Item 5d(3) Item 5d(4) 17-32-0 Item 5d(5) 17-3�;L1 RFX Park -DNR Grant - Resolution approving agreement with the Iowa Department of Natural Resources for a $157,300 grant from the Land and Water Conservation Fund for a Nature Play Area at Riverfront Crossings Park. Comment: The Land and Water Conservation grant program through the Iowa Department of Natural Resources provides federal assistance for the purpose of acquisition and/or development of land for outdoor recreation. Funds are provided in the form of 50% reimbursement grants through a competitive application process. The City has been awarded $157,300 for development of the nature play area in Riverfront Crossings Park. Terry Trueblood concession agreement - Resolution approving a two-year renewal of the concession agreement with Fin & Feather H2O LLC for Terry Trueblood Recreational Area. Comment: In 2012 the City and Fin & Feather H2O LLC ("Fin & Feather') signed a 3 -year agreement for the provision of rental equipment and food services at Terry Trueblood Recreational Area. The agreement provides for two, 2 -year renewals, and the City and Fin & Feather previously renewed it through Aug. 31, 2017. This resolution approves a second renewal through Aug. 31, 2019, on the same terms. Amending positions in the Parks and Recreation Department and the AFSCME pay plan - Resolution amending the budgeted positions in the Parks and Recreation Department and the AFSCME pay plan by deleting the full-time Office Coordinator - Recreation position and adding two full-time Maintenance Worker I - Forestry positions. Comment: The Parks & Recreation Department — Recreation Division has a vacant Office Coordinator position. After evaluating the needs of the Parks & Recreation Department it has been determined that the needs of the department can be better served by two new positions of Maintenance Worker I - Forestry. The financial impact of these changes in position classifications will result in a total annual increase to the Parks Maintenance Management budget of $2,057. October 17, 2017 City of Iowa City Page 4 Item 5d(6) Seventh Avenue Traffic Calming - Resolution authorizing the installation of radar feedback signs on Seventh Avenue, between Court Street and Glendale Road. Comment: The residents of Seventh Avenue, between Court Street and Glendale Road, have completed the City of Iowa City's Traffic Calming Program. A survey of neighbors yielded a 50% response rate. Twenty-eight households were surveyed; fourteen households responded. Of those households that responded, 71 % indicated their approval of the proposal to install radar feedback signs (10 of 14 neighbors in favor). Funding for the project is available in the annual traffic calming budget [CIP #S3816]. Item 5d(7) Outlot Dedication - Resolution Accepting the Dedication Outlots I and J, Lindemann Subdivision, Part Three, and 17 - 3a3 Outlots Q and R, Lindemann Subdivision, Part Five as Public Open Space. Comment: Pursuant to subdivider's agreements for these two subdivisions, the City agreed to accept these four outlots as public open space upon completion of the public improvements in the subdivisions, erosion control and ground cover established, and occupancy permits have been issued for all of the numbered lots adjacent to the outlots. Staff has determined that these conditions have been satisfied, and thus find acceptance of this dedication appropriate. Item 5d(8) Plan review software maintenance contract - Resolution / 3� authorizing the annual renewal of the maintenance contract for Avolve software Corporations services. Comment: The City entered into a contract with Avolve Software Corporation to provide plan review software and integrate it with our current permitting software. The $134,520 contract amount for the plan review software was within the $150,000 allowed by Council for the City Manager to approve. The contract states there is an annual maintenance contract renewal fee payable by the City. The cumulative contract amount and the annual contract renewal fee of $20,930 have exceeded the $150,000 allowed by the City Manager to approve. Annual maintenance is necessary for Avolve to continue to provide support — funds are available in the Building Inspection Division budget. October 17, 2017 City of Iowa City Page 5 Item 5d(9) 17-3aS Churchill Meadows Parts Two, Three and Four - Resolution accepting the work for the sanitary sewer, water main, storm sewer, drainageway, off-site sidewalk, temporary turnaround, and paving public improvements for Churchill Meadows Parts Two, Three, and Four, and declaring public improvements open for public access and use. Comment: This item will accept the public improvements for Churchill Meadows Parts Two, Three and Four generally located south of Herbert Hoover Highway and west of Taft Avenue. Item 5d(10)Ashton House Site Improvements REAP Grant 2016 - Resolution accepting the work for the Ashton House Site /7 -3 Improvements REAP Grant 2016 Project. Comment: The project has been completed by Carew Landscaping of Iowa City, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. :• Project Estimated Cost: $ 127,000.00 :• Project Bid Received: $ 132,722.25 :• Project Actual Cost: $ 136,097.25 Item 5e. Setting Public Hearings: Item 5e(1) Riverfront Crossing stepbacks and minimum building height — Motion setting a public hearing for November 6, 2017 on an ordinance amending Title 14, Chapter 2, Article G., Riverfront Crossings Form -based Development Standards, to allow minor adjustments to upper floor stepback requirements and the minimum building height standard. Comment: At its October 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of these zoning code amendments. Approval will allow administrative approval of adjustments or waivers of upper floor stepback requirements and minimum building height in certain circumstances. October 17, 2017 City of Iowa City Page 6 Item 5e(2) Regulation of sale of fireworks — Motion setting a public hearing for November 6, 2017 on an ordinance amending Title 14, Zoning, Chapter 4, Use Regulations and Article 14-2D, Industrial and Research Zones, to restrict sales of consumer fireworks to Industrial Zones. Comment: At its October 5 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this zoning code amendment. Approval will restrict sales of consumer fireworks to industrial zones. Item 5e(3) Burlington Clinton Street Intersection Improvements - Resolution setting a public hearing on November 6, 2017 J 7 -3a7 on plans, specifications, form of contract, and estimate of cost for the construction of the Burlington Clinton Street Intersection Improvements Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: This project includes the construction of new water main and ADA and sidewalk improvements along Clinton Street between Court Street and Burlington Street. It also includes the construction of new turn lanes and signal improvements at the Burlington and Clinton intersection and the restriping of Clinton Street to include a 4 -Lane to 3 -Lane conversion from Jefferson Street to Court Street and the addition of bike lanes from Church Street to Benton Street. The estimated cost of construction is $1,100,000 and will be funded with General Obligation Bond, Water Revenue, and Traffic Safety Improvement Program (TSIP) Fund proceeds. Item 5f. Item 7a Cardinal Pointe West Part 2 — Ordinance conditionally rezoning 28.03 acres from Interim Development - Research Park (ID -RP) zone to High Density Single -Family Residential (RS -12) zone for 5.35 acres, Low Density Multifamily (RM -12) zone for 3.3 acres and Rural Residential (RR -1) zone for 19.38 acres for property located west of Camp Cardinal Road and south of Kennedy Parkway (REZ17-00014/SUB17-00015). Comment: At its September 21 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning subject to general compliance with the concept plan, limiting the width of a private drive, and staff approval of a landscaping plan. October 17, 2017 Item 8 City of Iowa City Page 8 Prohibit tobacco use in parks - Ordinance amending Title 6, entitled "Public Health and Safety," Chapter 10, entitled "Smoke Free Places," and Title 10, entitled "Public Ways and Property," to prohibit the use of tobacco including smokeless tobacco in all City parks. (Pass and Adopt) Comment: Currently it is illegal to smoke tobacco and use electronic cigarettes in some parks, and the use of chewing tobacco is not prohibited in any park. This ordinance prohibits smoking tobacco, chewing tobacco and using electronic cigarettes throughout all parks except inside a privately owned vehicle. This includes trails that traverse parks. Riverfront Crossings Park, Phase 3 - Resolution approving, authorizing and directing the Mayor to execute and the City Clerk / - 3a� to attest an Agreement by and between the City of Iowa City and Confluence, Inc. to provide consultant services for the Riverfront Crossing Park, Phase 3 Project Comment: This resolution approves a contract with Confluence for design, bidding and construction management services for Phase 3 of Riverfront Crossings Park. Phase 3 includes two restroom/shelter buildings, park and trail lighting, park signage and Iowa River terrace and riverfront trails. The fee is $304,200. Item 10. Wastewater Treatment Facility Backup Generation and Electrical Distribution Upgrade - Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest an 7 - 3 a 9 agreement by and between the City of Iowa City and PRVN Consultants, Inc. to provide engineering consultant services for the Wastewater Treatment Facility Backup Generation and Electrical Distribution Upgrade Project 6e- ell Comment: This agreement authorizes PRVN Consultants to prepare preliminary design, final design, permitting, bidding and construction phase services for the Wastewater Treatment Facility Backup Generation and Electrical Distribution Upgrade Project. The project will upgrade the existing electrical distribution system and backup generation equipment necessary to meet current and future demands. The not to exceed amount is $205,275 and will be funded with Wastewater revenues. Action: fYA i n,4s / t y -dr tu-,� (A . 7 Workforce Housing Tax Credits - Resolution in support of the Dubuque & Prentiss Investments, LC Application for Workforce Housing Tax Incentives Program from the Iowa Economic Development Authority to construct residential housing at 225 E. Prentiss Street and committing local funds to the project. Comment: Dubuque & Prentiss Investments, LC is applying for Workforce Housing Tax Incentives from the Iowa Economic Development Authority to assist financing the construction of residential housing that will include up to 60 dwelling units. As part of its application, the developer needs a resolution by the local governmental subdivision supporting the application and committing at least $1,000 per dwelling unit to this project (up to $60,000 for 60 assisted housing units).
