Washington St., Iowa City, IA 52240 (319) 356-5144 RESOLUTION NO. 17-31 RESOLUTION ACCEPTING THE WORK FOR THE 2016 LANDFILL GAS COLLECTION SYSTEM EXPANSION PROJECT WHEREAS, the Engineering Division has recommended that the work for construction of the 2016 Landfill Gas Collection System Expansion Project, as included in a contract between the City of Iowa City and Joe Coleman & Son Environmental Services of Pana, IL, dated July 19, 2016, be accepted; and WHEREAS, the Engineer's Report and the performance and payment bond have been filed in the City Engineer's office; and WHEREAS, funds for this project are available in the Landfill Project account # 1-3327; and WHEREAS, the final contract price is $1,001,741.72. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa. This project was bid as a unit price contract and the final contract price is $1,001,741.72. There were seven change orders totaling $60,058.62 for the project as shown below: 1. CO #1 Installation of 2 inch Fiber Conduit $13,054.72 2. CO #2 Additional Gas Valves $22,500.00 3. CO #3 Installation of 6.5 inch Dual Wall Pipe $12,968.80 4. Washington St., Iowa City, IA 52240 (319) 356-5410 RESOLUTION NO. 17-32 RESOLUTION ACCEPTING THE WORK FOR THE WATER MAIN, PAVING AND EROSION CONTROL PUBLIC IMPROVEMENTS FOR WILD PRAIRIE ESTATES — PART SIX, AND DECLARING PUBLIC IMPROVEMENTS OPEN FOR PUBLIC ACCESS AND USE. WHEREAS, the Engineering Division has certified that the following improvements have been completed in accordance with the plans and specifications of the City of Iowa City: Water main improvements for Wild Prairie Estates — Part Six, as constructed by Maxwell Construction, Inc. of Iowa City, Iowa. Paving and erosion control improvements for Wild Prairie Estates — Part Six, as constructed by Metro Pavers, Inc. of Iowa City, Iowa. WHEREAS, the maintenance bonds have been filed in the City Clerk's office; and WHEREAS, the City of Iowa City has notified those contractors listed previously of the date on which it will consider acceptance of the aforementioned public improvements; and WHEREAS, the traffic control signs have been installed. Gilbert St., Iowa City, IA 52240 (319) 356-5104 RESOLUTION NO. 17 RESOLUTION ESTABLISHING A REVISED SCHEDULE OF FEES AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMMING AND RESCINDING RESOLUTION NUMBER 15-389 PREVIOUSLY ESTABLISHING SAID FEES AND CHARGES. WHEREAS, Section 10-9-5 of the City Code provides that, "Upon recommendation of the Parks and Recreation Commission, all Parks and Recreation fees shall be established by resolution of the City Council"; and WHEREAS, the Parks and Recreation Commission has reviewed all fees and is recommending certain increases to be implemented in FY17 along with tentative increases for FY18; and WHEREAS, it is in the public interest to review and occasionally revise said fees. History/Background: The Parks and Recreation Commission reviewed and adopted tentative increases for FYI and is recommending adoption at this time. Some of the FYI changes may be implemented in FYI because the summer season begins in FY17 and continues into FY18. The Parks and Recreation Commission reviewed and adopted the proposed changes at their meeting of December 14, 2016. Discussion of Solution: Review and approve the matrix with any suggested changes, recommendations and/or improvements. Recommendation: Recommended changes in the fee schedule include the following: • All recreation program rates increase by a minimum of 3%. • Room rental rates at the recreation centers increase by a minimum of 3%. • Gym rentals rates increase at Scanlon Gym and decrease at Grant Wood Gym and Robert A. Lee Gym. Price comparisons and use rate justify decreased changes for gyms. s Increase community garden plots from $25 to $25.75 • Increase park shelter fees from $16-$104 to $16.50-$107 • Raise minimum hourly rental of the Park Lodge from $50 per hour to $54 per hour. • Increase farmer's market stall fees from $14/$16 per market to $14.50/$16.50 • Increase pool passes, annual pool passes and 30 day pool passes 3%. • Daily admission for pools remains unchanged at $4 which remains consistent with other area pool rates. • Increase aquatics programs lessons by 3%. Private lessons reduced from 8 lessons to 6 lessons per session to allow for once per week sessions. Fee reduced from $75 to $56 due to fewer sessions. • Increase ball field and soccer field rental rates by a minimum of 3%. • Increase the potter's studio punch pass from $200 to $210. • Increase dog park daily fees and passes by 3%. • City Park ride fees remain unchanged. • Increase Cemetery fees by 3%. Fiscal Impact: This schedule will allow the department to plan its cost recovery mission for the next several years and make us more cost effective and efficient. February 7, 2017 The City Council of Iowa City, Iowa, met in regular session, in the Emma J. Harvat Hall, City Hall, 410 E. Washington, Iowa City, Iowa, at 7 o'clock P.M., on the above date. There were present Mayor Throgmorton in the chair, and the following named Council Members: Absent: Botchwav Cole Mims Throgmorton None -I- Council Member Botchway proposed the following Resolution and moved its adoption. Council Member Cole seconded the motion to adopt. After due consideration of said motion, the roll was called and the Resolution was adopted by the following vote: AYES: Botchway Cole Taylor Thomas Throgmorton NAYS: None The Resolution was thereupon signed by the Mayor and in evidence of approval attested by the City Clerk and declared to be effective. The Resolution is as follows: RESOLUTION NO. 17-34 "RESOLUTION AUTHORIZING AND PROVIDING FOR THE ISSUANCE OF NOT TO EXCEED $30,000,000 AGGREGATE PRINCIPAL AMOUNT OF REVENUE REFUNDING BONDS (ACT, INC. PROJECT), SERIES 2017A, OF THE CITY OF IOWA CITY, IOWA; THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT BETWEEN SAID CITY AND ACT, INC. PROVIDING FOR THE REPAYMENT OF THE LOAN OF THE PROCEEDS OF SAID BONDS AND THE SECURING OF SAID REPAYMENT OBLIGATION; AND RELATED MATTERS." WHEREAS, the City of Iowa City, Iowa, a political subdivision organized and existing under the Constitution and laws of the State of Iowa (the "Issuer"), is authorized by Chapter 419 of the Iowa Code, as amended (the "Act'), to issue revenue bonds for the purpose of defraying the cost of acquiring, constructing, installing and equipping a "project', as that term is defined in the Act, including any land, buildings or improvements suitable for use as a facility for an organization described in Section 501(c)(3) of the Internal Revenue Code (the "Code") which is exempt from federal income tax under Section 501(a) of the Code (a "Tax Exempt Organization") and to refinance any existing indebtedness on a facility for a Tax Exempt Organization; and WHEREAS, the Issuer has been requested by Act, Inc., an Iowa nonprofit corporation and a Tax Exempt Organization (the 'Borrower"), to authorize and issue its bonds pursuant to the provisions of the Act for the purpose of (i) refunding the $40,000,000 City of Iowa City, Iowa Variable Rate Demand Revenue Bonds (ACT, Inc.) Series 2001; and (ii) paying related costs, including costs of issuance of the Bonds (the "Refunding"); and WHEREAS, the Issuer has determined to proceed with the issuance of Revenue Refunding Bonds (ACT, Inc. Project), Series 2017A (the 'Bonds") to finance the costs of the Refunding; and WHEREAS, the Borrower has arranged for the sale of the Bonds to BMO Harris Bank N.A. (the "Purchaser"). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CITY IOWA, IOWA, AS FOLLOWS: Section 1. In order to provide for loaning the proceeds of the Bonds to the Borrower and to finance the costs of the Refunding, the Bonds are hereby authorized and ordered to be issued pursuant to the Loan Agreement to be dated as of February 1, 2017 (the "Loan Agreement') by and between the Issuer and the Borrower, in substantially the form as has been presented to this Board and containing substantially the terms and provisions set forth therein, with such changes therein as shall be approved by the officers of the Issuer executing the Bonds, and the forms, terms and provisions of the Bonds and the Loan Agreement are hereby approved, and the Mayor and the City Clerk are hereby authorized and directed to execute, attest, seal and deliver the Loan Agreement, and the Mayor and the City Clerk are further authorized and directed to execute, attest, seal and deliver the Bonds as provided in the Loan Agreement, including the use of facsimile signatures as therein provided; the Bonds shall be in an aggregate principal amount of not to exceed $30,000,000, shall be sold at such prices, shall mature on the dates and in the amounts and shall be subject to redemption on such dates and in such amounts as provided in the Loan Agreement. The execution and delivery by the Mayor and City Clerk of the Loan Agreement on behalf of the Issuer shall constitute approval by the Issuer of such interest rates, aggregate principal amount, and provisions thereof. Section 2. The Arbitrage Agreement of the Issuer, in substantially the form as has been presented to this Board and containing substantially the terms and provisions set forth therein, but with such changes therein as shall be approved by the officers executing the Arbitrage Certificate on behalf of the Issuer, is hereby authorized and approved and the form, terms and provisions of the Arbitrage Certificate are hereby approved, and the execution and delivery of the Arbitrage Certificate by the Mayor or the City Clerk is hereby authorized and approved. Section 3. The Bonds and interest and premium, if any, thereon shall never constitute a debt or indebtedness of the Issuer within the meaning of any constitutional or statutory provision or limitation and shall not constitute nor give rise to a pecuniary liability of the Issuer or a charge against its general credit or taxing powers, but the Bonds and interest and premium, if any, thereon shall be payable solely and only from the revenues derived from the Loan Agreement and the debt obligations of the Borrower thereunder; and no part of the cost of the Project will be payable out of the general funds or other contributions of the Issuer except the proceeds of the Bonds and any subsequent issues of bonds permitted under the Loan Agreement. Section 4. Introduction: The purpose of the ACOP is to define the Iowa City Housing Authority's policies for the operation of the Public Housing Program, incorporating Federal, State and local law. 1. History/Background HUD Requirement to implement smoke-free policy for Public Housing units: On December 5, 2016, the federal Department of Housing and Urban Development (HUD) published a final rule that requires each public housing agency (PHA) administering public housing to implement a smoke-free policy. Specifically, this rule requires that no later than 18 months from the effective date of the final rule, which is July 30, 2018, each PHA must implement a policy that bans the use of "prohibited tobacco products" in all living units, indoor common areas in public housing, and in PHA administrative office buildings (in brief, a smoke-free policy for all public housing indoor areas). The smoke-free policy must also extend to all outdoor areas up to 25 feet from the housing and administrative office buildings or to the property boundary where the boundary is less than 25 feet from the building. Prohibited tobacco products include cigarettes, cigars, pipes, and water pipes (aka, hookahs). HUD requires implementation of smoke-free public housing to improve indoor air quality in the housing, benefit the health of public housing residents and PHA staff, reduce the risk of catastrophic fires, and lower overall maintenance costs. All leases will be amended to include this policy. • Smoke-free policy amendment to ACOP: Staff recommends including the use of Electronic Cigarettes to the use of products prohibited by the HUD rule and adding the following new section to the ACOP. Electronic cigarette means vapor product as defined in Section 453A.1 of the Code of Iowa: 22.0 SMOKE-FREE POLICY 24 CFR 965.653 Iowa's Smoke Free Air Act went into effect on July 1, 2008. This law mandates that City buildings and the grounds around them be smoke free, pursuant to Iowa Code, Chapter 142D. In addition, the Iowa City Housing Authority bans the use of "prohibited tobacco products" in all public housing units and interior common areas, including but not limited to, hallways, laundry centers, and similar structures, as well as in all outdoor areas, including but not limited to, parking lots, back yards, front yards, playgrounds and other areas frequented by children. Prohibited tobacco products include the use of cigarettes, cigars, pipes, water pipes (aka, hookahs) and Electronic Cigarettes. Electronic cigarette means vapor product as defined in Section 453A.1 of the Code of Iowa. Tenants and their guests are allowed to use "prohibited tobacco products" on the Public Right of Way. Purpose of Smoke -Free Policy: The Iowa City Housing Authority is mitigating (i) the imitation and known health effects of secondhand smoke; (ii) the increased maintenance, cleaning, and redecorating costs from smoking; (iii) the increased risk of fire from smoking; and (iv) the higher costs of fire insurance for a non -smoke-free building. February 2, 2017 Page 2 2. History/Background HUD Streamlining Public Housing Administrative Regulations: Housing and Urban Development (HUD) published NOTICE PIH 2013-03 (HA) on January 22, 2013. This notice established guidelines intended to simplify the income determination and rent calculation process, which, together, should reduce Housing Authority staff burden and lower Housing Authority operating costs. This Notice was replaced by HUD NOTICE PIH 2016-05 (HA), published on April 7, 2016. Compliance with this notice requires the Iowa City Housing Authority to make the following amendments to ACOP: • HUD NOTICE PIH 2016-05 (HA) Streamlining amendments: 2016-05 (HA);: A. 11.2 Annual Income Exclusions H. Self Sufficiency Incentives: HUD reduced the length of time a working individual is eligible for the Earned Income Disregard from 48 months to 24 months. B. 12.4 Verification of Social Security Numbers: Provides more time for applicants to secure social security cards for family members under the age of six (6). C. 13.6 Rent for Families under the Noncitizen Rule: HUD changed the methodology for calculating public housing rents for mixed families. A mixed family is a family whose members include both those with citizenship or eligible immigration status, as well as those without citizenship or eligible immigration status. D. Definition of Extremely Low -Income Families: Those families whose income does not exceed the higher of 30 percent of the area median income or the federal poverty level. Recommendation: In December 2015, the Housing and Community Development Commission (HCDC) reviewed and approved adding Electronic Cigarettes to the HUD mandated smoke-free policy. Because the above amendments are mandatory, staff did not request any further formal action by HCDC. Staff did provide HCDC an informational memorandum, updating the smoke-free policy and a brief description of the streamlining amendments. While these changes are mandatory, they constitute a significant amendment to ACOP; and, require the approval of City Council. History/Background During the underwater inspections that were performed in August 2012 (Eastbound Burlington Street bridge) and October 2014 (Iowa Avenue bridge), scour around the upstream side of the existing piers was identified. In order to protect the integrity of the bridge foundations, as well as to prevent future scour, it was recommended by the design Consultant to install erosion control measures around the existing pier foundations. Discussion of Solutions: Erosion control measures that are typically used in these types of applications are either stone revetment or fabric formed concrete revetment. Fabric formed concrete revetment consists of specially woven, double layer synthetic forms that are filled (in the field) with fine aggregate concrete grout. Both of the options described above will provide an acceptable engineered solution to not only repair, but also mitigate future erosion. Because the two erosion control measures outlined above are very different when considering installation methods/required equipment, the stone revetment will be the main bid, with the fabric formed concrete revetment as a bid alternate. This will ensure that the City obtains the most cost effective price for comparable engineered solutions. Additionally, during the underwater inspection, some minor concrete spalling on the piers for both bridges was identified. A bid alternate to repair these areas was also included. Should the City receive favorable bids, the aforementioned repairs may be included. Financial Impact: The total estimated construction cost for this project is $252,000 and will be funded with road use tax proceeds. In 1995 Dean Oakes Fifth Addition was approved for the property directly to the west of the subject property. The property is apparently a remnant piece that the applicant would now like to plat for a single family lot. The applicant indicated that they have chosen not to use the "Good Neighbor Policy". ANALYSIS: Comprehensive Plan: The North District Plan identifies the area surrounding Bristol Drive as suitable for single-family and duplex residential uses. The North District Plan also shows the possibility of Bristol Drive connecting from where it currently dead -ends to North Dubuque Street. The proposed single family subdivision, which includes the potential for Bristol Drive to continue, complies with the Comprehensive Plan. 2 Zoning: This and the adjacent properties to the west are zoned Low -Density Single Family Residential (RS -5). The purpose of the RS -5 zone is to provide housing opportunities for individual households. Single family lots are required to have a minimum lot area of 8,000 square feet and a minimum lot width of 60 feet. The proposed lot complies with these requirements. Subdivision regulations: With the exception of street width (50 feet of right-of-way rather than the current standard of 60 feet): the proposed subdivision is in general compliance with the subdivision regulations. Because this is an extension of an existing 50 -foot wide right-of-way, staff recommends that it not be required to be widened to 60 feet to comply with current street standards. Due to the length of Bristol Drive, an emergency vehicle turn -a -round is required at the end of the street. Although the North District Plan shows the possibility of Bristol Drive being extended to the south, the steep ravine on the adjacent property and the limit development potential may not provide sufficient incentive for a developer to extent the street. For this reason staff recommends that Bristol Drive be terminated with "hammer head" to allow large vehicles, such as fire trucks to turn around. Storm water management: This property is less than the 3 acre threshold for which stormwater management is required. Therefore the City Engineer has determined that stormwater detention facilities are not required. Neighborhood open space: A subdivision of this size requires the dedication of 788 square feet of neighborhood open space or fees in lieu of. The Parks and Recreation Department has determined that fees are appropriate in lieu of neighborhood open space dedication. The fee will be equivalent to the value of 788 square feet of property. This requirement will need to be addressed in the legal papers for the final plat. Infrastructure fees: The water main extension fee of $435 per acre will apply to this subdivision and should be noted in the legal paperwork. Miklo began the staff report showing a map of the area noting that there are two parts of Bristol Drive and the thought is that someday the street may come through and connect. The likelihood of that is low due to steep ravines and difficulty of providing sanitary sewer service to the area east of Bristol Drive north of Dubuque Road. The zoning of this area and surrounding area is RS -5 low-density single family and the area to the east is rural residential (RR1) because it drains away from the city and currently cannot be served by the sanitary sewer network. The proposal is to take the last remnant piece of property, just east of Dean Oakes Fifth Addition and plat it for a single-family lot. Because of the slight possibility of a future road connection, the City is recommending a hammerhead turnaround to allow for fire trucks or large vehicles to turnaround. Miklo noted that the subdivision complies with the Comprehensive Plan, Zoning Code, and Subdivision Regulations. Introduction: The restoration project involves the preservation and rehabilitation of two significantly historic log cabin structures in upper City Park. History / Background: The cabins were constructed by the Old Settler's Association of Johnson County, and are both individually listed on the National Register of Historic Places (c.1889 and 1913), they are significant examples of the country's first generation of log houses and a visual reminder of Iowa's pioneering past. The cabins were used for recreation camps and programs from 1976 -2008. The programming stopped at the site due to the deteriorating condition of the cabins. Plans are to offer interpretive historical recreation programs again once the cabins are restored. Since the late 1990s the cabins have remain dormant. The cabins were deemed unfit and unsafe for any programming or even basic interior access, and were officially closed in 2009. Discussion of Solution: The foundation, structure and roofs have deteriorated over time and require specialized restoration following preservation guidelines and rehabilitation to the Secretary of Interior's Standards due to their historic designation. The project is also partially supported by a grant from the Historic Resource Development Program; the grant is to restore the roof structures of both cabins. The project will be bid with six separate line items prioritizing the repairs in the project: 1. Roof repairs- structurally repairing or replacing the roof rafters with salvaged old growth boards, felt and split shake shingles. 2. Foundation repairs- requires lifting existing log structures and hand digging the trench footing for the new foundation to shore and square up the existing structures, and to allow the log buildings to have natural air circulation to reduce moisture and further deterioration. 3. Flooring repairs- repairing the rotted floor joists to rehabilitated condition with salvaged old growth boards. February 1, 2017 Page 2 4. Window and Door repairs- windows are currently boarded up and have been augmented, they will be restored. There are as many as six types of window designs on the structures. 5. Log rehabilitation and restoration- the two log cabin structures have different structural constructions and assemblies and will require specialized repair and replacement for each individual building. 6. Concrete and site work. It should be noted, that due to the extent of restoration and costs, all items may not be accomplished under this contract. The intent is to maximize the repairs within the current allocated funds, to expedite the stabilization of the current structures from further deterioration, and plan for future phases. Financial Impact: The estimated cost for this project is $190,500.00 and will be funded from a $25,000 State of Iowa REAP Historic Preservation Grant, $11,263 in private donations and $154,237 from the City Park Cabin Restoration CIP account #R4187. Recommendation: Staff recommends proceeding with approving plans and specifications on January 3, 2017 for the City Park Cabin Restoration Project.
