RESOLUTION NO. 17-15
RESOLUTION RECOGNIZING THE SERVICES OF MARIAN K.
KARR AND NAMING THE OFFICE OF THE CITY CLERK THE
"MARIAN K. KARR CITY CLERK'S OFFICE"
WHEREAS, Marian K. Karr retired from the City after serving tirelessly for 37 years, 33
as the City Clerk, one of three positions appointed by and reporting directly to the City
Council; and,
WHEREAS, during Marian's tenure she served with (and survived through) 14 Mayors, 6
City Managers and 5 City Attorneys, as well as numerous council members and
department heads; and,
WHEREAS, when Marian joined the City in 1979 correspondence to the City was
delivered by the U.S. Postal Service, the IBM Correcting Selectric Typewriter was the
rage, "pinkies' were used to get ink off a Clerk's fingers, city records were archived by
microfilm and common use of the internet, email and the World Wide Web was years
away; and,
WHEREAS, while the technology of records dissemination, retention and retrieval
evolved dramatically during Marian's tenure, she was at all times an extraordinary
steward of the City's public records, dedicated to retaining them for future Councils and
generations; and,
WHEREAS, Marian was a strong advocate for making city records easily available to the
public and as the City Clerk she never took her eye off that ball; and,
WHEREAS, there was not a document that Marian could not find, often with the most
meager information to go on such as "Do you remember when...." or "How did we do
that;" and,
WHEREAS, in addition to staffing Council meetings Marian staffed numerous other
boards and commissions over the years, including four Charter Review Commissions in
1985, 1995, 2005 and 2015; and,
WHEREAS, Marian not only was an invaluable resource to all City employees, but
consistently went out of her way to ensure new employees felt welcome and comfortable
in their role with the City; and,
WHEREAS, Marian's intellect, memory, insight and attention to detail were instrumental
in the functioning of City Hall; she was always available to help solve a problem or
overcome a hurdle yet never sought individual credit or acknowledgement even when
she was solely responsible for leading on a particular issue; and,
WHEREAS, nothing escaped Marian's watchful eye at City Council meetings; if
proclamations, motions, resolutions and ordinances were not done right, she made sure
they were corrected; and,
WHEREAS, while poker-faced as Councilors, staff and members of the public spoke
during Council meetings, Marian had an incredible sense of humor for which the City
Attorney who sat next to her at meetings for 20 years will be eternally grateful; and,
WHEREAS, Marian's stamina for assuring public access to the decisions of the City
Council was remarkable; while the rest of us staggered home exhausted after a late
night council meeting she worked into the night to assure that the voting record was
available to the public as soon as possible and documents were ready for signing,
distribution and proper archiving; and,
WHEREAS, Marian was committed to the support and excellence of the City Clerk
profession and served in many capacities for her professional organizations including
President of the Iowa Municipal Finance Officers Association and Treasurer of the
Municipal Clerk's Education Foundation; and,
WHEREAS, Marian's staff will fondly remember her sense of humor, her high
expectations for the public services provided by the office and most of all herself, and
her telling them not to worry about a mistake as they could simply "snow peck" it out;
and,
WHEREAS, Marian has been deeply committed to the Iowa City community particularly
through her strong support and involvement in the United Way and University of Iowa
Athletics; and.
WHEREAS, Marian's legacy of selfless public service and community devotion will
continue to inspire the many employees and public officials she worked with and sets a
standard for service that all future employees will strive for in their daily work; and,
WHEREAS, in recognition of Marian's many contributions and loyal service to the City
and the public, the office of the City Clerk should be named the "Marian K. Karr's City
Clerk's Office."
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY IOWA THAT:
The office of the City Clerk shall be named the "Marian K. Karr City Clerk's Office" in
honor of Marian K. Karr's 37 years of exemplary public service.

RESOLUTION NO. 17-18
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF
IOWA CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION,
NORTH LIBERTY, IOWA FOR THE PROPERTY LOCATED AT 437 S.
GOVERNOR STREET, IOWA CITY, IOWA.
WHEREAS, the City of Iowa City holds two Mortgages in the total amount of $47,079,
executed by the owners of the property on August 13, 2012, recorded September 7,
2012, in Book 4973, Page 944 through Page 950, and in Book 4973, Page 951 through
Page 956 in the Johnson County Recorder's Office covering the following described real
estate:
The North half of Lot 14 in Block 1, in Berryhill's Second Addition to Iowa City,
Iowa, according to the recorded plat thereof,
WHEREAS, the City sold the real estate through the UniverCity program and the City's
mortgages reflect approximately $42,000 in rehab funds the City expended and a down
payment assistance loan of $5,000;
WHEREAS, University of Iowa Community Credit Union is refinancing its senior
Mortgage and is securing the loan with a Mortgage covering the real estate described
above; and
WHEREAS, it is necessary that the Mortgages held by the City be subordinated to the
loan of University of Iowa Community Credit Union in order for the University of Iowa
Community Credit Union to secure and maintain its first position; and
WHEREAS, University of Iowa Community Credit Union has requested that the City
execute the attached subordination agreement thereby making the City's liens
subordinate to the lien of said mortgage with University of Iowa Community Credit Union;
and
WHEREAS, if subordinated, the City will not be fully secure, just as it was not fully
secure at the time the City sold the real estate to the owners (typically with UniverCity
sales, the City is not secure because the value of the real estate does not increase one
dollar for every dollar of improvements made);
WHEREAS, the City's loans will be forgiven in seven months;
WHEREFORE, because the City's loans arise out of the UniverCity program and the
loans will be forgiven in seven months, the City should subordinate its loans and remain
junior to the primary lender's mortgage as is the present situation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA that the Mayor is authorized to execute and the City Clerk to attest
the attached subordination agreement between the City of Iowa City and University of
Iowa Community Credit Union, Iowa City, Iowa.

SUBORDINATION AGREEMENT
THIS AGREEMENT is made by and between the City of Iowa City, herein the City, and
University of Iowa Community Credit Union of North Liberty, Iowa, herein the Financial
Institution.
WHEREAS, the City is the owner and holder of certain Mortgages which at this time is in the
amount of $42.079, and was executed by Natalie N. Fixmer-Oraiz and Vanessa J. Fixmer-Oraiz
(herein the Owner), dated August 13. 2012, recorded September 7, 2012, in Book 4973, Page
944 through Page 950 and dated August 13, 2012, recorded September 7, 2012, in Book 4973,
Page 951 through Page 956, Johnson County Recorder's Office, covering the following described
real property:
The North half of Lot 14 in Block 1, in Berryhill's Second Addition to Iowa City, Iowa,
according to the recorded plat thereof,
WHEREAS, the Financial Institution proposes to loan the sum of $230.000 on a promissory note to
be executed by the Financial Institution and the Owner, securing a mortgage covering the real
property described above; and
WHEREAS, to induce the Financial Institution to make such loan, it is necessary that the
Mortgages held by the City be subordinated to the lien of the mortgage made by the Financial
Institution.
NOW, THEREFORE, in consideration of the mutual covenants and promises of the parties hereto,
the parties agree as follows:
1. Subordination. The City hereby covenants and agrees with the Financial Institution that
the above noted Mortgages held by the City is and shall continue to be subject and
subordinate to the lien of the mortgage about to be made by the Financial Institution.
2. Consideration. The City acknowledges receipt from the Financial Institution of One
Hundred and Fifty Dollars ($100.00) and other good and valuable consideration for its act of
subordination herein.
3. Senior Mortgage. The mortgage in favor of the Financial Institution is hereby
acknowledged as a lien superior to the Mortgages of the City.
4. Binding Effect. This agreement shall be binding upon and inure to the benefit of the
respective heirs, legal representatives, successors, and assigns of the parties hereto.

RESOLUTION OF INTENT TO BUDGET $70,000 IN ANNUAL FUNDING FOR
IOWA CITY AREA DEVELOPMENT GROUP FOR THE FOUR FISCAL YEARS
18-21 AND UP TO AN ADDITIONAL $100,000 IN SUPPORT OF THE MERGE
INNOVATION SPACE AND RESCINDING RESOLUTION NO. 16-270.
WHEREAS, the City of Iowa City has stated Economic Development goals and strategies, and
WHEREAS, stated economic development policies include supporting organizations which help to
incubate, grow, foster and create new business operations by providing non-traditional
collaborative environments; and
WHEREAS, the City of Iowa City has provided financial support to the Iowa City Area
Development Group (ICADG) for decades to assist in achieving stated Economic Development
goals; and
WHEREAS, the amount of funding has been $100,000 annually for ten years, in consideration of
ICADG's below-market rate.lease of two floors of publicly owned office space at 138 S. Dubuque
Street, the annual funding amount shall be $70,000 for fiscal years 2018 through 2021, and
WHEREAS, expenses for establishing the MERGE Innovation Space may require additional
funding, the City shall grant up to $100,000 for those expenses; and
WHEREAS, ICADG agrees to report annually on performance for its regular activities and for the
MERGE Innovation Space;
WHEREAS, Resolution No. 16-270 too narrowly defined the expenses associated with
establishing the MERGE Innovation Space,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. It is the intent of this City Council that $70,000 be budgeted for professional services from
the Iowa City Area Development Group in each budget year from fiscal year 2018 through
2021; and
2. The City Manager is granted authority to evaluate and approve up to an additional
$100,000 in FY2017 funding for expenses associated with establishing operations of the
MERGE Innovation space; and
3. Resolution No. 16-270 is rescinded.

Introduction
This resolution rescinds an earlier approved resolution (16-270) and revises it for the approval
of four fiscal years of continuing annual financial assistance and approval of the City Manager's
authority to disburse additional funding, if necessary, for expenses associated with
establishment of the new MERGE Innovation Space.
Specifically, it rescinds and replaces part two of Resolution No. 16-270 which granted authority
to the City Manager to distribute up to an additional $100,000 in FY2017 funding for expenses
associated with the build out of the MERGE Innovation Space. The revised resolution broadens
the approved use of those funds to establishing operations of the MERGE Innovation Space.
At the time of the first resolution, ICAD had been awarded an $800,000 EDA (Economic
Development Authority) grant for a joint project with the University of Iowa. ICAD has since
withdrawn from the EDA grant project.
Background/History
For the last ten years, the City has provided financial support to (CAD's operations with
$100,000 per year. In FY12, ICAD started the CoLab, a business incubator/co-working space
for start-ups and small businesses located in their offices on Court Street. To help ensure that
CoLab would succeed, the City contributed an additional $50,000 in FYI and $25,000 in FYI
and FY14. The MERGE Innovation Space is the successor to the CoLab, and now, the City will
be leasing space to ICAD at below market rate monthly prices — providing a savings to ICAD of
approximately $100,000 per year. This facilitates the important work of [CAD and MERGE and
puts the new hub of business innovation in downtown Iowa City.
Solution
Today's resolution provides:
1) Four years of $70,000 per year continued financial support of ICAD operations.
In light of the City forgoing approximately $100,000 year on the leased space in the library
building, the City's annual funding would drop from $100,000 per year as it has been for 10
years, to $70,000 per year for FY18 through FY21. The resolution specifies that it is the
intent of this City Council to budget $70,000 in each fiscal year, 2018 through 2021,
recognizing that the current City Council cannot commit to a future City Council budget.
2) Up to $100,000 for expenses associated with the establishment of the MERGE Innovation
Space.

Recommendation
Providing this financial support is aligned with several City Council Strategic Planning Priorities
including promoting a strong and resilient local economy, encouraging a vibrant and walkable
urban core, fostering healthy neighborhoods through the use of public spaces, and enhancing
community engagement and intergovernmental relations.
Staff recommends approval of this resolution because it considers both costs and benefits of
assisting in the creation of the MERGE Innovation Space, a center for innovation, coding
education, prototyping for manufacturing and business incubation in downtown Iowa City.

Introduction:
The City of Iowa City maintains a list of financial institutions authorized to be depositories of the
city's funds. The list that is on file needs to be updated to reflect changes that have occurred.
History/Background:
NXT Bank has requested to be added to the list with a maximum balance of $2,000,000.00.
Discussion of Solutions:
The resolution naming depositories being presented would update the list of financial institutions
that the City of Iowa City maintains.
Financial Impact:
No financial impact to the city.
Recommendation:
I recommend that NXT Bank be added with a maximum balance of $2 million.

GENERAL OBLIGATION BONDS, SERIES 2015, AND PROVIDING FOR PUBLICATION

RESOLUTION FIXING DATE FOR A MEETING ON THE
PROPOSITION TO AUTHORIZE A CHANGE OF USE OF A
NOT TO EXCEED $700,000 PORTION OF THE GENERAL
OBLIGATION BONDS, SERIES 2015, AND PROVIDING FOR
PUBLICATION OF NOTICE THEREOF
WHEREAS, General Obligation Bonds, Series 2015 in the amount of $7,785,000 were
previously issued to pay costs of various projects, including the construction of public recreation
facilities in a joint undertaking with the Iowa City Community School District; and
WHEREAS, it is deemed necessary and advisable that the City of Iowa City, Iowa,
should apply a not to exceed $700,000 portion of the proceeds of the General Obligation Bonds,
Series 2015, for the alternative purpose of renovating, equipping and furnishing the city -school
joint pool facility; and
WHEREAS, before said bond proceeds may be applied in that manner, it is necessary to

Introduction
In 2015, the City issued $700,000 of general obligation bonds for the purpose of constructing
joint recreation facilities with the Iowa City Community School District at the new Alexander
Elementary school. This resolution sets a public hearing on February 7 to discuss the change in
purpose of the 2015 bonds to improvements and renovations at the joint City -School facility: the
Mercer Park Aquatic Center.
History/Backnround
The City issued general obligation bonds in 2015 to be used in constructing a new City -School
recreation facility at Alexander Elementary school. Those funds will no longer be used at the
Alexander Elementary school and need to be re -purposed. In 1987, the City and the Iowa City
Community School District agreed to construct a joint use facility: the Mercer Park Aquatic
Center. That facility is approaching 30 years of age and is need of major repairs and
renovations.
The Parks and Recreation Department have developed a priority list for repairs at the Mercer
Park Aquatic Center. The recommended repairs were derived from the highest priority issues
identified in the City's 2012 Space Needs Study and are as follows:
• Double Boiler Replacement Project- $304,200.00
■ Boilers have been operating 24/7 since its original 1988 installation. Greater
efficiencies in water and energy use will be gained by a redesign and
replacement. The current HVAC system also has provided inconsistent heating
and cooling during the last year; there have been numerous patron complaints
regarding water and air temperature in the facility.
• Tuck -pointing and Masonry Repair Project- $383,250.00
• Exterior Masonry tuck -pointing on Mercer structure
• Interior masonry tuck -pointing in pool areas from chlorine damage
• Repair masonry and tuck -point at SE corner near pool equipment room
• Correct Steel Lintels in courtyard- causing water issues in facility
• Caulk the damaged Exterior Masonry walls- $7 to 10.00/LF
• Review leaks and caulk exterior window Kalwall system (Lift required, removing
caulk on window system)
• Upgrade ADA Chair Lift- $8,000.00
■ Electrical upgrades, tile work, and new ADA compliant lift that is self -actualizing

Discussion of Solution
The 2015 general obligation bonds totaling $700,000 that were to be used for a new joint City -
School recreation facility need to be re -purposed. These bonds can be re -purposed for repairs
and renovations at the older joint City -School facility; however, a public hearing is required to
make that change. The proposed solution re -purposes the 2015 bonds, provides funding for
major repairs at the Mercer Park Aquatic Center, and still utilizes the bonds for a joint City -
School recreation facility.
Financial Impact
The major financial impact for the City is the completion of repairs and" improvements at the
Mercer Park Aquatic Center that had not been previously funded. These improvements are
necessary and will reduce future maintenance and repair costs.
Recommendation
It is staff's recommendation for the City Council to approve the resolution to set a public hearing
on February 7 to discuss the change in purpose of the 2015 general obligation bonds.

RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN
ENTERPRISE LICENSE AGREEMENT FOR GIS SOFTWARE WITH ESRI, INC.
WHEREAS, on March 3, 2014 the City purchased a suite of GIS (geographic information
system) software from Environmental Systems Research Institute, Inc. (ESRI) through an
Enterprise License Agreement; and
WHEREAS, the price of the Enterprise License Agreement was $150,000 for three years, and
the procurement was approved by the City Manager, as it was within the City Manager's
spending authority; and
WHEREAS, the current Enterprise License Agreement with ESRI will expire in March 2017; and
WHEREAS, City staff have negotiated a new Enterprise License Agreement with ESRI at a cost
of $150,000 for a three year term; and
WHEREAS, the procurement of the new Enterprise License Agreement will bring the total cost of
the software expenditure with ESRI over $150,000, thus requiring City Council approval; and
WHEREAS this resolution authorizes the City Manager to sign the new agreement; and
WHEREAS, funds for the purchase of the Enterprise License Agreement are available in ITS
account number 83310510-476130 and the budget account number 446180 in all department
budgets; and
WHEREAS, approval of this procurement is in the public interest.

Introduction:
The City of Iowa City entered into a Small Government Enterprise Licensing Agreement in 2014 in
an effort to expand utilization of the ESRI software products for GIS management in a more cost
effective manner. The Enterprise Agreement allowed more City staff members to take advantage
of ESRI products and realize new uses for the application suite. The cost to the City was $50,000
per year.
History/Background:
Since the City entered the initial Enterprise License Agreement with ESRI in 2014, the utilization of
ESRI products has grown in the departments that originally used this product as well as in new
departments adopting the technology. The Small Government Enterprise License Agreement has
allowed for this growth providing a higher return -on -investment than purchasing the licensing on an
individual basis. The current Small Government Enterprise Licensing Agreement with ESRI will
expire in March 2017. The ITS division would like to renew this agreement to continue to take
advantage of the agreement's licensing and training model.
Financial Impact:
Pricing for the renewal of the Enterprise Agreement is based on a three year term. The cost of the
renewal is $50,000.00 per year for the next three years.
This pricing is for the products purchased at the time we entered into the agreement. Once the
agreement is signed we will be able to add and take away software licensing as business needs
require.
Funds for the purchase of Enterprise Agreement are available through account number 446180 in
each department budget and the ITS budget number 83310510-476130.
Recommendation
It is staff recommendation that City Council adopt the resolution for the City to enter into a three year
agreement for GIS software with ESRI, Inc.

Re: Wastewater Clarifier Repairs Project
Introduction:
This project involves the removal, repair and/or replacement of existing primary and secondary
clarifier equipment at the Wastewater Treatment Facility.
History/Background:
The four original clarifiers that were constructed circa 1989 still have their original carbon steel
mechanisms that are nearing the end of their useful life. The clarifiers were drained and
inspected during the design phase of the Wastewater Treatment Facilities Consolidation
Project. The inspection revealed substantial corrosion on significant portions of the
mechanisms. Repair work was not included in the Consolidation project due to budget
constraints.
Discussion of Solutions:
This project will disassemble the mechanisms and replace the portions that are too severely
corroded to salvage. The remaining portions of the mechanisms will be sand blasted and re -
coated to extend their useful life.
Financial Impact:
The estimated cost for this project is $281,750 and will be funded by the Wastewater Clarifier
Repairs fund (V3144).
Recommendation:
Staff recommends proceeding with approving plans and specifications on February 7t", 2017 for
the Wastewater Clarifier Repairs Project.

RESOLUTION REAFFIRMING THE PUBLIC SAFETY
FUNCTION OF LOCAL LAW ENFORCEMENT.
WHEREAS, the City of Iowa City devotes resources to law enforcement for the purpose of
assuring the safety of all persons who reside in or visit our community; and
WHEREAS, the power to regulate immigration is exclusive to the federal government and the
enforcement of immigration law is a function of the federal government that currently resides
with Immigration and Customs Enforcement (ICE) of the Department of Homeland Security; and
WHEREAS, no federal law compels the local police to participate in the enforcement of federal
immigration law and any such requirement would raise significant anti -commandeering issues
under the Tenth Amendment to the Constitution of the United States; and
WHEREAS, for as long as the City can remember, the Iowa City Police Department has not been
involved in the enforcement of federal immigration law; and,
WHEREAS, any perception that the local police are involved in the enforcement of immigration
law will undermine the police -community relationships that have been. built up over the years,
and thereby undermine the ability of the police to keep the community safe; and,
WHEREAS, it is essential to public safety that every person, regardless of immigration status,
who is a victim of or a witness to a crime feels comfortable reporting crimes or aiding in the
investigation of crimes.
NOW THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IN THE STATE OF IOWA:
1. Except as necessary for public safety as determined by the Police Chief or designee, or as
otherwise required by state or federal law, the Iowa City Police Department shall not undertake
any law enforcement action for the purpose of detecting the presence of undocumented persons
or devote any public resources to the enforcement of federal immigration law.
2. This resolution addresses the discretionary use of legal city resources and does not:
(i) Prohibit, or in any way restrict, any official or employee of the City of Iowa
City from sending to or receiving from ICE information regarding the citizenship
or immigration status, lawful or unlawful, of any individual (8 U.S. C. Section
1373);
(ii) Affect or limit the enforcement of federal immigration law by federal
authorities within the City of Iowa City;
(iii) Affect or limit ICE's Priority Enforcement Program (DVa Secure
Communities) whereby all fingerprints of adults arrested, or juveniles taken into
custody, for a crime other than a simple misdemeanor are automatically included

Gentlemen and Ladies:
As you can see from my address I am not a resident of your city. I am, however, a
resident of the State of Iowa and, of course, of the United States of America.
I fear that what you are doing in making Iowa City a "sanctuary city" is encouraging
people and business owners to break Federal Law. In recent years in my town we have
seen three sets of business owners arrested and tried for hiring illegal aliens. Two of these
"sets" are serving time in the Federal system. The third has been sentenced and I am not
sure if he is incarcerated at this time. As you are aware, or should be aware, there is no
parole in the Federal Prison system. The terms these people are serving, I believe, is at
least eight years. One of these individuals was a citizen of another country before coming
here legally years ago. Very likely he will be deported after serving his sentence. As I

understand it, he will very likely face charges in his home country for desertion. The penalty
for deserting that army is very severe. These people will be listed as Convicted Felons for
life. They will lose their right to vote and to own firearms, a high price to pay for being
crossways with Federal Law.
If it is illegal to hire illegals -- how then are they to earn a living? Are the citizens of
your city willing to pay taxes for their upkeep? Are the Churches who support this idea
willing to put money where their mouth is? I suspect some will say they are, but for how
long --- for the life of the individual?
Too often the businesses that hire illegals pay them below standard and some do
not provide safe working conditions. Who can they complain to without fearing deportation?
This is just not right. But, the Congress has not done their job here. By doing nothing they
have forced States and Individuals to act. Defiance of the Federal Government is not
something to be taken lightly. We have gang members, druggies, and other undesirables in
the mix of illegals. Most I suspect are here because of the promise that America offers --
that of freedom and the pursuit of happiness (in this case industry) [as is meant in the
beginning sentences of the Declaration of Independence --- we are the only
country/government that believes and states in its founding documents that these basic
rights come from God and not man. But, this does not mean we should have open borders.
We must have laws and means of enforcing them to protect society from the lawless.
I have a relative that works in your city. She has worried that the influx of the
"welfare" crowd has caused, in some cases, for the city to become more "third world" as she
describes it. I fail to see how allowing illegals to have "sanctuary" makes your city better.
Some months ago, shortly after the election I had occasion to visit Scheels All
Sports at the Coralville Ridge Mall. Hand gun ammo was almost non existent. Brass is in
short supply and certain calibers are hard to keep in stock. The Rep I talked to also stated
that gun sales were up 20% over one year ago. He told me that they had a pallet of .223
ammo ($15,000 worth) that was sold in three days. What are the people gearing up for? Are
they hoarding? Are they afraid of the possible actions of the new President? Not enough
info to tell. But, the story that really shocked was one he told of a U I Professor — a liberal
who voted for Obama — who now felt the need for a home defense weapon. Is crime up
17% in your city?? If true why? What part of the citizenship is responsible for this increase?
Part of the answer may be told by law enforcement officials when they are worried that
information will not be forth coming from illegals if they are afraid their status will be found
out.
Please think this deal through. I can see all kinds of unforeseen consequences.
Please do not put your business people in the position of breaking Federal Law!

As you vote tonight please consider this. What if citizens decided not to follow the law. I, myself, do not feel that I
should pay tax to a state that violates Federal law. There are several laws I don't agree with, but the power of a
republic is that I have the freedom to work to change those laws - I don't however, have the freedom to ignore the

If we first allow sanctuary to illegal immigrants, what's next? Please vote to follow the law - whether you agree with it

As a resident of Iowa, I would like to strongly encourage all members of the Iowa City City Council to vote "NO" to have Iowa
City become a sanctuary city. I think it would be a BIG mistake for Iowa City to become a sanctuary city. The United States is a
Republic (not a democracy), which means that it is a government based on laws; laws which apply to ALL citizens alike with bias
towards none. Consequently, if the laws are not upheld and favoritism is shown towards one or a few, the whole basis of our
country is destroyed. Iowa City is considered part of the heartland, the Bible belt, etc. and Midwesterners are looked up to for

SANCTUARY CITY [IP #4 of 12/29 packet] Mayor Throgmorton opened discussion and noted that a number of the emails and
phone calls opposing Sanctuary Cities were not from Iowa City residents and that the item is on the agenda at the request of
many residents. City Attorney Dilkes gave an overview of her memo contained in Info Packet. Discussion regarding immigration
enforcement and lack of cit'; involvement for as the police department can remenlber Agreement that public resources are to
be used for public safety, not for enforcement of federal immigration law.. Consensus of Council not to use "Sanctuary City"
label. Action: The City Attorney's office will draft a policy for the January 17 Council meeting regarding not using local
resources for immigration enforcement, and will reach out to the UI Law School to see if they will serve as a resource to the
City on these issues in the future.
CONVERSION THERAPY City Attorney Dilkes reported that the State occupies the field when it comes to Conversion therapy
and imposing local law would be problematic. Action: The City Clerk's Office will prepare a proclamation regarding banning
conversion therapy practices (if a draft is received from residents and is found to be acceptable by staff[.

City Council Members in Iowa City,
I am not a resident of Iowa City, however, I frequently visit to shop, dine, and attend sporting events. I am very concerned by
the position the city council is taking in their approach to handling illegal immigrants in your city. I understand that you are not
wanting the title of sanctuary city but anyone can read between the lines that this is just a way to duck potential efforts in the
future to cut federal funding. My view is if police, employers, or schools knowingly do not report an illegal immigration status,
then they are aiding and abetting a fugitive and should also be arrested and held accountable. We have laws on the books for
a reason and they need to be followed. We cannot pick or choose what laws we uphold. Can we look the other way for an
abusive spouse, thief, tax evasion? Why not? I believe our November election showed the voter does not approve of
government officials skirting the laws or using the power of the pen.
I was at a football game on Sunday with a large group of people when the topic of the Iowa City vote came up. Everyone at the
party was concerned, upset and furious about the approach the city is taking. They all agreed that if Iowa City votes to not
enforce the laws of the land, we would stop going to Iowa City to spend our money. Believe me, I will never shop, dine or
attend events in your city if you make this change. I believe this will be a very expensive mistake for the city. Consider
spending your effort to maximize the citizens who are in your city legally.
I always wonder why the media does not run a piece where they interview those who have applied for legal citizenship to the
US and are still waiting (but doing it the right way), and how they feel about the reaction to those whom have broken the law
but are allowed to stay and treated as citizens. I can't imagine they are very happy or feel treated fairly.
Please reconsider voting to not move to a "sanctuary" city (we know what you mean). I look forward to hearing the news
tonight, my wallet will be speaking for me.

This message is in protest of your position to allow illegals to remain in Iowa City and to also give them legal amnesty.
I am very tired of the actions of the council over the last several years ---placing the residents here is deep debt to give funds
and tax relief to private parties (so-called property developers and builders), who in turn are engaging in illegal activities, which
are placing undue social and economic burdens on the legal citizens of this city. I, for one, have lost over $40,000 equity in my
home and now have been straddled to pay an additional $700,000 of debt that I don't owe. And this is the norm, not the
exception. But you refuse to do anything about that. You won't even return a phone call. And then you turn around and let
even more contracts to these same people, without doing your background checks. Are you proud of giving contracts.... and all
kinds of money ..... to embezzlers, to defrauders, to absent landlords, to law breakers??? Anyone who has served on the council
over the last 20 years is an accessory to criminal activities!
Now, with amnesty to illegals, who most often have children they cannot support, my costs -of -living are rising even faster. They
have their children on welfare, when we already have enough here who are getting welfare because they will not take personal
financial responsibility for themselves and their children. And on top of that, the illegals are not paying property taxes, they
aren't paying payroll taxes, they aren't paying income and school taxes and they don't pay for medical services. They aren't
even properly insuring themselves, their children and their vehicles. And when there is a claim due to their negligence, it's my
insurance that has to pay -----and my premiums rise when I haven't done anything inappropriate, when I have lived within the
law and the social expectations of the community. I have to pay the school taxes for their children they had while criminally
inhabiting my city. I have to pay the income taxes that is paying for their welfare. I have to pay the payroll taxes which are going
into their pockets via SSI benefits. I'm paying for them and I DON'T HAVE THE INCOME TO KEEP PAYING. You are stripping
me of any semblance of economic security for both myself and my only child, for today and for the tomorrows to come. And I am
too old to financially start over. Most importantly, it is criminal to be in this country without proper documentation and if you
sanction that, you are breaking the law as much as they are. You all deserve prosecution and imprisonment if you aren't any
more intelligent than that.
We, who are the responsible citizens of this city, deserve a council who understands that they cannot live above MY law.

As police officer, I would know the problems associated with illegal aliens, not I do not use the politically correct term.
I have nothing against legal immigration into this country and feel compassion for these people.
However, we need a policy on immigration and we do not need to disobey the laws because we don't like the current one.
We should be taking care of our citizens first.
You could and likely do have illegal felons in your city. It is very easy for them to claim they don't speak English and have no
identification or fake ID.
I have personally had legal (US citizens) who look Hispanic, hide their identity by claiming to not speak English.

I am not a resident of Iowa City, but I just received a call from Priorities for Iowa encouraging me to voice my opinion about
Public Safety Function of Local Law Enforcement Resolution. Although I'm not quite sure how I got on their auto -dial list and
they weren't at all clear about which stand on the topic they were advocated, I'm guessing they are opposed to a "sanctuary city.'
Their energies to oppose your resolution (This resolution reaffirms that in the absence of a public safety need local resources
are not devoted to the enforcement of federal immigration law.) seem misguided at best and mean at worst. So, even though I'm
not a resident, I would like to add my voice to those who support this resolution, which seems quite practical on economic,
ethical, and human levels.
I hope that the group's efforts to create an outcry leads to many emails like mine in support of your statement: "We firmly reject

form an ad-hoc Climate Action Steering Committee consisting of community members to oversee the

sectors of this diverse community; and
WHEREAS, the Climate Action Steering Committee should consist of the following categorical representation
from the Iowa City community:
1) One member from the University of Iowa
2) One member from MidAmerican Energy
3) One member representing the business community in Iowa City
4) One member representing a large industry in Iowa City
5) One member representing Greater Iowa City Home Builders Association
6) One member from Kirkwood Community College, Iowa City campus
7) One member who is a certified architect

resolution authorizing the creation of a Climate Action Steering Committee. The purpose of the
Committee will be to assist in the creation of a community -wide Climate Action and Adaptation

History/background: Iowa City recently adopted greenhouse gas reduction targets of 26-28%

Discussion of Solution: A Request for Proposal (RFP) was issued by the City of Iowa City on

Financial Impact: No financial impact is expected in the creation of this Committee.

RESOLUTION ADOPTING A NEW PERMIT SYSTEM FOR SOLID WASTE
CONTAINERS IN THE DOWNTOWN ALLEYS INCLUDING FEES AND
RESCINDING RESOLUTION NO. 16-97.
WHEREAS, City Council adopted a permit system in Resolution No. 16-97 as required by City
Code section 14 -3H -8F for solid waste containers in the downtown alleys; and
WHEREAS, the City, its residents and visitors, and the Downtown District will benefit from
cleaner and safer alleys;
WHEREAS, in order to decrease the number of containers, provide for increased frequency of
pick-up, limit the presence of trucks to once daily, and increase recycling and composting, the
number of haulers allowed to remove solid waste and collect recyclables in the downtown

WHEREAS, a new permit system should be adopted to reflect that the number of permits to be
issued will likely be only one or two at the most.

PERMIT SYSTEM
FOR SOLID WASTE CONTAINERS IN THE DOWNTOWN ALLEYS

Definitions
Downtown The area bordered by Gilbert Street to the east, Iowa Avenue to the north,
Clinton Street to the west, and Burlington Street to the south and the area bordered by
Gilbert Street to the east, Bloomington Street to the north, Dubuque Street to the west, and
Jefferson Street to the south.
Solid Waste Container A receptacle used by any person or operator to store solid waste during
the interval between solid waste collections.
Grease Container A solid waste container in which grease is stored during the interval between
grease collections.
Recycling Container A solid waste container in which recyclables are stored during the interval
between recycling collections.
Compost Container A container in which compostable materials are stored during the interval
between compost collections.
Permit Process
Permit Required No person shall place or maintain any solid waste, grease, recycling or
compost container on the public right-of-way in the downtown without first obtaining a permit.
Application An application for a permit to place or maintain a solid waste, grease, recycling or
compost container in the downtown public right-of-way shall be filed with the Clerk on a form
provided by said department.
Notification All notifications required by this permit system by the City to the permit holder shall
be by electronic mail at the e-mail address listed on the application.
Issuance The Clerk or designee may issue a revocable permit to a person to use the downtown
public right-of-way to maintain a solid waste, grease, recycling or compost container after
payment of the permit fee, after providing proof of insurance, and after assurance that the person
shall comply with all conditions of the City ordinances, including the Fire Code, Section 7-1 of the
City Code, this permits system, and the administrative rules.
Number & Location The City shall determine the number of containers that the permit holder may
place on the right of way. The permit holder shall determine the location of the containers except
that they shall be placed flush with the face of the building.
Duration Each permit shall be issued for a period of three (3) years
Fees The annual permit fee of $60.00 is on a per dumpster basis and will coincide with the
fiscal year which begins July 1. No permit shall be issued without payment of the permit fee.
Permit fees are prorated quarterly. If a permit holder replaces a solid waste container due to its
poor condition or other reason, the permit may be transferred to the replacement container and
an additional fee shall not be required.
Insurance A permit holder shall provide, at the time the permit application is filed, a certificate of
insurance for comprehensive general liability, automobile liability, excess liability, and worker's
compensation insurance, naming the City of Iowa City as an additional insured. Minimum
coverage amounts are set by the City of Iowa City Risk Manager. The permit holder shall
provide thirty (30) calendar day notice to the City before cancellation of said insurance.
Hold Harmless A permit holder shall pay on behalf of the City all sums which the City shall be
obligated to pay by reason of any liability imposed upon the City for damages of any kind
resulting from the placement or maintenance of a solid waste container, whether sustained by
any person or persons, caused by accident or otherwise and shall defend at its own expense
and on behalf of the City any claim against the City arising out of the placement or maintenance
of said solid waste container.
Assignment The sale or assignment of a solid waste container permit is expressly prohibited
unless approved in writing by the City Manager or designee.
Revocation and Suspension If the City Manager or designee finds that a city ordinance, state
law, federal law, a provision of the "City of Iowa City Permit System for Solid Waste Containers
in the Downtown Alleys," or the administrative rules has been violated, any permit issued may
be revoked or suspended. The City shall provide the permit holder notice and opportunity to be
heard as set forth in the administrative rules.
Removal of Container If the solid waste container permit is revoked or suspended, the City may
remove the solid waste containers without further notice to the permit holder. If the solid waste
containers are removed, the City may store them at the Iowa City Landfill. The costs that must
be paid to reclaim it are the actual costs of removing the solid waste containers and a storage
fee for storing the solid waste containers. The storage fee shall be a flat fee of $5.00 per day
per container. If the permit holder does not claim the solid waste container within thirty (30)
days of its removal, it will be considered abandoned, and the City may dispose of it.
The City may remove a single container if it does not meet the cleanliness and related
standards set forth in the administrative rules upon notice and opportunity to cure the violation.
The costs and fees charged are the same as set forth above.
Disposal of Waste The permit holder shall remove and properly dispose of all waste placed in
or around a container regardless of type, including but not limited to any bulky waste, "white
goods," hazardous waste, toxic substances, and contaminants.
