Resolutions and Motions: Item 3d(1) April Disbursements — Motion to approve disbursements in the amount of $9,900,335.27 for the period of April 1 through April 30, 2017, as recommended by the Finance Director subject to audit. June 6, 2017 City of Iowa City Page 3 Item 3d(2) CDBG/HOME amendment for housing projects - Resolution adopting Iowa City's FY17 Annual Action Plan / -7- Amendment #1, which is a sub -part of Iowa City's 2016- 2020 Consolidated Plan (City Steps), authorizing the City Manager to submit said plan and all necessary certifications to the U.S. Department of Housing and Urban Development. Comment: The City currently has a HOME commitment shortfall and must commit funds to eligible HOME projects by July 31, 2017 per Department of Housing and Urban Development regulations. The FY17 Plan Amendment #1 proposes to move two HOME eligible projects that can proceed immediately from FY18 to FY17. The Iowa City Housing Authority was recommended for $200,000 in FY18 HOME funds and Habitat for Humanity was recommended for $50,000 to acquire a residential lot for new homeownership. Item 3d(3) Riverside Theatre Alcohol Agreement - Resolution 17-/65 approving an agreement with Riverside Theatre to allow the sale of wine and beer under limited circumstances in City Park. Comment: Section 4-5-3 of the City Code allows for the sale and consumption of alcohol in a city park and on a right-of-way pursuant to written agreement. Staff has approved the agreement, which is attached to the resolution, that allows Riverside Theatre to sell beer and wine and for attendees to consume beer and wine from June 9 through July 2 in a specified area in and around Riverside Festival Stage in City Park. The terms in the agreement are the same as in 2016. Item 3d(4) Fireworks agreement with University - Resolution approving a Memorandum of Understanding between the / 7- / e CA City and the University of Iowa regarding the 2017 Independence Day fireworks display. Comment: This Resolution will approve the Memorandum of Understanding developed by the City and the University to facilitate the City's Independence Day fireworks display on July 2nd. The display will take place at the University's Hubbard Park, with their permission and assistance. Comment: On March 31, 2017, the Purchasing Division issued a request for proposal for Body Work Repair Services for a one (1) year contract, with the option to renew for 4 additional one (1) year periods. Two proposals were received, evaluated and scored by staff who determined that the proposal submitted by Premier Automotive Inc. best met the needs of the City. This Resolution authorizes the award of the contract to Premier Automotive Inc. and authorizes the City Manager to effectuate future contract renewals. Approval will allow the development of the Larson Subdivision a 2 -lot, 12.28 -acre residential subdivision located north of Scott Boulevard west of First Avenue. On May 16 the Council approved a Planned Development Overlay (OPD) rezoning to allow a reduction of a protected slope buffer to permit installation of stormwater management facilities and development of two multi -family family buildings with a total of 60 dwelling units and one single family lot. Setting Public Hearings: Item 3e(1) Rezoning 513 Riverside Drive — Motion setting public hearing for June 20 for a rezoning of approximately 0.62 acres of land from Community Commercial (CC -2) Zone to Riverfront Crossings — West Riverfront (RFC -WR) zone for property located at 513 S. Riverside Drive. (REZ17-00005). Comment: At its May 18 meeting, by a vote of 6-0 (Dyer absent), the Planning and Zoning Commission recommended approval of the rezoning, subject to a conditional zoning agreement requiring dedication of land along the Riverside Drive frontage to widen the pedestrian area within the public right-of-way and closure of driveways consistent with the recently completed Riverside Drive Streetscape Plan and the City's access management standards. Approval will allow redevelopment of the property according to the Riverfront Crossings form -based zoning code. Item 3e(2) Univer-City Sale — 926 Davenport — Resolution setting public hearing for June 20, 2017, on a proposal to convey a 17-19 a— single family home located at 926 East Davenport Street. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 926 East Davenport Street. The amount of the sale will be $194,000. Item 3e(3) Happy Hollow Park Restroom and Shelter Replacement 2017 - Resolution setting a public hearing on June 20, 7 - 3 2017 on plans, specifications, form of contract, and estimate of cost for the construction of the Happy Hollow Park Restroom and Shelter Replacement 2017 Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: This project replaces an aging combination restroom, shelter and storage structure at Happy Hollow Park with a restroom and shelter. Fireworks Amendment — Ordinance amending Title 8, Police U Regulations, Chapter 5, Miscellaneous Offenses, Section 12, Fireworks: to allow for the sale of some fireworks, revise definitions of fireworks, and increase the penalty for use of fireworks within City limits, all in compliance with newly amended State law. (First Consideration) Comment: On May 9`h, 2017, the Governor signed Senate File 489, which made the sale and use of consumer fireworks legal in the State of Iowa. Under the new law, cities retained the right to prohibit use of fireworks within city limits. This amendment is needed to remove the City's current prohibition against sales of fireworks, to amend the definitions of various types of fireworks, and to increase the penalty for illegal use of fireworks within City limits, all to comply with the newly amended State Code. Amending City Code Title 1 Chapter 8 — Ordinance amending Title 1, Administration, Chapter 8, Administrative Service Departments, Section 1, Administrative Service Departments Organized: to revert the title of the Transportation and Resource Management department to the Transportation Services department to reflect a realignment of supervision over Resource Management to the Public Works Director. City Clerk Residency - Ordinance amending Title 1, "Administration", Chapter 7, "City Officers; City Attorney, City Clerk, City Manager", Section 2, "Appointment and Removal' to replace the residency requirement for the position of City Clerk with a residency preferred requirement. (First Consideration) Comment: Following the retirement of long term City Clerk Marian Karr at the end of 2016 the City Council has conducted two searches for a replacement. The Council recognizes the value of residency for City employees. However, based on its recent Sem experience and the duties of the City Clerk, Council believes it is in the City's best interests that the requirement for residency be eliminated and replaced with a residency .6 G preferred requirement. / Action: {t AYD�� �, try prl 9 nle 7/C •-�qr,� Item 9. Moratorium - An ordinance amending Title 17�f the City Code (Building and Housing) to establish a six month moratorium on the issuance of new rental permits, and building permits that result in an enlargement of a rental dwelling, in RS -5, RS -8 and RNS-12 zones within the area generally bounded by Scott Boulevard on the east, I- 80 on the north, the Iowa River and Mormon Trek Blvd on the west, and Highways 1/6 on the south in Iowa City, Iowa. (First Consideration) Comment: The City, like many cities around the country, currently regulates occupancy based upon its definition of "family' and whether the occupants are or are not related by blood, marriage, adoption or placement by a social service agency. The State legislature recently adopted a law that prohibits the City, after January 1, 2018, from adopting or enforcing any regulation or restriction related to occupancy of residential rental property that is based upon the existence of familial or nonfamilial relationships between the occupants of such rental property. Due to this new law, the City must study how to mitigate the impacts of rental housing and increases in occupancy levels on neighborhood stability, housing affordability, public and tenant safety, urban congestion, blight, risk to public peace and order, conflicts between rental and owner -occupied �� housing, and excessive demands upon public safety, infrastructure and municipal services. During the course of this study, it is prudent to establish a moratorium until December 31, 2017 on the issuance of new rental permits (i.e. not renewals of existing permits) and building permits that would result in an enlargement of existing rental dwellings.
