPOSITORIES - RESOLUTION NAMING DEPOSITORIES. Comment: See memo in Council packet. This resolution will include the following change: 1. We recommend adding NXT Bank to the authorized depository list with a maximum limit of $2 million. Investments at this institution are collateralized by the state sinking fund. GENERAL OBLIGATION BONDS - RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSITION TO AUTHORIZE A CHANGE OF USE OF A NOT TO EXCEED $700,000 PORTION OF THE GENERAL OBLIGATION BONDS, SERIES 2015, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF. Comment: The City issued general obligation bonds in 2015 to be used in constructing a new City -School recreation facility at Alexander Elementary school. Those funds will no longer be used at the Alexander Elementary school and need to be re -purposed. See memo in Council packet. GIS SOFTWARE AGREEMENT - RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN ENTERPRISE LICENSE AGREEMENT FOR GIS SOFTWARE WITH ESRI, INC. Comment: In 2014 the City entered an Enterprise License Agreement for GIS software with Environmental Systems Research Institute, Inc. (ESRI). The current agreement expires in March 2017. This resolution authorizes the City Manager to sign a new Enterprise License Agreement with ESRI. The agreement's term is three years at a total cost of $150,000. Setting Public Hearings: ITEM 4e(1) WASTEWATER CLARIFIER REPAIRS - RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 7, 2017 ON PLANS, 1-7 _-)�3 SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE WASTEWATER CLARIFIER REPAIRS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves the removal, repair and/or replacement of existing primary and secondary clarifier equipment at the Wastewater Treatment Facility. The four original clarifiers that were constructed circa 1989 still have their original carbon steel mechanisms that are severely corroded and are nearing the end of their useful life. The estimated construction cost is $281,750 and will be funded with Wastewater revenues. ITEM 4e(2) STORM SEWER EASEMENT - RESOLUTION OF INTENT TO CONSIDER THE PROPOSED CONVEYANCE OF A STORM SEWER / 7 EASEMENT ACROSS IOWA CITY MUNICIPAL AIRPORT PROPERTY (OUTLOT A, WESTPORT PLAZA - PART 2), AND SETTING A PUBLIC HEARING ON SAID PROPOSED CONVEYANCE FOR FEBRUARY 7, 2017. Comment: MXTE, LLC, is the owner of real estate adjacent to Outlot A, namely Lot 1, Westport Plaza - Part 2, which it wishes to develop. In order to do so, they need to secure a storm sewer easement across the Airport property. The Airport property in question is presently tillable agricultural land rented out by the Airport for farming. CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: S� OArl I( O HICKORY HILL PARK TRAIL BRIDGE REPLACEMENT — APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE HICKORY HILL PARK TRAIL BRIDGE REPLACEMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: The Hickory Hill Park Trail Bridge Replacement Project includes removing a damaged wooden pedestrian bridge in Hickory Hill Park and constructing a new pre-engineered steel pedestrian bridge in its place. This project also includes streambank stabilization and trail repairs. The estimated cost of construction is $153,000.00 and will be funded with $14,762.63 of FEMA funds and the remaining balance with General Obligation bond proceeds. a. PUBLIC HEARING Action: b. CONSIDER AN RESOLUTION_ l Action: PUBLIC SAFETY FUNCTION OF LOCAL LAW ENFORCEMENT. RESOLUTION REAFFIRMING THE PUBLIC SAFETY FUNCTION OF LOCAL LAW ENFORCEMENT. Comment: The purpose of the Iowa City Police Department is to protect the safety of the public. The enforcement of immigration law is a responsibility of the federal government as demonstrated by the lack of local involvement in such efforts for as long as the City can remember. This resolution reaffirms that in the absence of a public safety need local resources are not devoted to the enforcement of federal immigration law. t o Action: s January 17, 2017 City of Iowa City Page 7 ITEM 9. CLIMATE ACTION STEERING COMMITTEE - CONSIDER A RESOLUTION AUTHORIZING THE CREATION OF CLIMATE ACTION STEERING COMMITTEE. Comment: The Iowa City City Council recently established a community -wide greenhouse gas emissions target of 26-28% from 2005 and 80% by 2050. To accomplish this, Iowa City is seeking to create its first Climate Action and Adaptation Plan. The creation of a steering committee with both key stakeholders and at -large members will be established to work with a consultant (who is yet to be determined) in developing the Plan. FOOD TRUCK VENDING - ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," TO ESTABLISH A PILOT PROGRAM FOR FOOD TRUCK VENDING IN THE DOWNTOWN. (SECOND CONSIDERATION) Comment: In 2015 the City established a food truck vending permit system to allow vendors to operate on City streets except in certain restricted areas such as the downtown area, residential areas, and within 150 feet of any restaurant. Vendors have requested to be allowed to vend during the late evening and early morning hours in the downtown. At the direction of Council, this ordinance allows the City Manager to establish a pilot program to allow vending during the late evening and early morning hours in the downtown. WASTETREATMENT CITY CODE — ORDINANCE AMENDING TITLE 16, ENTITLED "PUBLIC WORKS", CHAPTER 3, "CITY UTILITIES", ARTICLE _vg7 D, "WASTEWATER TREATMENT WORKS USERS", TO ESTABLISH UPDATED INFLUENT LIMITATIONS AND TO ESTABLISH MAINTENANCE RESPONSIBILITIES. (SECOND CONSIDERATION) Comment: With the expansion of the South Wastewater Treatment Plant and demolition of the North Wastewater Treatment Plant, it necessary to amend the City Code. These amendments will eliminate the references to the South Plant and North Plant and replace them with Treatment Plant. The amendment will also establish the limitations on the composition of the influent to the Treatment Plant. These amendments have been approved by the Iowa Department of Natural Resources after providing for a 45 day comment period and receiving no comments. TRANSPORTATION NETWORK COMPANIES - ORDINANCE AMENDING TITLE 5, ENTITLED "BUSINESS AND LICENSE REGULATIONS," CHAPTER 3, ENTITLED "TRANSPORTATION NETWORK COMPANIES," TO REPEAL ORDINANCE NO. 16-4663 REGARDING CITY LICENSING OF TRANSPORTATION NETWORK COMPANIES. (SECOND CONSIDERATION) Comment: HF 2414 which the Gov'r. signed on May 9, 2016 (codified at Chapter 321N of the Iowa Code) voids all local ordinances regarding the regulation of Transportation Network Companies (e.g., UBER and LYFT) as of Jan. 1, 2017. The City passed Ord. No. 16-4663 in April 2016 to allow companies such as uber to operate in Iowa City. Cities no longer have home rule authority to regulate ride -sharing companies, and these companies now must obtain a license to operate from the State of Iowa. Staff requests expedited action. Action: a a ITEM 13. SOLICITATION/PANHANDLING - ORDINANCE AMEND'TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS OFFENSES," BY DELETING SECTION 2, ENTITLED "AGGRESSIVE PANHANDLING," AND PROHIBITING SOLICITATION REQUESTS TO PERSONS WITHIN A SIDEWALK CAFE WITHOUT THE CAFE'S PERMSISSION. (FIRST CONSIDERATION) Comment: Section 8-5-2 of the City Code prohibits "solicitation" (aka, panhandling) in certain manners and in certain places in the downtown. Since the Supreme Court's 2015 decision in Reed v. Town of Gilbert, lower courts addressing solicitation/panhandling throughout the U.S. have consistently found those ordinances to violate the First Amendment. In accordance with the City's Attorney's memo to Council of December 8, 2016 and as directed by Council at the January 3 work session, this ordinance repeals Section 8-5-2 thereby eliminating all panhandling restrictions in the downtown. Additionally, this ordinance adds one new, and very limited, restriction to prohibit requests/solicitation for the exchange/transfer of money or anything else to persons in a sidewalk cafe without the cafe's permission. Action: ITEM 14. ABANDONED BICYCLES - ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 8, ENTITLED "BICYCLES," SECTION 6, ENTITLED "PARKING VIOLATIONS," TO ALLOW THE CITY TO DONATE ABANDONED BICYCLES TO LOW INCOME YOUTH AND HOMELESS PERSONS. (FIRST CONSIDERATION) Comment: Currently the City must sell impounded bicycles at a public auction or donate them to nonprofit organizations that serve low income youth and families. This ordinance will add the third option that allows City staff to donate bicycles directly to low income youth and homeless persons. This amendment is requested by the Police Dept. in part to support its outreach to local youth including riding with some local youths in RAGBRAI next year. DEFINING "DOWNTOWN" IN THE PERMIT SYSTEM - ORDINANCE AMENDING TITLE 16, ENTITLED "PUBLIC WORKS," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE H, ENTITLED "SOLID WASTE," BY -�� DEFINING "DOWNTOWN" IN THE PERMIT SYSTEM ADOPTED BY RESOLUTION AND AUTHORIZING ADMINISTRATIVE RULES. (SECOND CONSIDERATION) Comment: Currently the City Code provides that solid waste containers (aka, dumpsters) cannot be placed in a public alley in the "downtown" without a permit, and downtown is defined as the CB -10 zone. Staff proposes to expand this to include the public alleys in the "northside." This ordinance deletes the definition of downtown and provides that it should be defined in the permit system adopted by resolution. The proposed northside area is bordered by Gilbert St. to the east, Bloomington St. to the north, Dubuque St. to the west, and Jefferson St. to the south. The ordinance also authorizes the City Manager to establish administrative rules. Staff requests expedited action. %_o L_ �, wck Action: ITEM 16. PERMIT SYSTEM FOR SOLID WASTE- RESOLUTION ADOPTING AA NEW PERMIT SYSTEM FOR SOLID WASTE CONTAINERS IN THE DOWNTOWN ALLEYS AND RESCINDING RESOLUTION NO. 16-97. Comment: If the previous item does not receive third consideration, this resolution should be deferred. Under the current permit system for solid waste containers (aka, dumpsters), any hauler may place a container in a downtown public alley upon obtaining a permit from the City. The ordinance in the previous agenda item and this resolution will allow staff to issue one permit and to limit the number of dumpsters. This resolution adopts a new policy that is attached to the resolution and sets the fee of $60.00 per dumpster. As a result, staff intends to permit only one hauler, and in addition to solid waste, grease, and recyclables, the hauler will be required to collect compostable materials.
