Comment: This agreement authorizes Foth Infrastructure and Environment LLC to provide consultant services including design development, preparation of construction documents bid phase services and limited construction administration services for the American Legion Road Improvements Project. The Project generally includes the reconstruction of American Legion Road from Scott Boulevard to Taft Avenue. The total cost of the services is $587,104 and will be funded by General Obligation Bonds. Item 4d(4) Southgate Addition, Part Two — Resolution accepting the — 1(0 l ( work for the sanitary sewer public improvements for g Southgate Addition, Part Two, and declaring public improvements open for public access and use. Comment: This item will accept the public improvements for Southgate Addition, Part Two generally located at the southwest corner of Highway 6 and Gilbert Street. Item 4d(5) Procurement of Track Type Tractor — Resolution authorizing the procurement of one (1 ) track type tractor for 1 ? " I landfill operations. Comment: This Resolution will approve the procurement of a new Caterpillar track type tractor for the Landfill Operations. The procurement is in accordance with the National Intergovernmental Purchasing Alliance (National IPA) contract #161534-01. The total purchase is $737,178.00, which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. May 29, 2018 City of Iowa City Page 5 Item 4d(6) Procurement of Medium-Voltage Metal-Clad Switchgear — Resolution Authorizing the Procurement of Medium-Voltage / " ) L03 Medal-Clad Switchgear for the Wastewater Treatment Facility Backup Generation and Electrical Distribution Upgrade Project. Comment: This agenda item will approve the advance procurement of medium-voltage metal-clad switchgear, circuit breakers, protection relays and overall enclosure to be incorporated in the Wastewater Treatment Facility Backup Generation and Electrical Distribution Upgrade Project. The project will upgrade the existing electrical distribution system and backup generation equipment necessary to meet current and future demands. The not-to-exceed amount is $395,100.00 funded through the Generator Relocation & Emissions Upgrade fund account#V3143. Item 4d(7) Procurement of Heavy Duty Cab and Chassis Trucks — Resolution authorizing the procurement of two (2) heavy S " I (= LI duty cab and chassis trucks for the City's Water Distribution Division. Comment: This agenda item will approve the procurement of two (2) new heavy duty cab and chassis trucks. Request for Bid #18-273 was solicited for this purchase. The total purchase price is $155,480.00, which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. Item 4d(8) MOU - Friends of the Animal Center Foundation — �� Resolution authorizing the Mayor to sign a Memorandum of Understanding with the Friends of the Animal Center Foundation. Comment: For many years the Friends of the Animal Center Foundation (FACF) has financially supported the City Animal Care and Adoption Center (aka, the shelter). The FACF Board recently sought to memorialize its relationship with the City via a Memorandum of Understanding. The FACF Board and City staff have negotiated the MOU that is attached to the resolution. May 29, 2018 City of Iowa City Page 6 Item 4d(9) MOU - Fireworks Agreement with University — Resolution approving a Memorandum of Understanding between the City and the University of Iowa regarding the 2018 Independence Day fireworks display. Comment: This Resolution will approve the Memorandum of Understanding developed by the City and the University to facilitate the City's Independence Day fireworks display on July 1St. The display will take place at the University's Hubbard Park, with their permission and assistance. Item 4d(10)Pebble Quicklime Contract — Resolution authorizing the 117 award of the contract for Pebble Quicklime. Comment: On April 17, 2018, the Purchasing Division issued a request for bid to provide Chemicals for the City of Iowa City. Bids were reviewed and it was determined that Graymont Western Lime Inc. was the lowest responsive, responsible bidder for Pebble Quicklime. The City expects to spend approximately $257,000 per year, so this purchase exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. The initial term of this contract is for one year, with an option to renew for four additional one-year periods. Funds for this purchase are available in the budget for Water Plant Operation under the quicklime line item. This resolution authorizes the award of a one year contract and authorizes the City Manager to effectuate future renewals. Item 4d(11 )28E Agreement - Optical Fiber — Resolution Approving a 28E Agreement between the City of Iowa City and the City 12 - I c? of University Heights Regarding an Optical Fiber along Melrose Avenue. Comment: This agreement will give Iowa City the right to install fiber optic ducts and cable within University Heights Melrose Avenue right-of-way, which will foster high speed communications between municipal traffic control facilities and data centers. Staff recommends approval. Item 4d(12)Forest Hill Estates — Resolution approving final plat of 1 ? - 1 I c1 Forest Hill Estates, Iowa City, Iowa. (SUB18-00008) Comment: A preliminary plat of Forest Hill Estates was approved on April 2. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the May 29 City Council meeting. Approval will allow the development of Forest Hill Estates, a 5-lot, 50.15-acre residential subdivision located west of Prairie Du Chien Road south of Interstate 80. May 29,2018 City of Iowa City Page 7 Item 4d(13)Subdivider's Agreement, Peninsula, 4th Addition - Resolution Authorizing Amendment No. 1 to the I ? - 11D Subdivider's Agreement for Peninsula Neighborhood, Fourth Addition Comment: Upon final platting this subdivision, the parties agreed that the City would take over ownership and maintenance obligations for Outlots J and K, which were to be dedicated to the City in excess of the neighborhood open space requirement. The HOA desires to maintain those outlots subject to the conservation easement and use restrictions for private open space. Staff finds this reasonable, given the availability of other public open space opportunities in the neighborhood. Item 4d(14)Rental Inspection Schedule - Resolution establishing a schedule for maintenance inspections for rental units and 1% - 11 l rescinding Resolution No. 08-119. Comment: This resolution establishes annual rental inspections for nearly all rental housing beginning July 1. The current inspection schedule is every two years. The change reflects the increased emphasis on monitoring rental properties in light of the legislation prohibiting the City from limiting occupancy based on family status. Item 4d(15)Depositories Resolution - Resolution Naming Depositories. 1 - 17 .-- Comment: NXT Bank has requested to have their depository limit raised from $2,000,000 to $10,000,000. Investments at this institution are collateralized by the state sinking fund. Item 4d(16)Dedication Outlot B, Cardinal Pointe South - Resolution Accepting the Dedication of Outlot B, Cardinal Pointe Ig - i--73 South, Part One, Iowa City, Johnson County, Iowa, as Public Open Space. Comment: Pursuant to the subdivider's agreement for this subdivision, the Owner was obligated to dedicate Outlot B to the City upon installation and acceptance of all public improvements for the subdivision, erosion control and ground cover established thereon, and occupancy permits had been issued for 90% of the numbered lots. In the course of developing Lot 1 with townhomes, the owner installed a retaining wall within Outlot B. Because this retaining wall is necessary to the stability of the improvements, Staff finds it reasonable to accept ownership of the outlot, subject to an easement allowing the wall to remain on the outlot and imposing maintenance and insurance requirements on the adjacent property owner. Staff finds that the conditions precedent to accepting the outlot have been satisfied and recommends acceptance of this dedication, subject to a wall maintenance agreement. Setting Public Hearings: Item 4e(1 ) Comprehensive Plan Amendment — Affordable Housing Annexation Policy — Motion setting a public hearing for July 3 on a resolution approving an amendment to the Comprehensive Plan, Annexation Policy, to add a section pertaining to affordable housing. Comment: At its May 17 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this amendment. Approval will establish a policy to address the provision of affordable housing when territory is annexed into the city for residential development. Item 4e(2) Cancer Cure Bond Resolution - Resolution setting a public hearing for July, 3, 2018 relating to the Midwestern Disaster Area Revenue Bonds (Iowa Cancer Cure Project) Series 2012, of the City of Iowa City, Iowa. Comment: The City of Iowa City has been asked to consent to the reissuance of the Iowa City Cancer Center Midwestern Disaster Area Revenue Bonds, Series 2012, to allow for a lower interest rate. (REZ18-00007) (Second Consideration) Comment: At its March 15 meeting, by a vote of 5-0 (Dyer and Hensch absent), the Planning and Zoning Commission recommended approval of this rezoning to designate at 410-412 North Clinton Street as a Historic Landmark. At its December 15 meeting, by a vote of 8-0 (Clore, DeGraw, and Wagner absent), the Historic Preservation Commission recommended approval. A protest petition has been submitted by the property owner, therefore a favorable vote of three-fourths of the members of the City Council is required for passage. FY19 Aid to Agency — Resolution allocating human services Aid I to Agencies funding for the Fiscal Year 19, July 1 , 2018 — June 30, 2019. Comment: The City Council annually budgets financial aid to human service agencies. The Housing and Community Development Commission (HCDC) reviewed and formulated a funding recommendation based on estimated .i/f allocations for these funds at their January 18, 2018 meeting. The City received e • more Community Development Block Grant and HOME funds than expected. Staff has recommended a revised allocation. As the increase was more than 20%, HCDC must accept staff's recommendation or make a revised recommendation at their May 24 meeting. Approval of the CDBG/HOME budget — Resolution adapting Iowa City's FY19 Annual Action Plan which is a sub-part of Iowa City's l 177 2016-2020 Consolidated Plan (CITY STEPS) Comment: A resolution is required for the use of federal CDBG and HOME funds for local projects. The Housing and Community Development Commission (HCDC) met on April 19, 2018 to formulate a funding recommendation. The City received more Community Development Block Grant and HOME funds than expected and S" staff has recommended an allocation of the extra funds.
