RESOLUTION ADOPTING IOWA CITY'S FY17 ANNUAL ACTION PLAN AMENDMENT #1, WHICH IS
A SUB -PART OF IOWA CITY'S 2016-2020 CONSOLIDATED PLAN (CITY STEPS), AUTHORIZING
THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE
U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT.
WHEREAS, the U.S. Department of Housing and Urban Development requires the City of Iowa City,
Iowa, to prepare and submit an Annual Action Plan as part of the City's Consolidated Plan (CITY STEPS)
to plan for the use of federal funds to assist lower income residents with housing, jobs and services; and
WHEREAS, the Shelter House Community Shelter and Transition Services declined acceptance of
$250,000 in allocated FY17 HOME funds; and
WHEREAS, the City proposes to amend the FY17 Annual Action Plan by canceling the Shelter House
FUSE project awarded $250,000 in HOME funds; and
WHEREAS, the City proposes to amend the FY17 Annual Action Plan by adding the Habitat for Humanity
acquisition of one vacant parcel for new affordable homeownership with $50,000 in HOME funds; and
WHEREAS, the City proposes to amend the FY17 Annual Action Plan by adding the Iowa City Housing
Authority tenant based rental assistance for $200,000 in HOME funds; and
WHEREAS, according to the City Council adopted Citizen Participation Plan, said amendment is
considered substantial and requires City Council approval; and
WHEREAS, the City has disseminated information soliciting public input at the June 6, 2017 City Council
meeting on the proposed Amendment #1; and
WHEREAS, proposed FY17 Annual Action Plan Amendment #1 is attached hereto as Exhibit A; and
WHEREAS, the City Council finds that the public interest will be served by the adoption of the Amended
FY17 Annual Action Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA,
THAT:
The City of Iowa City's Amendment #1 to the FY17 Annual Action Plan, copies of which are filed
in the Neighborhood and Development Services Department, are hereby approved and adopted.
2. The City Manager of Iowa City is hereby authorized and directed to submit the applicable
documentation for the City of Iowa City's Amended FY17 Annual Action Plan to the U.S.
Department of Housing and Urban Development to provide all the necessary certifications
required by the U.S. Department of Housing and Urban Development in connection with said
Plan.

Substantial Amendment #1
April 2017
City of Iowa City staff proposes amending the FY17 Annual Action Plan due to a FY17 HOME
recipient (Shelter House —FUSE Project) declining their award. The City proposes moving two
HOME eligible projects that can proceed immediately from FY18 to FY17. The Iowa City
Housing Authority was recommended for $200,000 in FY18 HOME funds and Habitat for
Humanity was recommended for $50,000 to acquire a residential lot for new homeownership.
The City currently has a HOME commitment shortfall and must commit HOME funds to eligible
projects by July 31, 2017.
Staff proposes amending the FY17 Annual Action Plan to enable the Housing Authority and
Habitat for Humanity to commit HOME funds and meet the City's commitment deadline. The
proposed amendment is detailed on the following page.
The City Council will consider this recommendation on June 6, 2017 following a 30 -day public
comment period and an amendment will be submitted to the U.S. Department of Housing and
Urban Development (HUD) subject to City Council approval.

PUBLIC MEETING NOTICE
FY17 ANNUAL ACTION PLAN AMENDMENT #1
The City Council will hold a public meeting, accept
comments, and consider approval of Iowa City's
FY17 Annual Action Plan Amendment #1 on June
6, 2017. The meeting will be held at City Hall,
Emma Harvat Hall, 410 East Washington Street at
7:00 p.m.
Annual Action Plans (AAP) are a portion of Iowa
City's Consolidated Plan (a.k.a. CITY STEPS). The
AAP includes information on the proposed use of
Community Development Block Grant (CDBG) and
HOME Investment Partnership (HOME) funds for
housing, jobs, and services for low -moderate
income persons. The AAP outlines proposed
activities and their budgets.
The Annual Action Plan Amendment #1 proposes
to add two projects and cancel one project. A FY17
HOME recipient declined $250,000. This
amendment proposes to use $200,000 in HOME
funds for the Iowa City Housing Authority's tenant -
based rental assistance (TBRA) project and $50,000
in HOME funds for Iowa Valley Habitat for
Humanity to acquire one property for affordable
homeownership.

Executive Summary:
A resolution considering approval of the FY17 Annual Action Plan Amendment #1 will be
considered at the June 6, 2017 City Council meeting. A FY17 recipient (Shelter House — FUSE
Project) declined a $250,000 HOME award. As the City has a HOME commitment shortfall, the
City must reallocate these funds before July 31 to avoid HUD recapturing funds. This
amendment moves two proposed FY18 HOME projects to FY17. Staff and the Housing and
Community Development Commission (HCDC) recommend approval of this amendment.
Background / Analysis:
A FY17 HOME recipient declined $250,000 in funds. The City must commit these funds to
another HOME eligible activity or activities by July 31. To meet the commitment requirement
under the HOME program, an applicant must have site control, an environmental review
completed, a market analysis, underwriting review must be completed, and an agreement
entered with the City for the funds.
HCDC had recommended projects for funding in the proposed FY18 Annual Action Plan. Two
of these projects can meet the HOME commitment requirements by July 31. HCDC
recommended moving these two proposed FY18 projects; Habitat for Humanity, Affordable
Homeownership, $50,000 and Iowa City Housing Authority, Tenant Based Rent Assistance,
$200,000 to FY17.
The City opened another funding round for the available FY18 HOME funds. Applications for
these FY18 funds are due June 5, 2017.
To date, the City has received no written comments from the public concerning the FY17 Annual
Action Plan Amendment #1.

RESOLUTION NO. 17-185
RESOLUTION APPROVING AN AGREEMENT WITH RIVERSIDE THEATRE TO
ALLOW THE SALE OF WINE AND BEER UNDER LIMITED CIRCUMSTANCES
IN CITY PARK.
WHEREAS, section 4-5-3D of the City Code allows private entities to sell, consume, and
possess alcohol in a city park, on public right-of-way or on a city ground excluding public
buildings under limited circumstances;
WHEREAS, Riverside Theatre would like to be able to sell beer and wine during performances
from June 9 through July 2 in a demarcated area in an around Riverside Festival Stage in City
Park; and
WHEREAS, it is in the City of Iowa City's interest to execute the attached agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
The City Manager is authorized to sign the attached agreement and any needed amendments

AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND RIVERSIDE THEATRE
TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND
POSSESSION OF BEER AND WINE IN CITY PARK
This Agreement is made between Riverside Theatre (hereinafter "Riverside") and
the City of Iowa City, a municipal corporation (hereinafter "City"), in Iowa City, Iowa.
WHEREAS, Riverside is an "authorized entity" as that term is defined in Iowa City
City Ordinance No. 04-4123, codified at section 4-5-31D of the City Code;
WHEREAS, Riverside has applied for a license to sell beer and wine for 213 N.
Gilbert Street, Iowa City, Iowa and intends to apply to transfer said license to an area in
City Park in and around the Riverside Theatre Festival Stage; and
WHEREAS, the parties wish to enter into an agreement to allow Riverside to sell
beer and wine and to allow persons to possess and consume beer and wine under limited
circumstances in City Park.
THE PARTIES THEREFORE AGREE AS FOLLOWS:
1. Authorized Site. In consideration for Riverside's promises herein, the City
agrees to allow Riverside control over an area south and east of the festival
stage and the seating area as shown on the diagram, which is attached,
marked Exhibit A, and incorporated herein ("authorized site").
2. Term. This agreement shall commence on June 9, 2017 and shall expire on
July 2, 2017.
3. Access. Riverside shall take all reasonable steps to ensure that every person on
the authorized site has a ticket or invitation to that day's event or is an employee
of, an independent contractor of, or volunteer for Riverside and shall exclude any
person who is not.
4. License. This agreement is void if Riverside does not have a license to sell beer
or wine on the authorized site at any time during the period of June 9, 2017
through July 2, 2017.
5. Sale of Beer/Wine. Riverside shall only sell beer or wine to a person who is over
twenty-one (21) years of age and who has a ticket or invitation to that day's
event or is an employee of, an independent contractor of, or a volunteer for
Riverside.
6. Advertisement. Riverside shall not, nor shall it allow anyone to, erect or place
any sign or other matter advertising any brand of alcoholic liquor, beer, or wine
upon the authorized site. Notwithstanding any other provision, sponsorship
signage unrelated to businesses selling alcohol, beer, wine, or tobacco will be
allowed.
7. Inspection. City staff, including the Iowa City Police Department, may
periodically inspect the authorized site without any prior notice to determine
compliance with the terms of this agreement.
8. Debris and Trash. Riverside shall be solely responsible for collecting all debris
and trash from the authorized site, and the City shall then remove the debris and
trash. If Riverside fails to do so and if City staff has to collect the debris and
trash from the authorized site, Riverside may be responsible for the cost incurred
by the City, including staff time, and shall pay the costs in full within thirty (30)
days of receiving an invoice.
9. Insurance.
a) Premises Insurance. From June 9, 2017 through July 2, 2017, Riverside
shall carry comprehensive general liability insurance for bodily injury and
property damage on the authorized site in the amount of $1,000,000 (one
million dollars) for each occurrence and $2,000,000 (two million dollars) in
the aggregate, shall name the City as an additional insured, and shall
include the Governmental Immunities Endorsement, a copy of which is
attached, marked Exhibit B, and incorporated herein. Riverside shall
furnish a copy of a certificate of insurance for same, satisfactory to the
City at the time of execution of this agreement. Riverside shall provide
thirty (30) days notice to the City before cancellation of said insurance,
and said cancellation shall automatically terminate this Agreement.
b) Dram Shoo Insurance. From June 9, 2017 through July 2, 2017,
Riverside shall carry "dram shop" insurance in compliance with Iowa
Code section 123.92 (2017) in the amount of $500,000 (five hundred
thousand dollars). Riverside shall provide thirty (30) days notice to the
City before cancellation of said insurance, and said cancellation shall
automatically terminate this Agreement.
10. Indemnification. Riverside shall pay on behalf of the City all sums which the
City shall be obligated to pay by reason of any liability imposed upon the City
for damages of any kind resulting from the use of the authorized sight or sale,
consumption, or possession of beer or wine on the authorized site, whether
sustained by any person or person, caused by accident or otherwise and shall
defend at its own expense and on behalf of the City any claim against the City
arising out of the use of the authorized site or sale, consumption, or possession
of beer or wine on the authorized site.
11. No Smoking. Smoking, including the use of electronic cigarettes, is prohibited
in the authorized sites, and Riverside shall post a no -smoking a sign at the
front entrance to the authorized site and two signs inside the authorized site.
The signs shall comply with Iowa Code Section 142D.6 (2017). Electronic
cigarette means vapor product as defined in Section 453A.1 of the Code of
Iowa (2017).
12. Non -Discrimination. Riverside shall not discriminate against any person in
employment or public accommodation because of race, religion, color, creed,
gender identity, sex, national origin, sexual orientation, mental or physical
disability, marital status or age. "Employment' shall include but not be limited to
hiring, accepting, registering, classifying, promoting, or referring to employment.
"Public accommodation" shall include but not be limited to providing goods,
services, facilities, privileges and advantages to the public.
13. Termination. The City may terminate this agreement upon written notice for
violation of any provision of this agreement.
14. Assignment and Subletting. Riverside shall not assign or sublet this

15. Entire Agreement. This constitutes the whole agreement between the
parties, and may be modified in writing only, duly signed by the parties.

Governmental Immunities Endorsement
1. Non -waiver of Government Immunity. The insurance carrier expressly agrees
and states that the purchase of this policy and the including of the City of Iowa
City, Iowa as Additional Insured does not waive any of the defenses of
governmental immunity available to the City of Iowa City, Iowa, under Code of
Iowa Section 670.4 as it now exists and as it may be amended from time to
time.
2. Claims Coverage. The insurance carrier further agrees that this policy of
insurance shall cover only those claims not subject to the defense of
governmental immunity under the Code of Iowa Section 670.4 as it now exists
and as it may be amended from time to time. Those claims not subject to
Code of Iowa Section 670.4 shall be covered by the terms and conditions of
this insurance policy.
3. Assertion of Government Immunity. The City of Iowa City, Iowa, shall be
responsible for asserting any defense of governmental immunity, and may do
so at any time and shall do so upon the timely written request of the insurance
carrier. Nothing contained in this endorsement shall prevent the carrier from
asserting the defense of governmental immunity on behalf of the City of Iowa
City.
4. Non -Denial of Coverage. The insurance carrier shall not deny coverage under
this policy and the insurance carrier shall not deny any of the rights and
benefits accruing to the City of Iowa City, Iowa under this policy for reasons of
governmental immunity unless and until a court of competent jurisdiction has
ruled in favor of the defense(s) of governmental immunity asserted by the City
of Iowa City, Iowa.
5. No Other Change in Policy. The insurance carrier, the City of Iowa City, Iowa
agree that the above preservation of governmental immunities shall not
otherwise change or alter the coverage available under the policy.

Background / Analysis:
Section 4-5-3 of the City Code allows for the sale and consumption of alcohol in a city park and
on a right-of-way pursuant to written agreement. Staff has approved the agreement, which is
attached to the resolution, that allows Riverside Theatre to sell beer and wine and for attendees
to consume beer and wine from June 9 through July 2 in a specified area in and around
Riverside Festival Stage in City Park. The terms in the agreement are the same as in 2016.

Resolution approving a Memorandum of Understanding between the
City and the University of Iowa regarding the 2017 Independence Day
fireworks display.
Whereas, since the 2008 flooding, the City has hosted their Independence Day fireworks display
in the University of Iowa's (University) Hubbard Park, adjacent to the Iowa Memorial Union; and
Whereas, in 2017, the University is again allowing the City to host the fireworks in Hubbard
Park; and
Whereas, the parties wish to memorialize their agreement as to allocation of tasks and risk
management in putting on this event; and
Whereas, the parties have reduced their agreement to the attached Memorandum of
Understanding (MOU); and
Whereas, said MOU requires Council approval; and
Whereas, it is in the best interest of the City to approve the attached MOU.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa:
1. City Council for the City of Iowa City hereby approves said Memorandum of
Understanding with the University of Iowa as being in the best interest of the City of Iowa
City and members of the public, and ratifies said MOU.
2. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached
MOU, in duplicate, subject to the approval of the City Attorney's Office.

MEMORANDUM OF UNDERSTANDING
BETWEEN
THE CITY OF IOWA CITY
AND THE UNIVERSITY OF IOWA
This MEMORANDUM OF UNDERSTANDING (hereinafter "MOU") is entered into this 6th
day of June, 2017 by and among, the City of Iowa City (hereinafter "City") and the State
University of Iowa (hereinafter "University") hereinafter referred to collectively as the "Parties".
WHEREAS, the Parties recognize the benefits of mutual cooperation between the Parties in the
presentation of an Independence Day fireworks display ("Event') on July 2, 2017 ("Event
Date"), with a rain date of July 3, 2017;
WHEREAS, to help effectively assign responsibilities for the various tasks required to present
the Event successfully, the City and University wish to delineate the responsibilities of each
party for the Event;
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE to assist in the production of the
Event by performing the respective duties as designated below:
UNIVERSITY:
• To permit the use of the Pentacrest and Hubbard Park for the Event, subject to all the
terms and conditions in this Memorandum;
• Contact "One Call" and have all utilities and other obstructions marked by June 28;
• Close Hubbard Park July 1 and 2 for set-up;
• Keep Hubbard Park closed July 3' in the event the rain date is needed;
• Secure any areas of construction, and keep the shoot and fall -out zones free of
combustible materials;
• Provide 24-hour UIPD security for the fireworks (the explosive devices only) on July 1
from 6:00 p.m. until 8:00 a.m. July 2, when ICPD will assume responsibility for security
of the fireworks;
• Install barricades closing the IIVIU parking lot;
• Post "No Parking" signs at 8:00 A.M. on July 2, leaving them in place until after the
display;
• Assist the ICPD with foot patrols immediately before, during, and after the show as
needed and available; provided, however, that the City will retain all responsibility to
provide security for the Event and its related activities.
CITY:
• The City maintains responsibility for all aspects of security for the Event and its related
activities except those particular services delineated above as the University's
responsibilities;
• Direct and oversee Parks and Recreation staff's installation of fencing as required on July
1;
• Ensure that caution is exercised in driving vehicles on Hubbard Park grass;
• Provide barricades at Madison/Washington; Hwy 6/Iowa Ave., and Jefferson/Madison
for duration of fireworks. Iowa Ave. will be closed to vehicular traffic;
• Prevent public from accessing any point North of the South curb on Iowa Ave;
• Run street sweeper on July 3`a on all streets bordering Hubbard Park;
• Conduct and direct foot patrols as needed immediately before, during, and after the
Event;
• Direct ICFD to hose down Danforth Chapel immediately prior to the display;
• Place ICFD firefighters on the roof of the IMU during the display;
• ICFD will check for unexploded shells on the IMU roof prior to 6:00 A.M. on July Yd;
• Secure assistance in sweeping for unexploded shells in Hubbard Park by 6:30 A.M. on
July Yd; and
• Defend, indemnify and hold harmless the University of Iowa from any and all liability for
claims for bodily injury (including personal injury and death) and property loss and
damage (including damage to or destruction of any building or facility) arising out of,
resulting from, or in any way involving the Event or its related activities; this provision

Executive Summary:
The City of Iowa City has, every year since 2008, put on a fireworks display in celebration of
July 4" in Hubbard Park in Iowa City. City personnel, University personnel, and pyrotechnicians
from J & M Displays collaborate to provide a safe and visually appealing fireworks display for
the Iowa City community. This resolution authorizes the Mayor to execute the Memorandum of
Understanding between the City of Iowa City and the University of Iowa detailing the
responsibilities of both parties regarding the 2017 fireworks display.
Background / Analysis:
The 2017 City of Iowa City Independence Day fireworks display is scheduled for Sunday, July 2.
The display will coincide with the conclusion of Jazz Fest, beginning between 9:30 and 9:45
p.m. on July 2. July 3 is scheduled as a rain date. The cost of the display is $23,000 with funds
budgeted in account 10210100-448040. This cost is consistent with previous years.

Whereas, a Request for Proposal (RFP) was issued to solicit body work and repair services for
City of Iowa City on March 31, 2017; and
Whereas, the City received two proposals in response to the RFP; and
Whereas, an evaluation committee composed of staff from the City's Equipment Division reviewed
and scored the proposals and selected Premier Automotive; and
Whereas, the initial term of this contract is for one year, with an option to renew for four additional
one-year periods upon the mutual consent of the City and Premier Automotive; and
Whereas, the City expects to expend approximately $50,000 per year, making the total amount of
the contract approximately $250,000;
Whereas, funds for this purchase are available in the General Fleet Maintenance- Vehicle
Repairs line item, 81710510-441050, in the operating budget for the Equipment Division; and
Whereas, approval of this procurement is in the public interest.

Executive Summary:
On March 31, 2017, a Request for Proposal was issued for body work and mechanical repair
services for City vehicles. The contract includes body work and mechanical repair services
(including large trucks), painting and frame repair (providing fully protected paint bays and
ovens), fiberglass work, spray -in liners, paintless dent removal repair (PDR) work, air
conditioning (evacuating, recycling, recharging), air bag and ABS replacementtrepair, preparing
and finishing miscellaneous items including snow plows, small trailers, etc.
Background / Analysis:
The City received proposals from the following vendors: Midwest Frame and Axle and Premier
Automotive Inc. Proposals were distributed to an evaluation committee, which consisted of
representatives from the Equipment Division. The evaluation committee performed a thorough
evaluation of each proposal based on the company's facilities, capabilities to perform the
required work, company history, customer satisfaction, references, and pricing.
After a complete evaluation of the proposals, the evaluation committee recommends Premier
Automotive Inc. to receive the contract award for body work and repair services for the City of
Iowa City.

Executive Summary:
Plans, Specifications, Form of Agreement and Estimate of Cost for the Davenport Brick Street
Reconstruction Project were approved at the May 2, 2017 Council Meeting.
This project will replace the brick street surface and upgrade storm sewer and water
utilities along Davenport Street from Linn Street to Clinton Street. Work on this project also

Background / Analysis:
Due to severe deterioration of the brick surface of Davenport Street, from Linn Street to Clinton
Street, reconstruction of Davenport Street was included in the 2016 Capital Improvement Plan.
The project includes the following design elements:
• Salvage and reinstallation of existing brick pavers
• 7" concrete base
• New drainage system under the road
• New 6" concrete curb and gutter.
• New curb ramps at Clinton/Davenport, Dubuque/Davenport, and Linn/Davenport
intersections to meet ADA compliance
• New 12" water main from Clinton to Dubuque to replace existing 1900's -1920's water
main

NOTICE TO BIDDERS
DAVENPORT BRICK STREET RECONSTRUCTION PROJECT
CITY OF IOWA CITY
Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, until
3:00 P.M. on the 24th day of May, 2017. Sealed proposals will be opened immediately
thereafter. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes
of this Project. Proposals received after this deadline will be returned to the bidder
unopened. Proposals will be acted upon by the City Council at a meeting to be held in the
Emma J. Harvat Hall at 7:00 P.M. on the 6" day of June, 2017, or at special meeting
called for that purpose.
The Project will involve Brick Street Reconstruction along Davenport Street between
Clinton Street and Linn Street. The project will include the following:
Excavation of 1202 cubic yards of Class 10; installation of 633 feet of storm sewer and
associated structures; installation of 460 feet of water main with associated valves,
fittings and fire hydrants; paving 2,755 square yards of Brick pavers with a V HMA
setting bed above a 7" PCC slab, and 736 square yards of sidewalk; as well as
clearing and grubbing, site work, grading, and associated construction activities.
All work is to be done in strict compliance with the plans and specifications prepared by
McClure Engineering Company, of North Liberty, Iowa, which have heretofore been
approved by the City Council, and are on file for public examination in the Office of the City
Clerk.
Each proposal shall be completed on a form furnished by the City and must be submitted
in a sealed envelope. In addition, a separate sealed envelope shall be submitted
containing a completed Bidder Status Form and a bid bond executed by a corporation
authorized to contract as a surety in the State of Iowa, in the sum of 10% of the bid. The
bid security shall be made payable to the TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shall be forfeited to the City of Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar days of the City Council's award of the
contract and post bond satisfactory to the City ensuring the faithful performance of the
contract and maintenance of said Project, if required, pursuant to the provisions of this
notice and the other contract documents. The City shall retain the bid security furnished
by the successful bidder until the approved contract form has been executed, a bond has
been filed by the bidder guaranteeing the performance of the contract, and the contract
and bond have been approved by the City. The City shall promptly return the checks or
bidders bonds of unsuccessful bidders to the bidders as soon as the successful bidder is
determined or within thirty days, whichever is sooner.
The successful bidder will be required to furnish a bond in an amount equal to one hun-
dred percent (100%) of the contract price, said bond to be issued by a responsible surety
approved by the City, and shall guarantee the prompt payment of all materials and labor,
and also protect and save harmless the City from all claims and damages of any kind
caused directly or indirectly by the operation of the contract, and shall also guarantee the
maintenance of the improvement for a period of Five (5) year(s) from and after its
completion and formal acceptance by the City Council.

Specified Date of Substantial Completion: August 11, 2017
Incentive/Disincentive: $750 per calendar day ($10,000 Maximum Incentive)
The plans, specifications and proposed contract documents may be examined at the office
of the City Clerk. Copies of said plans and specifications and form of proposal blanks may
be secured at the Office of McClure Engineering Company 1740 Lininger Lane North
Liberty, Iowa 5231 by bona fide bidders.
A $25.00 fee is required for each set of plans and specifications provided to bidders or
other interested persons. The fee shall be in the form of a check, made payable to
McClure Engineering Company. The fee is refundable if returned within 14 days of award
of the project by City Council in re -usable condition.
Prospective bidders are advised that the City of Iowa City desires to employ minority
contractors and subcontractors on City projects. A listing of minority contractors can be
obtained from the Iowa Department of Inspections and Appeals at (515) 281-5796 and the
Iowa Department of Transportation Contracts Office at (515) 239-1422.
Bidders shall list on the Form of Proposal the names of persons, firms, companies or other
parties with whom the bidder intends to subcontract. This list shall include the type of work
and approximate subcontract amount(s).
The Contractor awarded the contract shall submit a list on the Form of Agreement of the
proposed subcontractors, together with quantities, unit prices and extended dollar
amounts.
By virtue of statutory authority, preference must be given to products and provisions grown
and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent
lawfully required under Iowa Statutes. The Iowa reciprocal resident bidder preference law
applies to this Project.
The City reserves the right to reject any or all proposals, and also reserves the right to
waive technicalities and irregularities.

Executive Summary:
This project constructed a new recreational trail along Dubuque Street from Foster Road to the
Butler Bridge, including an approximately 270 -foot long pedestrian bridge over 1-80. The
existing Iowa River Trail along Dubuque Street was the most heavily used trail in the metro area
with over 765 users per day prior to construction and is now complete with connectivity to the
north.
This project has been completed by Peterson Contractors, Inc. of Reinbeck, Iowa in substantial
accordance with the plans and specifications. The Engineer's Report is on file with the City
Clerk.

Included with the actual cost of the project are repairs to the Dubuque Street overpass over 1-80

There were a total of twelve (12) change or extra work orders for the project as described

2. An existing structure was 1.5 feet lower than stated on the plan.
The structure and site grading was modified and storm sewer

The applicant, Kevin Hanick, is requesting approval of the preliminary plat of Larson Subdivision,
a 2 -lot, 12.28 -acre residential subdivision located at 2201 North Dubuque Road. The northern
tract, Lot 1 is planned to be the location of a new single family dwelling for the property's current

owners. The existing house and accessory buildings are planned to be removed from Lot 2. The
City Council has approved first reading of an ordinance rezoning Lot 2 to Low Density Multifamily
Residential (RM -12) with a Conditional Zoning Agreement allowing a maximum of 60 dwelling
units.
The property contains regulated slopes and woodlands. The preliminary plat includes a sensitive
areas development plan indicating grading and tree clearing within the 50 -foot buffer for the
protected slope located in the southeastern portion of Lot 2. The zoning ordinance requires
approval of a Planned Development Overlay where disturbance of a protected slope buffer is
proposed. Therefore this application requires a rezoning from Low Density Multifamily (RM -12) to
Planned Development Overlay/Low Density Multifamily (OPD/RM-12).
The applicant has indicated that they have chosen not to use the "Good Neighbor Policy".
ANALYSIS:
Comprehensive Plan: As noted in the staff report for the recent rezoning of this property (REZ16-
00008) The Northeast District Plan map shows the area north of Scott Boulevard, including this
property, as being appropriate for Office Research Park development, but the text of the Plan
notes that alternative uses, including residential should be considered. The text of the Plan also
encourages a diversity of housing including multifamily near Scott Boulevard. In Staff's view, the
proposed subdivision for two residential lots is in compliance with the Comprehensive Plan.
Zoning: Lot 1 is currently zoned RS -5. The proposed lot exceeds the minimum 60 foot lot width
and 8,000 square foot minimum lot area required in that zone. The sensitive areas plan shows
that there will sufficient land area for a single family dwelling and associated accessory buildings
outside of the sensitive areas.
Lot 2 is in the process of being rezoned to RM -12. Lot 2 exceeds the minimum 60 foot lot width
and 8125 square foot lot area required in the zone. The sensitive areas plan illustrates that
development will be in conformance with the Conditional Zoning Agreement currently be
considered by the City Council.
Subdivision design: No new streets are proposed for this subdivision. Access to Lot 1 will be
from Dubuque Road. Lot 2 will have one driveway access to Scott Boulevard. The proposed
driveway onto Scott Boulevard has been located where it will provide for adequate site distance.
The steep ravines located on this and adjacent properties would make the creation of an
interconnected street network typically required in residential subdivisions infeasible.
The portion of Dubuque Road adjacent to the north side of Lot 1 is currently in an easement.
The subdivision plat includes dedication of the owners half of the road to the City as street right-
of-way (Outlot A.)
Sensitive Areas: The property contains regulated slopes and woodlands. Lot 1 includes a
construction limit line that confines potential development areas to the portions of the property
that do not contain regulated slopes and woodlands.
On Lot 2, disturbance of woodlands and slopes is generally limited to the area necessary for the
stormwater management facilities proposed in the southern part of the ravine. Smaller areas of
disturbance will occur along the west edge of the driveway for Lot 2.
Tree removal and grading necessary for the stormwater management facilities will impact the
50 -foot protected slope buffer. Stormwater detention facilities are permitted within buffer areas
if they are designed and constructed to minimize their impact upon the protected sensitive

areas and associated buffers. The design and construction should include measures to protect
against erosion, pollution and habitat disturbance, and result in minimal amounts of excavation
and filling. The City Engineer is currently reviewing a revised stormwater management plan
and anticipates completing the review prior to the March 16 Planning and Zoning Commission
meeting.
As proposed the 17.5% of the steep slopes, 2.5% of the critical slopes and 18.9% of the
woodlands will be affected. This may change depending on City Engineer review of the
stormwater management facilities.
Neighborhood Open Space: A subdivision of this size requires the dedication of .70 acres of
neighborhood open space or fees in lieu of. The Parks and Recreation Department has
determined that fees are appropriate in lieu of land dedication. The fee will be equivalent to the
value of 30,867 square feet of property. This requirement will need to be addressed in the legal
papers for the final plat.
Infrastructure fees: The water main extension fee of $435 per acre will apply to this subdivision
and should be noted in the legal paperwork. There are no sanitary sewer tap fees that apply to
this area.
STAFF RECOMMENDATION: Staff recommends deferral pending resolution of any deficiencies
identified on the recently submitted preliminary plan and sensitive areas development plan. Upon
resolution of any identified issues, staff recommends approval of a rezoning of approximately
10.26 acres from Low Density Multifamily Residential (RM -12) to Planned Development
Overlay/Low Density Multifamily Residential (OPD/RM-12) zone and a preliminary plat and
sensitive areas development plan of Larson Subdivision, a 2 -lot, 12.28 -acre residential
subdivision located north of Scott Boulevard between Hickory Heights Lane and First Avenue.

DEFICIENCIES AND DISCREPANCIES:
Revised Plan: A revised preliminary plat and sensitive areas development plan were submitted
on March 10. Staff is in the process of reviewing the plans to assure that all deficiencies and
discrepancies have been resolved. We anticipate the staff review will be completed prior to the
March 16 Planning and Zoning Commission meeting.

Consider a motion setting a public hearing for April 20 for discussion of an amendment to the
Comprehensive Plan to address mitigating impact of redevelopment on existing tenants of multi-

Miklo explained this item is a formality to set a date for community input and the Staff report
regarding this item will be delivered at the April 20, 2017 meeting.
Theobald moved to set a public hearing for April 20 for discussion of an amendment to

REZONING/DEVELOPMENT ITEM (REZ16-00008/SUB16-00012):
Discussion of an application submitted by Kevin Hanick for a rezoning of approximately 10.26
acres from Low Density Multifamily Residential (RM -12) to Planned Development Overlay/Low
Density Multifamily Residential (OPD/RM-12) zone and a preliminary plat of Larson Subdivision,
a Not, 12.28 -acre residential subdivision located north of Scott Boulevard between Hickory
Heights Lane and First Avenue.
Miklo noted that this property was reviewed by the Commission earlier this year for a rezoning
to Low Density Multifamily (RM -12) and the Commission recommended approval and the
Council has since approved. The Applicant then submitted a subdivision application for a
preliminary plat to create two lots, a larger lot for the multi -family development and a smaller lot
for a single family home. During the review of the subdivision Staff determined there was
development activity proposed in the protective slope buffer for the stormwater management
basin and that requires a Planned Development Overlay, which is beyond what Staff can
approve with regards to sensitive areas. Therefore this item is a rezoning as well as a
preliminary plat application.
Both proposed lots conform to the underlying zoning and conform to the subdivision
requirements. The subdivision standards typically require street connectivity to adjacent
properties. However in this case due to steep ravines Staff is not recommending a street
connection and rather a private lane or driveway serve the multi -family development and then
the existing single family home will be served by Dubuque Road.
Miklo stated there will some disturbance to the environmentally sensitive areas, the ravines, in
order to allow the installation of a stormwater management facility. The plan does show a
grading limit line which generally coincides with the edge of the woodland with the exception of
the area for the stormwater basin. The ordinance does allow for reduction of buffers if done in a
design that is sensitive and minimizes the damage to slopes and woodlands. Staff has
reviewed this plan and the recommendations approval of the buffer reduction.
Signs mentioned the issue of connectivity to another street, and in the future if this area is
further developed is there a proposal to put another street in the area. Miklo said because of
the ravines that run through the area, Staff would not recommend that they be disturbed for a
street.

CODE AMENDMENT:
Discussion of amendments to Title 14, Article 2G, Riverfront Crossings and Eastside Mixed Use
Districts Form Based Development Standards, to add zoning standards for the new Orchard
Subdistrict within the Riverfront Crossings District located north of Benton Street and west of
Orchard Street.
Howard reminded the Commission that last year they recommended amending the City's
Riverfront Crossings Master Plan to include a new subdistrict on the west side of Riverfront
Crossings north of Benton Street and west of Orchard Street. Based on the Commission's
recommendation, the City Council amended the master plan to expand the boundary of the
district to include a new Orchard Subdistrict. Several new pages were added to the plan
describing the desired character of this new subdistrict and the goals of objectives for
redevelopment of the area. In order to facilitate implementation of these goals, the form -based
code for Riverfront Crossings needs to be amended to include zoning standards for the Orchard
District. Howard stated that the area is currently fully developed under the current zoning with a
mix of duplexes, multi -family buildings and a few single family dwellings. She noted that the
existing development creates an unpleasant environment for walking and biking. The duplexes
along Orchard Street have auto -oriented frontages with large garages and driveways that
interrupt the sidewalk, there is front yard parking and few street trees. Several of the single
family dwellings are located with no street frontage or pedestrian access and can only be
accessed from a narrow gravel drive. There is also an abrupt change from the scale of the
single family neighborhood to the west and the higher intensity mixed use and commercial
development planned along Riverside Drive. The existing zoning is low density single family
and medium density single family (RS -5 & RS -8), which doesn't create any incentive for
redevelopment. Adopting a new form -based zoning district will help achieve the goals of the
Master Plan while at the same time create an incentive for redevelopment.
Howard showed some photos of the area. Next she showed some images of the area from the
Master Plan of redevelopment concepts that would be complementary in mass and scale to the
adjacent single family neighborhood, create a transition from the larger scale mixed-use and
commercial buildings along Riverside Drive to the single family neighborhood to the west,
improve the design quality of development and create a better and more visible street access.
The development character and scale of buildings should be appropriate for transition from the
larger scale mixed-use to the adjacent single family. Buildings should front tree -lined streets,
parking should be located behind or within buildings with minimal surface parking lots, using
rear or side yard setbacks, upper floor setbacks and landscaping to create that transition to the
single family neighborhood to the west, and a development program that limits the types of

RESOLUTION NO. 17-192
RESOLUTION SETTING PUBLIC HEARING FOR JUNE 20, 2017, ON A
PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 926
EAST DAVENPORT STREET.
WHEREAS, the UniverCity Neighborhood Partnership Program is a joint effort between the
University of Iowa and the City to encourage home ownership and reinvestment in designated
neighborhoods surrounding the University of Iowa; and
WHEREAS, the City purchases rental units located in designated neighborhoods surrounding
the University of Iowa, rehabilitates them, and then sells them to income -eligible buyers; and
WHEREAS, the City purchased and rehabilitated a single family home located at 926 East
Davenport Street, Iowa City; and
WHEREAS, the City has received an offer to purchase 926 East Davenport Street for the
principal sum of $194,000; and
WHEREAS, this sale would provide affordable housing in a designated area surrounding the
University of Iowa; and
WHEREAS, this sale is conditioned on the family securing adequate financing for the purchase
of the home.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, that:
1. The City Council does hereby declare its intent to convey a single family home located at
926 East Davenport Street, Iowa City, Iowa, also known as part of Outlot 8, Original Town
of Iowa City, Iowa, for the sum of $194,000.
2. A public hearing on said proposal should be and is hereby set for June 20, 2017, at 7:00

Executive Summary:
On June 20, 2017, City Council will hold a public hearing and vote on a resolution authorizing
the conveyance of 926 E. Davenport as part of the UniverCity Neighborhood Partnership
Program. Once this home is sold, this will be the 58th home sold under the program.
Background / Analysis:
Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 926 E.
Davenport St. for $194,000. City funds were used to rehabilitate and sell the home to an eligible
homebuyer. Renovations included electrical work, plumbing, repainted interior walls, insulation

Executive Summary:
This agenda item begins the bidding process for the Happy Hollow Restroom and Shelter
Replacement Construction Project 2017.
Background / Analysis:
This project replaces an aging combination restroom, shelter and storage structure at Happy
Hollow Park with a restroom and shelter. A neighborhood meeting was held on May 25, 2016
with approximately 25 residents attending. The design of the restroom and shelter includes
architectural features and finish choices which fit the character of the historic neighborhood
surrounding the park.
The Historic Preservation Commission reviewed and approved the project on April 13, 2017.
The architecture, materials and color choices were made to reflect and enhance the historic
neighborhood of the park. Only the shelter and restroom are being replaced at this time. The
ball field, playground, basketball court and open field area will not change.

Whereas, Peterson Contractors, Inc. of Reinbeck, Iowa has submitted the lowest responsible bid
of $2,988,693.14 for construction of the above-named project; and
Whereas, the bid includes the base bid and Alternates #1 and #2; and
Whereas, funds for this project are available in the Park at Site of North WWT Plant account
#R4185 and North Wastewater Plant Demolition account #V3142.
Whereas, the City Engineer and City Manager are authorized to execute change orders according
to the City's Purchasing Policy as they may become necessary in the construction of the above-
named project.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:

This agenda item awards a construction contract for the Riverfront Crossings Park, Phase 1
Project 2017.
Background / Analysis:
Staff recommends accepting the base bid along with Alternates #1 and #2. The base bid
includes creation of a 5 -acre wetland, undergrounding of overhead power lines, grading of the
site in preparation for future park amenities, construction of trails in the park with a new
connection to Gilbert Street along Highway 6 and a bridge crossing of Ralston Creek at Second
Street. Alternate #1 adds an additional north -south trail connection on the western side of the
park, and Alternate #2 includes a new entrance at Clinton Street/Kirkwood Avenue, circle drive
and parking area at the north end of the park.
The project estimate was $2,760,000 for the base bid, $84,700 for Alternate #1 and $995,700
for Alternate #2. Two bids were received for the project:

Based upon the bids received, staff recommends awarding a construction contract to PCI.
Alternates #1 and #2 were selected due to the prioritization of additional trail connections within
the park and a need for vehicle parking and access, including handicapped parking near the
future Nature Play area. The Nature Play area will be bid as a separate project later this
summer. Alternate #3, including an additional pedestrian bridge and trail connection at First
Street, was not selected due to available funding and the need for further considerations
regarding ongoing development in the area.

Riverfront Crossings Park is located at the site of the City's decommissioned North Wastewater
Treatment Plant. In an effort to move critical infrastructure facilities out of the floodplain after
the major flood event in 2008, the City secured funding through the Iowa Flood Mitigation
Program to decommission and demolish the City's North Wastewater Treatment Plant (WWTP)
and convert the area into a new riverfront park. The approximately 25 -acre park site is located
on the banks of the Iowa River. The City -owned portion of the site (approximately 17 acres) has
been cleared of the wastewater treatment plant in preparation for future park development.
The goal of the Riverfront Crossings Park is to transform the riverside area into a new flood
resilient park that includes walkable/bikeable connections from urban areas to the river and
enhance Ralston Creek to become a community asset.
Project funding:

NOTICE TO BIDDERS
RIVERFRONT CROSSINGS PARK— PHASE I PROJECT
Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, until
3:00 P.M. on the 30"' day of May. 2017. Sealed proposals will be opened immediately
thereafter. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes of
this Project. Proposals received after this deadline will be returned to the bidder unopened.
Proposals will be acted upon by the City Council at a meeting to be held in the Emma J.
Harvat Hall at 7:00 P.M. on the 6`" day of June, 2017, or at special meeting called for that
purpose.
The Project will involve the following:
Generally, preparation, site clearing and site improvements for a wetland park located at
site at 1001 Clinton Street, Iowa City, Iowa. Scope of work includes earth moving and
associated work for the realignment of Ralston Creek, a tributary of the Iowa River, and
the creation of an off -channel wetland; construction of hard surface trails; construction of
two pedestrian crossings over the creek; seeding; planting; and other related site
construction. This project will include add -alternates for construction of vehicular access
road; parking lot; and nature play area as indicated in the Plan Documents.
All work is to be done in strict compliance with the plans and specifications prepared by
Confluence of Cedar Rapids, Iowa, which have heretofore been approved by the City
Council, and are on file for public examination in the Office of the City Clerk.
Each proposal shall be completed on a form furnished by the City and must be submitted in a
sealed envelope. In addition, a separate sealed envelope shall be submitted containing a
completed Bidder Status Form and a bid bond executed by a corporation authorized to
contract as a surety in the State of Iowa, in the sum of 10% of the bid. The bid security shall
be made payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be
forfeited to the City of Iowa City in the event the successful bidder fails to enter into a contract
within ten (10) calendar days of the City Council's award of the contract and post bond
satisfactory to the City ensuring the faithful performance of the contract and maintenance of
said Project, if required, pursuant to the provisions of this notice and the other contract
documents. The City shall retain the bid security furnished by the successful bidder until the
approved contract form has been executed, a bond has been filed by the bidder guaranteeing
the performance of the contract, and the contract and bond have been approved by the City.
The City shall promptly return the checks or bidder's bonds of unsuccessful bidders to the
bidders as soon as the successful bidder is determined or within thirty days, whichever is
sooner.
The successful bidder will be required to furnish a bond in an amount equal to one hundred
percent (100%) of the contract price, said bond to be issued by a responsible surety
approved by the City, and shall guarantee the prompt payment of all materials and labor, and
also protect and save harmless the City from all claims and damages of any kind caused
directly or indirectly by the operation of the contract, and shall also guarantee the
maintenance of the improvement for a period of five years (5) year(s) from and after its
completion and formal acceptance by the City Council.

Bidders shall list on the Form of Proposal the names of persons, firms, companies or other

The Contractor awarded the contract shall submit a list on the Form of Agreement of the
proposed subcontractors, together with quantities, unit prices and extended dollar amounts.
By virtue of statutory authority, preference must be given to products and provisions grown
and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully
required under Iowa Statutes. The Iowa reciprocal resident bidder preference law applies to
this Project.
