Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easement to construct the Rochester Avenue Sidewalk Infill. The project will construct a 4 -foot wide sidewalk along Rochester Avenue between the water storage site at 2410 Rochester Avenue and St. Thomas Court. Comment: This item will accept the public improvements for Sandhill Estates Part 4, generally located north of Langenberg Avenue and east of Oxen Lane. Hilton Garden Inn TIF Agreement - Resolution authorizing the Mayor to sign and the City Clerk to attest the First Amendment to Agreement for Private Development by and between the City of Iowa City and Iowa City Hotel Associates, L.L.C. Comment: The TIF Agreement for the Hilton Garden Inn authorized the City to make certain economic development grants to the developer based in part upon tax increment generated from adjacent property previously contemplated to be developed for the University of Iowa Museum of Art. Because plans for development of that adjacent property at the corner of Clinton and Burlington Street have changed, the developer desires to amend the Agreement to eliminate that property from the sources from which the economic development grants are paid. Staff recommends approval. Hieronymus Square TIF Agreement - Resolution authorizing the Mayor to sign and the City Clerk to attest the First Amendment to Agreement for Private Development between the City of Iowa City, Hieronymi Partnership, L.L.P., Hieronymus Square Developers, L.L.C., Iowa City ES Hotel, L.L.C., and HS314, L.L.C. Comment: This amendment corrects the legal description contained in the September 19, 2017 TIF Agreement for the development of a mixed-use building and hotel at the comer of Clinton and Burlington Street. This amendment is necessary to ensure the accurate collection and division of tax revenues arising from the construction of the project contemplated in the agreement. Staff recommends approval. January 16, 2018 City of Iowa City Page 4 Item 3d(7) Financial consultant agreement - Resolution authorizing the City Manager to execute an agreement between the City / / and National Development Council regarding community and economic development advisement. Comment: In 2010, the City entered into an agreement with National Development Council (NDC) to facilitate negotiations and pursue financing packages to assist in the redevelopment of key areas including Towncrest, Downtown and Riverfront Crossings. Since 2010, the City has negotiated and renewed the contract in 2014 and 2016 and must renew again for 2018. The services are being procured on a sole -source basis consistent with the requirements of the Purchasing Manual. Item 3d(8) Westside Estates Phase One — Resolution approving final plat of West Side Estates Phase One, Iowa City, Iowa (SUB17-00017). Comment: A preliminary plat of Westside Estates Phase One was approved as Country Club Estates Seventh and Eighth Addition on September 19, 2017. The applicant has chosen to change the name. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the January 16 City Council meeting. Approval will allow the development Westside Estates Phase One, a 42 -lot, 14.88 -acre residential subdivision located on Rohret Road. Item 3e. Setting Public Hearings: Item 3e(1) Rezoning 11 and Muscatine for Kum & Go and Hospice — Motion setting a public hearing for February 6 on an ordinance conditionally rezoning approximately .5 acres of property at 1010 1St Avenue from Low Density Single Family Residential (RS -5) to Community Commercial (CC - 2), and 1022 1St Avenue from (RS -5) to Commercial Office (CO -1) and a portion of 1025 Wade Street from (CO -1) to (CC -2). (REZ17-00019) Comment: At its January 4 meeting, by a vote of 5-0 (Martin and Theobald absent), the Planning and Zoning Commission recommended approval of this rezoning subject to a conditional zoning agreement requiring general conformance to the concept site plan and landscaping plan to create a buffer between commercial and residential development. Comment: This project is the third phase of the Riverfront Crossing Park Project and involves the construction of combination restroom/shelter structures, trail lighting and park signage. Theme Semester Joint Declaration - R approve-djoint- declaratkon- kirking off the S< ` Change" Comment: The joint declaration celebrates the 2018 University of Iowa Spring Theme Semester, "Climate for Change". As part of the 2018 Theme Semester, local projects and activities taking place over the next five months will focus upon environmental sustainability and tying together various elements along the Iowa River corridor. Passage of this resolution calls upon the businesses and people of Iowa City as well as students, faculty, and staff at the University to participate in joint projects and programs in celebration of the imminent Theme Semester. Action: Item 8. Assessment Schedule - Resolution adopting an assessment schedule of unpaid mowing, clean-up of property, snow removal, sidewalk repair, and stop box repair charges and directing the Clerk to certify the same to the Johnson County Treasurer for collection in the same manner as property taxes. Comment: The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
