The City of Iowa City shall provide public transit service to the City of University Heights. Iowa City shall determine the scheduling of buses, the routes, and the location of bus stops within University Heights. It is agreed that residents of University Heights will obtain the same level of transit service as residents of Iowa City who are served by the same routes. Residents of University Heights will also be eligible for the same fare structure as Iowa City residents. //. Duration The term of this agreement shall commence July 1, 2018, and continue through and including June 30, 2019. ///. Termination This agreement may be terminated upon thirty calendar days written notice by either party. In the event of termination, Iowa City shall provide public transit service through the last day of the thirty -day notice period, and University Heights shall pay for all services rendered, including those rendered in the thirty -day period. /V. Compensation The City of University Heights agrees to pay $38,299 for the provision of public transit service as herein described during FY2019. Payment shall be made in twelve monthly payments of $3,191.58 each, to be received by the City of Iowa City on or before the 15th of each month. Recommendations: Staff: Approval Commission: N/A Attachments: 28E Agreement, Resolutions Executive Summary: The City of Iowa City Transportation Services department currently operates transit service for the City of University Heights utilizing a 28E Agreement for FY18. This resolution will continue that service through FY19 for a contracted payment of $38,299. Background / Analysis: University Heights has contracted with the City of Iowa City for transit services since the 1970's. Currently Iowa City Transit provides service with five routes during peak service, which include the Melrose Express, Oakcrest, Plaen View, Westside, Hospital and Westwinds routes. This serves Melrose Avenue and Sunset Street with roughly 90 trips per day. The contract amount is based on a formula which considers the Consumer Price Index as an escalator of the previous year's contract. This contract is then submitted to the City of University Heights for approval. The University Heights City Council approved this agreement at their March 61, 2018 meeting. Per this agreement, University Heights agrees to pay an amount of $38,299 for the contracted fixed route transit services in FY19. Whereas, MidAmerican Energy Company is removing their existing power poles and overhead electric lines, and installing the underground electric along the length of the City's Rochester Sidewalk Infill Project in order to accommodate the project; and, Whereas, undergrounding of the utilities requires a switchgear and there is not enough room in the right of way to place the switchgear; and Whereas, MidAmerican will bear the cost of undergrounding the utilities but requires a 15 foot by 15 foot underground utility easement on City property to accommodate the switchgear. In consideration of such grant, Grantee agrees that it will repair or pay for any damage which may be caused to crops, fences, or other property, real or personal of the Grantor by the construction, reconstruction, maintenance, operation, replacement or removal of the Facilities (except for damage to property placed subsequent to the granting of this easement) that Grantee determines interferes with the operation and maintenance of the Facilities and associated equipment The cutting, recutting, trimming and removal of trees, branches, saplings, brush or other vegetation on or adjacent to the Easement Area is expected and not considered damage to the Grantor. 5. Additionally, when Grantor provides or installs duct/conduit for said Facilities, this grant shall cover and include all Facilities installed as a part of the Easement Area. 6. Grantor certifies that it is not acting, directly or indirectly, for or on behalf of any person, group, entity or nation named by any Executive Order or the United States Treasury Department as a terrorist, "Specially Designated National and Blocked Person" or any other banned or blocked person, entity, nation or transaction pursuant to any law, order, rule or regulation that is enforced or administered by the Office of Foreign Assets Control; and are not engaged in this transaction, directly or indirectly, on behalf of, any such person, group, entity or nation. In the event of any matter of dispute arising out of or related to this easement, it is agreed between the parties that the law of the jurisdiction and location where this easement is recorded (including statute of limitation provisions) will govern the interpretation, validity and effect of this easement without regard to the place of execution or place of performance thereof, or any conflicts or law provisions. Background / Analysis: MidAMerican Energy Company has power poles that conflict with the proposed location of the Rochester Sidewalk Infill project between the City's water storage site at 2410 Rochester Avenue and Bluffwood Lane. With the limited distance between the back of curb of Rochester Avenue and the right-of-way line, there is no good place to relocate the power poles to accommodate the proposed sidewalk. After meeting and discussing with MidAmerican Energy Company, it was determined that the best option would be to go underground with the electric lines. In order to install the electric lines underground, a switchgear is needed. Since there is not room in the right-of-way for the switchgear, the switchgear will need to be located outside the right-of-way on the City's property at 2410 Rochester Avenue. There is nothing in the location of the proposed easement and city staff recommends granting the easement. Since MidAmerican Energy Company is removing their existing power poles and overhead electric lines, installing a switchgear, and installing the underground electric along the length of the City's Rochester Sidewalk Infill Project in order to accommodate the project, and since the easement is needed to have the space to install the switchgear, the City is not going to have MidAmerican pay for the easement. TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF BEER AND WINE DURING IOWA ARTS FESTIVAL AND IOWA CITY JAZZ FESTIVAL This Agreement is made between Summer of the Arts, Inc. ("SOTA") and the City of Iowa City, a municipal corporation ("City"), in Iowa City, Iowa. WHEREAS, SOTA is an "authorized entity" as that term is defined in section 4-5-3D of the City Code; WHEREAS, SOTA has applied for a license to sell beer and wine during the Iowa Arts Festival ("Arts Fest") and the Iowa City Jazz Festival ("Jazz Fest") in downtown Iowa City; and WHEREAS, the parties wish to enter into an agreement to allow SOTA to sell beer and wine and to allow persons to possess and consume beer and native wines under limited circumstances on downtown City streets. THE PARTIES THEREFORE AGREE AS FOLLOWS: 1. Authorized Site. a) Arts Fest. In consideration for SOTA's promises herein, the City agrees to allow SOTA control over the area in the 100 -block of Iowa Avenue as shown on the diagram which is attached, marked Exhibit A, and incorporated herein ("Arts Fest authorized site") during the Term of this agreement. b) Jazz Fest. In consideration for SOTA's promises herein, the City agrees to allow SOTA control over the area east of Schaeffer Hall on N. Clinton Street as shown on the diagram which is attached, marked Exhibit B, and incorporated herein ("Jazz Fest authorized site") during the Term of this agreement. 2. Term. This agreement shall commence at 6:00 pm on May 31, 2018 and shall expire at 4:00 pm on June 3, 2018 for Arts Fest and shall commence again at 6:00 pm on June 28, 2018 and shall expire again at 11:00 pm on July 1, 2018 for Jazz Fest. More particularly, alcohol may only be sold and possessed on the Arts Fest authorized site during the following hours: May 31: 6pm-9pm; June 1: 4pm-11pm; June 2: noon-11pm; and June 3: noon-4pm. More particularly, alcohol may only be sold and possessed on the Jazz Fest authorized site during the following hours: June 28: 6pm — 9pm; June 29: 4pm — 11pm; June 30: 11:30am-11pm; and July 1: 11:30 am-11pm. 3. Access. SOTA shall take all reasonable steps to ensure that every person on the authorized site has a stamp or wrist band for entry or is an employee of, an independent contractor of, or volunteer for SOTA and shall exclude any person who is not. 4. License. This agreement is void if SOTA does not have a license to sell beer and wines on the Arts Fest authorized site at any time during the period of May 31, 2018 through June 3, 2018, on the Jazz Fest authorized site at any time during the period of June 28, 2018 through July 1, 2018. 5. Sale of Beer and Alcohol Restrictions. SOTA shall only sell beer to a person who is over twenty-one (21) years of age. SOTA acknowledges that the authorized sites are subject to all applicable alcohol restrictions in the City Code including Ordinance No. 104388 that restricts entry to those over twenty-one (21) years of age after 10:00 p.m. with limited exception. 6. Advertisement. SOTA shall not, nor shall it allow anyone to, erect or place any sign or other matter advertising any brand of alcoholic liquor, beer, or wine upon the authorized site with the exception that signage may be placed on the interior tent wall. Sponsorship signage unrelated to businesses selling alcohol, beer, wine, or tobacco will be allowed. 7. Inspection. City staff, including the Iowa City Police Department, may periodically inspect the authorized sites without any prior notice to determine compliance with the terms of this agreement. B. Debris and Trash. SOTA shall be solely responsible for collecting all debris and trash from the authorized sites, and the City shall then remove the debris and trash. If SOTA fails to do so and if City staff has to collect the debris and trash from the authorized sites, SOTA may be responsible for the cost incurred by the City, including staff time, and shall pay the costs in full within thirty (30) days of receiving an invoice. 9. No Smoking. Smoking is prohibited in the authorized sites, and SOTA shall post a no -smoking a sign at the front entrance to the authorized sites and two signs inside the authorized sites. The signs shall comply with Iowa Code Section 142D.6 (2017). Additionally, the use of electronic cigarettes is prohibited. Electronic cigarette means vapor product as defined in Section 453A.1 of the Code of Iowa (2017). 10.Temporary Toilet Facilities. SOTA shall provide at its sole cost eight (8) temporary toilet facilities during Arts Fest in the location shown on Exhibit A, ten (10) temporary toilet facilities during Jazz Fest in the location shown on Exhibit B, including two (2) that are handicap accessible. 11. Occupancy and Exits. The maximum occupancy load of the Arts Fest authorized site is 313 persons and the Jazz Fest authorized site is 352, and SOTA is solely responsible for maintaining the occupancy limits. SOTA shall post a sign with the maximum occupancy load inside the authorized site. SOTA shall maintain two (2) exits in each authorized site and post "exit' signs at both exits, with the location and size of the signs to be approved by the City Fire Department. Each exit must be a minimum 36 inches in width. 12. Anchoring and Drilling. SOTA shall not drill any holes into the pavement or the sidewalk and shall not anchor a tent tie down or pole to the pavement or the sidewalk. 13. Fencing. At a minimum, the authorized site shall be enclosed by a double row of fencing. If available, the City prefers a fencing product that is a single fence 2 that consists of six feet (6) interlocking panels with a mesh that does not allow for a container of beer or wine to get passed from through the fencing. 14. Fire Lane. SOTA shall maintain a fire lane of twenty feet (20') between the outside fence and the vendors across the street, unless approved by the Fire Code Official. 15. Insurance. a) Premises Insurance. From May 31, 2018 through June 3, 2018 and from June 28, 2018 through July 1, 2018. SOTA shall carry comprehensive general liability insurance for bodily injury and property damage on the Arts Fest and Jazz Fest authorized sites respectively in the amount of $1,000,000 (one million dollars) for each occurrence and $2,000,000 (two million dollars) in the aggregate and shall name the City as an additional insured. SOTA shall fumish a copy of a certificate of insurance for same, satisfactory to the City at the time of execution of this agreement. SOTA shall provide thirty (30) days notice to the City before cancellation of said insurance, and said cancellation shall automatically terminate this Agreement. b) Dram Shoo Insurance. From May 31, 2018 through June 3, 2018 and from June 28, 2018 through July 1, 2018 SOTA shall carry "dram shop" insurance in compliance with Iowa Code section 123.92 (2017) in the amount of $500,000 (five hundred thousand dollars). SOTA shall provide thirty (30) days notice to the City before cancellation of said insurance, and said cancellation shall automatically terminate this Agreement. c) Governmental Immunities Endorsement. SOTA shall obtain a governmental immunities endorsement that meets the requirements set forth on Exhibit C, which is attached and incorporated herein. 16. Indemnification. SOTA shall pay on behalf of the City all sums which the City shall be obligated to pay by reason of any liability imposed upon the City for damages of any kind resulting from the use of the authorized sight or sale, consumption, or possession of beer and native wines on the authorized site, whether sustained by any person or person, caused by accident or otherwise and shall defend at its own expense and on behalf of the City, its officers, employees and agents any claim against the City, its officers, employees, and agents arising out of the use of the authorized site or sale, consumption, or possession of beer and native wines on the Arts Fest and Jazz Fest authorized sites. 17. Non -Discrimination. SOTA shall not discriminate against any person in employment or public accommodation because of race, religion, color, creed, gender identity, sex, national origin, sexual orientation, mental or physical disability, marital status or age. "Employment" shall include but not be limited to hiring, accepting, registering, classifying, promoting, or referring to employment. "Public accommodation" shall include but not be limited to providing goods, services, facilities, privileges and advantages to the public. 18. Termination. The City may terminate this agreement upon written notice for violation of any provision of this agreement. 19. Assignment and Subletting. SOTA shall not assign or sublet this agreement without prior written approval of the City. 20. Entire Agreement. Claims Coverage. Washington St., Iowa City, IA 52240;319/356.5030 2018 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA CITY DOWNTOWN SELF - SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF BEER AND WINE DURING THE 100 MEN & WOMEN WHO CARE EVENT, NORTHSIDE OKTOBERFEST, AND FARM TO STREET DINNER This Agreement is made between Iowa City Downtown Self Supported Municipal Improvement District, d/b/a Iowa City Downtown District ("District") and the City of Iowa City, a municipal corporation ("City"), in Iowa City, Iowa. WHEREAS, District is an "authorized entity" as that term is defined in section 4-5- 3D of the City Code; WHEREAS, District has applied for a license to sell beer and wine during the 100 Men & Women Who Care event, Farm to Street dinner and the Northside Oktoberfest; and WHEREAS, the parties wish to enter into an agreement to allow District to sell beer and wine and to allow persons to possess and consume beer and wine under limited circumstances on downtown City streets. THE PARTIES THEREFORE AGREE AS FOLLOWS: 1. Authorized Site. a) Farm to Street. In consideration for District's promises herein, the City agrees to allow District control over an area in the 100 block of North Linn on August 16, 2018 from 4:00 pm to 10:00 pm as shown on the diagram which is attached, marked Exhibit A, and incorporated herein ("Farm to Street authorized site"). District must allow members of the public not participating in the event to walk through the Authorized Site on the sidewalk and keep the alley open for vehicle access. b) Oktoberfest. In consideration for District's promises herein, the City agrees to allow District control over the area in the 200 - 300 block of Market Street, the City parking lot in the 300 block, and 100-200 block of N. Linn St. on September 29, 2018 from 10:00 am to 6:00 pm as shown on the diagram which is attached, marked Exhibit B, and incorporated herein ("Oktoberfest authorized site"). District must allow members of the public not participating in the event to walk through the Authorized Site on the sidewalk. c) 100 Men & Women. In consideration for District's promises herein, the City agrees to allow District control over the area in the 100 block of N. Linn St. on June 7, 2018 from 4:00 pm to 9:00 pm as shown on the diagram which is attached, marked Exhibit C, and incorporated herein ("100 Men & Women authorized site"). District must allow members of the public not participating in the event to walk through the Authorized Site on the sidewalk and keep the alley open for vehicle access. 2. Term. This agreement shall be in effect only on June 7, 2018 for 100 Men & Women Who Care, on August 16, 2018 for Farm to Street, and on September 29, 2018 for Oktoberfest. 3. Access. District shall take all reasonable steps to ensure that only persons over twenty-one (21) years of age have access to beer and wine. Said reasonable steps include, but are not limited to, ensuring that: a) all persons over twenty-one (21) years of age shall be provided a wrist band and an approved container upon purchase of beer or wine; and b) no one may possess an open container of beer or wine unless it is in an approved container and the person is wearing a wrist band. Approved container means a glass or cup that is approved by the City prior to the event. If the District observes anyone in possession of an open container of beer or wine (or any type of alcohol) that is not in an approved container or anyone in possession of an approved container with beer or wine who does not have a wrist band, the District shall immediately request that the person pour out the liquid. If the person refuses to do so, the District shall immediately contact the Iowa City Police Department. 4. License. This agreement is void if District does not have a license to sell beer on the 100 Men & Women authorized site on June 7, 2018, beer and wine on the Farm to Street authorized site on August 16, 2018, and beer on the Oktoberfest authorized site on September 29, 2018. 5. Sale of Beer/Wine and Alcohol Restrictions. District shall only sell beer and wine to a person who is over twenty-one (21) years of age. District acknowledges that the authorized sites are subject to all applicable alcohol restrictions in the City Code. 6. Advertisement. District shall not, nor shall it allow anyone to, erect or place any sign or other matter advertising any brand of alcoholic liquor, beer, or wine upon the authorized site with the exception that signage may be placed on the interior and exterior tent walls. Sponsorship signage unrelated to businesses selling alcohol, beer, wine, or tobacco will be allowed. 7. Inspection. City staff, including the Iowa City Police Department, may periodically inspect the authorized sites without any prior notice to determine compliance with the terms of this agreement. 8. Debris and Trash. District shall be solely responsible for collecting all debris and trash from the authorized sites, and the City shall then remove the debris and trash. If District fails to do so and if City staff has to collect the debris and trash from the authorized sites, District may be responsible for the cost incurred by the City, including staff time, and shall pay the costs in full within thirty (30) days of receiving an invoice. 9. No Smoking. Smoking is prohibited in the City parking lot, and District shall post two no -smoking signs in said lot. The signs shall comply with Iowa Code Section 142D.6 (2017). Additionally, the use of electronic cigarettes is prohibited in the parking lot. Electronic cigarette means vapor product as defined in Section 453A.1 of the Code of Iowa (2017). 10. Temporary Toilet Facilities and Hand Washing Stations. a) Oktoberfest. District shall provide at its sole cost sixty (60) temporary toilet facilities in the location shown on Exhibit A, including two (2) that are handicap accessible. District shall further provide at its sole cost thirty (30) hand washing stations adjacent to the facilities unless the facilities themselves are equipped with hand washing stations. b) Farm to Street. Toilet Facilities shall be available at High Ground Cafe. c) 100 Who Care. Toilet Facilities shall be available at one or more restaurants in the 100 block of N. Linn Street. 11. Exits. District shall maintain at least three (3) exits in the authorized site and post "exit" signs at all exits, with the location and size of the signs to be approved by the City Fire Department. Each exit must be a minimum 36 inches in width. 12. Anchoring and Drilling. District shall not drill any holes into the pavement or the sidewalk and shall not anchor a tent tie down or pole to the pavement or the sidewalk. 13. Fencin . a) Oktoberfest. At a minimum, the Oktoberfest authorized site shall be enclosed by a double row of fencing. If available, the City prefers a fencing product that is a single fence that consists of six feet (6') interlocking panels with a mesh that does not allow for a container of beer to get passed from through the fencing. b) Farm to Street. The Farm to Street authorized site shall be enclosed on the north and south sides by a fencing product that is 4 feet tall, double barricaded with 4 feet in between, such that a container of alcohol cannot get passed through the fencing. c) 100 Men & Women. The 100 Men & Women authorized site shall be enclosed on the north and south sides by a fencing product that is 4 feet tall, double barricaded with 4 feet in between, such that a container of alcohol cannot get passed through the fencing. 14. Insurance. a) Premises Insurance. On June 7, 2018, August 16, 2018 and September 29, 2018, District shall carry comprehensive general liability insurance for bodily injury and property damage on the authorized site in the amount of $1,000,000 (one million dollars) for each occurrence and $2,000,000 (two million dollars) in the aggregate and shall name the City as an additional insured. District shall furnish a copy of a certificate of insurance for same, satisfactory to the City at the time of execution of this agreement. District shall notify the City 1 week before cancellation of said insurance, and said cancellation shall automatically terminate this Agreement. b) Dram Shop Insurance. On June 7, 2018, August 18, 2018 and September 29, 2018, District shall carry "dram shop" insurance in compliance with Iowa Code section 123.92 (2017) in the amount of $500,000 (five hundred thousand dollars). District shall provide 1 week notice to the City before cancellation of said insurance, and said cancellation shall automatically terminate this Agreement. 3 c) Governmental Immunities Endorsement. District shall obtain a governmental immunities endorsement that meets the requirements set forth on Exhibit C, which is attached and incorporated herein. 16. Indemnification. District shall pay on behalf of the City all sums which the City shall be obligated to pay by reason of any liability imposed upon the City for damages of any kind resulting from the use of the authorized sight or sale, consumption, or possession of beer on the authorized site, whether sustained by any person or person, caused by accident or otherwise and shall defend at its own expense and on behalf of the City, its officers, employees and agents any claim against the City, its officers, employees, and agents arising out of the use of the authorized site or sale, consumption, or possession of beer on the authorized site. 17. Non -Discrimination. District shall not discriminate against any person in employment or public accommodation because of race, religion, color, creed, gender identity, sex, national origin, sexual orientation, mental or physical disability, marital status or age. "Employment" shall include but not be limited to hiring, accepting, registering, classifying, promoting, or referring to employment. "Public accommodation" shall include but not be limited to providing goods, services, facilities, privileges and advantages to the public. 18. Termination. The City may terminate this agreement upon written notice for violation of any provision of this agreement. 19. Assignment and Subletting. District shall not assign or sublet this agreement without prior written approval of the City. 20. Entire Agreement. Non -waiver of Government Immunity. The insurance carrier expressly agrees and states that the purchase of this policy and the including of the City of Iowa City, Iowa as Additional Insured does not waive any of the defenses of governmental immunity available to the City of Iowa City, Iowa, under Code of Iowa Section 670.4 as it now exists and as it may be amended from time to time. 2. Claims Coverage. The insurance carrier further agrees that this policy of insurance shall cover only those claims not subject to the defense of governmental immunity under the Code of Iowa Section 670.4 as it now exists and as it may be amended from time to time. Those claims not subject to Code of Iowa Section 670.4 shall be covered by the terms and conditions of this insurance policy. 3. Assertion of Government Immunity. The City of Iowa City, Iowa shall be responsible for asserting any defense of governmental immunity, and may do so at any time and shall do so upon the timely written request of the insurance carrier. Nothing contained in this endorsement shall prevent the carrier from asserting the defense of governmental immunity on behalf of the City of Iowa City. 4. Non -Denial of Coverage. The insurance carrier shall not deny coverage under this policy and the insurance carrier shall not deny any of the rights and benefits accruing to the City of Iowa City, Iowa under this policy for reasons of governmental immunity unless and until a court of competent jurisdiction has ruled in favor of the defense(s) of governmental immunity asserted by the City of Iowa City, Iowa. 5. No Other Change in Policy. The majority of the revenues being amended are for Charges for Services, Miscellaneous revenues, and Transfers In. Charges for Services (line 10) are being amended by $445,500 primarily for the receipt of an 'Affordable Housing Fee in Lieu of and additional Water Meter sales. Miscellaneous revenues (line 12) are being amended by $373,100 primarily due to the receipt of Police funding for Data Driven Justice and budgeted donations for the Animal Center expansion study and project. Lastly, Transfers In (line 14) are being amended by $330,000 primarily due to the transfer for the Van Buren Water Main/Storm Sewer project. The section entitled Expenditures & Other Financial Uses (lines 16-28) provides for an increase in appropriations of $1,361,412. The majority of the increase in appropriations is related to governmental capital improvement projects that have been added (line 23) and total $485,000. The property was annexed in 2008 and rezoned to General Industrial with a Planned Development Overlay (OPD / 1-1) in 2010. At the time of this rezoning, a preliminary plat was also approved for the three -lot subdivision, Iowa City Industrial Campus. Preliminary plats expire after 24 months, so the preliminary plat for Iowa City Industrial Campus expired in 2012. At this time, the applicant is seeking reapproval of this preliminary plat. The preliminary plat is consistent with the previously approved plat. Comprehensive Plan: The subject property is located within the Southeast District. The Comprehensive Plan indicates that this area is appropriate for industrial uses, and this area was purchased by the City for the purpose of providing land for an industrial park as an economic development strategy to encourage diversification of the industrial tax base. The property is contiguous with existing industrial land and located next to a rail line and major truck routes to Interstate 80 and Highway 6, making it ideally suited for industrial development. Subdivision Regulations: The preliminary plat of Iowa City Industrial Campus includes 3 lots and 3 outlots. Lot 1 has access from Compass Drive, located west of the subject property, and Lots 2 and 3 have access from 420'" Street. The subject property also includes a railroad spur that extends south between Lots 2 and 3. Two of the outlots, Outlots A and C, are reserved for future development. The third outlot, Outlot B, is a wetland mitigation area. The location and acreage of these lots are consistent with the previously approved preliminary plat. Environmentally Sensitive Areas: At the time of rezoning, wetland restoration was conducted to enhance and replace low quality wetlands that were located throughout the subject area. These restored wetlands are located in Outlot B, which is reserved as a wetland mitigation area in the preliminary plat. Stormwater management: Storm sewers will be constructed within the ROW of the proposed streets and drainage easements are shown on the preliminary plat to allow for future stormwater basins to be built at the time of development. At the time of development each lot will be required to provide appropriately -sized stormwater basins to handle run-off. The enhanced and created wetlands in Outlot B will also provide natural stormwater filtering and drainage functions for the area. Miklo stated the annexation and rezoning of this property was approved a number of years ago. A preliminary plat was also approved at that time. However, preliminary plats are valid for two years so the plat has expired and the City is now seeking reapproval of basically the same design with a couple of changes. The original design had the area south of 420th Street broken into smaller lots and they are now proposing to leave that as one outlot for future development so it would come back before the Commission if it were to be subdivided. The plan also has an outlot that covers the wetland area. There would be three industrial lots for development with access to 4201h Street. Freerks opened the public hearing. Seeing no one Freerks closed the public hearing. Public Housing Capital Fund The omnibus provides $2.75 billion for the Capital Fund, $808.5 million more than FY 2017 funding. The omnibus includes $2.122 billion more than the Presi- dent's 2018 budget, $805 million more than the Senate bill, and $900 million more than the House bill. NAHRO has long worked to see increases to the Capital Fund and is pleased that the omnibus provides such a significant increase compared to 2017 funding levels. Affordable housing is a contrib- uting factor to stabilizing families. Stable families are better equipped to take advantage of educational opportunities. With opportunities for and access to advanced education and training, families increase their employability. Sustainable employment offers opportunities to attain self-sufficiency. Economic self -sufficiency leads to a better society and strengthens the "sense of community." Through our Self -Sufficiency programs, the Housing Authority is helping low income families bridge the economic gap by building assets, improving employ- ment opportunities, and transitioning from renters of units to owners of homes. First-time homebuyers with a household income of less than 80% of the Area Median Income (AMI) may be eligible for a forgivable loan for down payment assistance. From May 2011 to May 2015, the Iowa City Housing Authority provided $102,276 in down payment assistance to sixteen (16) families purchasing a Uni- verCity home. In FY2014, the ICHA allocated $170,000 to the UniverCry Neighborhood Part- nership for the rehabilitation of homes purchased by the City of Iowa City, In FY 2015, an additional $20,000 was allocated for rehabilitation of homes. The uses of the cash sources are based on relevant HUD notices and signed agreements between the Housing Authority and HUD. Housing Choice Voucher (HCV) Administrative Fees Administrative fees are available to the ICHA for the operation and manage- ment of the HCV program. Starting January 31, 2004, HUD and Congress, through the approval of the Annual Appropriations Act, restricted the use of ad- ministrative fee income to activities related to the HCV tenant -based rental assis- tance and related development activities (PIH Notice 2008-15). Housing Assistance Payments (HAP) HUD provided funds to cover the housing subsidy paid to owners/landlords directly by the ICHA on behalf of the participating family. The family pays the difference between the actual rent charged by the landlord and the amount subsidized by the program. Under certain circumstances, if authorized by the ICHA, a family may use its voucher to purchase a modest home. HUD/Veterans' Affairs Supportive Housing (VASH) This is tenant based rental assistance funds targeting homeless veterans partici- pating in VA Case Management Services, Family Self -Sufficiency (FSS) The FSS program is a tenant self-sufficiency work incentive program. ICHA estab- lishes cash accounts for FSS program participants that will be available to them if they complete the program. ICHA's contributions to these accounts are funded by HUD through the ICHA's regular funding process. FSS ash is not available to ICHA for any other use. Public Housing Operations Under Section 9(3) of the Housing Act of 1937, Operating Funds are available to the ICHA for the operation and management of the Public Housing program. These funds assist the ICHA in bridging the gap between the rent collected and the operating expenses of the program. Operating cash is only available for the use and benefit of public housing units and residents. Page 17 Annual Report — 2018 Housing Authority Capitol Fund Grants HUD provides funds to the ICHA to improve the physical condition, upgrade the management and operation and carry out other activities for Public Housing developments. These funds are primarily used for general maintenance and re- pair of the Public Housing units. As necessary, these funds will also be used to upgrade structures, interiors, HVAC systems and appliances. Capital Funds are calculated and allocated by an established formula. Affordable Dream Homeownership Program (ADHOP) On September 3, 1993, the ICHA entered into a Section S(h) Agreement with HUD. The purpose of this program is to create affordable home ownership oppor- tunities throughout Iowa City. This agreement authorizes the ICHA to sell Public Housing units and use the sales proceeds to construct or purchase homes for reha- bilitation to continue the cycle. To ensure affordability, the ICHA provides a sec- ond mortgage for the homeowners. Broadway Sales Proceeds ICHA received approval from HUD for the sale of 18 units at 1926/1946 Broadway Street, Iowa City, Iowa. Per the approved plan submitted to HUD, the sales pro- ceeds were to be used for the development of 18 low-density scattered site re- placement units that would be more efficiently and effectively operated as lower income housing. There is no other permissible use of these funds per the agree- ment Public Housing Tenant Security Deposits The ICHA holds security deposits until tenants vacate units. At that time, the ten- ants receive a full or partial refund depending on such factors as remaining rental or other charges outstanding and reimbursement of damage repairs. Tenant security deposit cash is not available to ICHA for any other use. Detailed credit considerations Economy and tax base: growing tax base benefits from institutional presence Iowa City's economy and tax base are poised for growth given positive demographic trends, ongoing development, and the presence of several large institutions. The city serves as a regional economic center for much of eastern Iowa. The University of Iowa and the University of Iowa Hospitals and Clinics (Aa2 stable) are the city's largest employers, with over 19,600 and 10,400 staff, respectively. The city's labor market is sound and experienced minimal contraction during the recession. As of December 2017, the city's unemployment rate was 1.9016, well below the state (2.8%) and national (3.9%) rates for the same period. Median family income, 114.8% of the national median, is low for Aaa rated cities but is deflated due to a significant college student population. The city's $5.9 billion tax base grew at a compound annual growth rate of 4.8% in the five years through 2017. These trends are expected to continue given the substantial amount of new commercial and residential development that is taking place throughout the city. Financial operations and reserves: very strong reserves and stable operations The city's financial position, which consists of stable operations and healthy reserves, will remain strong. Aided by steady revenue growth, the C&r has increased its available reserves in each of the last eight years. While the city fully utilizes its $810 per $1,000 general levy, it maintains $2.4 million of untapped capacity in its emergency and employee benefits levies. Additionally, the city is not currently utilizing the fully available 5% franchise fee on electric and gas bills, which would generate up to $4.0 million if fully tapped. Collectively, the city's available revenue raising flexibility amounts to nearly 10% of annual operating revenue. LIQUIDITY The city closed fiscal 2017 with an $80.0 million cash balance, equal to 112% of operating revenues. This figure includes $10.3 million of restricted sales tax reserves that are committed to various infrastructure projects. The city began spending down these restricted cash reserves in fiscal 2017 and expects to continue to do so until they are nearly depleted in fiscal 2019. Excluding the restricted cash, the city's available cash balance remains a very strong 97.6% of operating revenue. Debt and pensions: heightened leverage due to capital borrowing and participation in state retirement plans The city's overall leverage will remain somewhat above average for the Aaa rating category. Following the city's upcoming sale, net direct debt will be 1.1% of full value and 0.9x operating revenue. While officials report additional near-term borrowing plans, overall debt is expected to be level due to rapid amortization of outstanding principal. The city's three year average adjusted net pension liability (ANPL), which incorporates adjustments we make to reported pension data, is equal to 2.4% of full value and 2.Ox operating revenues. Fixed costs associated with the city's debt service and retirement contributions are above average and consumed approximately 28% of fiscal 2017 operating revenues. The relatively high fixed costs are largely due to the city's rapid principal payout (all GO debt is scheduled to mature within ten years). Additionally, the city benefits from unlimited levies for debt service and employee benefits, which help mitigate the risk of heightened fixed costs. On an annual basis, each pla ab ishldWocal gonment retirement contributions as a share of payroll based on actuarial requirements. The city has routinely made its full I@utory contributions to the plans. However, we expect unfunded liabilities to grow primarily because investment returns have fallen short of plan assumptions. In aggregate, all participating governments contributed well above the "tread water" indicator in fiscal 2015. The "tread water" indicator is the annual employer contribution required to prevent unfunded liabilities from growing if plan assumptions hold. Despite making contributions above tread water, plan level ANPLs for IPERS and MFPRSI grew 36% from fiscal 2015 to 2016. IPERS and MFPRSI contributions were 96% and 153% of "tread water" in fiscal 2016. In March 2017, IPERS reduced its assumed investment return to 7.0% from 7.5%. The change will increase reported unfunded pension liabilities and necessitate higher government contributions to keep pace with reported plan funding needs. The next opportunity for the plans to enact an increase in contribution rates would impact government budgets beginning July 1, 2018 Management and governance: very strong institutional framework, prudent management Iowa cities have an Institutional Framework score of Aaa, which is high. Institutional framework scores measure a sectorstegal ability to increase revenues and decrease expenditures. Even with property tax caps on general and emergency levies, cities have revenue -raising flexibility due to various additional levies, including an unlimited levy for employee benefits. Unpredictable revenue fluctuations tend to be minor. Across the sector, fixed and mandated costs are generally moderate. However, Iowa has pubc sector unions, which can limit the ability to cut expenditures. The City Council will receive a summary of those bids that night and then consider approval of the lowest bid for each series. Background / Analysis: The City issues bonds every spring to fund the current year's capital improvement projects listed in the Five -Year Capital Improvement Program. The City Council adopted the 2018 capital improvement program on March 6, 2018. The 2018 projects funded from general obligation bonds total $11,753,500. With issuance costs and contingencies, the anticipated funding requirements total $11,995,000. The bonds are being sold in two separate series. Series A will be tax-exempt general obligation bonds in the amount of $8,895,000 and Series B will be taxable general obligation bonds in the amount of $3,100,000. These amounts are subject to change depending on the bids received. Bids will be received by the City and Speer Financial between 10:00am and 11:00am on May 1. The results of the two separate sales will be summarized, and the bidders of the lowest interest rates for each issue will be recommended to be awarded the sale.
