AUTOMATION SYSTEMS DESIGN PROJECTS FOR
CITY HALL, ROBERT A. LEE RECREATION CENTER, AND MERCER
PARK AQUATIC CENTER AND BOILER REPLACEMENT PROJECT AT
MERCER.
Comment: On January 11, 2017, the City issued a request for proposal for
the HVAC Study and Building Automation Systems Design Project for City
Hall, Robert A. Lee Recreation Center, and Mercer Park Aquatic Center.
Four proposals were received, evaluated and scored by staff who determined
that the proposal submitted by Shive-Hattery best met the needs of the City.
This Resolution authorizes the City to enter into a contract with Shive-Hattery
and authorizes the City Manager to execute contract amendments that are
deemed necessary to complete the study and design of the above-named
project. The total amount for the contract will not -to -exceed $64,250.00;
amendment to agreement and upon approval by the City Manager.
GENERAL OBLIGATION BONDS - APPOINTING PAYING AGENT -
RESOLUTION APPOINTING U.S. BANK NATIONAL ASSOCIATION OF
ST. PAUL, MINNESOTA, TO SERVE AS PAYING AGENT, BOND
REGISTRAR, AND TRANSFER AGENT, APPROVING THE PAYING
AGENT AND BOND REGISTRAR AND TRANSFER AGENT
AGREEMENT AND AUTHORIZING THE EXECUTION OF THE

Comment: This resolution provides final authorization for US Bank of St
Paul, Minnesota to act as paying agent for the City of Iowa City in regard to
the issuance of $9,765,000 General Obligation Bonds, Series 2017A.
GENERAL OBLIGATION BONDS - FINAL AUTHORIZATION -
RESOLUTION AUTHORIZING AND PROVIDING FOR THE ISSUANCE
OF $9,765,000 GENERAL OBLIGATION BONDS, SERIES 2017A, AND
LEVYING A TAX TO PAY SAID BONDS; APPROVAL OF THE TAX
EXEMPTION CERTIFICATE AND CONTINUING DISCLOSURE
CERTIFICATE.
Comment: This resolution provides final authorization for the issuance of
$9,765,000 General Obligation Bonds. The Tax Exemption Certificate sets
out in detail a number of facts, promises and obligations that must be met
and agreed to by the City in order to maintain these bonds as tax exempt.
The Continuing Disclosure Certificate is being executed and delivered for
the benefit of the holders and beneficial owners of the bonds and in order to
comply with Securities and Exchange Commission (SEC) rule 15c2-12.

IOWA CITY DOWNTOWN DISTRICT — FARM TO STREET DINNER AND
NORTHSIDE OKTOBERFEST POSSESSION OF ALCOHOL
AGREEMENTS - RESOLUTION APPROVING AN AGREEMENT WITH
THE DOWNTOWN DISTRICT TO ALLOW THE SALE, CONSUMPTION,
AND POSSESSION OF BEER AND WINE DURING FARM TO STREET
DINNER AND NORTHSIDE OKTOBERFEST ON CITY STREETS.
Comment: Section 4-5-3 of the City Code allows for the sale and
consumption of alcohol in a city park, on a right-of-way, or other public
ground, excluding public buildings, pursuant to written agreement. The
agreement, which is attached to the resolution, allows the "Downtown
District' to sell beer and wine in a fenced off area on the 100 block of N.
Linn St. for the Farm to Street Dinner on Aug. 17 and on streets and a
parking lot on the north side during the Northside Oktoberfest on Sept. 24.
The exact locations of the sites are attached as an exhibit to the proposed
agreement. The agreement is substantially similar to the one executed last
year with the exception of added provisions to address open containers as
the result of the ordinance set for third consideration in Item 9.

ITEM 4d(9) SUMMER OF THE ARTS - ARTS FEST AND JAZZ FEST POSSESSION
OF ALCOHOL AGREEMENTS — RESOLUTION APPROVING AN
3 AGREEMENT WITH SUMMER OF THE ARTS, INC. TO ALLOW THE
SALE, CONSUMPTION, AND POSSESSION OF BEER DURING ARTS
FEST AND JAZZ FEST ON CITY STREETS.
Comment: The City Code allows for the sale and consumption of
alcohol in a city park, on a right-of-way, or other public ground, excluding
public buildings, pursuant to written agreement. The agreement, which is
attached to the resolution, allows Summer of the Arts, Inc. (SOTA) to sell
beer in a fenced off area on Iowa Ave. during Arts Fest and on N. Clinton
St. during Jazz Fest. The exact locations and dimensions of the sites are
attached as exhibits to the agreement. The agreement is substantially
similar to the one executed last year except that SOTA is requesting to host
a private party for donors the evening before the festivals as the events are
being set up.
ITEM 4d(10) SHERATON HOTEL AND HOTEL VETRO — RESOLUTION

ATTEST A CONSENT TO ASSIGNMENT OF PARKING AGREEMENTS
BETWEEN THE CITY AND RBD IOWA CITY, LLC.
Comment: RBD Iowa City LLC, the owner of the Sheraton Hotel and Hotel
Vetro, has a purchase agreement to sell the hotel. The City has two
agreements with the owner for hotel guest parking in City ramps. The
owner is requesting that the City consent to the assignment of the
agreements to the buyer, AJ CP LLC, an Illinois limited liability company.
Under the agreements, the City's consent may only be withheld for the
same reason it could deny a liquor license. Staff has not identified any
basis to withhold the City's consent.

Comment: In order to facilitate the dev opment of the new Hoover
Elementary School bei g constructed at alon American gion Road SE,

plan review process.

ITEM 4e(2) URBAN RENEWAL PLAN AMENDMENT. RESOLUTION DETERMINING
THE NECESSITY OF AND SETTING DATES OF A CONSULTATION
AND PUBLIC HEARING ON A PROPOSED RIVERSIDE DRIVE URBAN
RENEWAL PLAN, AMENDMENT NO. 3 IN THE CITY OF IOWA CITY,
IOWA.
Comment: A resolution of necessity initiates the legislative process for the
City to engage in urban renewal projects in urban renewal areas. Following
the adoption of a resolution of necessity, the City holds a consultation with
the other local taxing jurisdictions (June 1) and a public hearing before a
vote on whether to adopt the plan (June 20). Amendment #3 in the
Riverside Drive Urban Renewal Area enables the City to finance four public
works projects with the tax increment created by new value in the district.

Comment: This Resolution approves the proposed ground lease to Bread Garden
of Iowa City, L.C. for 668.5 square feet of pedestrian mall space adjacent to Bread
Garden Market for twenty years to enable them to construct a structure to serve their
patrons year-round. The lease agreement includes an annual lease rate of $14.70
per square foot, for an initial annual lease of $9,826.95, which would be adjusted for
inflation every five years. The tenant is responsible for any and all maintenance and
property taxes.

Comment: Section 4-5-3 of the City Code allows for the sale and consumption of
alcohol in a city park, on a right-of-way, or other public ground, excluding public
buildings, pursuant to written agreement. The agreement, which is attached to the
resolution, is the area roughly bounded by Iowa Ave. to the north, Linn St. to the
east, the ped mall to the south, and Clinton St. to the west. The exact location of
the site is attached as an exhibit to the proposed agreement. If the ordinance in
Item 9 passes, this agreement will allow the open container of beer and wine on
the street, sidewalk, and the ped mall. Persons may purchase beer and wine from
an establishment in an approved cup and then leave that establishment with a cup
of beer or wine.

RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO

BETWEEN THE CITY OF IOWA CITY AND ELEVATE ENERGY TO PROVIDE
CONSULTANT SERVICES FOR THE DEVELOPMENT OF THE CITY'S

Comment: This Resolution approves and authorizes the execution of a consulting
agreement with Elevate Energy for consulting services assisting the development of
the City's Climate Action and Adaptation Plan. The City issued a Request for
Proposal (RFP) to procure consulting services for the project. An evaluation
committee reviewed and scored the proposals and awarded the contract to Elevate
Energy of Chicago, Illinois. The fees for the consulting services are not to exceed
$81,775, which exceeds the City Manager's spending authority of $60,000, thus
requiring City Council approval.

THE IOWA CITY COMMUNITY SCHOOL DISTRICT'S 2017 GENERAL

Comment: This resolution expresses City Council's support for the Iowa City
Community School District's planned 2017 referendum approving the issuance of
General Obligation Bonds. Bond proceeds will fund the second half of the District's
approved ten-year Facilities Master Plan. Referendum election day is planned for
