A public hearing was held on an ordinance conditionally rezoning approximately 1.89 acres from Planned Development Overlay/High Density Single Family (OPD/RS-12) zone to Low Density Multifamily (RM-12) zone for the property located at 1705 Prairie Du Chien Road (REZ18-00002). Moved by Botchway, seconded by Salih, to continue public hearing to May 15. Bob Guyer, Curt Moore, Nancy Penningroth appeared. Moved by Botchway, seconded by Mims to defer first vote to May 15 on an ordinance conditionally rezoning approximately 1.89 acres from Planned Development Overlay/High Density Single Family (OPD/RS-12) zone to Low Density Multifamily (RM-12) zone for the property located at 1705 Prairie Du Chien Road (REZ18-00002). Moved by Botchway, seconded by Salih, to accept correspondence from Ross Nusser and John Fenstemaker, rezoning protest petition signed by 36 individuals. Moved by Mims, seconded by Botchway, that the ordinance conditionally rezoning approximately 1.1 acres of property located at 225 and 225 1/2 Prentiss Street, from Intensive Commercial (CI-1) to Riverfront Crossings — Central Crossings (RFC-CX) (REZ18-00003), be given second vote. Moved by Salih, seconded by Botchway, that the ordinance conditionally rezoning approximately 0.62 acres of land from Community Commercial (CC-2) zone to Riverfront Crossings — West Riverfront (RFC-WR) zone for property located at 513 S. Riverside Drive (REZ17-00005), be given second vote. Mayor Throgmorton noted there were no renderings or elevations for the building. City Manager Fruin stated there are inconsistencies with applications and that a future discussion should take place by Council on the expectations for rezoning's. Moved by Taylor, seconded by Botchway, that the ordinance rezoning property located at 715 Park Road from Low Density Single Family Residential (RS-5) to RS-5 with a Historic Preservation Overlay (RS-5/OHP) Zone (REZ18-00011), be given second vote. Moved by Mims, seconded by Botchway, that the ordinance rezoning property located at 1029 North Dodge Street from Medium Density Single Family Residential (RS-8) to RS-8 with a Historic Preservation Overlay (RS-8/OHP) (REZ18-00010), be given second vote. Moved by Botchway, seconded by Salih, that the ordinance rezoning property located at 504 East Bloomington Street from Commercial Office (CO-1) to CO-1 with a Historic Preservation Overlay (CO-1/OHP) (REZ18-00012), be given second vote. Moved by Taylor, seconded by Botchway, that the ordinance rezoning property located at 213 East Market Street from Central Business Support (CB-5) to CB-5 with a Historic Preservation Overlay (CB-5/OHP) (REZ18-00009), be given second vote. Complete Description May 1, 2018 Page 4 A public hearing was held on a resolution authorizing the filing of an application with the Iowa Department of Transportation for FY2019 Iowa DOT State Transit Assistance and Federal Transit Administration Funding. City Manager Fruin stated this was an annual filing. Moved by Botchway, seconded by Thomas, to adopt Res. 18-127, authorizing the filing of an application with the Iowa Department of Transportation for FY2019 Iowa DOT State Transit Assistance and Federal Transit Administration Funding. A public hearing was held on a resolution approving plans, specifications, form of agreement, and estimate of cost for the construction of the Asphalt Resurfacing 2018 — US Hwy 6 (N Riverside Drive) Rocky Shore Drive to Sturgis Corner Drive Project, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. A public hearing was held on a resolution authorizing conveyance (Univer-City Sale) of a single family home located at 115 North Dodge Street. Moved by Botchway, seconded by Mims, to adopt Res. 18-131, authorizing conveyance (Univer-City Sale) of a single family home located at 115 North Dodge Street. Individual Council members expressed their views. Neighborhood & Development Services Director Hightshoe and Housing Administrator Rackis presented information. A public hearing was held on a resolution authorizing conveyance (Univer-City Sale) of a single family home located at 619 North Johnson Street. Moved by Mims, seconded by Botchway, to adopt Res. 18-132, authorizing conveyance (Univer-City Sale) of a single family home located at 619 North Johnson Street. Moved by Mims, seconded by Botchway, that Ord. 18-4746, providing that general property taxes levied and collected each year on all property located within the 2017 Amended Riverside Drive Urban Renewal Area, in the City of Iowa City, County of Johnson, State of Iowa, by and for the benefit of the State of Iowa, City of Iowa City, County of Johnson, Iowa City Community School District and other taxing districts, be paid to a special fund for payment of principal and interest on loans, rebates, grants, monies advanced to and indebtedness, including bonds issued or to be issued, incurred by said city in connection with the Riverside Drive Urban Renewal Plan (Establish TIF District), be passed and adopted. Moved by Thomas, seconded by Botchway, that Ord. 18-4747, providing that general property taxes levied and collected each year on all property located within that area added to the Foster Road Urban Renewal Area in the City of Iowa City, Iowa, by and for the benefit of the State of Iowa, City of Iowa City, County of Johnson, Iowa City Community School District and other taxing districts, be paid to a special fund for payment of principal and interest on loans, rebates, grants, monies advanced to and indebtedness, including bonds issued or to be issued, incurred by said city in connection with the Foster Road Urban Renewal Plan (Establish TIF District), be passed and adopted. Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 18-4748, amending Title 10, entitled "Public Ways And Property," Chapter 5, entitled "City Plaza," to allow an association of downtown businesses to place a commercial structure on City Plaza under limited circumstances for more than 45 days in 2018 and 2019, be voted on for final passage at this time. Moved by Mims, seconded by Thomas, that the ordinance be finally adopted at this time. Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 18-4749, amending Title 14, "Zoning Code", Chapter 7, "Administration", Article A, "Administration," Section 2 "Board of Adjustment" to provide for an alternate temporary appointment when a Board member is unable to participate in an appeal due to a conflict of interest, be voted on for final passage at this time. Moved by Mims, seconded by Botchway, that the ordinance be finally adopted at this time. Individual Council members expressed their views. Moved by Mims, seconded by Taylor, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that Ord. 18-4750, amending Title 5, entitled "Business and License Complete Description May 1, 2018 Page 6 Regulations," Chapter 2, entitled "Taxicabs," to allow for "soft" taximeters and for taxicab business licenses to be sold, be voted on for final passage at this time. Assistant City Manager Monroe noted the Terry Trueblood project as a partial recipient of the sustainability partnership grant, the Iowa City Airport tour on May 4th and May 18th and her new role as Interim Coordinator at the Senior Center. Senior Center maintenance positions ...Mayor Pro tern Taylor asked for clarification on which departments budget the salaries would come out of. • [Agenda Item 5h]... Rezoning Historic Landmark Designation 319 East Bloomington Street ... Mayor Throgmorton inquired if the work session would be the appropriate time to discuss deferral of the item. City Attorney Dilkes directed the Mayor to wait for discussion until the public hearing. • [Agenda Item 3e(4)and Item 3e(5)]... Univer-City Sale— 115 North Dodge and 619 North Johnson...Council member Salih asked if the correct time to ask questions would be at the April 17 formal meeting. City Manager Fruin explained that they were only setting the public hearing and the appropriate time to discuss would be when the public hearing is held at the May 1 meeting. • [Agenda Item 3e(1)]... Rezoning 1705 Prairie Du Chien Road ...Mayor Pro tem Taylor asked if there was any information available regarding the displacement of the residents. City Manager Fruin stated there was not at this time, but the applicant should be expected to answer that at the public hearing. Information Packet Discussion !April 5, April 121 ➢ April 5 1. (IP2, Email from Mayor Throgmorton: Please make our city a net neutrality city-- sign the Cities Open Internet Pledge) Mayor Throgmorton stated he had received numerous emails asking to join other mayors in signing the Cities Open Internet Pledge and asked if the Council would like to have a discussion. City Manager Fruin asked to report back to the Council with additional information on the topic before discussion. Action: In the next information packet, CMO will include an explanation of what actions the pledge supports. 2. (IP7, Community Police Review Board Community Forum: April 23) Council member Mims mentioned the forum date and that it was being held at the IC Public Library. (IP5, Memo from Neighborhood and Development Services Director: Affordable Housing Action Plan Update) Council member Salih had some suggestions she would like to see added to the table of information. Individual Council members expressed their views. Action: NDS will update the the Affordable Housing Action Plan Chart(#9)to reflect the new occupancy standards and staff will continue to develop performance metrics. 4. (IP6, Letter from William Lesser, FEMA Federal Insurance and Mitigation Administration: National Flood Insurance Rating) Mayor Throgmorton noted the change in the rating which should lower the cost of flood insurance. 6. Student Liaison Alternate Stewart: The hidden crisis on college campuses) Mayor Pro tem Taylor thanked the UISG Alternate Liaison Stewart for the article and asked how the City could help. Stewart informed the Council of current programs and looked forward to possible coordinated efforts between the University and the City. 3. (IP8, Bar Check— March 2018) Council member Thomas inquired if the information was useful to Council. City Manager Fruin stated that the information is used to determine whether exception certificates to businesses should be issued. Individual Council members expressed their views. 4. (Pending Work Session Topics) Mayor Throgmorton stated there was not a topic for the May 1 meeting. City Manager Fruin indicated some topics that would be ready for discussion.
