Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Throgmorton
presiding. Council members present: Botchway, Cole, Dickens, Mims, Thomas,
Throgmorton. Absent: Taylor. Staff members present: Fruin, Monroe, Dilkes, Fruehling,
Miklo, Howard, Seydell-Johnson, Eckhardt, Havel, Laverman. UISG: Nelson, Stewart.
The Mayor presented Student Leadership Awards to Hom Elementary students:
Ben Morrilly, Piyush Pydipalli.
A Special Presentation by Parks and Recreation Director Seydell-Johnson and
Aquatic Supervisor Eckhardt, to recognize Gary Wafts for his fundraising efforts by
hosting a 24-hour swim in May of 2016 and matching the funds to raise money for
swimming lesson scholarships for Iowa City youth.
The Mayor presented a Student Leadership Award to Hom Elementary student:

Moved by Mims, seconded by Botchway, to adopt Res. 17-360, calling on the United
States Congress to pass a Revenue Neutral Carbon Fee and Dividend Program.
James McCoy and Eric Johnson appeared. Individual Council members expressed their
opinions.
Ginalie Swaim, Chair of the Iowa City Historic Preservation Commission, appeared
regarding item IP4 in the 11/30/17 Information Packet — Saving Iowa City's Oldest House,
109 E. Market Street.
A public hearing was held on an ordinance conditionally rezoning approximately 21.79
acre of property from Interim Development Multifamily (ID -RM) zone to Low Density
Multifamily Residential (RM -12) zone located north and south of the intersection of South
Gilbert Street and McCollister Boulevard [Preserve at Sandhill] (REZ17-00001). The
Mayor requested Council members disclose any ex parte communications and none were
reported. No one appeared.
Moved by Thomas, seconded by Mims, that the ordinance conditionally rezoning

permit cap and to strengthen the minimum requirements for rental housing, be given
second vote. Individual Council members expressed their views.
Moved by Mims, seconded by Botchway, to make the following appointments to
Boards and Commissions: appoint Ryan Hall, 200 S. Summit St., to the Board of
Adjustment for a five-year term, January 1, 2018 - January 1, 2023; The Mayor declared
the motion approved, 5/0/1/1, with the following division of roll call vote. Ayes: Botchway,
Dickens, Mims, Thomas, Throgmorton. Nays: None. Abstain: Cole. Absent: Taylor.
Moved by Mims, seconded by Dickens, to make the following appointments to Boards
and Commissions: reappoint Andrea French, 531 S. 15t Ave., to the Board of Appeals for
a five-year term, January 1, 2018 - December 31, 2022, for a Licensed Plumber.
Moved by Mims, seconded by Dickens, to make the following appointments to Boards
and Commissions: appoint Arianna Aron1227 2nd Ave., Cathy McGinnis 1628 Burns
Ave., Jonathon Munoz 330 Cayman St., to the Human Rights Commission for three
vacancies to fill three-year terms, January 1, 2018 - January 1, 2021.
Moved by Dickens, seconded by Thomas, to defer the appointments for, two Parks
and Recreation Commission vacancies for four-year terms, January 1, 2018 - January 1,
2022, to December 19, 2017.
Moved by Dickens, seconded by Mims, to make the following appointments to Boards
and Commissions: appoint Vera Rose Smith, 916 Kirkwood Ave., to the Public Art
Advisory Committee for a three-year term, January 1, 2018 - January 1, 2021 for Art
Design Professional.
Moved by Dickens, seconded by Mims, to make the following appointments to Boards
and Commissions: appoint reappoint Cheryll Clamon, 1023 Village Green Blvd., Jay
Honohan, 1610 Somerset Ln., to the Senior Center Commission for two vacancies to fill
three-year terms, January 1, 2018 - December 31, 2020.
The Mayor noted that no applications were received or gender balance requirement
not met for the following Boards and Commissions and all will be readvertised: Airport
Zoning Brd. of Adjustment for an unexpired term, upon appointment - December 31, 2018
(Formerly advertised); Airport Zoning Brd. of Adjustment for an unexpired term, upon
appointment - December 31, 2020; Airport Zoning Commission for an unexpired term,
upon appointment - December 31, 2021; Board of Appeals for a HBA Rep. or qualified by
experience and training representative, for a five-year term January 1, 2018 - December
31, 2022; Historic Preservation Commission for a Jefferson St. representative to fill a
three-year term, July 1, 2016 - July 1, 2019 (New District formed); Public Art Advisory
Committee for a three-year term, January 1, 2018 - January 1, 2021;
Telecommunications Commission for a three-year term, July 1, 2017 - July 1, 2020.

The Mayor noted the current vacancies: Community Police Review Board for an
unexpired term, upon appointment — July 1, 2021; Airport Zoning Commission for a five-
year term, January 1, 2018 — December 31, 2022. Applications must be received by 5:00
P.M., Tuesday, January 9, 2018.
Benjamin Nelson, UISG Liaison, appeared with UISG updates.
Council member Mims reported on a meeting with Colleen Schmidt from Kirkwood
Community College on the lack of English language classes in the community,
developing partnerships, where the City may or may not be involved and gathering
information.
Mayor Pro tem Botchway mentioned the downtown pop-up shops and the different
businesses rotating through. Botchway also mentioned receiving the snow removal
notice from the City and to pay attention to where you park your car according to the
notice.
Council member Cole raised concerns for the number of phone calls relating to rising
crime issues and would like to start monitoring it more closely and encourage residents to
reach out to Council. Mayor Throgmorton requested Chief Matherly attend the next
meeting to give an update.
Council member Thomas gave information on his visit to the Prairie Hill co -housing
project and the mix of housing types, price points, and people.
Mayor Throgmorton reported on a meeting with UI Student Government, attending the
grand opening of the Hilton Garden Inn, a panel discussion at Film Scene involving
Mayors from Cedar Rapids, Waterloo, and Madison, WI. The Mayor also mentioned a
quarterly meeting he would be attending with Council member Mims.
City Manager Fruin noted the late handout from the Telecommunications Commission
requesting the Council to take similar action and oppose the rollback on net neutrality.
The Council agreed to join the Telecommunications Commission in supporting their
position.
Assistant City Manager Monroe stated there was a new Listsery for e -subscriptions
related to the budget so anyone can sign up for budget news.

Transportation Planner Ralston presented a Power Point and information on six general topics
and the staff recommendations for each as outlined in the memo (1133) included in the
November 2 info packet.
Action:
• Public Works will plan to pursue the construction of the Jefferson Street bump outs in
2018. PW should contact the UI in the planning phase to get input on design.
• NDS will review intersection sight lines and make recommendations for necessary
changes to the City Council in the spring of 2018.
• The implementation of bicycle plan projects in the Northside will be discussed at the
January CIP budget meetings.
• Staff will not pursue traffic circles, however NDS and PW staff will evaluate Church
Street for possible on -street parking additions.
• NDS staff will prepare a parking survey for the Northside Neighborhood. Additionally,
Transportation Services will begin spot enforcement of existing regulations. After the
survey results and increased enforcement periods are complete, staff will present the
information to the Council to determine what next steps are appropriate.
• NDS staff will evaluate the use of meters around College Green Park. The City Council
requested that this work be done as expeditiously as possible.
Clarification of Agenda Items
• [Agenda item 8]... Revised TIF Policies ...Mayor Throgmorton announced he would be
asking for a motion to defer in order to give interested people time to comment.
• [Agenda Item 9]... Rental Permit Requirements ...Mayor Throgmorton asked for
clarification on the ordinance for rental permit requirements regarding rental cap, district
boundaries and unrelateds. City Manager Fruin, City Attorney Dilkes and Senior Housing
Inspector Laverman provided information.
• [Agenda Item 4d(1)]... Annual TIF certification filing ...Council member Mims stated she
would like to comment on this item after the motion to accept the consent calendar.

• [Agenda Item 4f(3)]... Hallee Haygood: Joint Resolutions ... Council member Taylor
noted that it was great to see students become active and register to vote and engaging
in their civic responsibilities.
• [Agenda Item 9]... Rental Permit Requirements ...Council member Thomas inquired on
the status of the student housing study. City Manager Fruin stated they had received a
draft report and submitted comments back to the University who were taking final
comments from stakeholders. Fruin was unsure of the turnaround time.

member Taylor stated the information had mentioned the Department of Veteran
Affairs and thought it would be great to include that group when having discussions
on potential market space.
2. (IP3, Information from Mayor Pro tem Botchway: Transportation Policy in Johnson
County) Mayor Pro tem stated he felt transportation was a really important issue and
asked Council to keep that in mind.

vehicles) Council member Thomas pointed out transportation -like company systems
related to restaurants, similar to Uber but they deliver meals who are already
affecting the use of City Streets.
2. (I134, Memo from Interim NDS Director: Affordable Housing Action Plan Update)
Mayor Pro tem Botchway stated it was great information with continuing updates and
Mayor Throgmorton mentioned he had met with the Student Liaisons and discussed
affordable housing from a student perspective.
3. (11135, Memo from Equity Director and Human Rights Coordinator. Social Justice and
Racial Equity Third Quarter Update for 2017) Mayor Pro tem Botchway stated it was
great Information with continuing updates and Mayor Throgmorton thanked Bowers
for the updates and asked City Attorney 0111kes to briefly state what the I.GBT amicus
brief is about since it was not included in the report Equity Director Bowers stated it
was just filed and would be included in the next update.
4. (1138, Memo from City Clerk: Proposed Council Meeting Schedule, January-- March
2018) Mayor Throgmorton confirmed spring break was not the week of March 20th.

1. (IP5, Memo from Equity Director and Human Rights Coordinator. Racial and
Socioeconomic Review Toolkits Pilot with Attachments) Mayor Pro tem Botchway
mentioned his appreciation for all the work that has gone into the project and asked
about the next steps. City Manager Fruin stated the City would proceed as outlined
in the memo and identify new departments to go through the excursive. Council
member Mims stated she saw no glaring issues but it was good the City was looking
to improve.

Council uadates on assiuned boards, commissions and committees
Council member Mims — Access Center Steering Committee — Nothing specific to update but
appears to be getting closer.
Council member Cole -- City of Literature — Continuing to get updates but it should not impair
the status.
Council member Taylor — InvestHealth — Attended a convening in Henderson, Nevada and was
able to share ideas and plans with other representative from InvestHealth and receive a lot of
feedback. The Reinvestment Fund ends in December but the group plans to continue to get
together and work closely with the stakeholder group.
Council member Thomas — Johnson County Emergency Management — Thomas asked the
opinion of staff or Council on whether JECC should purchase drones. City Attorney Dilkes
stated that the City cannot use drones for traffic enforcement purposes but didn't think it would
affect JECC because they are a separate entity. The City could use them for public safety and
drones are becoming increasingly popular in the emergency management field.
Mayor Throgmorton - Convention and Visitors Bureau — Mentioned the possibility of Iowa City
being a stopping point for RAGBRAI. Partnership for Alcohol Safety — Discussion regarding
possible changes from ABD and how that would affect the City.

Lusk Avenue code review
City Council members discussed the Lusk Avenue code review and the six claims outlined by
Manville Heights neighbors as outlined in a memo from Mayor Throgmorton which includes an
email from Karin Southard (IP2 of the 11/g/17 Information packet) and a memo from the City
Manager and City Attorney (IP3 of the 11/16/17 Information Packet) responding to the Mayor's
specific inquires.
Action:
• Staff from CMO, CAO and NDS will begin advancing discussions on the following topics
related to the 'Kinnick House' discussion:
❖ 'Infill tripwire'- potential neighbor notification when residential building permits
are received for a structure that may not fit the mass/scale of the surrounding
properties
In addition to pending zoning changes, explore a 'quick fix' zoning code solution
that may limit the mass/scale of a new structure to a size relative to surrounding
properties
Consider the feasibility of an alternate appointment to the Board of Adjustment
that can step into a decision-making process when there is a recusal of a
permanent appointee
Continue to explore a reciprocal representation agreement with in-house counsel
of neighboring municipalities
❖ Emphasize to the Board of Adjustment at the time of an appeal that they reserve
the right to defer votes and that they should carefully consider all input prior to

Clarification of Agenda Items
• [Agenda Item 4d(4)]... Iowa City Downtown District Budget ... Mayor Pro tem Botchway
questioned the purpose of the budget. City Manager Fruin stated the budget was
showing how the ICDD was planning to allocate the SSMID property tax funds.
Botchway also requested a review of city -funded organizations "commitment to diversity

there was time to insert the University impact zone (1 mile radius) on the rental cap map.
Howard responded that the University impact map was created specifically for the
stabilization effort for multi -family, so it is slightly different than what they are considering
now with the single-family duplexes.
[Agenda Item 4f(7)]... James McCoy: Iowa City Municipal Carbon Fee and Dividend
Resolution ...Council member Cole stated he was supportive of either a proclamation or
resolution. Mayor Throgmorton thought a resolution would be more appropriate so that
Council could act on the item. Council member Taylor had discussions with McCoy to
ensure that there was no conflict with the climate action committee and McCoy had
assured that it complimented what the climate action committee was trying to do.
Action: The CAO will prepare a resolution of support related to item 4f(7) — Carbon Fee
and Dividend Proposal.

Multifamily (RM -12) zone for 3.3 acres and Rural Residential (RR -1) zone for 19.38
acres for property (Cardinal Pointe West Part 2) located west of Camp Cardinal
Road and south of Kennedy Parkway (REZ17-00014/SUB17-00015), be passed and
adopted. The Mayor requested Council members disclose any ex parte communications
and none were reported.
Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 17-4731, amending Title 14, Chapter 2, Article G., Riverfront
Crossings Form -based Development Standards, to allow minor adjustments to
upper floor stepback requirements and the minimum building height standard, be
voted on for final passage at this time. Moved by Mims, seconded by Dickens, that the
ordinance be finally adopted at this time.

considered and voted on for final passage at two Council meetings prior to the meeting at

Regulations and Article 14-21), Industrial and Research Zones, to restrict sales of

agreement, and estimate of cost for the construction of the City of Iowa City Building
Automation Upgrades and Improvement Projects 2017, establishing amount of bid security
to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and
place for receipt of bids. No one appeared.

Moved by Thomas, seconded by Botchway, to adopt Res. 17-350, adopting City
of Iowa City Tax Increment Financing (TIF) Policies. Mayor Throgmorton proposed two
amendments. Moved by Cole, seconded by Taylor, to amend the resolution adding a
sentence to Sustainability to read, "New residential projects shall be certified silver under
the National Green Building Standard, or the LEED Green Building rating system,
appropriate to the building type." And adding three words to Further "for LEED projects", at

Based Code "or urban design plan" is adopted. Mayor Pro tem Botchway proposed an
additional three amendments which were discussed. Individual Council members
expressed their views. A majority of Council agreed to Mayor Throgmorton's first two
amendments and Mayor Pro tem Botchway's proposed amendment to change "social
justice" to "economic justice". The Mayor declared the resolution adopted as amended,
4/3, with the following division of roll call vote: Ayes: Taylor, Thomas, Throgmorton, Cole.

Moved by Mims, seconded by Botchway, that the ordinance amending Title 17,
entitled "Building And Housing," Chapter 5, entitled "Housing Code," to establish a rental
permit cap and to strengthen the minimum requirements for rental housing, be given first
vote. Urban Planner Howard presented a power point. Chris Warnock, Sue Mellecker,
Cecile Gunsley, Austin Wu, Benjamin Nelson, Gustave Stewart, Hunter Gillaspie, Mike
McLaughlin, Nancy Carlson, Regenia Bailey, Riley Lewers, Mike Oliveria, and Chris
Villhauer appeared. Individual Council members expressed their views. All Council
members agreed to amend the ordinance, changing the rental permit cap from 35% to

Gustave Stewart, UISG Liaison Alternate, appeared with UISG updates.
Council member Taylor reported that the Council Listening Post held at Oaknoll was
well attended.
Mayor Pro tem Botchway mentioned Dave Ricketts retirement, attending the Iowa City
Federation of Labor meeting, and saying a few words at the Armistice Day observance at
the Pentacrest. Botchway also attended the Willowind solar panel ribbon cutting and
stated he attended a presentation by the Executive Director of the Cedar Rapids Airport
regarding the "buy local" approach.
Council member Mims informed the Council of a work session with the County Board
of Supervisors and the Steering Committee and Governance Committees for the access
center that was held.
Mayor Throgmorton noted his attendance at the National League of Cities summit in
Charlotte, NC and the Mayor's Institute on City Design event in Indianapolis, IN. The
Mayor also congratulated Mims and Botchway on their re -elections and congratulated
Salih on her victory.
