August 2, 1990, Transit Facility Conference Room
The meeting was called to order at 12:13 P.M.
Present were Commissioners Blum, Foster, Hamilton, Hicks and Ockenfels.
Also present was Asst. City Atty Hennesey, and E.K. Jones, representing
the Iowa City Flying Service (ICFS)
The only agenda item was the discussion and action relating to the fuel
tanks at the airport.
Blum and Ockenfels presented a report of the findings and recommendations
of the sub -committee. Blum indicated that their preference was to replace
the tanks with two new tanks, provided that ICFS would agree to lease the
new tanks. It had been thought that an agreement had been worked out with
Mr. Jones to that effect, but a letter from Mr. Barker, Atty for ICFS,
appeared to rule out that option.
Mr. Jones joined in the discussion, and re -opened the possibility of a
lease agreement.
City Atty Gentry arrived at 12:20.
The discussion continued, exploring various options. The discussion also
included aspects of the fuel flowage rates, and the current provisions for
those rates under the present lease between the Commission and ICFS. It
was estimated by Jones and Blum that current annual usage is approximately
210,000 gallons of aviation gasoline and jet fuel, combined.
Mr. Jones reported that the results of tests which ICFS had made on the
monitor wells had shown no contamination levels in excess of or even close
to permitted levels, and that the tests confirmed that there were no
leaking tanks.
It was moved by Hamiliton and seconded by Hicks, to recommend to the City
Council, the following:
1. That two new 10,000 gal, fuel tanks be installed, and after they are
in operation, close down the old tanks, and remove them.
2. That this action be taken, contingent on the completion of an
amendment to the lease with ICFS that would include the new tanks in
the leasehold, with lease rates based upon usage, subject to the
negotiation process spelled out in the existing lease, but not to be
less than $.05 per gallon on gross usage. A second contingency is an
increase in the fuel flowage fee from $.02 to $.05, in accordance with
the existing lease terms.
The motion carried 5-0, with Mr. Jones adding that if he could vote, it
would be 6-0.
It was further agreed that the cost of removing the old tanks and any
resulting cleanup costs would be a shared responsibility of the Commission
and ICFS. Ockenfels indicated that he had information re disposal of any

contaminated earth that might be found, by spreading it on airport
property, thus saving considerable cost
Mr. Jones also stated that he thought that the first choice for the up-
grading of tanks should be re -lining. Gentry responded that the Commission
had spent considerable time studying the issue and had ruled out this
option, for various reasons, and as the policy making body, that decision
was the duty and responsibility of the Commission to make. She suggested
that Mr. Jones could attempt to convince the City Council if he wished.
A motion to adjourn was approved by unanimous consent at 1:20PM.
