Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Throgmorton
presiding. Council members present: Botchway, Cole, Mims, Salih, Taylor, Thomas,
Throgmorton. Absent: None. Staff members present: Fruin, Monroe, Andrew, Dilkes,

The Mayor presented Student Leadership Awards to Longfellow Elementary students:

The Mayor proclaimed: The 50th Anniversary of Municipal Home Rule in Iowa; Black

Moved by Mims, seconded by Salih, to adopt Res. 18-35, setting a public hearing
on February 20, 2018 on plans, specifications, form of contract, and estimate of
cost for the construction of the Pedestrian Mall Improvements Project, directing
City Clerk to publish notice of said hearing, and directing the City Engineer to

summary to clarify the cost difference listed in the resolution that was discussed at the
work session. City Manager Fruin presented information regarding the costs.
Community Comment, the following individuals appeared: Joe Murphy appeared
regarding the naming of the stage in on the pedestrian mall as the Dennis Jones stage;
Anthony Smith, Pastor of New Creations International Church and President of the
Johnson County Interfaith Cluster, appeared regarding the Johnson County Interfaith
Cluster and hate propaganda in Iowa City; Sam Massey, Pastor of First Presbyterian
Church, appeared regarding the Johnson County Interfaith Cluster; Chitoka Webb
appeared regarding racism, sexism, ageism, and making a change in Iowa City; Rafael
Montoya appeared regarding racist graffiti in Scott Park; Nicholas Theisen appeared
regarding affordable housing; Joel Gilbertson White appeared regarding support for
Johnson County Interfaith and Affordable Housing; Mayor Throgmorton reread his
statement from 1/16/18 meeting regarding fliers in Wetherby Park neighborhood.
A public hearing was held on an ordinance conditionally rezoning approximately 0.5
acres of property located at 1010 S. First Avenue (Kum & Go and Hospice) from Low
Density Single -Family Residential (RS -5) to Community Commercial (CC -2), 1022 S. First
Avenue from Low Density Single -Family (RS -5) to Commercial Office (CO -1) and a
portion of 1025 Wade Street from Commercial Office (CO -1) to Community Commercial
(CC -2) (REZ17-00019). The Mayor requested Council members disclose any ex parte
communications and none were reported. Senior Planner Miklo presented a power point.
Moved by Botchway, seconded by Salih, to continue public hearing to February 20.
Moved by Mims, seconded by Botchway, to defer to February 20th, the first vote on

and Mims reported as stated. Senior Planner Miklo presented a power point for Item 6b
and 6c. Megan Carr from Sands Development appeared representing the applicant IC
Housing Group and presented information.
Moved by Mims, seconded by Salih, to adopt Res. 18-36, for a voluntary annexation
of approximately 8.62 acres of property located at 4643 Herbert Hoover Highway SE
(ANN17-00001).

A public hearing was held on an ordinance rezoning approximately 8.62 acres of
property from County Commercial (C) and County Multifamily Residential (RMF) to Interim
Development Multifamily Residential (ID -RM) zone for 5.86 acres and Interim
Development Single Family for 2.76 acres located at 4643 Herbert Hoover Highway SE
(REZ17-00020). The Mayor reported ex parte communications as stated in previous item,
6b, resolution for voluntary annexation 4643 Herbert Hoover Highway. Megan Carr from
Sands Development appeared representing the applicant IC Housing Group and
presented information. Individual Council members expressed their views.
Moved by Thomas, seconded by Botchway, that the ordinance rezoning approximately
8.62 acres of property from County Commercial (C) and County Multifamily Residential
(RMF) to Interim Development Multifamily Residential (ID -RM) zone for 5.86 acres and
Interim Development Single Family for 2.76 acres located at 4643 Herbert Hoover
Highway SE (REZ17-00020), be given first vote.
Moved by Mims, seconded by Salih, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting at
which it is to be finally passed be suspended, the second consideration and vote be
waived, and that Ord. 18-4737, conditionally rezoning approximately .48 acres of
property from Intensive Commercial (CI -1) zone to Riverfront Crossings -Central
Crossings Subdistrict (RFC -CX) zone located at 703, 705, and 709 S. Dubuque Street
(REZ17-00018), be voted on for final passage at this time. The Mayor requested Council
members disclose any ex parte communications and none were reported. Mayor
Throgmorton expressed his concern with the project. Moved by Mims, seconded by
Botchway, that the ordinance be finally adopted at this time. The Mayor declared the
motion carried, 6/1, with the following division of roll call vote: Ayes: Thomas,
Throgmorton, Botchway, Cole, Mims, Salih. Nays: Taylor. The Mayor declared the

rezoning approximately 3.6 acres of property from Neighborhood Public (P1) to Planned
Development Overlay Neighborhood Public (OPD/P1) zone located at 300 Teeters Court
(Sensitive Areas Plan for Lincoln School) (REZ17-00016). The Mayor requested Council
members disclose any ex parte communications and none were reported. The Mayor
declared the motion carried, 6/0/1, with the following division of roll call vote. Ayes: Cole,
Mims, Salih, Taylor, Thomas, Throgmorton. Absent: None. Abstaining: Botchway.

agreement, and estimate of cost for the construction of the Riverfront Crossings Park,
Phase 3 Project, establishing amount of bid security to accompany each bid, directing

Recreation Director Seydell-Johnson presented a power point. No one appeared.

specifications, form of agreement, and estimate of cost for the construction of the

agreement, and estimate of cost for the construction of the 2018 Roof Improvements —
Water Treatment Plant & Water Distribution Facility Project, establishing amount of bid
security to accompany each bid, directing the City Clerk to post notice to bidders, and
fixing time and place for receipt of bids. No one appeared.
Moved by Botchway, seconded by Mims, to adopt Res. 18-38, approving plans,
specifications, form of agreement, and estimate of cost for the construction of the

Moved by Botchway, seconded by Mims, that the ordinance amending Title 2 entitled
"Human Rights," Chapter 1, entitled "Definitions" to remove reference to "masculine" and
"feminine" from the definition of gender identity and make it inclusive of non -binary
expression, be given first vote. City Attorney Dilkes summarized the ordinance. Individual
Council members expressed their views.
Moved by Botchway, seconded by Salih, to defer resolution to February 20 rejecting
bids received on January 30, 2018 for the Happy Hollow Park Restroom and Shelter
Replacement Project 2018. City Manager Fruin and Parks & Recreation Director Seydell-
Johnson presented information. Council member Thomas proposed deferring the item,
having a community meeting, and reporting back at the next meeting. Individual Council
members expressed their views. Moved by Botchway, seconded by Mims, to accept
correspondence from Sharon DeGraw.
Moved by Botchway, seconded by Salih, to adopt Res. 18-39, authorizing
acceptance of City Bridge Funds from the Iowa Department of Transportation and
authorizing the City Manager to sign the Project Agreement.
Moved by Botchway, seconded by Taylor, to adopt Res. 18-40, approving,
authorizing and directing the Mayor to execute and the City Clerk to attest an
agreement by and between the City of Iowa City and Neumann Monson Architects
Inc. to provide architectural and engineering consultant services for the Public
Works Facility - Phase 1 Project. Public Works Director Knoche presented a power
point. Individual Council members expressed their views.
Moved by Botchway, seconded by Salih, to adopt Res. 18-41, approving settlement
of imminent litigation.
Moved by Botchway, seconded by Taylor, to appoint Council members: Cole, Mims and
Mayor Throgmorton, to the Economic Development Committee 2016-17. Council member
Salih initiated discussion regarding the size of the Committee. Moved by Salih, seconded
by Botchway to expand the Economic Development Committee from three to five people.
The Mayor declared the motion defeated, 1/6. Ayes: Salih. Nays: Botchway, Cole, Mims,
Taylor, Thomas, Throgmorton. Council member Salih moved to limit the time each
Council member could serve on the Economic Development Committee and amended
the motion to any committees. Motion died for lack of a second. Mayor Throgmorton
asked the item be added to the pending work session list.
The Mayor noted the previously announced vacancies to Boards and Commissions:

Clerk's office.
Community Comment, the following individuals appeared: Benjamin Nelson, UISG
Liaison, appeared with UISG updates.
Council members reported on various meetings attended, upcoming meetings,
community events, and items of interest.
Assistant City Manager Monroe provided information on the first scheduled facility tour
at Robert A. Lee Rec Center. Monroe also mentioned the Library had been nominated
for Best Library in the Country and encouraged everyone to vote!
Moved by Mims, seconded by Salih, to adjourn regular meeting 9:35 p.m. and resume
work session.

Review of Saturday's work session
Mayor Throgmorton introduced the item, and requested input from Council Members on budget
items or concerns after the staff budget presentations the previous Saturday. Council agreed to
defer discussion of Saturday's budget presentations and three-year financial plan to the next
Work Session on January 16.
FY78-FY22 CAPITAL IMPROVEMENT PROGRAM (CIP)
City Manager Fruin announced that the majority of the presentation would be made through a
GIS -based map that once the CIP is finalized will be a tool for residents to drill into specific
areas of town and understand what improvements may be coming up in a neighborhood.
PW Dir. Knoche gave opening remarks and overview of how Capital Improvement presentation
would be presented starting on pg. 497, noted on-going projects, and facilitated a GIS -based
presentation (archived with the City Clerk). Finance Director Bockenstedt gave an overview of
the CIP program calendar and the Capital Projects Fund by Division. (pgs. 497-602)

Review of Pedestrian Mall plans
City Manager Fruin gave an introduction of the presenters and a timeline for setting the public
hearing and approving plans and specs. Senior Civil Engineer Sovers and Angie Coyier from
Genus Landscape Architects gave a power point presentation on the Pedestrian Mall
Improvements project. Individual Council members expressed their views.
Action:
• Engineering will provide a detailed cost opinion for the Pedestrian Mall improvement
project. They will proceed with the base bid and two alternates as presented. However,
staff will explore other possible alternates before finalizing the bid documents.
Communications will use City information channels to share images of the proposed
pedestrian mall design to encourage public feedback.
Clarification of Agenda Items
• [Agenda Item 3a(1)]... January 2 minutes, Special Formal (Organizational) Official &
Complete ... Mayor Throgmorton noted that Council member Cole was not present for
the organizational meeting and therefore could not comment on if he wanted to continue
on the Economic Development Committee when Council member Salih was appointed.
Cole and Salih have since talked and agreed Cole could stay on the committee.
Action: Council agreed that the serving members of the Economic Development
Committee will include Mayor Throgmorton, Councilor Mims, and Councilor Cole. A vote
for formal appointment will be put on the next Council Meeting agenda.
[Agenda Item 5b]... Rezoning Sensitive Areas Plan for Lincoln School ... Council
member Botchway noted that he would be recusing himself from this item.
• [Agenda Item 7]... Theme Semester Joint Declaration ... Council member Botchway
asked what other types of themed semesters had there been in the past and if this would
be a continued partnership. Mayor Throgmorton stated there had been others but could
not list them and that he was approached specifically regarding the sustainability theme
and partnering with the University.

• [Agenda Item 3e(3)]... Rezoning Herbert Hoover Highway ...Council member Thomas
asked for confirmation that not all the land needed to be rezoned as multi -family. Mayor
Throgmorton stated he thought only the northern part needed to be but that they were
only setting the public hearing.
• [Agenda Item 3f(1)]... Lorraine Bowans: Thank you for your concern ... Mayor
Throgmorton acknowledged the correspondence and asked if there was anything that
could be done. City Manager Fruin stated that their concern was what the intention of
the rental cap was for and that would be one of the consequences that the City would
have to accept with the rental cap in place.
• [Agenda Item 3f(9)]... Adil Adams: The Sudanese farm at Tiffin ... Mayor Throgmorton
asked if anyone had to spoke to Mr. Adams about how to get an item on the agenda and
if there was more information regarding the item.
• [Agenda Item 3d(5)]... Hilton Garden Inn TIF Agreement ...Council member Cole
questioned why the developer wanted to make the change. City Manager Fruin
explained the changes in the project that necessitate the amendment.

Council members discussed the items listed in the City Managers memo [IP4 of the January
111 Information packet] and agreed to continue discussion at the February 6'h work session.
Action:
• City Manager will provide a memo outlining the discussed changes to the budget in the
next Information Packet and the scheduled Work Session on February 6th will be
extended and begin at 4:30 p.m.

A public hearing was held on an ordinance conditionally rezoning approximately .48
acres of property from Intensive Commercial (CI -1) zone to Riverlront Crossings -Central
Crossings Subdistrict (RFC -CX) zone located at 703, 705, and 709 S. Dubuque Street
(REZ17-00018). The Mayor requested Council members disclose any ex parte
communications and none were reported. Urban Planning Planner Karen Howard
presented a power point. Glen Meisner from MMS Consultants appeared.
Moved by Botchway, seconded by Salih, that the ordinance conditionally rezoning
approximately .48 acres of property from Intensive Commercial (CI -1) zone to Riverfront

expressed their opinions.
Moved by Mims, seconded by Thomas, that the ordinance rezoning approximately 3.6
acres (Sensitive Areas Plan for Lincoln School) of property from Neighborhood Public (P-
1) to Planned Development Overlay Neighborhood Public (OPD/P1) zone located at 300
Teeters Court (REZ17-00016), be given second vote. The Mayor requested Council
members disclose any ex parte communications and none were reported. The Mayor
declared the motion carried, 6/0/1, with the following division of roll call vote. Ayes: Mims,
Salih, Taylor, Thomas, Throgmorton, Cole. Nays: None. Abstaining: Botchway. Mayor Pro
tem Taylor and Council member Salih stated their support.

agreement, and estimate of cost for the construction of the Iowa City Public Housing
Roofing and Siding Replacement Project, establishing amount of bid security to
accompany each bid, directing City Clerk to post notice to bidders, and fixing time and
place for receipt of bids. No one appeared. Mayor Pro tem Taylor confirmed her support.

Assistant City Manager Monroe gave a brief summary of previous themed semesters at
the University. Mayor Pro tem asked if this item could be added to the Joint Entities
meeting agenda and Mayor Throgmorton requested staff to add the item.

Assessment schedule of unpaid mowing, clean-up of property, snow removal,
sidewalk repair, and stop box repair charges and directing the Clerk to certify the
same to the Johnson County Treasurer for collection in the same manner as
property taxes.

training; Historic Preservation Commission for a Jefferson St. representative to fill a three-
year term, July 1, 2016 — July 1, 2019 (New District formed); Telecommunications

City Council Information:
Council member Thomas reported attending a 'deliberative dialogue training' at
Kirkwood Community College with Mayor Throgmorton and Mayor Pro tem Taylor.
Council member Mims noted the Martin Luther King events at Grant Wood, the
Economic Forecast luncheon in Cedar Rapids, and an upcoming open house at the Free
Medical Clinic.
Mayor Pro tem Taylor stated she attended the following events: pinning ceremony for
Iowa City Firefighter Parker, the STEAM mural unveiling, and the Iowa City School
District Board meeting. Taylor mentioned an upcoming event on January 24th, a film
screening "At the River I Stand" at the IMU Illinois room.
Council member Botchway thanked committee members for planning events on
Martin Luther King Day, noted a community roundtable on January 22nd at Old Brick
Church, attending the Englert for Rebirth Brass Band, the Stand up and Speak Out event
at the Iowa City Public Library on January 20th, and the improv comedy cage match at
West High School on January 19tH
Council member Salih reported being a keynote speaker at Weber Elementary for
Martin Luther King Day, International night at Lincoln Elementary, and receiving many
calls regarding snow on sidewalks over the weekend.

Council member Cole commended the committee who planned the events for Martin
Luther King Day, the AME Church for their service, and Mayor Throgmorton and Council
member Botchway on their speeches. Cole also mentioned he would be going on a civil
rights tour with Henri Harper this summer.
Mayor Throgmorton noted he is also going on the tour, enjoyed the events of the
previous day for Martin Luther King Day, mentioned the great job Chief Matherly did
speaking at New Creations Church and Bethel AME. Mayor Throgmorton and the City
Manager also met with representatives of Gloria Dei Lutheran Church and will be having
a follow up meeting. Upcoming events for the Mayor include a strategic planning meeting
for the Convention and Visitors bureau on January 23rd, a Partnership for Alcohol Safety
meeting, lunch with Mayors Lundell and Donahue on January 31St, and a meeting with the
University of Iowa's Government Relations Committee on February 1St with Mayor Pro
tem Taylor.

Assistant City Manager Monroe reported on the final agreement and upcoming
assessments for solar voltaic systems that have potential at various City sites with Blue
Stem Energy Solutions, LLC.
