Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Throgmorton
presiding. Council Members present: Botchway, Cole, Dickens, Mims, Taylor, Thomas,
Throgmorton. Staff members present: Fruin, Monroe, Andrew, Dilkes, Fruehling, Knoche,
Yapp, Hightshoe. UISG: Nelson, Stewart.
Mayor's statement regarding Las Vegas.
Student Leadership Awards for Robert Lucas Elementary students were postponed to
May 15.
The Mayor proclaimed: Domestic Violence Awareness Month - October, Kristie Doser,
accepting; Indigenous Peoples' Day - October 9, Tracy Peterson, Xiomara Santana,
Jessica Owens accepting.

Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 17-4726, conditionally rezoning 2.4 acres of property from
Medium Density Single -Family (RS -8) zone to Planned Development Overlay -
Medium Density Single -Family Residential (OPD -8) zone located on Dodge Street
Court (REZ17-00010/SUB17-00007), be voted on for final passage at this time. Moved
by Mims, seconded by Dickens, that the ordinance be finally adopted at this time. Moved
by Dickens, seconded by Botchway to accept correspondence from Jason Harder, Built to
Suit, Inc.
A public hearing was held on a resolution Authorizing Conveyance of a Portion of
Vacated Right -of -Way Adjacent to 2222 Old Highway 218 South to the State of Iowa. No
one appeared.
Moved by Botchway, seconded by Dickens, to adopt Res. 17-317, Authorizing
Conveyance of a Portion of Vacated Right -of -Way Adjacent to 2222 Old Highway
218 South to the State of Iowa.
Moved by Mims, seconded by Botchway, that the ordinance amending Title 6, entitled
"Public Health and Safety," Chapter 10, entitled "Smoke Free Places," and Title 10,
entitled 'Public Ways and Property," to prohibit the use of tobacco including smokeless
tobacco in all City parks, be given second vote. The Mayor declared the motion carried,

Moved by Botchway, seconded by Dickens, that Ord. 17-4727, amending Title 17,
entitled "Building and Housing," Chapter 5, entitled "Housing Code," to provide for
the abatement of rent in emergencies, be passed and adopted.
Moved by Mims, seconded by Botchway, that Ord. 17-4728, amending Title 18, Site
Plan Review, to require notification to occupants and an occupant transition plan
for any additions or alterations to a residential development with more than 12
residential units, be passed and adopted.
Moved by Mims, seconded by Botchway, to adopt Res. 17-318, committing $330,000
in FY2017 and FY2018 General Funds to the Del Ray Ridge LP application for 2018
Low Income Housing Tax Credit funds. Interim Neighborhood & Development
Services Director Hightshoe presented information. Marianne Dennis appeared.

Jefferson St. representative to fill a three-year term, July 1, 2016 — July 1, 2019 (New
District formed); Telecommunications Commission for a three-year term, July 1, 2017 —

Benjamin Nelson, UISG Liaison, appeared with UISG updates.
Mayor Pro tem Botchway gave dates in October for the Shelter House BBQ Bash on
October 13th and Out of Darkness, a walk for suicide prevention on October 15th.
Council member Thomas reported on the Neighborhood Council meet and greet that
he and Mayor Throgmorton attended at Lower City Park and his attendance at the
Johnson County Affordable Housing Coalition's annual meeting.
Council member Taylor reminded all about the fall employee luncheon on November
16th at Terry Trueblood park.
Council member Cole listed some of the items they have gone over at the
Sustainability conference he was currently attending in Dubuque.

Council member Dickens reported on his attendance at the Leslie Odom Jr concert at
Hancher. Dickens also announced that the U of I liaisons would be joining him during the
October 25th KXIC morning show.
Mayor Throgmorton mentioned a meeting with the City Manager and University of
Iowa President Harreld. The Mayor also made welcoming comments at the Iowa
Recycling and Solid Waste Conference, will be visiting with a kindergarten class at Lucas
Elementary and an ELL class at City High in addition to attending the Women's
Foundation luncheon on October 5th. He also stated that the Iowa Homecoming parade
was Friday, October 6th, that he and the City Manager would be meeting with Governor
Reynolds on October 9th, and mentioned the Joint Entities meeting on October 16th.
Assistant City Manager Monroe stated that the next Climate Action Steering
Committee meeting would be on November 2nd, Iowa City Public Library at 6:00 p.m.

Neighborhood Stabilization Update
City Manager Fruin gave a brief summary review on Neighborhood Stabilization and
House File 134. Fruin presented a Power point on the concept of a cap on rental
permits for single-family and duplex units within a defined impact area. Senior Housing
Inspector Laverman gave an overview of the recommendations for Housing Code
changes. Urban Planner Howard reviewed the recommendations for the Zoning Code
changes. Individual Council Members expressed their views.
Action: Staff noted the comments on the neighborhood stabilization memo and presentation
and will complete the final analysis and prepare the code revisions in the coming months.
Clarification of Agenda Items
• [Agenda Item 8]... Mixed Use Development - 314 S Clinton St ... Mayor Throgmorton
asked Council if they would consider deferring this item to ensure the public had an
opportunity to state their views before the vote. Individual Council Members expressed
their views and the majority chose to move forward on the item.

Summary Report) Council Member Taylor noted the impressive turnout at Uptown

approach to the Parks Master plan.
5. (IPS, Article from Mayor: From Mobility to Community Building: Rethinking the
Future of State DOTs — Project for Public Spaces) Council member Thomas
referred to the article and the sensitivity to context on the State designated streets
within the City.
6. (IP6, Memo from City Clerk: Listening Post Update) Mayor Thrdgmorton referred to
the memo and suggested Oaknoll for the next listening post site. Council agreed
and directed the City Clerk to work with Steve Roe at Oaknoll to schedule a date in
November.

passed be suspended, the second consideration and vote be waived, and that Ord. 17-
4725, amending Title 9, Motor Vehicles and Traffic, Chapter 3, Rules of the Road,
Section 9, General Driving Restrictions, Subsection C, referencing unattended
vehicles, to allow safely parked vehicles with the motor running to be left
unattended, matching State code, be voted on for final passage at this time. Moved
and seconded that the ordinance be finally adopted at this time.

waived, and that Ord. 17-4724, amending Title 4, Alcoholic Beverages, Chapter 5,
Prohibitions and Restrictions, Section 8, Persons Under the Legal Age in Licensed
or Permitted Establishments (SHOUT), Subsection C, referencing the City's under
21 law, adding an exception for those working with a law enforcement agency, be
voted on for final passage at this time. City Manager Fruin gave a brief explanation of the
ordinance. Council member Taylor thanked the City Manager and the Police Chief for the
memo containing additional information that was included in the packet. Moved by Mims,
seconded by Dickens, that the ordinance be finally adopted at this time.
Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 17-4725, amending Title 9, Motor Vehicles and Traffic, Chapter
3, Rules of the Road, Section 9, General Driving Restrictions, Subsection C,
referencing unattended vehicles, to allow safely parked vehicles with the motor
running to be left unattended, matching State code, be voted on for final passage at

authorizing and directing the Mayor to execute and the City Clerk to attest an
Agreement by and between the City of Iowa City and HR Green, Inc., to provide
engineering consultant services for the Idyllwild Drainage Diversion Project. Public
Works Director Knoche presented information. Kurt Kimmerling, President of the Idyllwild
Homeowners Association and Ivan Hall appeared. Individual Council members
expressed their views. City Manager Fruin made a statement regarding correspondence
received on the storm water management district.

Benjamin Nelson, UISG Liaison, appeared with UISG updates.
Council member Dickens reported on attending the ribbon cutting for the Frauenholtz
Miller park and a historic building meeting at the Englert which was well attended.
Dickens also mentioned Oktoberfest coming up on September 30th.
Mayor Pro tem Botchway noted a conference Sept 25th and 26th on trauma care at the
Radisson Hotel in Coralville. Botchway also stated he had been communicating with
residents on the Manville Heights neighborhood and they had requested pushing back
the work session on their item until December. Council asked if Botchway could follow up
to assure it was the majority of neighbors and not just one or two that wanted the item
delayed to December.
Council member Mims thanked City staff for the employee tailgate luncheon. Mims
also expressed her appreciation to the citizens in the Iowa City Community School District
who voted in favor of the bond and spoke about how it affects neighborhood stabilization
and economic development. Mims also mentioned the PBS showing which is a 10 -part
series, 'The Vietnam War', and reminded Council of the MPO meeting the following night.
Council member Thomas followed up on Council member Mims' comments regarding
the school bond vote.
Council member Taylor thanked and congratulated everyone involved in the World
Cup Cyclocross for having another successful event.
Council member Cole noted the respect he has for those who run for school board
because of the passion in the community regarding school board issues and the stress
they endure urging citizens to work with them.
Mayor Throgmorton mentioned attending Doug Boothroy's well-deserved retirement
reception. The Mayor also noted the upcoming Economic Development Committee

turnout for those who voted on the bond.
