WHEREAS, the Airport Commission of the City of Iowa City has
negotiated a lease agreement for Corporate Hangar No. 33, located
at the Iowa City Municipal Airport; and
WHEREAS, the Commission finds the proposed lease to be proper and
in the best interest of the Iowa City Municipal Airport; and,
WHEREAS, the term of the lease shall be from March 1, 1999, through
February 28, 2001 .
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE
CITY OF IOWA CITY:
1 . That the proposed hangar lease for Corporate Hangar No. 33, is
hereby approved.
2 . That the Chairperson is directed and authorized to execute and
the Secretary to attest to the corporate hangar lease between
the Airport Commission and John Ruyle.

RESOLUTION NO. R-099
RESOLUTION AUTHORIZING THE CHAIRPERSON TO SIGN AND THE
SECRETARY TO ATTEST A MAINTENANCE AGREEMENT BETWEEN THE IOWA
CITY AIRPORT COMMISSION AND MARKETING SYSTEMS
UNLIMITED CORPORATION
WHEREAS, the Airport Commission of the City of Iowa City, Iowa, and
Marketing Systems Unlimited Corporation (MSUC) have negotiated a
maintenance agreement for a parcel of Airport property, located in
the RPZ for Runway 24, as shown in Exhibit A of the lease; and,
WHEREAS, maintenance of the property by MSUC will be mutually
beneficial to the Airport and to MSUC; and,
WHEREAS, the term of the agreement is for one (1) year, from May 1,
1999 to April 30, 2000.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE
CITY OF IOWA CITY, IOWA, that the Chairperson is hereby authorized
to sign and the Secretary to attest said maintenance agreement with
Marketing Systems Unlimited Corporation.

RESOLUTION NO. 9-101
RESOLUTION DESIGNATING CERTAIN AIRPORT PROPERTY AS PERMANENT
GREEN SPACE.
WHEREAS, on December 1, 1998 the City of Iowa City acquired certain property from
Detlef Schellin as described in Attached Exhibit "A" through condemnation on behalf of the
Iowa City Airport as part of the implementation of the Iowa City Airport Master Plan; and
WHEREAS, for safety reasons it was in the public interest to acquire said property; and
WHEREAS, the Iowa City Airport Commission ("Commission") is responsible for the
management and control of Iowa City Airport property pursuant to Chapter 330, Code of
Iowa; and
WHEREAS, the Commission intends to construct a public road through a portion of the
property acquired from Detlef Schellin which is outside the runway protection zone for
Runway 24 as shown on the Preliminary Plat dated April 8, 1999 for the North Airport
Development; and
WHEREAS, it would be in the public interest for safety reasons to designate the property
acquired from Detlef Schellin which IS not used for roadway purposes as permanent green
space in order to protect existing and future runway approaches for Runway 24 and to
prevent any future obstructions, buildings where public assembly could occur, or other
incompatible land uses in or near the runway protection zone for Runway 24.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF
IOWA CITY, IOWA, that:
1. It is in the public interest for safety reasons to designate the property legally
described in Exhibit "A" which is not used for roadway purposes as
permanent green space in order to protect existing and future runway
approaches for Runway 24 and to prevent any future obstructions, buildings
where public assembly could occur, or other incompatible land uses in or near
the runway protection zone for Runway 24.
2. All property which is legally described in Exhibit "A" that is not used for
roadway purposes is hereby designated as permanent green space.

RESOLUTION NO. R-102
RESOLUTION AUTHORIZING THE CHAIRPERSON TO SIGN AND THE
SECRETARY TO ATTEST CONTRACT FOR RENOVATION OF THE AIRPORT
TERMINAL BUILDING, SUBJECT TO THE CITY COUNCIL OF IOWA CITY
AUTHORIZING FUNDING FOR SAID CONTRACT.
WHEREAS, it is the goal of the Iowa City Airport Commission to provide adequate aviation
facilities at the Iowa City Municipal Airport; and
WHEREAS, the proposed renovation of the Terminal Building is part of the 1996 Airport Master
Plan; and
WHEREAS, the Airport Commission and the City of Iowa City have a vested interest in providing
attractive and functional facilities that provide a gateway to the City of Iowa City; and
WHEREAS, renovation of the Terminal Building would be a capital asset to the Airport and the
City of Iowa City; and
WHEREAS, the following bids were received for construction of the above-named project:

NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF
IOWA CITY, IOWA, that:
1. Selzer Werderitsch Associates of Iowa City, Iowa has submitted the lowest responsible bid for
the base bid and alternates one (1) and two (2) in the amount of$536,600.00.
2. Subject to the City of Iowa City authorizing funding, the contract for the construction of the
above-named project is hereby awarded to Selzer Werderitsch Associates for the base bid
and alternates one (1) and two (2), subject to the condition that awardee secure adequate
performance and payment bond, insurance certificates, and contract compliance program
statements.
3. Subject to the City of Iowa City authorizing funding, the Chairperson is hereby authorized to
sign and the Secretary to attest the contract for the construction of the above-named project
for the base bid and alternates one (1) and two (2), subject to the condition that awardee

RESOLUTION NO. R-103
RESOLUTION AUTHORIZING THE CHAIRPERSON TO SIGN AND THE
SECTRETARY TO ATTEST A LEASE AGREEMENT BETWEEN THE IOWA CITY
AIRPORT COMMISSION AND IOWA CITY FLYING SERVICE, INC. FOR' THE
OLD UNITED HANGAR, THE OLD SHOP BUILDING, AND THE NEW SHOP
BUILDING
WHEREAS, the Iowa City Airport Commission has entered into a lease with Iowa City Flying
Service, Inc. (ICFS) for the new Southwest FBO Hangar, said lease becoming effective June
1, 1999; and
WHEREAS, the Southwest FBO Hangar lease supercedes the provisions of the October 7,
1982 lease between the parties regarding the old United hangar, the old shop building, and
the new shop building, including any obligations by the Airport to improve or maintain said
hangar and buildings; and
WHEREAS, the parties wish to enter into a new lease for the old United hangar, the old shop
building, and the new shop building.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF
IOWA CITY, IOWA, that:
1 . The attached lease between the Iowa City Airport Commission and Iowa City
Flying Service, Inc. for the old United hangar, the old shop building, and the
new shop building is hereby approved as to form and substance; and
2. Upon the direction of the City Attorney, the Chairperson is hereby authorized
to sign and the Secretary to attest said Lease.

IOWA CITY MUNICIPAL AIRPORT
OLD UNITED HANGAR, NEW SHOP BUILDING, AND OLD SHOP BUILDING LEASE
This agreement, is made and entered into this 13 day of May
1999, by and between the Iowa City Airport Commission, (hereinafter " Commission"),
whose address for the purpose of this lease is 1801 South Riverside Drive, Iowa City,
Iowa, 52246, and Iowa City Flying Service, Inc. (hereinafter "ICFS"), whose address for
the purpose of this lease is 1801 South Riverside Drive, Iowa City, Iowa, WITNESSETH
THAT:
1 . Property leased. In consideration of the mutual terms, agreements, and conditions
contained herein, the Commission agrees to lease unto ICFS the structures known
as the old United hangar, old shop building, and new shop building, as shown in
attached Exhibit A, which are situated at the Iowa City Municipal Airport in Iowa
City, Johnson County, Iowa.
2. Term. This lease shall be in effect beginning the 1s` day of June, 1999, and ending
the 31st day of December, 2001. Either party may terminate this lease in its
entirety or with respect to either the old shop building and new shop building or the
United hangar upon thirty (30) days written notice to the other party.
3. Rent. ICFS shall pay the Commission rent for the leased premises as follows:
$751.00 per month, in advance, payable on the 1st day of each month during the
term of this lease for the old shop building and new shop building; and $394.00
per month, in advance, payable on the 1st day of each month during the term of
this lease for the old United hangar. Payment received after the 15th day of each
month shall draw interest at 9% per annum from the date due, until paid.
ICFS shall be responsible for property taxes, if any, on the leased premises and
improvements thereon. ICFS acknowledges that the Commission does not and
cannot make any representation as to whether real estate taxes will be assessed
against the leased property or improvements thereon.
4. Possession. ICFS shall be entitled to possession on the first day of the term of this
lease, and shall yield possession to the Commission at the time and date of the
close of this lease, except as herein provided. Should the Commission be unable to
give possession on said date, ICFS's only damages shall be a rebating of the pro
rata rental.
5. Non-exclusive right. It is agreed that nothing herein contained shall be construed to
grant or to authorize the granting of an exclusive right prohibited by Section 308 of
the Federal Aviation Act of 1958, as amended, and the Commission reserves the
right to grant to others the privilege and right of conducting any activity of an
aeronautical nature or otherwise.

6. Use of premises.
A. ICFS shall not use the leased property and shall not permit the use of the
leased property for any purpose without a valid fixed base operator's lease or
commercial lease with the Commission or without the prior written approval
of the Commission.
B. ICFS shall not use or permit the premises to be used for any unlawful
purpose. ICES shall comply with all local, state and federal codes, including
but not limited to the Iowa Department of Transportation and Federal
Aviation Administration rules and regulations. Vehicle and equipment parking
shall be limited to approved hard-surfaced areas and access to other areas of
the Airport shall not be obstructed.
C. Any improvements to the leased property shall become the property of the
Iowa City Municipal Airport upon the expiration or termination of this lease.
The Commission shall have the right to insure its interest in any such
improvements.
7. Rules and Regulations. ICFS agrees that the Commission has the right to adopt
and enforce reasonable rules and regulations and that ICFS and all its employees,
agents and servants will faithfully observe and comply will all rules and regulations
as may be adopted by the Commission, City of Iowa City, the State of Iowa, or the
United States of America.
8. Reasonable care of property. ICFS shall not permit or allow any portion of the
premises to be damaged by any negligent act or omission of ICFS or its employees,
and ICFS agrees to surrender the premises at the expiration of this agreement in as
good condition as at the commencement of this agreement, normal wear and tear
excepted. ICFS agrees to give the Commission free access to inspect the premises
at all reasonable times.
9. Utilities. ICFS shall provide and pay for heat and utilities used on and within the
old shop building and new shop building, including, but not limited to, gas and
electricity. The Commission shall provide and pay for electricity to the old United
hangar.
10. Commission control. The Commission reserves the right, but shall not be obligated
to ICFS, to maintain and keep in repair the landing area of the Airport and publicly
owned facilities of the Airport, together with the right to direct and control all
activities of ICFS in this regard.
The Commission further reserves the right to take any action it considers necessary
to protect the aerial approaches of the Airport against obstructions, together with
the right to prevent ICFS from erecting, or permitting to be erected, any building or
other structure on the Airport, which in the opinion of the Commission, would limit
the usefulness of the Airport or constitute a hazard to aircraft or violate any local,
state, or federal law or regulation.

ICFS shall not act as an agent or represent itself as an agent for the Commission in
any matter, including those between the Federal Aviation Administration and the
Commission.
11 . Commission improvements. The Commission reserves the right to further develop
or improve the landing area and all publicly owned aviation facilities of the Airport
as it sees fit, without interference or hindrance from ICFS. However, if the Airport,
in its entirety, is closed, or all runways at the Airport are closed, for a period of five
(5) days or more, there shall be no rent due from ICFS, for a period beginning on
the fifth (5th) day until a runway is open again.
12. Default of lease. If there be any default in the payment of rent as stated in this
agreement, or if ICFS shall break any of the covenants and agreements contained
herein, or shall willfully or maliciously do injury to the premises or shall file a
petition in bankruptcy or have an involuntary petition in bankruptcy filed against it
or seek any other relief from creditors through a court of bankruptcy or make an
assignment for the benefit of creditors, the Commission shall have the right at any
time thereafter, without notice, to declare the tenancy in default and declare the
lease be terminated. The Commission may expel ICFS, using whatever force is
necessary, without prejudice to any remedies which the Commission may have for
arrears for rent; and it is agreed that upon the occurrence of any default by ICFS
under this lease, the Commission shall have the right to distrain for rent and shall
have a valid and first lien upon any equipment located upon said premises as
security for the payment of the rent and other obligations herein provided for. ICFS
agrees that after any default, it will not remove from the premises any of it's
equipment, books of account or possessions until the accounts of the Commission
and ICFS under this lease have been finally and completely settled.
13. Lessee's Property. Subject to Paragraph 13 hereof, ICFS shall have the right to
remove from the demised premises all unattached machinery, apparatus, and
equipment installed therein, excepting that such right of removal shall not apply to
any machinery, apparatus, or equipment owned or paid for in whole or in part by the
Commission, Iowa City Airport, or City of Iowa City and provided that all such
machinery, apparatus, and equipment shall be removed at the date of the
termination of this lease and provided further that ICFS shall restore and repair any
damage to the demised premises caused by the removal of such machinery,
apparatus, and equipment.
14. Advertising. ICFS agrees that no signs or advertising material shall be placed or
erected upon the leased premises without the prior written consent of the
Commission. All signs and advertising material shall be well maintained and in a
readable condition. Any such sign or advertising material that is determined by the
Commission or City of Iowa City not to be in conformance with the City of Iowa
City sign ordinances shall be removed upon receipt of written notice.

15. Official notices. Notices to the Commission as herein provided shall be sufficient if
sent by certified mail, postage prepaid, to the Airport Manager, Iowa City Municipal
Airport, 1801 South Riverside Drive, Iowa City, Iowa, 52246.
ICFS shall give the Commission notice when:
a. There is any abandonment or expected abandonment of any of the leased
buildings or premises.
b. When there is or is expected any breakdown in services or reduction or
increase of services.
c. When there is a change in the use of the leased premises or a planned or
anticipated change in the use of the leased premises.
d. When any condition exists that may lead to major maintenance and repair of
Lessor owned facilities and equipment.
e. Any event in which the Airport may be subjected to a major loss, accident,
investigation, or need of representation by a City official.
Notice to ICFS shall be sufficient if sent by certified mail, postage prepaid, to: 1801
South Riverside Drive, Iowa City, Iowa.
16. Non-discrimination. ICFS covenants, in consideration of the right to lease property
at the Iowa City Municipal Airport, that ICFS, its employees, and agents, shall not
discriminate against any person in employment or public accommodation because
of race, religion, color, creed, gender identity, sex, national origin, sexual
orientation, mental or physical disability, martial status, or age. "Employment"
shall include but not be limited to hiring, accepting, registering, classifying,
upgrading, or referring to employment. "Public accommodation" shall include but
not be limited to providing goods, services, facilities, privileges and advantages to
the public. ICFS shall remain in compliance with all requirements of 49 CFR Part
21 , Non-Discrimination in Federally Assisted Programs of the Department of
Transportation.
17. Assignment or Transfer. ICFS shall not assign or transfer this lease, or any interest
herein, or sublet the premises or any part thereof without the prior written consent
of the Commission.
18. Changes to be in writing. This agreement shall not be modified, waived, or
abandoned except in writing duly executed by both parties. This agreement
contains the whole agreement of the parties, and is not assignable by either party
without the written consent of the other.
19. Severability. In the event any portion of this lease is found invalid, the remaining,
portions shall be deemed severable and shall remain in full force and effect.

20. Indemnification. To the fullest extent permitted by law, ICFS shall indemnify and
hold harmless the City of Iowa City, the Iowa City Airport Commission, its agents,
servants, and employees against all claims, demands, and judgments, including
attorney's fees, made or recovered against the City for damages to real or tangible
personal property, or for personal injury, bodily injury, or death to any person arising
out of, or in connection with, any acts or omissions or use or misuse of the leased
premises by ICFS, its agents, or sublessees, or any one directly or indirectly
employed by any one of them.
21 . Grant assurances. This agreement shall be subordinate to the provisions of any
outstanding or future agreement between the Commission and the United States
government or the Commission and the State of Iowa relative to the maintenance,
operation, or development of the Iowa City Municipal Airport. ICFS acknowledges
and agrees that the rights granted to ICFS in this agreement will not be exercised
so as to interfere with or adversely affect the use, operation, maintenance or
development of the Airport.
22. National emergency. During time of war or national emergency, the Commission
shall have the right to enter into an agreement with the United States government
for military use of part or all of the landing area, the publicly owned air navigation
facilities and/or other areas or facilities of the airport. If any such agreement is
executed, the provisions of this instrument insofar as they are inconsistent with the
provisions of the agreement with the government, shall be suspended. Any fees
associated with such suspension shall also be suspended during the time period of
the above described emergency.
This agreement shall extend to and be binding upon the heirs, executors, administrators,
trustees, successors, receivers, and assigns of the parties hereto.

WHEREAS, the Airport Commission of the City of Iowa City, Iowa, and the
United States Army Reserve (USAR) , have negotiated a lease agreement for
a 24, 600 square foot parcel of Airport property, located west of the
Army Reserve Center on Airport property, as shown in Exhibit A of the
lease, attached hereto and incorporated by reference; and,
WHEREAS, the term of the lease is for three (3) years, from August 15,
1999,to August 14, 2002, with an annual rental fee of $ 1845.00.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF
IOWA CITY, IOWA, that the Chairperson is hereby authorized to sign and
the Secretary to attest said lease agreement with the United States Army
Reserve.

WHEREAS, it is the intent of the Iowa City Airport Commission to provide
a safe environment for the aviation and public users of the Iowa City
Municipal Airport; and
WHEREAS, the safety markings on the rotating beacon tower are in need of
repainting; and
WHEREAS, the Iowa Department of Transportation has agreed to fund a
portion of the $24, 000.00 project.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF
IOWA CITY, IOWA, that the Chairperson is hereby authorized to sign and
the Secretary to attest to a grant agreement with the Iowa Department of

Whereas, it is the intent of the Iowa City Airport Commission
(Commission) to develop a parcel of property known as the North
Commercial area (NCA) ; and,
Whereas, the property was originally appraised by East Iowa Commercial
Real Estate Appraisers (EICREA) ; and,
Whereas, now that the parcel has been divided into lots, the Commission
would like to have the appraisal updated; and,
Whereas, the Commission and EICREA have negotiated an agreement to
update the appraisal for a fee of $150.00 per hour, with a total amount
not to exceed $ 1200. 00.

aircraft at the Iowa City Municipal Airport; and,
WHEREAS, numerous changes have occurred since the approval of the
1996 Airport Master Plan; and,
WHEREAS, it is the intent of the Airport Commission to provide the
Iowa Department of Transportation and the Federal Aviation
Administration with an Airport Layout Plan that reflects the changes
made while implementing the 1996 Master Plan, and,
WHEREAS, through an interview process, Snyder and Associates were
selected to provide the consulting services to update the Airport
Master Plan and narrative.
NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY
OF IOWA CITY, IOWA, that the Chairperson is hereby authorized to sign
and the Secretary to attest to a resolution authorizing the Airport

52' X 230' HANGAR BUILDING LOCATED AT THE IOWA CITY
MUNICIPAL AIRPORT.
WHEREAS, it is the intent of the Iowa City Airport Commission to
attract and accommodate corporate, business, and personal use
aircraft at the Iowa City Municipal Airport; and,
WHEREAS, the proposed hangar is part of the 1996 Airport Master Plan;
and,
WHEREAS, the Airport Commission has commitments to lease all of the
hangars in the building, and,
WHEREAS, additional hangar space would be a capital asset to the
Airport by increasing revenue for the Airport Commission and
increasing the number of based aircraft at the Iowa City Municipal
Airport; and,
WHEREAS, the cost of the project would be financed through an
internal departmental loan, to be repaid through hangar rental fees .
WHEREAS, the following bids were received:

OF IOWA CITY, IOWA, that the Chairperson is hereby authorized to sign
and the Secretary to attest to a resolution authorizing the Airport
Commission to:
a. Accept the bid from Selzer Werderitsch Construction in the amount
of $ 305, 430. 00.
b. Authorize the Airport Manager and Assistant City Attorney to
negotiate a construction contract with Selzer Werderitsch
Construction for the amount listed above, after approval of funding
is received from the Iowa City Council.
c. Authorize a "Notice to Proceed" for construction of Building "K",
a nine unit T-hangar building at the Iowa City Municipal Airport as
soon as the signed contract is received from Selzer Werderitsch
Construction.
