dissenting), the Planning and Zoning Commission recommended approval of this rezoning
subject to a conditional zoning agreement requiring a north/south public street to be built to
City standards and dedicated to the City as a public improvement,a City Forester approved
landscaping plan abng Herbert Hoover Highway, and replatting of the site to ensure
consistency with the proposed zone district boundaries.Approval will allow the development

amendment, which would allow public art funds received for height bonus to be spent
anywhere in the Riverfront Crossings District, induding the park, as opposed to only within
the same subdistrict as the project that requests the bonus.

Comment The Hickory Hill Park Improvements Project- Phase 1 includes trail, bridge, and
drainage improvements in Hickory Hill Park as detailed in the Hickory Hill Park Master Plan.This
project also incudes new signage and wayfinding throughout the park. The estimated cost of
construction is$306,000 and will be funded by account#R4224.

Comment This project will involve construding a retaining wall that will stabilize the river bank

Comment This project will upgrade the existing electrical distribution system and backup
generation equipment necessary to meet current and future demands. The estimated cost for

Comment The 2018 Annual Sewer Rehab Project is part of ongoing sanitary sewer
maintenance that includes lining sewer pipes and manholes at various locations throughout the

17. Sidewalk retailing permit
Ordinance amending Title 10, entitled "Public Ways and Property,"
I g- Lt-1-1 I Chapter 3, entitled "Commercial Use of Sidewalks," to provide for
sidewalk retailing every day from March through October. (Second
Consideration)
Comment The City Code currently authorizes an annual sidewalk retailing
permit for businesses to use the sidewalk adjacent to their storefront for merchandise display.
The permit is limited to Thursdays through Sundays from March 1 to October 31. The
Downtown District requests that the permit be expanded to all days of the week during this time „Ito(

18. Council Compensation
Ordinance Amending Title 1 "Administration", Chapter 5 "City Council",
Section 3 "Compensation" of the City Code to increase the salary and
health insurance benefit of the Mayor and Members of the City Council
effective January 1, 2020. (Second Consideration)
Comment: At Council's direction this ordinance will increase the annual salary of council
members and the Mayor to $11,960 and $14,950, respell ively, and make health
insurance benefits available to council members at the rate offered to half-time city
employees. In accordance with Iowa law,the changes will be effective January 1,2020.

Resolution assessing $1500.00 civil penalty against Creekside Market
Comment Iowa Code section 453A.22(2) provides that, after a hearing, a civil penalty shall be
assessed when an employee of a retailer violates Iowa Code Section 453A2(1) by selling or
providing tobacco to a minor. This hearing is the time designated for the Council to consider

City. For a second violation within a two-year period the permittee has the option of either a
