Item 3d(1) Industrial Campus Listing Agreement - Resolution
(c) authorizing the City Manager to sign a one-year extension
of the listing agreement with Lepic-Kroeger Realtors for the
Iowa City Industrial Campus.
Comment: The 420th Street Industrial Campus is a 173-acre shovel-ready
industrial use site. In 2015, the City entered into a one-year
listing/marketing agreement with Lepic-Kroeger Realtors. One lot has been
sold. The designated broker is Jeff Edberg, and the sales commission is
6% of the final sale price. The agreement was previously amended to
extend the term for a second year, and this resolution approves another
one-year extension of the agreement to July 15, 2019.
7 o'"3 Item 3d(2} West Riverbank Stabilization - Resolution approving,
authorizing, and directing the Mayor to execute and the
City Clerk to attest Amendment No. 1 to the August 22,
2017 Agreement by and between the City of Iowa City and
Bolton & Menk, Inc. to provide consultant services for the
West Riverbank Stabilization Project.
Comment: This agenda item will amend the consultant agreement with
Bolton & Menk Inc. to include additional ecological investigation and
permitting services in relation to a mussel survey required by the Iowa
Department of Natural Resources The amendment will increase the fee by
$28,072. Funds are available in Account # P3981 West Riverbank
Stabilization.

F Item 3d(3) Procurement of Water Meters - Resolution authorizing the
procurement of water meters for the City's Water Division
for Fiscal Year 2019.
The City purchases new water meters, which are required for utility billing
on an ongoing basis. The meters are required for new water accounts and
to replace old and nonfunctional meters. The budgeted fiscal year 2019
amount is $200,000. This exceeds the $150,000 spending authority of the
City Manager, and so requires Council approval. Funds are available in
account #7373014.

work for the Wetherby Park Improvement Project.
Comment: The project has been completed by LL Pelling Company of North
Liberty, Iowa, in substantial accordance with the plans and specifications.
The Engineer's Report and Performance and Payment bonds are on file
with the City Clerk.

I - oto Item 3d(5) PATV Agreement - Resolution authorizing the Mayor to
sign an agreement with Public Access Television, Inc. to
provide carriage public access and community
programming and to distribute equipment.
Comment: For nearly 30 years PATV has provided public access and
community programming pursuant to agreements with the City. Under the
City's franchise agreement, Mediacom is required to collect public access
funds that the City passes through to PATV. The City's franchise
agreement with Mediacom terminates on Aug. 1 as does the City's
agreement with PATV. This agreement provides that PATV will continue to
provide public access and community programming but with no financial
support from the City. This agreement further provides that the City
relinquishes all rights to the equipment that PATV has purchased over the
years with the pass-through funds. The agreement is attached to the
resolution.

Motion setting a public hearing for August 7 on an
ordinance conditionally rezoning approximately 18.03 acres
from Interim Development Multifamily Residential (ID-RM)
zone to Planned Development Overlay/Low Density Single
Family Residential (OPD/ RS-5) zone (5.8 acres) and
Planned Development Overlay/Low Density Multifamily
Residential (OPD-12) zone (12.23 acres) located east of S.
Gilbert Street and west of Sandusky Drive (REZ18-00005).
Comment: At its July 5 meeting by a vote of 6-1 (Dyer-no) the Planning and
Zoning Commission recommended approval of this rezoning subject to a
conditional zoning agreement addressing a City Forester approved tree
replacement and protection plan, location of roof drains and gutters, and
contracting with an archaeologist prior to additional grading. Approval will
allow the development of 93 multi-unit dwellings, 2 two-unit dwellings, and
15 single-unit dwellings.

Comment: At its June 7 meeting by a vote of 6-0 (Signs abstained) the
Planning and Zoning Commission recommended approval of this rezoning
subject to a conditional zoning agreement addressing the need for general
compliance with the concept plan, detailed landscaping plan, dedication of
public right-of-way along Taft Avenue, creation of an outlot for a trail
extension, and provision of roadway access to the single-family property to

pertaining to affordable housing.

will establish a policy to address the provision of affordable housing when

Item 6. Wastewater Treatment Facility Influent Channel Modifications -
\''6 Resolution approving plans, specifications, form of agreement,
and estimate of cost for the construction of the Wastewater
Treatment Facility Influent Channel Modifications Project,
establishing amount of bid security to accompany each bid,
directing City Clerk to post notice to bidders, and fixing time and
place for receipt of bids.
S Comment: This project will install fillets and weirs to help reduce maintenance and
repairs associated with the sediment accumulation. It will also prevent sediment
from accumulating and interfering with operations and flow metering. The
estimated construction cost is $158,000 and will be funded with Wastewater
revenue funds.

Item 7. Housing Code - Ordinance amending Title 17, entitled "Building
and Housing," Section 5, entitled "Housing Code," to add the
1 7 — 4-7 61> requirements for deadbolt locks and duplex separation
requirements to Section 19, entitled "Responsibilities of Owners
Relating to the Maintenance and Occupancy of Premises."

5 Comment: When Council adopted major changes to the housing code last fall to
address occupancy issues in rental properties, provisions requiring deadbolt locks
z_Ki-rc in all dwelling units and permanent separation of the two dwelling units within a
duplex were adopted as part of Section 18 of the Housing Code, the list of
minimum structural standards. These two provisions should also have been added
to Section 19, the list of responsibilities of owners relating to the maintenance and
occupancy of permits. Section 19 contains the primary requirements for obtaining
a rental permit, and it was an oversight not to include these two provisions in
Section 19. Staff requests expedited action.

Item 9. Riverfront Crossings Affordable Housing Requirement - Fee in
_ Lieu - Resolution establishing the fee an owner may opt to pay in
lieu of providing affordable housing in the Riverfront Crossings
District and rescinding Resolution No. 16-216.
Comment: The Riverfront Crossings Affordable Housing Requirement allows for an
owner to contribute a fee to a Riverfront Crossings affordable housing fund as a
means to meeting the affordable housing requirement. The ordinance requires
that the fee shall be determined biennially by resolution, based on a formula that
�xct o� analyzes the difference between market rate units and units subjected to the
affordability requirement. The fee was set at $80,872 per unit in July of 2016.
Based on this analysis method, the proposed fee, effective after passage of this
resolution, shall be $94,652. f `

Comment: Following the May 24, 2018 Housing and Community Development
Commission (HCDC) meeting, a subcommittee reviewed the Aid to Agencies
S (A2A) allocation process. Historically, A2A provided predictable funding for
nonprofit agencies, but more recently, it has also provided new and developing
'�- agencies flexible funding. The subcommittee developed several recommendations
which seek to balance both functions of A2A funds, as well as improve the
allocation process. HCDC voted to send the recommendations to City Council for
consideration after discussion on June 21 and July 10, 2018.

Item 11 . Foster Road/Ewing Development Agreement - Resolution
Approving an Agreement for Private Development By and
Among the City, Foster Road Developers, L.L.C., Vintage
Cooperative of Iowa City, and Ewing Land Development &
Services, L.L.C. for Foster Road and The Vintage Cooperative
Senior Living.

Comment: This agreement will result in the construction of Foster Road between
�xkrti Dubuque Street and Prairie du Chien Road and a senior living facility. The new tax
base created by the living facility will be the source for up to 10 years of tax
increment finance rebates to reimburse the developer for up to $3,367,000 of the
costs to build the road. The Foster Road Urban Renewal Area requires that 45% of
the tax increment generated be directed to low and moderate income housing
