FY19 Annual Action Plan Amendment #1 Resolution adopting Iowa City's FY19 Annual Action Plan Amendment #1 which is a sub-part of Iowa City's 2016-2020 Consolidated Plan (CITY STEPS). Comment: The City received additional FY19 HOME funds; however was not able to allocate these funds to specific activities before the FY19 Annual Action Plan was due to HUD. The City reserved the additional funds, $185,000, under the category of Other Housing Activities in the Annual Action Plan. The City held another funding round and has now allocated these funds to eligible housing projects as recommended by the Housing and Community Development Commission (HCDC) at their July 10, 2018 meeting to support rental rehabilitation and additional operational funding by The Housing Fellowship and the acquisition of a single family home to support permanent supportive housing to persons experiencing homelessness by Shelter House. Traffic Pole Painting Resolution authorizing the procurement of cleaning and I - S painting of additional traffic poles under the Traffic Pole Painting Contract. Comment: In March 2018 the City awarded a contract to Pospisil Painting Inc. for the cost of paint and labor to clean and paint traffic poles on 1st Avenue, Keokuk Street, South Gilbert Street, Orchard Street, Miller Street and Sunset Street. Popisil Painting has done a satisfactory job, and Phase 2 of that contract involves the cleaning and painting of additional traffic poles on Boyrum and Highway 6, Jefferson, Market and Dubuque and Church at a cost of $81,414, bringing the total cost of the contract to $178,724. This resolution authorizes the City Manager to effectuate future projects and renewals. 6.c. West Riverbank Stabilization Resolution authorizing the acquisition of property interests " may necessary for construction of the West Riverbank Stabilization Project. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the West Riverbank Stabilization Project. The project will construct a retaining wall that will stabilize the river bank and accommodate a future recreational trail north of Highway 6. 6.d. Hwy 1 Trail Project - Sunset Street to Mormon Trek Boulevard 18" P.5 5- Resolution authorizing the Mayor to sign and the City Clerk to attest the Transportation Alternatives Program (TAP) funding agreement from the Iowa Department of Transportation (DOT) for the Highway 1 Trail Project - Sunset Street to Mormon Trek Boulevard, including a commitment to be responsible for maintenance of the trail for a minimum of 20 years following project completion. Comment: The City desires to connect the existing Iowa River Corridor Trail to the existing Mormon Trek Boulevard wide sidewalk by extending the Highway 1 Trail System from Sunset Street to Mormon Trek Boulevard. The City has applied for TAP assistance to provide funding for the Highway 1 Trail Project - Sunset Street to Mormon Trek Boulevard. The TAP funding is conditional on the assurance that the City of Iowa City will maintain the trail for a minimum of 20 years. Public Works and Engineering recommend approving the TAP funding agreement and authorizing maintenance responsibilities. Title VI Compliance Plan _ Resolution authorizing the Mayor to sign and the City Clerk /g - 5�`' to attest the Title VI Non-Discrimination Agreement with the Iowa Department of Transportation (IDOT) and the United States Department of Transportation's (USDOT) Standard Title VI/Non-Discrimination Assurances. Comment: Title VI of the Civil Rights Act of 1964, as amended, prohibits discrimination based on race, color, religion, and national origin in federal funding. The Iowa Department of Transportation (IDOT) has worked with City staff (and other governmental subdivisions) on a plan to implement Title VI requirements such as establishing a complaint procedure and appointing a coordinator for federal monies. The City must adopt a Title VI plan in order to receive Federal Highway Administration (FHWA) funds, which are administered by the IDOT, in the future. This plan addresses all federal funding, not just transportation funds, and is consistent with the broader contract compliance plan adopted by Council that prohibits discrimination based on all the protected classes in the City of Iowa City Human Rights Ordinance. Public Works and Engineering recommend approving the Title VI Compliance Plan. 6.f. Hwy 6 Trail - Fairmeadows Boulevard to Heinz Road Resolution authorizing an application for Federal f - 57 Recreational Trails Program funding Comment: This item will authorize City staff to apply for Federal Recreational Trails (FRT) program funding for the Hwy 6 Trail from Fairmeadows Boulevard to Heinz Road. This trail section is currently included in the Capital Improvement Plan with the Hwy 6 Trail from Sycamore Street to Heinz Road Project (#R4227). 6.g. Accepting Tobacco Penalty, Kum & Go #51 Resolution accepting imposition of civil penalty and waiver of right to hearing from Kum & Go #51 . Comment: This Resolution accepts a waiver of right to hearing and payment of a $300 civil penalty by Kum & Go #51. The civil penalty is required by Iowa Code Section 453A.22(2) due to an employee selling or providing tobacco to a minor. Public Works Facility Phase I Resolution setting a public hearing on September 18, 2018 Jo on plans, specifications, form of contract, and estimate of cost for the construction of the Public Works Facility Phase I Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: This agenda item begins the bidding process for the Public Works Facility Phase I Project. The facility is intended to include approximately 49,813 square feet of heated vehicle storage (60,623 square feet with the alternate), 9,292 square feet of first floor shop space, 6,734 square feet of heated mezzanine storage / shop area and 4,158 square feet of wash bay area. The site will include site security and a fire training area. Site grading, paving and utilities are included to provide additional outdoor laydown and storage areas with drive aisles to accommodate future phases. The estimated project cost is $10,900,000 with funds available in account #P3959. Hickory Hill Park Improvements Resolution approving plans, specifications, form of agreement, and estimate of cost for the construction of the Hickory Hill Park Improvements Project, establishing amount of bid security to accompany each bid, directing City Clerk to post notice to bidders, and fixing time and place for receipt of bids. Comment: The Hickory Hill Park Improvements Project includes trail, bridge, and drainage improvements in Hickory Hill Park as detailed in the Hickory Hill Park Master Plan. This project also includes new signage and wayfinding throughout the 2 p✓ park. Rental Permit Cap Amendment Ordinance amending Title 17, entitled "Building and Housing," Section 5, entitled "Housing Code," to require properties with new rental permits to be leased promptly. (Second Consideration) Comment: City Council established a rental permit cap and strengthened the minimum requirements for rental housing in December 2017. Staff is aware of homeowners within these areas obtaining rental permits as a speculative measure. Massage Business Requirements Ordinance amending Title 5, entitled "Business and License IE-LI Regulations," to add a new Chapter 3, entitled "Massage Business Information Requirement ." (Pass and Adopt) Comment: This ordinance requires massage businesses to provide basic information gfto City staff upon request including the name of the local manager and the name of the commercial tenant. The purpose of the ordinance is to give staff another tool to disrupt and close illicit massage businesses. Animal Services Ordinance r 8 L176 7 Ordinance amending Title 8, entitled "Police Regulations," Chapter 3, entitled "General Animal Regulations," and Chapter 4, entitled "Animal Control" to provide for animal services. (Pass and Adopt) Comment: Sections 8-3 and 8-4 of the City Code govern the provision of animal services including licensing, permitting, and neglect. Staff recommends a general overhaul of both chapters that will combine them into one code chapter, eliminate duplicative provisions, clarify certain provisions, increase the civil penalty, and add new provisions on tethering and irresponsible owners.
