Item 2. Appeal of Historic Preservation Commission Decision — Deciding
the appeal to the City Council of the decision of the Historic
Preservation Commission denying a Certificate of Appropriateness
to apply aluminum siding at 318 N. Gilbert Street in the Northside
Historic District.
Comment: At its November 9, 2017 meeting, by a vote of 10-0, the Historic
Preservation Commission denied approval of a Certificate of Appropriateness for an
exception to the historic preservation guidelines to allow the application of aluminum
siding to the house located at 318 N. Gilbert Street. In a letter dated November 20,
2017, Juila Ella Leupold and Jerod Leupold, submitted an appeal of the
Commission's decision. In deciding the appeal, the City Council must consider
whether the Commission has exercised its powers and followed the adopted
guidelines. and whether the Commission's action was patently arbitrary and
capricious. After applying this standard of review, the City Council may in conformity
with the provisions of 14-8E-2 (D) (Historic Review section of the Zoning Code)
affirm the Commission's decision, or upon finding the Commission acted in error,
reverse or modify, wholly or partly, the decision. Written materials from the applicant
and the Commission are included in the Council packet.
