Resolutions and Motions: Item 3d(1) Easement Agreements, Hoover (East) - Resolution Authorizing the Mayor To sign and The City Clerk To attest certain easement agreements and accepting the Dedication of right-of-way to facilitate the development of Hoover (East) Elementary School In Iowa City, Iowa. Comment: In order to facilitate the development of the new Hoover Elementary School being constructed at along American Legion Road SE, it is necessary for the School District and the Lacinas to dedicate certain easements and rights-of-way to the City. No subdivision was required for this project, therefore these dedications are occurring as part of the site plan review process. 1- a 1r1 Item 3d(2) Wastewater Chemicals Contract - Resolution authorizing the award of the contract for ferric chloride and sodium hypochlorite for the City's Wastewater Division. Comment: On May 11, 2017, the Purchasing Division issued a request for bid for ferric chloride and sodium hypochlorite for a one (1) year contract, with the option to renew for additional one (1) year periods. Five vendors submitted pricing for the two products, the lowest price came from Hawkins, Inc. for $160,OOO.This Resolution authorizes the award of the contract to Hawkins Inc. and authorizes the City Manager to effectuate future contract renewals. July 18, 2017 City of Iowa City Page 4 1-1 - Xa 8 Item 3d(3) Amendment to Development Agreement - Resolution approving Amendment #3 to an Agreement for Private Development by and between the City of Iowa City, Iowa and Riverview West, L.L.C. formerly known as EMRICO Properties II, L.L.C. Comment: This amendment to the development agreement (resolution 14- 440, passed December 2, 2014) for the Riverside West apartments at 629 S. Riverside Drive extends the TIF rebate timeframe by one year. The total TIF subsidy for the project remains the same. Construction delays prevented timely lease -ups and thus, the affordable housing rental units were not able to be leased in time to certify for the first TIF rebate. Because of the delay, the first rebate will be a partial rebate and the developer will have the opportunity to make up the difference by the extended timeframe. In exchange, the affordability requirements will also be extended by one year. Item 3d(4) ICCSD use of Mercer pool - Resolution authorizing the City Manager to sign an agreement with Iowa City Community School District for use of Mercer pool. Comment: The City and the ICCSD previously entered into an agreement for use of the swimming pool in 1987, which is expiring. This is a 5 -year agreement in which the ICCSD pays a $94,000 annual usage fee and a $25,000 annual fee toward the capital expenses of the overall operations of Mercer Recreational Facility. The ICCSD may renew it every 5 years. The ICCSD approved the agreement at the June 27 School Board meeting. Item 3d(5) Disburse budgeted funds - Resolution approving the disbursement of budgeted FY18 funds to the Iowa City UNESCO City of Literature, Riverside Theatre, Film Scene and the Entrepreneurial Development Center. Comment: The City Council Economic Development Committee entertains requests for funding organizations that further economic development activities. The committee has approved recommendations in various ways for funding these organizations and the amounts were budgeted in the FY18 budget. This resolution approves the disbursement of budgeted funds. Comment: Bids for this project were opened on Wednesday, July 12, 2017, and the following bids were received: Woodruff Construction Calacci Construction North Construction Selzer-Werderitsch Tricon General Contractors Engineer's Estimate Tiffin, IA $ 251,652.00 Iowa City, IA $ 253,480.00 Muscatine, IA $ 265,495.00 Iowa City, IA $ 342,355.00 Dubuque, IA $ 361,000.00 $ 182,250.00 The lowest bid received exceeded the estimated cost by 39%. Staff recommends rejecting the bids. Item 3d(7) 2017 Clearing and Grubbing - Resolution accepting the work for the 2017 Clearing and Grubbing Project. Comment: The project has been completed by Delong Construction of Washington, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. Setting Public Hearings: Item 3e(1) Rezoning (Country Club Estates - Rohret Road west of Lake Shore Drive) — Motion setting a public hearing for August 1 on an ordinance rezoning approximately 21.77 acres from Rural Residential, RR -1, (4.16 acres) and Interim Development—Single Family Residential, ID -RS (17.61) acres to Single Family Residential, RS -5, zone for property located north of Rohret Road, west of Lake Shore Drive. (REZ17-00009) Comment: At its June 15 meeting, by a vote of 6-0 (Martin absent), the Planning and Zoning Commission recommended approval of this rezoning subject to a Conditional Zoning Agreement requiring that the developer: 1) reconstruct Rohret Road to the entrance to the subdivision, 2) contribute 50% of the cost of improving the remainder of the Rohret Road adjacent to this property, and 3) complete a water pressure analysis and, if necessary, design and construct the water system to include a booster pump to provide adequate water pressure. Approval of this rezoning will allow this property to be developed with approximately 80 single family residential lots. The Commission also voted 6-0 (Martin absent) to recommend to the City Council that improvement to the remainder of Rohret Road be added to the Capital Improvements Plan. July 18, 2017 City of Iowa City Page 7 Item 3e(2) Rezoning (Stone Bridge Estates - Thames Drive and Huntington Drive) — Motion setting a public hearing for August 1 on an ordinance rezoning 1.59 acres of property from Medium Density Single -Family, RS -8, zone to Low Density Multi -Family, RM -12, zone located west of Taft Avenue and east of Huntington Drive. (REZ17- 00011 /SUB 17-00008) Comment: At its July 6 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning subject to a Conditional Zoning Agreement requiring that the developer: 1) dedicate space along Taft Avenue for right-of-way and construction easements to allow the future improvement of the arterial street, 2) substantial conformance with the concept plan in regard to lot depths and street layout, 3) substantial compliance with the landscaping plan, and 4) substantial compliance with the elevations submitted for two buildings consisting of 4 townhomes each. Approval will allow the development of 8 multifamily dwellings in Stone Bridge Estates Part 10. \'1—'�3 (o Item 3e(3) Water Treatment Plant Supervisory Control and Data Acquisition (SCADA) Upgrade - Resolution setting a public hearing on August 1, 2017 on plans, specifications, form of contract, and estimate of cost for the construction of the Water Treatment Plant Supervisory Control and Data Acquisition (SCADA) Upgrade Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: The Water Treatment Plant SCADA Upgrade Project is the upgrade of computer and telemetry hardware to better monitor and control the treatment of Iowa City's drinking water production. The estimated project cost is $800,000 and will be funded from Water revenues. July 18, 2017 City of Iowa City Page 8 Item 3e(4) Utility Easement for Airport Hangar Project - Resolution of intent to consider the proposed conveyance of a utility easement on and over portions of the Iowa City Municipal Airport to accommodate construction of additional hangars and setting a public hearing on said proposal for August 1, 2017. Comment: MidAmerican Energy Company has requested that the City grant to it a utility easement across a portion of the Airport property to accommodate construction of new hangars there. The Airport Commission has approved of the construction of the hangars, and has requested that Council approve the utility easement. Council approval, following a public hearing, is needed to convey any permanent property right at the Airport. Item 3f. Comment: This project renovates the two lower level lobby restrooms into two accessible, single occupancy restrooms with entrance directly adjacent to the gym entrance and creates a lactation room. These changes eliminate the staff office located adjacent to the gym, necessitating a minor remodel to the administrative office area to accommodate an additional office upstairs. The stair railing and stair treads will be replaced, as the railings do not meet ADA standards. Solid Waste Code Amendments for Cardboard Ban - Ordinance Amending Title 16, Public Works, Chapter 3, City Utilities, Article H, Solid Waste, To Prohibit Landfilling of Corrugated Cardboard. (Second Consideration) Comment: This ordinance further advances waste minimization goals presented to City Council in June of 2016 by recommending the banning of corrugated cardboard from being landfilled. Poor Farm Water Well - Ordinance amending Title 16, "Public Works", Chapter 3, "City Utilities", Article C, "Potable Water Use and Service", Section 10, "Private Wells Restricted" to allow private wells to be installed by governmental entities within city limits if determined by the City to be in the public interest and to clarify that geothermal wells are not private water wells for purposes of this section of the City Code. (First Consideration) Comment: This ordinance will amend Section 16-3C-10 of the City Code that prohibits private water wells within City limits to allow governmental entities to install private water wells on property they own if the installation does not adversely affect City water and the City determines that it is in the public interest, and to clarify that geothermal wells are not private water wells for purposes of this section of the Code. American Legion Road and Barrington Road Speed Limits - Consider an ordinance amending Title 9, Entitled "Motor Vehicles and Traffic," Chapter 3, Entitled "Rules of the Road," Section 6, Entitled "Speed Restrictions," Subsection B, Entitled "Exceptions" to establish a maximum allowable speed of 35 mph on American Legion Road between the intersection of Scott Boulevard and Taft Avenue and amending Subsection C, Entitled "School Speed Zones" to establish a 20 mph school speed zone for Hoover Elementary School. (First Consideration) Comment: Iowa City Code defines the maximum speed limit on "American Legion Road" between Scott Boulevard and Taft Avenue as "45 mph. This action will reduce the maximum allowable speed to 35 mph in anticipation of the opening of the new Hoover Elementary in August 2017 and reflect the new design speed of American Legion Road when reconstructed in 2020. City Code also does not currently include a school speed zone for the new school. This action will also allow for the implementation of a 20 mph school speed zone adjacent to the new school. Art Work in Black Hawk - i Park - Resolution authorizing the City Manager to sign an agreement with Iowa City Downtown District for temporary placement of art work in Black Hawk Mini Park. Comment: In order to draw persons to the downtown, Iowa City Downtown District (ICDD) desires to place a piece of art in Black Hawk Mini Park until Oct. 31. The Iowa City Public Art Committee has approved proceeding with a Prairie Box design, a depiction of which is attached to the resolution. Aid to Agencies -Resolution allocating an services aid to agencies funding for FY18. Comment: The City Council annually budgets financial aid to human service agencies. The Housing and Community Development Commission (HCDC) reviewed and formulated a funding recommendation based on estimated allocations for these funds at their January 19, 2017 meeting. Minutes are attached to the CAR. Reductions in the final CDBG award required adjustments. All agencies received a 0.61 % decrease. The final recommendation is attached to the resolution as Exhibit A.
