Item 3d(3) City Hall Landscaping - Resolution accepting the work for
the City Hall Landscaping Project.
Comment: The project has been completed by Feldman Concrete of
Dyersville, Iowa, in substantial accordance with the plans and
specifications. The Engineer's Report and Performance and Payment
bonds are on file with the City Engineer.

Item 3d(4) Iowa City Landfill and Recycling Center Consulting
Services - Resolution approving, authorizing and directing
7- Q-ePg' the Mayor to execute and the City Clerk to attest
Amendment No. 3 to the November 12, 2013, Agreement
by and between the City of Iowa City and Barker Lemar
Engineering Consultants to provide engineering consultant
services for the Iowa City Landfill and Recycling Center.
Comment: This amendment to the November 12, 2013 agreement
authorizes Barker Lemar Engineering Consultants to provide additional
engineering services necessary for regulatory compliance including
expanded annual services, additional regulatory assistance, and a dual
extraction pumping system. The additional cost of engineering consultant
services is $154,755 for all three years. Funding will be provided by landfill
revenues.
Item 3d(5) Termination of agreement - Resolution approving
termination of agreement with ATI Properties, L.L.C.
Comment: In 1999, ATI Properties, L.L.C. and the City entered into an
agreement for the sole purpose of fulfilling a condition of a special
exception, namely a traffic barrier in the commercial parking lot at 1410
Waterfront Dr. With the recent vacation of a portion of Waterfront Dr., the
City's need for a traffic barrier no longer exists. The Board of Adjustment
on June 14 amended the earlier special exception by removing the
condition of a barrier. This resolution terminates the 1999 agreement.

MOU with Uofl for Water Storage Facility. Resolution
approving a Memorandum of Understanding with the
University of Iowa to share the expense of repairing the
potable water storage facility and parking ramp.
Comment: The City and University entered into a 28E Agreement in 1988
for the operation of a City -owned potable water storage facility located
within the University's parking ramp at 340 N. Madison St. In May the fill
valve on the storage facility failed causing the tank to overflow and resulting
in damage to the University's parking ramp. This resolution approves a
memorandum of understanding to share the costs for repairing the damage
without admission or assignment of liability. The estimated cost to the City
is $80,000 to $140,000.
Item 3d(7) Iowa Cancer Cure Project - Resolution approving a
/ ? —a 7 I Consent to Transfer, Waiver of Default, and Release of
Guaranty relating to a bond purchase agreement and
assignment, and related loan agreement regarding
Midwestern Disaster Area Revenue Bonds (Iowa Cancer
Cure Project) Series 2012.
Comment: In April 2012, the City sponsored a conduit bond issue for
$5,376,250 in Midwestern Disaster Area Revenue Bonds to finance the
cost of a medical office building for the Iowa City Cancer Treatment Center.
The City of Iowa City has been asked to retroactively consent to the sale of
the Iowa City Cancer Treatment Center medical practice to the University of
Iowa Health System. This resolution provides the City's retroactive consent
for the sale of the medical practice. See CAR in Council Packet.

hearing on amending the FY2018 Operating Budget.
Comment: This resolution sets a public hearing for September 5, 2017 to

Comment: At its July 31 meeting, by vote of 7-0 (Boyd, Builta, Kuenzli, and
Wagner absent), the Historic Preservation Commission recommended approval
of landmark designation. At its August 3 meeting, by a vote of 6-0 (Theobald

Item 5c Rezoning (Country Club Estates - Rohret Road west of
Lake Shore Drive) — Ordinance conditionally rezoning
approximately 21.77 acres of property located north of
Rohret Road and west of Lake Shore Drive, from Rural
Residential, RR -1, (4.16 acres) and Interim Development—
Single-Family Residential, ID -RS (17.61 acres) to Low -
Density Single -Family Residential, RS -5, zone.

Comment: At its June 15 meeting, by a vote of 6-0 (Martin absent), the
Planning and Zoning Commission recommended approval of this rezoning
subject to a Conditional Zoning Agreement requiring that the developer: 1)
reconstruct Rohret Road to the entrance to the subdivision, 2) contribute
50% of the cost of improving the remainder of the Rohret Road adjacent to
this property, and 3) complete a water pressure analysis and, if necessary,
design and construct the water system to include a booster pump to
provide adequate water pressure. Approval of this rezoning will allow this
property to be developed with approximately 80 single family residential
lots. The Commission also voted 6-0 (Martin absent) to recommend to the
City Council that improvement to the remainder of Rohret Road be added

Item 6. 2017 Sewer Rehabilitation - ResolutidA approving plans,
specifications, form of agreement, and estimate of cost for the
7 — a 7 construction of the 2017 Sewer Rehabilitation Project,
establishing amount of bid security to accompany each bid,
directing City Clerk to post notice to bidders, and fixing time and
place for receipt of bids.
Comment: This annual project involves lining the sanitary sewer and manholes at
various locations throughout Iowa City. The estimated cost for this project is
$335,000 and will be funded with Sewer Revenues.

Ordinance amending Title 9, entitled "Motor Vehicles and Traffic,"
q IM chapter 3, entitled "Rules of the Road," section 6, entitled "Speed
Restrictions," subsection C, entitled "School Speed Zones" to
establish a 20 mph school speed zone for Horace Mann
Elementary School effective for certain time periods. (Second
Consideration)
Comment: Iowa City Code Title 9-3-6(C) defines school speed zone limits and
does not include a zone for Horace Mann Elementary on Dodge Street. A
reference to "Dodge Street' from 350 feet north of Church Street to a point 250 feet
south of Church Street effective 7:25 AM to 8:10 AM and 2:40 PM to 3:25 PM
Monday, Tuesday, Wednesday, and Friday and 7:25 AM to 8:10 AM and 1:40 PM
to 2:25 PM on Thursday when school is in session should be added, which will
allow for the implementation of a 20 mph school speed zone for Horace Mann

Item 8. Alcohol in parks - Ordinance amending Title 4, entitled "Alcoholic
Beverages" and Title 10, entitled "Public Ways and Property," to
allow alcohol in park shelters. (Second Consideration)
Comment: The Code currently allows alcohol in City parks by a permit issued by the
City. This ordinance will allow alcohol in a park shelter with any park shelter
reservation. Possession of alcohol will be limited to the shelter itself, and only beer

Item 9. Small Cell Antennae in ROW - Ordinance amending Title 16,
17 entitled 'Public Works," Chapter 1, entitled "Streets, Sidewalks
and Public Right of Way," to establish a permit process for
placement of small cell antennae in the right of way. (Second
Consideration)
Comment: SF 431 passed this spring limits the ability of cities to prevent private
companies from placing their small antennae on poles in the right of way, including
on City traffic and light poles as well as installing new poles. These antennae are
used to provide cell service. This ordinance establishes a permitting process
consistent with the requirements of SF 431. Staff requests expeditedotion.

Comment: If the ordinance establishing a permit process for small wireless
facilities is adopted (see previous agenda item), then the permitting fees are to be
set by resolution. This resolution provides for an application fee, which is capped
by state law (SF 431).

compensation for fiscal year 2018 for the City manager and City
