The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. Project Estimated Cost: $ 90,000.00 e Project Bid Received: $ 82,241.37 Project Actual Cost: $ 58,077.00 Item 4d(3) Burlington and Madison Intersection Improvements - Resolution approving, authorizing and directing the Mayor to )7-3)4 execute and the City Clerk to attest an Agreement by and between the City of Iowa City and Anderson -Bogert to provide engineering consultant services for the Burlington and Madison Intersection Improvements Project. Comment: This agreement authorizes Anderson -Bogert to prepare preliminary and final design, and provide bidding and construction phase services for the Burlington and Madison Intersection Improvements Project. The project includes traffic signal, pedestrian signal, ADA sidewalk, and public utility improvements. The project also includes the restriping of Madison Street to include a 4 -lane to 3 -lane conversion and bike lanes. The not to exceed amount is $142,129 and will be funded with TSIP and STP Grants and GO Bonds. Item 4d(4) Burlington Clinton Intersection Improvements - Resolution 17-315 approving, authorizing and directing the Mayor to execute and the City Clerk to attest Amendment No. 2 to the February 19, 2013, agreement by and between the City of Iowa City and Shive-Hattery, Inc. to provide engineering consultant services for the Burlington Clinton Intersection 5� Improvements Project. Comment: This amendment authorizes Shive-Hattery, Inc. to provide engineering services and revisions to the construction documents. This amendment cost is $11,500, which along with Amendment #1 will bring the total consultant service fees to $115,100. This project will be funded with General Obligation Bond, Water Revenue, and Traffic Safety Improvement Program (TSIP) Fund proceeds. October 3, 2017 City of Iowa City Page 4 Item 4d(5) Boat Storage Agreement with Johnson County - Resolution authorizing the Mayor to sign and City Clerk to attest Storage and Indemnification Agreement for 821 South Clinton Street, in which Johnson County will allow the storage of the Fire Department water rescue boat. Comment: This Resolution approves a storage agreement with Johnson County for the Iowa City Fire Department's use of a portion of the building at 821 S. Clinton St. for purposes of storing the FD's water rescue boat. The space is provided by Johnson County free of charge. The agreement continues until either party terminates with 14 days' notice. Item 4e. Setting Public Hearings: Item 4e(1) Cardinal Pointe West Part 2 — Motion setting a public hearing for October 17 on an ordinance conditionally rezoning 28.03 acres from Interim Development - Research Park (ID -RP) zone to High Density Single -Family Residential (RS -12) zone for 5.35 acres, Low Density Multifamily (RM -12) zone for 3.3 acres and Rural Residential (RR -1) zone for 19.38 acres for property located west of Camp Cardinal Road and south of Kennedy Parkway (REZ17-00014/SUB17-00015). Comment: At its September 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning subject to general compliance with the concept plan, limiting the width of a private drive, and staff approval of a landscaping plan. Approval will allow the development of Cardinal Pointe West Part 2, a residential subdivision with 9 single family lots, 6 duplex lots and one multifamily lot with 33 units. Item 4f. Comment: This proposed conveyance is in conjunction with the proposed vacation of the unimproved right of way adjacent to 2222 S Riverside Drive, the University Surplus building. Prohibit tobacco use in parks - Ordinance amending Title 6, entitled "Public Health and Safety," Chapter 10, entitled "Smoke Free Places," and Title 10, entitled "Public Ways and Property," to prohibit the use of tobacco including smokeless tobacco in all City parks. (Second Consideration) Comment: Currently it is illegal to smoke tobacco and use electronic cigarettes in some parks, and the use of chewing tobacco is not prohibited in any park. This ordinance prohibits smoking tobacco, chewing tobacco and using electronic cigarettes throughout all parks except inside a privately owned vehicle. This ep includes trails that traverse parks. Rent Abatement in Emergencies - Ordinance amending Title 17, �� If 13-7 entitled "Building and Housing," Chapter 5, entitled "Housing Code," to provide for the abatement of rent in emergencies. (Pass and Adopt) Comment: The Code of Iowa grants municipalities the authority to abate rent if a dwelling does not comply with the housing code. The City's Affordable Housing Action Plan includes a provision to allow the City to order that rent be abated in an emergency. This ordinance allows the City to order that rent be abated in certain instances when the Housing Code violations pose a substantial risk to the health or safety of the tenant and when the landlord fails to obtain a rental permit. Occupant transition plan — Ordinance amending Title 18, Site Plan Review, to require notification to occupants and an 7 - `f 7,-'-Y occupant transition plan for any additions or alterations to a residential development with more than 12 residential units. (Pass and Adopt) Comment: The Comprehensive Plan was recently amended to support mitigating the impact of large-scale residential redevelopment on occupants of existing residential structures. This ordinance will require and define occupant transition plans, which are to be approved by the City Council. See Council Action Report for more detail. Action: M SMS �rcrfort Item 10. Commitment of City funds for Low Income Housing Tax Credit proposal - Resolution committing $330,000 in FY2017 and FY2018 General Funds to the Del Ray Ridge LP application for 2018 Low Income Housing Tax Credit funds. Comment: A resolution committing $330,000 in City funds to the Del Ray Ridge LP application for 2018 Low Income Housing Tax Credit (LIHTC) funds. The proposed location, 628 South Dubuque Street, is located near public and private services and will provide twenty affordable rental units and eight market -rate units.
