Resolution No. 17-362
Resolution authorizing an Agreement between the City of Iowa
City and MidAmerican Energy Company for the relocation of
utilities necessary to accommodate the Iowa City Gateway
Project.
Whereas, the Iowa City Gateway Project includes the elevation of Dubuque Street, the
reconstruction of Park Road Bridge and all necessary improvements of sidewalks, public and
private utilities and intersections within the project limits; and
Whereas, in order to accommodate said project, it is necessary to relocate existing overhead
electrical facilities, convert electric facilities from overhead to underground, and replace power
pole guy wires and anchors; and
Whereas, City staff has negotiated Agreements with MidAmerican Energy Company to relocate
said utilities; and
Whereas, the City Council deems it in the public interest to enter into the negotiated Agreement
With MidAmerican Energy Company for the relocation of utilities to accommodate the Iowa City
Gateway Project; and
Whereas, funds for this project are available in the Iowa City Gateway account # S3809.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
1. The City Manager is hereby authorized to enter into and execute all agreements with
MidAmerican Energy for the relocation of utilities, as may be necessary to complete the
project.
3. The City Manager is authorized to execute amendments to the Consultant Agreement as
they may become necessary.

Executive Summary:
As part of the Iowa City Gateway Project, it is necessary to relocate existing overhead electrical
facilities, convert existing overhead electric facilities to underground, and replace power pole
guy wires and anchors. This item approves an agreement that has been negotiated with
MidAmerican Energy to relocate utilities for the Iowa City Gateway Project. The estimated cost
of the relocations is $1,271,264, and funding is available in the Iowa City Gateway Project
(Dubuque Street) account.
Background / Analysis:
The Iowa City Gateway Project is under construction and includes the elevation of Dubuque
Street to one -foot above the 100 -year flood elevation, the reconstruction of Park Road Bridge
such that the bottom deck elevation of the new through -arch bridge is one -foot above the 200 -
year flood and all necessary improvements of sidewalks, public and private utilities and
intersections within the project limits.

and the City Clerk to attest a contract for construction of the
Burlington Clinton Street Intersection Improvements Project
Whereas, Ricklefs Excavating Ltd. of Anamosa, Iowa, has submitted the lowest responsible bid of
$1,067,777.00 for construction of the above-named project; and
Whereas, funds for this project are available in the Burlington/Clinton Intersection Imp account
# S3840; and
Whereas, The City Engineer and City Manager are authorized to execute change orders
according to the City's Purchasing Policy as they may become necessary in the construction of
the above-named project.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that:
1. The contract for the construction of the above-named project is hereby awarded to
Ricklefs Excavating Ltd., subject to the condition that awardee secure adequate
performance and payment bond, insurance certificates, and contract compliance program
statements.
2. The Mayor is hereby authorized to sign and the City Clerk to attest the contract for
construction of the above-named project, subject to the condition that awardee secure
adequate performance and payment bond, insurance certificates, and contract compliance
program statements.

NOTICE TO BIDDERS
BURLINGTON CLINTON STREET INTERSECTION IMPROVEMENTS
PROJECT
Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, until 3:00 P.M.
on the 6th day of December, 2017. Sealed proposals will be opened immediately thereafter. Bids
submitted by fax machine shall not be deemed a "sealed bid" for purposes of this Project.
Proposals received after this deadline will be returned to the bidder unopened. Proposals will be
acted upon by the City Council at a meeting to be held in the Emma J. Harvat Hall at 7:00 P.M. on
the 1 gth day of December, 2017, or at special meeting called for that purpose.
The Project will involve the following:
Replacement of water main along Clinton Street between Court Street and Burlington Street.
Replacement of traffic signal at the intersection of Clinton Street and Burlington Street. ADA and
sidewalk improvements between along Clinton Street between Court Street and Burlington Street.
Replacing concrete panels and adding right and left turn lanes to Clinton Street at the intersection
with Burlington Street. Pavement markings on Clinton Street between Benton Street and Church
Street.
All work is to be done in strict compliance with the plans and specifications prepared by Shive-
Hattery, of Iowa City, Iowa, which have heretofore been approved by the City Council, and are on
file for public examination in the Office of the City Clerk.
Each proposal shall be completed on a form furnished by the City and must be submitted in a
sealed envelope. In addition, a separate sealed envelope shall be submitted containing a
completed Bidder Status Form and a bid bond executed by a corporation authorized to contract
as a surety in the State of Iowa, in the sum of 10% of the bid. The bid security shall be made
payable to the TREASURER OF THE CITY OF IOWA CITY, IOWA, and shall be forfeited to the
City of Iowa City in the event the successful bidder fails to enter into a contract within ten (10)
calendar days of the City Council's award of the contract and post bond satisfactory to the City
ensuring the faithful performance of the contract and maintenance of said Project, if required,
pursuant to the provisions of this notice and the other contract documents. The City shall retain
the bid security furnished by the successful bidder until the approved contract form has been
executed, a bond has been filed by the bidder guaranteeing the performance of the contract, and
the contract and bond have been approved by the City. The City shall promptly return the checks
or bidder's bonds of unsuccessful bidders to the bidders as soon as the successful bidder is
determined or within thirty days, whichever is sooner.
The successful bidder will be required to furnish a bond in an amount equal to one hundred
percent (100%) of the contract price, said bond to be issued by a responsible surety approved by
the City, and shall guarantee the prompt payment of all materials and labor, and also protect and
save harmless the City from all claims and damages of any kind caused directly or indirectly by
the operation of the contract, and shall also guarantee the maintenance of the improvement for a
period of FIVE (5) year(s) from and after its completion and formal acceptance by the City
Council.

The plans, specifications and proposed contract documents may be examined at the office of the
City Clerk. Copies of said plans and specifications and form of proposal blanks may be secured
at Rapids Reproductions, 415 Highland Ave Suite 100, Iowa City, Iowa, Iowa, by bona fide
bidders.
A $30 fee is required for each set of plans and specifications provided to bidders or other
interested persons. The fee shall be in the form of a check, made payable to City of Iowa City.
The fee is refundable if returned within 10 days of award of the project by City Council in re -usable
condition.
Prospective bidders are advised that the City of Iowa City desires to employ minority contractors
and subcontractors on City projects. A listing of minority contractors can be obtained from the
Iowa Department of Inspections and Appeals at (515) 281-5796 and the Iowa Department of
Transportation Contracts Office at (515) 239-1422.
Bidders shall list on the Form of Proposal the names of persons, firms, companies or other parties
with whom the bidder intends to subcontract. This list shall include the type of work and
approximate subcontract amount(s).
The Contractor awarded the contract shall submit a list on the Form of Agreement of the proposed
subcontractors, together with quantities, unit prices and extended dollar amounts.
By virtue of statutory authority, preference must be given to products and provisions grown and
coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required
under Iowa Statutes. The Iowa reciprocal resident bidder preference law applies to this Project.
The City reserves the right to reject any or all proposals, and also reserves the right to waive
technicalities and irregularities.

Executive Summary:
This agenda item awards the construction contract for the Burlington Clinton Street Intersection
Improvements Project.
Three (3) bids were received for the project:

Ricklef's Excavating Ltd. of Anamosa, Iowa, has submitted the lowest responsible bid of
$1,067,777.00. Staff recommends awarding the construction contract to Ricklef's Excavating
Ltd.
Background / Analysis:
The Burlington Clinton Street Improvement Project is expected to improve traffic and pedestrian
safety and multimodal travel at the Burlington Street and Clinton Street intersection, and
throughout the Clinton Street corridor. This project includes the construction of new water main,
as well as ADA and sidewalk improvements, along Clinton Street, between Court Street and
Burlington Street, and the construction of new tum lanes and signal improvements at the
Burlington and Clinton intersection. In addition, this project was designed to maximize the use
of the existing pavement, and includes the restriping of Clinton Street to include a 4 -lane to 3 -
lane conversion from Jefferson Street to Court Street, and the addition of continuous bike lanes
on Clinton Street from Church Street to Benton Street.

Whereas, the owner, Steve Kohli Construction, L.C., filed with the City Clerk the final plat of
Brookwood Pointe Fifth Addition, Iowa City, Iowa, Johnson County, Iowa; and
Whereas, said subdivision is located on the following -described real estate in Iowa City, Johnson
County, Iowa, to wit:

Whereas, the Neighborhood and Development Services Department and the Public Works
Department examined the proposed final plat and subdivision, and recommended approval; and

The applicant, Steve Kohli, has submitted a final plat for Brookwood Pointe Fifth Addition, an 18 -
lot, 4.92 -acre residential subdivision located on Terrapin Drive and Covered Wagon Drive. The
preliminary plat was approved on August 15.
ANALYSIS:
The preliminary and final plat of Brookwood Pointe Fifth Addition is in general compliance with the
approved preliminary plat and the subdivision regulations. Legal papers and construction plans
are currently being reviewed by staff. It is anticipated that these documents will be approved prior
to the September 5 Council Meeting.
Infrastructure fees: Water main extension fees of $435 per acre; sanitary sewer tap -on fees of
$1,796.50 per acre and Sycamore Street improvement fees of $2,507.08 per acre of development
need to be included in the legal papers.
Neighborhood parkland: At the time Brookwood Pointe was approved in 2005, the Parks and
Recreation Commission chose to collect fees in lieu of open space due to the subdivision's
proximity to Wetherby Park. Open space fees for the entire subdivision were collected at the time
of final plat approval for the First Addition and no further fees are due.
STAFF RECOMMENDATION:
Staff recommends approval of SUB17-00014, the final plat of Brookwood Pointe Fifth Addition, an
18 -lot, 4.92 -acre residential subdivision located at Terrapin Drive and Covered Wagon Drive
subject to approval of construction drawings and legal papers by the City Engineer and City
Attorney.

BACKGROUND INFORMATION:
The applicant, Steve Kohli, has submitted a final plat for Brookwood Pointe Fifth Addition, an 18 -
lot, 4.92 -acre residential subdivision located on Terrapin Drive and Covered Wagon Drive. The
preliminary plat was approved on August 15.
ANALYSIS:
The final plat of Brookwood Pointe Fifth Addition is in general compliance with the approved
preliminary plat and the subdivision regulations. Legal papers and construction plans are currently
being reviewed by staff. It is anticipated that these documents will be approved prior to the
November 6 Council Meeting.
Infrastructure fees: Water main extension fees of $435 per acre; sanitary sewer tap -on fees of
$1,796.50 per acre and Sycamore Street improvement fees of $2,507.08 per acre of development

need to be included in the legal papers.
Neighborhood parkland: At the time Brookwood Pointe was approved in 2005, the Parks and
Recreation Commission chose to collect fees in lieu of open space due to the subdivision's
proximity to Wetherby Park. Open space fees for the entire subdivision were collected at the time
of final plat approval for the First Addition and no further fees are due.
STAFF RECOMMENDATION:
Staff recommends approval of SUB17-00014, the final plat of Brookwood Pointe Fifth Addition, an
18 -lot, 4.92 -acre residential subdivision located at Terrapin Drive and Covered Wagon Drive
subject to approval of construction drawings and legal papers by the City Engineer and City
Attorney.

This project will expand park amenities for Cardigan Park in a newly developed neighborhood
on the east side of Iowa City to add a shelter structure, fire ring, concrete walking paths and a

Executive Summary:
This agenda item begins the bidding process for the Douglass Street and Douglass CourtWater
Main Improvements Project. This project generally includes the replacement of approximately
2,000 feet of water main, new domestic water services, driveway replacements as needed to
install the water main and final surface restoration.
Background / Analysis:
The existing 6 -inch ductile iron water main along Douglass Street and Douglass Court has
reached the end of its service life. As a result, there have been approximately 15 water main
breaks since 1992. In order to reduce the inconvenience residents experience during breaks,
and to decrease water fund expenditures resulting from frequent repairs, the existing water
main was identified for replacement.
Given the impact and disruption that the proposed water main replacement would have on
residents, in addition to the City's accessibility goals, the installation of sidewalks on both sides
of Douglass Street and Douglass Court were originally included in the project. Upon receipt of
questions, comments and concerns from residents and property owners regarding sidewalk
installation, City staff developed options that minimized private property impacts by reducing
the sidewalk width and adjusting the alignment of the proposed sidewalk to preserve as much
of the mature tree canopy as possible. Two options, including the installation of sidewalk on
one side of Douglass Street and Douglass Court or the elimination of sidewalk on both Douglass
Street and Douglass Court, were presented to Council at the December 6, 2016 council
meeting. At this meeting, Council directed staff to eliminate sidewalks on Douglass Street and
Douglass Court from the project.
The plans, specifications, form of contract, and estimate of cost for construction of the Douglass
Street and Douglass Court Water Main Improvements Project have been filed in the Office of
the City Clerk for public examination. The estimated cost of construction is $562,000, and the
project is expected to be completed in the fall of 2018.

RESOLUTION NO

Resolution authorizing conveyance of a single family
home located at 521 South Governor Street.
Whereas, the UniverCity Neighborhood Partnership Program is a joint effort between the
University of Iowa and the City to encourage home ownership and reinvestment in designated
neighborhoods surrounding the University of Iowa; and
Whereas, the City purchases rental units located in designated neighborhoods surrounding the
University of Iowa, rehabilitates them, and then sells them to income -eligible buyers; and
Whereas, the City purchased and rehabilitated a single family home located at 521 South
Governor Street, Iowa City; and
Whereas, the City has received an offer to purchase 521 South Governor Street for the
principal sum of $225,000; and
Whereas, on December 5, 2017, the City Council adopted a Resolution proposing to convey its
interest in 521 South Governor Street, authorizing public notice of the proposed conveyance,
and setting the date and time for the public hearing; and
Whereas, following the public hearing on the proposed conveyance, the City Council finds that
the conveyance is in the public interest.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa, that
1. Upon the direction of the City Attorney, the Mayor and the City Clerk are authorized to
execute a warranty deed conveying the City's interest in 521 South Governor Street,
legally described as Lot 12, except the South 20 feet in Block 1, Berryhill's Second
Addition, Iowa City, Iowa.
2. The City Attorney is hereby authorized to deliver said warranty deed and to carry out any
actions necessary to consummate the conveyance required by law.

Executive Summary:
No bids were received on the original bid date of December 14, 2017. After discussions with
local contractors, City Staff recommends rebidding the project. It was noted that some
contractors felt they did not have sufficient time to pull together an accurate bid. Rebidding
the project will allow contractors more time to develop bids, while also minimizing the impact
to the overall project schedule.
This agenda begins the process for rebidding the City of Iowa City Building Automation
Upgrades and Improvement Projects 2017. This project includes modifications and upgrades
to temperature control systems at three buildings for the purpose of integrating existing
heating, ventilation and air conditioning (HVAC) systems into the City's existing Building
Automation System (BAS). Included is related mechanical and electrical work. This work will
be performed at the following three buildings:
• City Hall - 410 East Washington Street, Iowa City, Iowa 52240
• Robert A. Lee Recreation Center - 220 South Gilbert Street, Iowa City, Iowa 52240

Background / Analysis:
The existing HVAC and BAS systems in City Hall, Robert A. Lee Recreation Center, Mercer
Aquatic Center and Scanlon Gymnasium are reaching the end of their useful lives and require
upgrades and/or replacement. This work will significantly reduce operating costs and energy
consumption in these facilities.

CITY OF IOWA CITY BUILDING AUTOMATION UPGRADES AND IMPROVEMENT PROJECT 2017
Sealed proposals will be received by the City Clerk of the City of Iowa City, Iowa, until 3:00 P.M. on the 10 day of
December, 2017. Sealed proposals will be opened immediately thereafter by the City Engineer or designee. Bids submitted by
fax machine shall not be deemed a "sealed bid" for purposes of this Project. Proposals received after this deadline will be
returned to the bidder unopened. Proposals will be acted upon by the City Council at a meeting to be held in the Emma J.
Harvat Hall at 7:00 P.M. on the 19`R day of December, 2017, or at a special meeting called for that purpose.
There is a recommended pre-bid meeting. This will start at 10 a.m. local time on Thursday, November 30, 2017 in City Hall in
the Helling Lobby Conference Room located at 410 East Washington Street, Iowa City, Iowa.
The Project will involve the following:
The project consists of modifications and upgrades to temperature controls systems at three buildings for the City of Iowa
City: City Hall, Robert A. Lee Recreation Center and Mercer Aquatic Center/Scanlon Gymnasium for the purpose of
integrating existing HVAC systems into the City's existing Building Automation System. The contractor will be responsible
for all associated mechanical, structural and electrical work.
All work is to be done in strict compliance with the plans and specifications prepared by Shive-Hattery Inc., of Iowa City,
Iowa, which have heretofore been approved by the City Council, and are on file for public examination in the Office of the
City Clerk.
Each proposal shall be completed on a form furnished by the City and must be accompanied in a sealed envelope,
separate from the one containing the proposal, by a bid bond executed by a corporation authorized to contract as a surety in
the State of Iowa, in the sum of 10% of the bid. The bid security shall be made payable to the TREASURER OF THE CITY
OF IOWA CITY, IOWA, and shall be forfeited to the City of Iowa City in the event the successful bidder fails to enter into a
contract within ten (10) calendar days of the City Council's award of the contract and post bond satisfactory to the City
ensuring the faithful performance of the contract and maintenance of said Project, if required, pursuant to the provisions of
this notice and the other contract documents. Bid bonds of the lowest two or more bidders may be retained for a period of not
to exceed fifteen (15) calendar days following award of the contract, or until rejection is made. Other bid bonds will be returned
after the canvass and tabulation of bids is completed and reported to the City Council.
The successful bidder will be required to furnish a bond in an amount equal to one hundred percent (100%) of the contract
price, said bond to be issued by a responsible surety approved by the City, and shall guarantee the prompt payment of all
materials and labor, and also protect and save harmless the City from all claims and damages of any kind caused directly or
indirectly by the operation of the contract, and shall also guarantee the maintenance of the improvement for a period of one
(1) year(s) from and after its completion and formal acceptance by the City Council.
The following limitations shall apply to this Project:
Robert A. Lee Recreation Center and Mercer Aquatic Center, Start Date: January 15, 2018, Substantial Completion date
June 15, 2018 and Final Completion Date is July 13, 2018. City Hall, Start Date July 14, 2018, Substantial completion date
December 14, 2018 and Final Completion Date, January 11, 2019.
Liquidated Damages: $250.00/day

A $30.00 refundable fee is required for each set of plans and specifications provided to bidders or other interested persons.
The fee shall be in the form of a check, made payable to Technigraphics. The fee will be returned if the plans are returned in
unmarked and reusable condition within 15 days of Council Award. A separate and nonrefundable J15.00 shipping and
handling fee will apply to plans that are sent through postal mail. Prospective bidders are advised that the City of Iowa City
desires to employ minority contractors and subcontractors on City projects. A listing of minority contractors can be obtained
from the Iowa Department of Economic Development at (515) 242-4721 and the Iowa Department of Transportation
Contracts Office at (515) 239-1422.
Bidders shall list on the Form of Proposal the names of persons, firms, companies or other parties with whom the bidder
intends to subcontract. This list shall include the type of work and approximate subcontract amount(s).
The Contractor awarded the contract shall submit a list on the Form of Agreement of the proposed subcontractors, together
with quantities, unit prices and extended dollar amounts.
By virtue of statutory authority, preference must be given to products and provisions grown and coal produced within the
State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa Statutes. The Iowa reciprocal resident
bidder preference law applies to this Project.
The City reserves the right to reject any or all proposals, and also reserves the right to waive technicalities and irregularities.
