Comment: Upon final platting Cardinal Pointe South, Part Three, Outlots E
and F were reserved for mailboxes and were to be owned and maintained
by the HOA. USPS elected not to utilize Outlots E and F for mailboxes, so
the developer now desires to convey Outlots E and F to the adjacent lot
owners free of this use restriction. It is in the public interest to amend the
subdivider's agreement and allow conveyance to private property owners to
better ensure that these outlots are properly maintained.

Acquisition (SCADA) Upgrade - Resolution awarding
contract and authorizing the Mayor to sign and the City
Clerk to attest a contract for construction of the Water
Treatment Plant Supervisory Control and Data Acquisition
(SCADA) Upgrade Project.
Comment: Bids for this project were opened on Thursday, August 23, 2017,
and the following bids were received:

Riverside Drive Pedestrian Tunnel and Myrtle Avenue
Intersection Improvements — Resolution authorizing the
acquisition of property interests necessary for construction
of the Riverside Drive Pedestrian Tunnel and Myrtle
Avenue Intersection Improvements Project.
Comment: The City of Iowa City must acquire right-of-way, fee title,
permanent easements and/or temporary construction easement to
construct the Riverside Drive Pedestrian Tunnel and Myrtle Avenue
Intersection Improvements Project. The project generally includes the
installation of sidewalk on the west side of Riverside Drive from the south
side of the Iowa Interstate Railroad to Myrtle Avenue, a pedestrian tunnel
under the Iowa Interstate Railroad and signalization of the Riverside Drive
and Myrtle Avenue Intersection. The project will be funded by General
Obligation bond proceeds.
Item 3d(7) Asphalt Resurfacing 2018 — Resolution authorizing the
acquisition of property interests necessary for construction
of the Asphalt Resurfacing 2018 Project.
Comment: The City of Iowa City must acquire right-of-way, fee title,
permanent easements and/or temporary construction easement to
construct the Asphalt Resurfacing 2018 Project. The project includes street
resurfacing, sidewalk replacement, curb ramp replacement, and storm
intake adjustment along Governor Street between Burlington Street and
Dodge Street, Burlington Street between VanBuren Street and Governor
Street, and Riverside Drive / US Highway 1 and US Highway 6 between
Rocky Shore Drive and Sturgis Corner Drive.

Item 3d(8) Landfill FY18 Cell Construction - Resolution approving,
authorizing and directing the Mayor to execute and the City
Clerk to attest an Agreement by and between the City of
Iowa City and Barker Lemar Engineering Consultants to
provide engineering consultant services for the Landfill
FY18 Cell Construction Project.

Comment: This agreement authorizes Barker Lemar Engineering
Consultants to provide design engineering and construction inspection
services related to the Landfill FY18 Cell Construction Project. The scope
of construction will include a new landfill cell in accordance with all State
and Federal regulations. The consultant services agreement is for
$206,070 and will be funded by Landfill revenues.
Personnel Policies Amendment - Resolution amending the
2017 Personnel Policies Employment of Relatives
provision to clarify that it shall be a violation of the policy
when a Management Conflict is created by the hire of an
external candidate.
Comment: An amendment to the Employment of Relatives Management
Conflict provision is necessary to the efficient operations of the City by
affording the City Manager the ability to promote or otherwise transfer
employment assignments of existing employees as not otherwise
prohibited.
ITEM 3e. Setting Public Hearings:
Item 3e(1) Dodge Street Court — Motion setting a public hearing for
September 19 on an ordinance rezoning 2.4 acres of
property from Medium Density Single -Family (RS -8) zone to
Planned Development Overlay- Medium Density Single -
Family Residential (OPD -8) zone located on Dodge Street
Court. (REZ17-00010/SUB17-00007).
Comment: At its August 17 meeting meeting, by a vote of 6-0 (Freerks
absent), the Planning and Zoning Commission recommended approval of
this rezoning subject to conditions regarding dedication of right-of-way on
Dodge Street Court and staff approval of stormwater drainage final building
designs. Approval will allow the development of 7 townhomes along the
Dodge Street Court frontage. Correspondence included in Council packet.

Item 3e(2) Alley north of City Hall — Motion setting a public hearing for
September 19 on a resolution vacating alley right of way in
Block 44, Original Town Plat.
Comment: It is anticipated the Planning and Zoning Commission will make a
recommendation at their September 7 meeting. With the pending
redevelopment of the north half of Block 44 north of City Hall, the alley right
of way is no longer necessary.
Item 3e(3) ROW adjacent to 2222 Old HWY 218 S — Motion setting a
public hearing for September 19 on a resolution vacating
right of way adjacent to 2222 Old Highway 218 South.
Comment: It is anticipated the Planning and Zoning Commission will make a
recommendation at their September 7 meeting. This right of way is not
improved to City standards, is only used for local access, and is not expected
to ever be necessary for general traffic circulation.
Item 3e(4) Sale of lot in the Industrial Park - Resolution setting a public
hearing for September 19, 2017 to approve a purchase
-a80f agreement with Alexander Lumber, Inc. for Lot 2 in the
Industrial Park and to consider a proposal to convey said
property.

Comment: This resolution sets a public hearing on the approval of a
purchase agreement with Alexander Lumber, Inc. that staff has negotiated
for the sale of Lot 2 (approximately 11.2 acres) for $589,495 contingent on
Council approval. The 4201h Street Industrial Park is a 173 -acre shovel ready
parcel for industrial use, which the City has been marketing since acquisition
in 2008. If approved, this will be the first sale in the industrial park.
Belt Filter Press Replacement - Resolution setting a public
hearing on September 19, 2017 on plans, specifications,
form of contract, and estimate of cost for the construction of
the City of Iowa City Belt Filter Press Replacement Project,
directing City Clerk to publish notice of said hearing, and
directing the City Engineer to place said plans on file for
public inspection.
Comment: This project includes removal and replacement of the sludge
dewatering equipment at the Wastewater Treatment Plant. The estimated
cost for this project is $1,790,000 and will be funded with Wastewater
Revenues.

50% of the cost of improving the remainder of the Rohret Road adjacent to
this property, and 3) complete a water pressure analysis and, if necessary,
design and construct the water system to include a booster pump to

Item 7. Alcohol in parks - Ordinance amending Title 4, entitled "Alcoholic
Beverages" and Title 10, entitled "Public Ways and Property," to
allow alcohol in park shelters. (Pass and Adopt)
Comment: The Code currently allows alcohol in City parks by a permit issued by
the City. This ordinance will allow alcohol in a park shelter with any park shelter
reservation. Possession of alcohol will be limited to the shelter itself, and only beer
and wine will be allowed. Staff requests indefinite deferral. Please see staff memo

Item 8. Under 21 Amendment for SHOUT - Ordinance amending Title 4,
Alcoholic Beverages, Chapter 5, Prohibitions and Restrictions,
Section 8, Persons Under the Legal Age in Licensed or
Permitted Establishments, Subsection C, referencing the City's
under 21 law, adding an exception for those working with a law
enforcement agency. (First Consideration)
Comment: This Amendment to the City's Under 21 ordinance will make clear that
e;eQi those working in conjunction with a law enforcement agency will be exempt. This
will accommodate those participating in the University's new Students Helping Out
("SHOUT") program, as well as those engaged in ride-alongs or compliance
checks.

Item 9. Unattended Vehicle Ordinance Amendment - Ordinance
amending Title 9, Motor Vehicles and Traffic, Chapter 3, Rules of
the Road, Section 9, General Driving Restrictions, Subsection C,
referencing unattended vehicles, to allow safely parked vehicles
with the motor running to be left unattended, matching State
code. (First Consideration)
Comment: The current City ordinance prohibits vehicles from being left unattended
unless their motor is turned off and the ignition keys removed. The growing
prevalence of remote start functionality, as well as keyless ignition, has rendered
those portions of this ordinance obsolete. For that reason, the State legislature
recently eliminated those requirements, while preserving the requirement that such
vehicles be safely secured. The ICPD wishes to mirror that change in our own law.

Item 10. Rent Abatement in Emergencies - Ordinance amending Title 17,
entitled "Building and Housing," Chapter 5, entitled "Housing
Code," to provide for the abatement of rent in emergencies.
(First Consideration)
Comment: The Code of Iowa grants municipalities the authority to abate rent if a
dwelling does not comply with the housing code. The City's Affordable Housing
Action Plan includes a provision to allow the City to order that rent be abated in an
S� emergency. This ordinance allows the City to order that rent be abated in certain
instances when the Housing Code violations pose a substantial risk to the health or

Item 11. Occupant transition plan — Ordinance amending Title 18, Site
Plan Review, to require notification to occupants and an
occupant transition plan for any additions or alterations to a
residential development with more than 12 residential units.
(First Consideration)
Comment: The Comprehensive Plan was recently amended to support mitigating
the impact of large-scale residential redevelopment on occupants of existing
residential structures. This ordinance will require and define occupant transition
U/ plans, which are to be approved by the City Council. See Council Action Report
for more detail.
