Comment: At its April 5 meeting, by a vote of 6-0 (Dyer absent), the Planning
and Zoning Commission recommended approval of this rezoning subject to
conditions to address the need for housing relocation assistance for the current
residents of the mobile home park; limits on building height and the number of 3-
bedroom units, Design Review approval to ensure compatibility with the
neighborhood; and a requirement for outdoor amenities to attract longer term
residents. Approval will allow for the development of multi-family dwellings on this
property. Applicant requests expedited action.

As discussed in the email correspondence below, there appears to be consensus that I should resign as a trustee of the
Iowa City Public Library due to my living situation in the coming school year.This message serves as my notice to resign,
. effective August 1,2018. I will participate in the June meeting remotely and in the July meeting in person. I also am
willing to continue serving beyond August 1 until a replacement is named if that would be helpful.
I am disappointed that my professional obligations conflict with my ability to serve out the second half of my term as
trustee. I am grateful for the opportunity to be involved and I will continue to support the ICPL in other ways.

Hi Adam.
As discussed,Susan has sought opinions from the City staff concerning your status as a Trustee.
Geoff Fruin,City Manager has responded-
/am not aware of any historical precedent for an arrangement like this. While I'm sure remote participation can work I
would think the ICPL would be much better served by having someone who is living in IC full-time. I'm guessing there
would be no shortage of great candidates to replace Adam. Of course,if Adorn returns to IC full-time he could look to
reapply or get involved in some other capacity.
Eric Goers,from the City Attorney's office responded.
That's where our office comes down too. Legally,electronic participation counts as being present,so the policy language
to which you refer(attached below for the convenience of others)would not be implicated.
Vacancies.Any vacancy on the Board because of death,resignation,long-term illness,disqualification or
removal due to four(4)consecutive unexcused absences from regular meetings shall be filled by appointment by
the Mayor,with approval of the City Council,or the Board of Supervisors in the case of the non-resident

member. The appointed trustee shall fill out the unexpired term for which the appointment is made.Members
are expected to give the Mayor at least 30 days written notice of intention to resign.
As your policy states(also attached below for the convenience of others),he would need to remain a resident of
Iowa City to continue to serve,as he's not the member appointed by the Board of Supervisors. Residency analysis does
not include bright lines,but instead a myriad of factors taken into consideration by the courts. While there could be
additional facts gathered in Adam's case to ascertain whether he would continue to qualify as an Iowa City resident,
based on the facts included in his e-mail,I think he would,and thus would legally remain eligible for service.
All members shall be residents of the City and shall be over the age of eighteen(18),except there may be one(1)
non-resident member if the library is receiving funds for a county-wide library service on a contract basis.
Appointments are approved by the City Council except the non-resident member who is approved by the Board
of Supervisors.
That's where Geoff's comments come in, with which we agree fully.
Please update me as to your plans.

I share your concern.
Seeking the City's input seems appropriate. It's fine with me if you want to forward this thread. I just want to
arrive at a decision such that everyone feels comfortable. I should have raised this with you and Susan earlier.
Jay seemed comfortable with it so I put it out of mind.
FYI, when the videoconference works as it is supposed to, then I feel very comfortable with my participation
and I don't feel like I'm missing any important context or nuance. I've done a lot of my work that way for a
long time. What I miss is the relationship building and the sidebars that happen in person. And of course the
unique work related to the director transition would greatly benefit from (or would require) in-person
presence.

After thinking about all of this,I do have concern as some of the additional work falls on the other Trustees.And it feels awkward to me if for a
year,you would not be in the building for events or interact with the other Trustees,the staff,the consultants,or the public particularly during
the hiring period.

But with that said,I believe that the issue concerns the City Council's intent when they selected you as a Trustee.Perhaps we should ask the
appropriate person on the City staff about their expectations and even if there is a precedent for some type of a leave of absence as a third
option.If they feel that this manner of being a Trustee is appropriate,I believe their opinion should be respected.
Let me know what you think about us seeking the City opinion.

At this time I expect to return to Iowa City in summer 2019 and then my schedule at that point would likely be similar to what
it was like in 2016 and 2017.

Thanks for writing.This is a tricky issue and I have not looked up what is technically possible but am only sharing my thoughts
at this point.
Missing all of the meetings in person is a challenge.You and I both have had to attend Trustee meetings in a virtual manner at
times and I personally do not get the full gist of the meeting when I am not present in person.The virtual connection has not
allowed me to get the nuances of the discussion and sometimes even receive the audio portion in a smooth manner.When
you have attended meetings in person in the past,I believe that all of the Trustees have found your contribution to have great
value to the discussions and wish you were more available to us as a group.
Missing the meetings is not the only challenge however.This is apt to be a very busy year for the Board with the turnover in
Directorship in addition to the normal issues that arise each year.Participating in the multiple committees and the upcoming
focus groups is also important. What is your availability for these meetings with the consultants and committees?
Could you also clarify what your schedule will be like concerning regular attendance at future Board
meetings following the time in NYC?I believe that your term runs until mid 2021 and future availability might be relevant
in this decision.

Thank you for accepting the nomination to serve again as President.The
ICPL and your fellow trustees are fortunate that you're able to make this
commitment.
I'm writing to explain my status/availability for the coming year and ask
how you'd like to handle it.I had a very informal conversation with Jay
about this six months ago but I thought it would be appropriate to bring it
up with you.
Background:
When I joined the board,my intention and goal was to travel less and less
for work.I expected to be able to attend most board meetings in person and
keep my schedule open to at least call in for meetings when I was out of
town.Since then,life stuff has happened and I've not only had to travel
more for work than I'd hoped but am also-as you know-moving my family
to NYC for the coming school year.If I were not doing so,then I'd be
traveling there almost every week to support my company's east coast
operations and I'd only see my family on weekends.
I told Jay that I was willing to remain on the board and that I think I'm
technically allowed to remain,as I am not establishing residency in NY.
Rather we are keeping our permanent residence and voter registration in
Iowa City and we will be living in NYC less than six months of 2018 and
less than six months of 2019.
But I also want to do what's best for the ICPL and I want to avoid creating
hassles and disruption.In the coming year it is unlikely that I would be
able to attend*any* board meetings in person.I would fully intend to
participate in nearly every meeting via phone or videoconference,but we've
seen these past few years that I've had unexpected and unavoidable work

conflicts that have cropped up.Also,the technology doesn't seem to work
consistently,and I feel badly when a meeting is delayed or disjointed
because of the guy who has to be accommodated differently.
Please let me know if you have any input here or a decision on what would
be best.I'd prefer to remain on the board,but I'd completely understand
if you think we should seek to replace me with someone who doesn't have
these kinds of conflicts.
