Officer Schwindt from the Iowa City Police Department presented information. Council member Mims and City Manager Fruin added additional information and congratulated Officer Schwindt on his new position. Adil Adams appeared regarding Mazahir Salih's elected appointment to City Council. Brandon Ross appeared regarding the tax cut proposal. Moved by Botchway, seconded by Dickens to accept correspondence from Adil Adams. A public hearing was held on an ordinance conditionally rezoning approximately 21.79 acre of property from Interim Development Multifamily (ID -RM) zone to Low Density Multifamily Residential (RM -12) zone located north and south of the intersection of South Gilbert Street and McCollister Boulevard (Preserve at Sandhill) (REZ17-00001). The Mayor requested Council members disclose any ex parte communications and none were reported. Moved by Mims, seconded by Botchway, to continue public hearing to December 5 and defer first consideration to December 5, ordinance conditionally rezoning approximately 21.79 acre of property from Interim Development Multifamily (ID -RM) zone Complete Description November 21, 2017 Page 3 to Low Density Multifamily Residential (RM -12) zone located north and south of the intersection of South Gilbert Street and McCollister Boulevard (Preserve at Sandhill) (REZ17-00001). Break (9:13 pm) Moved by Dickens, seconded by Mims, that Ord. 17-4730 conditionally rezoning 28.03 acres from Interim Development - Research Park (ID -RP) zone to High Density Single -Family Residential (RS -12) zone for 5.35 acres, Low Density Multifamily (RM -12) zone for 3.3 acres and Rural Residential (RR -1) zone for 19.38 acres for property (Cardinal Pointe West Part 2) located west of Camp Cardinal Road and south of Kennedy Parkway (REZ17-00014/SUB17-00015), be passed and adopted. The Mayor requested Council members disclose any ex parte communications and none were reported. Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 17-4731, amending Title 14, Chapter 2, Article G., Riverfront Crossings Form -based Development Standards, to allow minor adjustments to upper floor stepback requirements and the minimum building height standard, be voted on for final passage at this time. Moved by Mims, seconded by Dickens, that the ordinance be finally adopted at this time. Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 17-4732, amending Title 14, Zoning, Chapter 4, Use Regulations and Article 14-211), Industrial and Research Zones, to restrict sales of consumer fireworks to Industrial Zones, be voted on for final passage at this time. Moved by Mims, seconded by Dickens, that the ordinance be finally adopted at this time. A public hearing was held on a resolution approving plans, specifications, form of agreement, and estimate of cost for the construction of the City of Iowa City Building Automation Upgrades and Improvement Projects 2017, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. No one appeared. Moved by Botchway, seconded by Thomas, to adopt Res. 17-349, approving plans, specifications, form of agreement, and estimate of cost for the construction of the City of Iowa City Building Automation Upgrades and Improvement Projects 2017, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. Public input was received on resolution adopting City of Iowa City Tax Increment Financing (TIF) Policies: Economic Development Coordinator Ford stated an overview was given at the November 6m meeting. Ryan Sempf, Karen Kubby, Rod Sullivan, Caroline Dieterle, Anthony Marlow, Sara Barron, Martha Norbeck appeared. Moved by Thomas, seconded by Botchway, to adopt Res. 17-350, adopting City of Iowa City Tax Increment Financing (TIF) Policies. Mayor Throgmorton proposed two amendments. Moved by Cole, seconded by Taylor, to amend the resolution adding a sentence to Sustainability to read, "New residential projects shall be certified silver under the National Green Building Standard, or the LEED Green Building rating system, appropriate to the building type." And adding three words to Further "for LEED projects", at least 8 points... The second amendment on page 2 of the policies to insert after the Form- Complete Description November 21, 2017 Page 4 Based Code "or urban design plan" is adopted. Mayor Pro tem Botchway proposed an additional three amendments which were discussed. Individual Council members expressed their views. A majority of Council agreed to Mayor Throgmorton's first two amendments and Mayor Pro tem Botchway's proposed amendment to change "social justice' to "economic justice". The Mayor declared the resolution adopted as amended, 4/3, with the following division of roll call vote: Ayes: Taylor, Thomas, Throgmorton, Cole. Nays: Dickens, Mims, Botchway. Moved by Mims, seconded by Botchway, to accept correspondence from Martha Norbeck (x2), G.T, Karr, Matt Krieger, Kim Casko (x2), Ryan Sempf, Bill Gerhard, Karyl Bohnsack, Nancy Bird, Tim Weitzel, Laura Roth, Anthony Marlowe. Moved by Mims, seconded by Botchway, that the ordinance amending Title 17, entitled "Building And Housing," Chapter 5, entitled "Housing Code," to establish a rental permit cap and to strengthen the minimum requirements for rental housing, be given first vote. Urban Planner Howard presented a power point. Chris Warnock, Sue Mellecker, Cecile Gunsley, Austin Wu, Benjamin Nelson, Gustave Stewart, Hunter Gillaspie, Mike McLaughlin, Nancy Carlson, Regenia Bailey, Riley Lewers, Mike Oliveria, and Chris Villhauer appeared. Individual Council members expressed their views. All Council members agreed to amend the ordinance, changing the rental permit cap from 35% to 30%. Moved by Botchway, seconded by Dickens, to accept correspondence from Ann Freeks, Cheryl Cruise, Reuben Grandon, David Ginger, R. Michael Hayes. Moved by Mims, seconded by Dickens, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 17-4733, amending Title 10, entitled "Public Ways And Property," Chapter 5, entitled "City Plaza," to allow an association of downtown businesses to place a commercial structure on City Plaza under limited circumstances, be voted on for final passage at this time. Moved by Mims, seconded by Dickens, that the ordinance be finally adopted at this time. Moved by Mims, seconded by Botchway, to adopt Res. 17-351, approving settlement of imminent litigation. The Mayor stated that the following Council Appointments to Boards and Commissions would be deferred to December 5 meeting: Airport Zoning Brd. of Adjustment for an unexpired term, upon appointment - December 31, 2018 (Formerly advertised); Airport Zoning Brd. of Adjustment for an unexpired term, upon appointment - December 31, 2020; Airport Zoning Commission for an unexpired term, upon appointment — December 31, 2021; Board of Adjustment for a five-year term, January 1, 2018 - January 1, 2023; Board of Appeals for two vacancies for a five-year term, January 1, 2018 - December 31, 2022 one vacancy for a Licensed Plumber and HBA Rep. or qualified by experience and training; Historic Preservation Commission for a Jefferson St. representative to fill a three-year term, July 1, 2016 — July 1, 2019 (New District formed); the Human Rights Commission for three vacancies for three-year terms, January 1, 2018 - January 1, 2021; Parks and Recreation Commission for two vacancies for four-year terms, January 1, 2018 - January 1, 2022; Public Art Advisory Committee for two three- year term, January 1, 2018 - January 1, 2021 one vacancy for an Art Design Professional; Senior Center Commission for two vacancies for three-year terms, January 1, 2018 — December 31, 2020; Telecommunications Commission for a three-year term, July 1, 2017 — July 1, 2020. Applicants MUST reside in Iowa City and be 18 years of age unless specific qualifications are stated. Gustave Stewart, UISG Liaison Alternate, appeared with UISG updates. Council member Taylor reported that the Council Listening Post held at Oaknoll was well attended. Mayor Pro tem Botchway mentioned Dave Ricketts retirement, attending the Iowa City Federation of Labor meeting, and saying a few words at the Armistice Day observance at the Pentacrest. Botchway also attended the Willowind solar panel ribbon cutting and stated he attended a presentation by the Executive Director of the Cedar Rapids Airport regarding the "buy local" approach. Council member Mims informed the Council of a work session with the County Board of Supervisors and the Steering Committee and Governance Committees for the access center that was held. Mayor Throgmorton noted his attendance at the National League of Cities summit in Charlotte, NC and the Mayor's Institute on City Design event in Indianapolis, IN. The Mayor also congratulated Mims and Botchway on their re -elections and congratulated Salih on her victory. Moved by Mims, seconded by Botchway, to adjourn regular meeting at 12:08 a.m. Jamep. Council member Mims reported on attending the Human Rights breakfast, the ped mall design meeting at the Sheraton, and the Climate Action Committee meeting. Mayor Pro tem Botchway mentioned the upcoming MSEI Second Annual Leadership Conference (Mediation Services of Eastern Iowa) on 11/10, the Armistice Day observance on the Pentacrest on 11/11, and Creative Jellies open mic night on 11/12. Council member Cole announced he would be attending the Iowa vs. Wisconsin game. Council member Taylor stated she and Botchway would be attending the Council Listening Post at Oaknoll on Wednesday, November 15th. Taylor also gave a reminder that the City was observing Veterans Day on Friday 11/10 and to be aware of office and some service closures, and the City employee lunch on 11/16 at Terry Trueblood. Mayor Throgmorton informed the Council of a meeting with three members of the Climate Action Steering Committee and a visitor from India who works for a climate action organization called C40. The Mayor also participated in a re-entry parole simulation sponsored by Inside Out and a tour of the City's water plant.
