Van Buren St Background: The applicant proposes to add alcohol sales to the current operation of a hookah bar at the subject property. Liquor License: The applicant needs approval of a liquor license. The verified statement lists hours of operation that are after midnight (6:00 PM to 2:00 AM). Any establishment where the principal use is the dispensing of food and/or beverages and is open after midnight is classified as a Drinking Establishment. Using 14-4A of City Code, the current use classification of the use of this property as a hookah bar is a combination of Indoor Commercial Recreational and Sales Oriented Retail uses. Since it is unknown how much of sales will be alcohol related and what the intensity of that activity will be, the city considers alcoholic beverage sales as another principal use. Section 14 -4A -2A1 states that developments may have more than one principal use. The property is located in the Eastside Mixed Use District of Riverfront Crossings. Per Section 14 -2G -3B -2f drinking establishments are not permitted. Recommendation: Therefore, as the Building Official i am recommending that the liquor license application be denied. I have reported it to the police so many times now already, but since these problems seem to continue for some mysterious reason, I now have to report it to you. I am being constantly harassed by several of my neighbors, but especially the house at 1124 Muscatine Avenue. The house is owned by Nicolas Carek-Marino and his wife. They are the main instigators of this. I will allow you to check the reports by email to Officer Terry Tack several years ago for the main details, of which it all is still continuing. Things have gotten much worse since then. We have had the police out here several times in the past few weeks. The Marino's have apparently recruited the house at 115 Pearl St. to scream the same insults they have been using for the past six years now, including many homophobic remarks such as "faggot", etc.. This is a house where several freshman women's volleyball players live. I have reported them to the UI Athletic Dept.. There was a large gathering of menacing looking people threatening me about gunfire at around 2 a.m.. I didn't bother to call the police because I now think that someone in the police department is allowing this to happen. The officer -in -charge when I was arrested for public intoxication the other night, who's name I don't have, said he has been acting as a night watchman for their house. What a joke. So, when he's there, I can't confront anyone for all of the insults they seem to feel free to scream at me. Please read the comments, as there are some really good ones, and also some great ideas! I did not expect the petition to go viral like it did, as I was simply taking an idea that a friend had given me about trying to create a petition to try and save the rides and seeing if I could get enough signatures, and I ended up getting much more than I expected! These rides are a huge part of so many of our lives, and it would be sad to see them go. It seems that Iowa City enjoys destroying historical things and building other things instead of trying to save them so that our children can grow up with them and learn to admire and appreciate our history. While I understand that it sounds like it is a done deal, I encourage you to at least consider changing your mind about getting rid of them, or at the very least, getting new ones (as I understand that with their age, they're becoming harder to maintain). With the money from selling the rides, combined with funds raised by the community, there should be enough money to try and get new rides, instead of creating a totally different park. I was told that you believe ridership was down, but I have picture proof that there were lines for the rides on the weekend they closed, and everyone was talking about how they wished they would stay open. For any argument you might have about why continuing to have rides there would not work, I am sure that I have a solution for it. I have included a few pictures of the crowds on closing weekend, and there are more that would not fit in this email. Please look to your heart to save this fun piece of history that has inspired our children's imagination for decades, and could inspire it for many more if we save them now! We have all grown up riding these rides, and they are a piece of Iowa City history, and we would all hate to see them go. We would like our children and children of future generations to be able to enjoy these rides as we did growing up. That's why I signed a petition to Iowa City City Council Members, which says: "The citizens of Iowa City would like to petition the City of Iowa City to either save the City Park rides and move them to higher ground to protect them from future flood waters, or purchase new rides to continue the tradition of the City Park rides. We have all grown up with these rides, and are sad to see them go. We would like to see our children be able to grow up with these rides as well, and hopefully several generations after that, as these rides are a piece of Iowa City history. When plans began for an electric interurban line to connect Iowa City and Cedar Rapids in 1903,the company known as the Cedar Rapids and Iowa City Railway or CRANDIC acquired right-of-way through the Woolf farm. Idyllwild came very close to flooding this past week. In spite of unanswered calls for assistance to the City, we remained a solitary force battling the runoff, clearing drains and storm retention basins, paying our own engineers to advise us as we studied the maps and planned for the worse. We are Iowa City taxpayers and we deserve better than this. We deserve to have our phone calls returned in a timely manner. We deserve to have our questions addressed and to be first in line for communications from the City when events such as this imminently threaten our neighborhood. In 2016-17, Idyllwild homeowners paid Hart Frederick engineers to study, design and help us find contractors for building flood protection in the form of a berm to safeguard Idyllwild from a 100 year flood. We also installed sluice gates in the ponds to enable us to shut them off from the river. The Homeowners'Association paid in excess of$200,000 to put these protections into place. Idyllwild ponds were initially designed in the 1990's to manage the runoff from its 21 acres of development. When excess water flows into the pond, it then is drained to the river by way of an underground connecting pipe. A concern for Idyllwild is when the river hits flood stage at 22 feet and the water begins to flow backward from the river back into the ponds. The sluice gates can then be shut to stop all water flow. Unfortunately for Idyllwild, somehow we have become the stewards of illegal runoff from the 81 acres in the drainage shed above us. As you can well imagine, this greatly complicates matters as when we shut the sluice gates, we are no longer able to rid ourselves of all the drainage coming at us from the bluffs. Case in point: On October 6, shortly before midnight and in the pouring rain with the river at 22 feet, the HOA closed the sluice gates. By morning our ponds had filled to overflowing from all the runoff rushing into Idyllwild. If we had had a pump in place, we would have started it up to remove the excess water coming from the 81 acres above us. Instead, we held our breath, opened the sluice gates and sighed in relief as the water pressure from the over-full ponds forced its way to the river. Earlier this fall, the Homeowners spent $7,000 to maintain the ponds, replacing rock and removing silt, issues resulting not just from our own drainage into the ponds, but also from the other 81 acres. This is not the first time we have done this. Why have we been so alone in managing the water from these extra 81 acres?Who allowed the development of this area without ensuring adequate water control? And shouldn't the $7,000 we just spent be paid out of public funding? It is a vital part of the plan to keep Idyllwild dry in high water events such as we are experiencing this week and deal with the runoff from 81 acres above us. There are 2 more parts of our flood mitigation plan with which we request your assistance: 1. In a high river event when the Army Corps of Engineers increases outflow from the Reservoir resulting in high river levels that approach flood stage, if little rainfall is expected, we can close the sluice gates for protection from river flooding without the worry that the ponds will fill up from the drainage shed and flood us from within. However in times of heavy rainfall, a pump will still be needed to remove the excess water. Our engineer tells us that as the pump removes the runoff water from Idyllwild and the drainage shed above us, it will also keep Foster Road from flooding. With the benefit this imparts to the residents of the Peninsula and Mackinaw, we believe it is the City's responsibility to fund the pump. Idyllwild should not be tasked with the study, installation and payment for water control for the entire neighborhood. We have done our part by building a berm, installing sluice gates and shouldering the responsibility to maintain and use these installations. We are asking the City to not only prioritize and expedite completion of the drainage channel, but also to fund, install and maintain a sufficiently sized pump to safeguard Idyllwild, Foster Road and the Peninsula. 2. Additionally, we request a better line of communication when these high water events occur. We asked about Hesco barriers, and we were not given answers about whether they were available to us or whether we could count on them. We asked about a pump and several days later, only after we had secured a pump and had it installed for use, did we receive a phone call from the City asking if we needed one. As you can well imagine, this does not work for us. If we knew for sure that the Hesco barriers or a pump were being held for us and would be available when needed, we could spend our energies monitoring our ponds and communicating with our homeowners. We wouldn't need to search out and obtain them from somewhere else like we did this time. We need a commitment from the City regarding these things. At least call us back and let us know like in any other business transaction. Don't leave us hanging. We deserve better. Thank you for your consideration. The Friends of the Deer group, I believe, propose a bandaid solution to this problem and if I had to guess have never had issues the same way most of the citizens have or have had who spoke in favor of harvesting. Most of the people who spoke that night had concerns of property damage, land erosion, car accidents and deer ticks. From my prospective, the rep from the Humane Association was the most compelling in his argument regarding thinning out any animal population who has exceeded their number. I am in hopes that the current newspaper articles have been prominent because the "deer friends" are trying to stop the harvesting. I hope you will remember that the majority of the speakers spoke in favor of a substantial mitigation program and you will move forward with this. Our deer are currently breeding yet again. A brief heads up will suffice: 954-806-4996 appreciate the follow-up thus far from the council and associated city employees in regards to my goal to amend City Housing Code Title 17, Chapter 5; 19-A. On August 7, 1 spoke at the City Council meeting, expressed my concerns in the open forum, and subsequently submitted a letter (see attached) addressing Code 19 and its adverse effects on my property and its historic integrity. It was recommended I speak with Stan Laverman's office for which they kindly met with me and toured the home. I was told although a valid argument, it was not amendable and I would have to return the issue to the City Council. I contacted Mr. Cole to advise on how I might move forward. He suggested I write a summary of my previous council presentation and letter. In summary: Housing Code 19-A stating "duplexes require permanent separation between units" if enforced as it stands now will result in the following objective complications on my property: 1. The lower level tenants will be unable to move most pieces of furniture in and out of the apartment. 2. The safety of both apartments will be significantly compromised by eliminating a second escape route if needed 3. The airflow of the apartments will be compromised by eliminating the chance to have cross ventilation if needed. 4. The single family home transitioned to a duplex by my parents in 1959 was and could still be a beautiful single family home. On occasion, I have chosen to rent the entire house to a couple. With the permanent separation that will no longer be an option. As a property owner I should be able to make this decision. 5. The apartments share certain house responsibilities and spaces, including the thermostat, and the main house shut -offs. Both apartments need access in case of an emergency and mutual arrangements/leases are in place. 6. Permanent separation will potentially decrease the value of my home if and when I chose to sell. Value and rent is determined by a dynamic real estate environment, significantly changing as of recent times with the future relatively unknown. My options are a. Permanently switch the rental status to single family home or b. Permanently separate the two units. As per above, the change from single family to duplex was made in 1959, carefully non -altering and preserving all historic aspects. I believe I should have the choice of how to market my home if I decide to sell, based on the real estate market at the time. 7. The costs to redo the back entrance would be substantial to accommodate the need to have furniture moved in and out of the downstairs apartment if the front access was permanently closed. Less objective and more individual: 1. The historic integrity will be altered for the worse: Unique historic amenities that distinguish my property from the new costly modern apartments reproducing like rabbits, give my property a niche and attract certain tenants I desire. This will be compromised including the disappearance of a large front porch, beautiful sliding doors, extra storage, and open spaces. 2. My understanding is the cities' goal is to return historic neighborhoods to their original single family status, a day I lived in, remember, and my goal as well. Code 19 is counterproductive on my property to foster that goal. 3. Historic Preservation only addresses the external appearance of historic properties; the fagade and external appearance, producing shells of historic preservation, ignoring the integrity of the inside. Neither of my historic homes have been altered and all efforts are taken to preserve this integrity. Who monitors this very important aspect of historic homes? It seems no one, leaving many original single family homes altered into ugly makeshift apartments and room for rent hidden by acceptable paint jobs and hidden garbage cans. Code 19 actually requires this alteration. Building internal walls, closing off areas of the house, and amenities is counter intuitive to the historic goal and quite frankly, shameful. Locking the doors and clear legal arrangements of shared spaces has been in place for almost 50 years in my house. Occupancy has never been more than 4, and is usually only 3. 1 do not make money, but I will not change this. I am unaware of other houses affected adversely by Code 19 but I would guess there might be. I am hoping enforcing the rule on "all" homes instead of allowing for exceptions was a simple oversight when passed by the Council, well attended, but perhaps unaware of the adverse effects it could have on certain homes. The argument could be made that nothing is permanent, whatever separation put in place can be changed at a later time if so desired. It is the adverse effects those changes will have now and in regards to my long term goals. Removal at a later date is not fair argument. As previously mentioned, I propose a grandfather clause with certain criteria determined by the council as workable, i.e. occupancy not over a certain number and or transitioned before a certain date such as 1965. This seems like a productive and reasonable solution and will in my case work towards the goal of maintaining and rebuilding the historic preservation of the neighborhood as I understood was the goal of the city. Please advise. I will again attend the Council meeting on October 15 and hope this can move forward. Wichert 954-806-4996 Please see original letter attached: August 7, 2018 To: Iowa City City Council and Those That May Be Concerned I would greatly appreciate clarification why Iowa City Housing code (Title 17, Chapter 5; 19-A) is being enforced upon my 1924 historic home at 824 E College street. On April 3, 2018 1 was told after a routine rental inspection as per the code "duplexes require permanent separation between units". This letter is to ask your advice and to problem solve on possible alternative solutions as it seems counter intuitive to the overall long term goals of the College Street Historic neighborhood. Please consider grandfathering in homes with certain criteria, including the year they were changed from single to duplex status. I appreciate your time in reading the following rationale. As per the city, compliance will require removal of large beautiful oak pocket doors in the front foyer as well as the oak doors at the top and bottom of a curved back staircase and replaced with permanent walls/structures. I do not understand how this alteration improves any aspect of my house, the neighborhood, or historic preservation. Currently, as per city code, the units are separated by locked doors. This 1924 national and state historic single family home has been in my family since 1959. My parents lived in the identical home next door (816 E College) and bought 824 transforming it into a rental duplex, carefully preserving the unique historic characteristics of this beautiful house out of respect and appreciation for its historic qualities, before the rules of historic preservation. Their goal was to control and protect as best they could the integrity of their own home and the beautiful family neighborhood in which they were located. Unfortunately, at that time, the neighborhood was in the initial stages of negative changes brought about by uninterested investors tearing down beautiful homes (i.e. Jim Clark at 806 E College) or converting beautiful homes into what became ugly run down rentals filled all too often with obnoxious disrespectful tenants without controls. There were no city codes preventing this. My family continued to rent 824 and live in 816, maintaining the integrity of their homes and tenants despite these ongoing changes which resulted in long term negative consequences. In 2002, 1 purchased my parent's estate and continue to rent to top notch renters at 824 while having family, friends, and or myself living in 816. Long before Historic Preservation and to date we have relentlessly worked to protected the historic integrity of the neighborhood and the houses, making them homes not just houses. Many of the tenants remain family friends and continuing to reside and make a positive impact on Iowa City. Much of the work has been done by my family's hard work. Increasing taxes, ever changing costly city requirements with uncertain purpose, new building construction, and the culture of Iowa City laborer's feel stacked against the small landlords such as myself making ownership with a heart difficult. It feels the spirit of protecting the historic integrity of the neighborhood is being challenged by the very institutions that should be fostering it. Moving forward, in the spirit of improving our neighborhoods, please don't target the wrong people. I feel as perhaps there has been a mistake made in my case. I would like to discuss options with the city as well as someone from historic preservation to better understand the bottom line for the code and perhaps to consider other options as per suggested above. Possibly the code needs to be re-evaluated and analyzed taking other recent changes in the area into consideration.
