Special Primary Election Abstract Motion accepting the Abstract of Votes for the September 4, 2018 Iowa City City Council Special Primary Election. 8.b. Special Election Abstract Motion accepting the Abstract of Votes for the October 2, 2018 Iowa City City Council Special Election. 8.c. Removal of Appointee Resolution Removing Appointee to the Civil Service Commission. Comment: State law requires that removal of a person appointed by the Council to a city office must be by written order detailing the reasons for the removal and the appointee must be given notice of the removal and the opportunity to be heard at a public hearing. On 3/20/2018 Council appointed Emily Bushman to the Civil Service Commission for a 4-year term starting on April 2, 2018. Since then numerous attempts to contact Ms. Bushman, including those by the Chair of the Commission, have been unsuccessful. By law the Commission has only 3 members. The lack of a full Commission will be particularly problematic in the event of an appeal by a civil service employee from suspension, demotion or discharge. 8.d. Churchill Meadows Part Five - Final Plat Resolution approving final plat of Churchill Meadows ",29t1 Subdivision - Part Five, Iowa City, Iowa. Comment: Staff recommends approval of the final plat, which will allow the development of Churchill Meadows Part Five, a six-lot residential re- subdivision of 1.821 acres of Churchill Meadows Parts One and Two on Herbert Hoover Highway. City Manager Settlement Authority _ Resolution repealing Resolution No. 17-246 and approving a new compilation of contractual authority delegated from the City Council to the City Manager which increases the City Manager's settlement authority. Comment: Resolution No. 17-246 authorizes the City Manager to sign certain contracts without City Council approval, including settlement agreements of up to $20,000. This resolution increases that amount to $60,000, in order to track the Council-approved Purchasing Manual authority for the City Manager in approving contracts for professional and technical services. No other changes are being made to City Manager signature authority. 8.f. Amending budgeted positions Resolution amending the budgeted positions in the Parks and Forestry Division of the Parks and Recreation Department and the Administrative pay plan by deleting one full-time Maintenance Worker III - Parks position and adding one full-time Assistant Superintendent of Parks position. Comment: The Parks & Recreation Department - Parks Division has a vacant Maintenance Worker Ill - Parks position. After evaluating the needs of the Parks & Recreation Department it has been determined that the needs of the department can be better served by a new position of Assistant Parks Superintendent. The financial impact of these changes in position classifications is a modest savings in year one. However, the new position is a higher classification which will result in incremental increases each year. Iowa City Landfill and Recycling Center Consulting Services Resolution ratifying the contract extension and -c c 7 memoranda of understanding to the November 12, 2013 Agreement by and between the City of Iowa City and Barker Lemar Engineering Consultants to provide consultant services for the Iowa City Landfill and Recycling Center. Comment: The City of Iowa City previously entered into an Agreement with Barker Lemar Engineering Consultants for annual Landfill Engineering Services. Staff previously agreed to extend the contract and requested that Barker Lemar perform additional tasks in response to deficiencies observed during an EPA inspection. This resolution ratifies those actions. The total cost for the contract extension and memorandums of understanding is $160,140 and will be funded with Landfill revenues. 8.h. Idyllwild Stormwater Drainage Diversion Resolution approving, authorizing and directing the Mayor to execute and the City Clerk to attest Amendment No. 2 to the September 19, 2017, agreement by and between the City of Iowa City and HR Green, Inc. to provide engineering consultant services for the Idyllwild Stormwater Drainage Diversion Project. Comment: The City entered into a Consultant Agreement to evaluate the results of the 2016 Idyllwild Drainage Diversion Study, determine the best stormwater bypass alternative and develop a preliminary pump station design. This amendment revises the scope of services to more accurately represent the City's preferred stormwater diversion and pump station. The negotiated decrease in cost will be $20,583 for the revised services performed, which will reduce the total consultant service fees to $192,923. 8.i. Water Park Trail Connection Resolution accepting the work for the Water Park Trail l? "` /�I Connection Project. Comment: The project has been completed by Feldman Concrete of Dyersville, Iowa, in substantial accordance with the plans and specifications. Iowa City Public Housing Roofing and Siding Replacement Resolution accepting the work for the Iowa City Public '8 - JOS- Housing Roofing and Siding Replacement Project. Comment: The project has been completed by Pa's Construction of Hiawatha, Iowa, in substantial accordance with the plans and specifications. November 6, 2018 City of Iowa City Page 7 8.m.Dodge Street Functional Design Resolution approving, authorizing and directing the Mayor - 3o3 to execute and the City Clerk to attest an Agreement by and between the City of Iowa City and Strand Associates, Inc. to provide engineering consultant services for the Dodge Street Functional Design. Comment: This agreement authorizes Strand Associates, Inc. to provide consultant services for the development of functional design plans that will assist in identifying project funding and determining a schedule for the Dodge Street Improvements Project. The project generally includes the reconstruction of Dodge Street from Burlington Street to Governor Street. The total cost of the services is $117,268 and will be funded by Road Use tax proceeds. 8.n. Iowa City Public Works Facility Phase I Resolution authorizing the Mayor to sign and the City Clerk I . to attest an agreement between Terracon Consultants, Inc. of Cedar Rapids, IA and the City of Iowa City for consulting services during construction of the Iowa City Public Works Facility Phase I Project. Comment: The Iowa City Public Works Facility Phase I Project will require geotechnical and construction material testing, monitoring and special inspection services during construction. The City received proposals and has negotiated an Agreement with Terracon Consultants, Inc. of Cedar Rapids, IA to provide said services for $81,142.00. Funds for this project are available in the Iowa City Public Works Facility Phase I account #P3959. (ZCA18-00003) Comment: At its October 18th meeting, by a vote of 6-0 (Baker absent), the Planning and Zoning Commission recommended approval of this amendment, which would allow transfer of development rights city-wide for certain historic properties. Hickory Hill Park Improvements Project - Phase 1 Resolution setting a public hearing on November 20, 2018 3 - 3o5 on project manual and estimate of cost for the construction of the Hickory Hill Park Improvements Project — Phase 1 , directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: The Hickory Hill Park Improvements Project — Phase 1 includes trail, bridge, and drainage improvements in Hickory Hill Park as detailed in the Hickory Hill Park Master Plan. This project also includes new signage and wayfinding throughout the park. The estimated cost of construction is $306,000 and will be funded by account #R4224. 9.d. City Hall MPOJC Renovation Resolution setting a public hearing on November 20, 2018 /g -3o6, on plans, specifications, form of contract, and estimate of cost for the construction of the City Hall MPOJC Renovation Project, directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: This project includes the renovation of the MPJOC office in City Hall. The estimated project cost is $126,000 and will be funded by account #E4522 and #E4520. 9.e. West Riverbank Stabilization Resolution setting a public hearing on November 20, 2018 /Z -13C// on project manual and estimate of cost for the construction of the West Riverbank Stabilization Project directing City Clerk to publish notice of said hearing, and directing the City Engineer to place said plans on file for public inspection. Comment: This project will involve constructing a retaining wall that will stabilize the river bank and accommodate a future recreational trail. The estimated cost for this project is $895,000. Funds are available in the West Riverbank Stabilization and Trail fund #P3981. Comment: This project will upgrade the existing electrical distribution system and backup generation equipment necessary to meet current and future demands. The estimated cost for this project is $1,500,000. Comment: The 2018 Annual Sewer Rehab Project is part of ongoing sanitary sewer maintenance that includes lining sewer pipes and manholes at various locations throughout the city. Staff recognizes that this rezoning is consistent with S'fr Johnson County's Future Land Use Map and Comprehensive Plan, but is not consistent with the Fringe Area Agreement, which is part of the City's Comprehensive Plan. Council Compensation Ordinance Amending Title 1 "Administration", Chapter 5 "City Council", Section 3 "Compensation" of the City Code to increase the salary and health insurance benefit of the Mayor and Members of the City Council effective January 1 , 2020. (First Consideration) /„� Comment: At Council's direction this ordinance will increase the annual salary of council members and the Mayor to $11,960 and $14,950, respectively, and make health insurance benefits available to council members at the rate offered to half- time city employees. (First Consideration) Comment: The City Code currently authorizes an annual sidewalk � ,Q� retailing permit for businesses to use the sidewalk adjacent to their storefront for 9_ merchandise display. The permit is limited to Thursdays through Sundays from March 1 to October 31. Comment: The City Manager Proposes to Provide a Parental and Family Leave Benefit to Administrative and Confidential Employees and seeks City Council Authority to do so as there will be a cost to the City. Comment: This resolution approves the Purchase Agreement negotiated with Bedrock, L.L.C. for lot 1 of the Cherry Creek Subdivision, off of South Gilbert Street, for potential future use as Fire Station #5. Assessment Schedule Resolution adopting an assessment schedule of unpaid 13-315 mowing, clean-up of property, snow removal, sidewalk repair, and stop box repair charges and directing the Clerk to certify the same to the Johnson County Treasurer for collection in the same manner as property taxes. Comment: The City has the authority under Iowa Code §364,13B to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the homeowners to abate the nuisance (for example, to remove snow from the sidewalk) and after the homeowner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the homeowner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
