Item 2. Council vacancy — option to appoint. Resolution giving notice of
intent to appoint a qualified individual to fill the vacancy created by
council member Botchway's resignation.

Comment: State law gives Council the choice of appointing an individual who would
be qualified to be a candidate for the office, or calling for a special election. If
Council wants to make an appointment the first step is to adopt this resolution giving
notice of Council's intent to make an appointment. The appointment must be made
on or before September 15, 2018 (60 days after the resignation on July 17, 2018). If
an appointment is made the public may petition for a special election. See City
Attorney's July 19, 2018 for details. ('()1c

� v Comment: If Council chooses not to make an appointment it must call for a special
election to fill the vacancy at the earliest practicable date. Notice to the auditor must
be given at least 60 days prior to the election, so if the Council adopts this resolution
at its meeting on August 3, 2018, the election can be held on October 2, 2018. See
