Recommendations: Staff: Approval Commission: Attachments: Resolution Executive Summary: In 2015, the Iowa City Landfill and Recycling Center began accepting asphalt shingles for recycling through a contract with LL Pelling. Customers receive a discount to recycle the shingles rather than landfill them; the contractor and Landfill staff have reached out to roofing contractors to encourage them to participate in the project. To date, 5,660 tons of shingles have been recycled. The current contact expires at the end of 2018 with the option for up to two three-year extensions. A new price has been negotiated and the Landfill would like to utilize a three-year extension to continue the contract with LL Pelling at a rate of $35 per ton; the Landfill would continue to charge customers $30 per ton and subsidize the program with $5 per ton from Landfill operating fees to continue the program. Background /Analysis: The Landfill encourages customers to recycle asphalt shingles rather than landfill them. The cost to customers has been $30 per ton compared to the landfill tipping fee of either $42.50 or $47.50 per ton. The Landfill pays LL Pelling $28 per ton, retaining $2 per ton to scale the vehicles and assist with administrative and reporting requirements. The market for recycled shingles is variable and LL Pelling is working to find a consistent use for the material at a reasonable cost. They have proposed a new rate of $35 per ton to the Landfill for the three-year extension, which staff feels is a reasonable request. Several landfills in Iowa have ended their shingles recycling programs due to increased cost. The Iowa City Landfill sees the diversion of approximatly 1,600 tons per year and has covered the cost of the program with the $30 recycling charge to customers. With the increased rate from LL Pelling, the Landfill plans to hold the customers' cost to $30 per ton to continue to encourage them to recycle; landfill operating funds would subsidize the additional $5 per ton at the cost of about $8,000 per year for a total of $24,000 over the three-year contract extension. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. • Project Estimated Cost: $ 450,000.00 • Project Bid Received: $ 492,419.20 • Project Actual Cost: $ 483,329.80 One change order occurred on this project, which set the location of the concrete pad for the compressor building, extended air piping to the building location, and added casing pipe to protect the additional air pipes from vehicular traffic using the gate to the Flare Station. Barker Lemar will be submitting a Construction Observation Report to the Iowa Department of Natural Resources (DNR) for their information on the as built conditions of the project. Background /Analysis: The landfill has an active gas collection system that has been installed and expanded over time. During the course of operation, many of the vertical gas extraction wells have become overwhelmed with liquid. As a conclusion of a Gas Collection System Audit, requested by the U.S. Environmental Protection Agency (EPA) as part of the Consent Agreement Final Order (2015), it was identified that the City should implement a dewatering system to remove liquid from wells where landfill gases are hindered due to limited screen exposure. As such, it was recommended to dewater selected landfill gas wells, which involves pumping out the accumulated liquid from these wells and discharging it for treatment at the wastewater treatment facility. Exposing additional perforated pipe within a well improves landfill gas extraction and limits the potential effects of landfill gas, leachate migration, and can have a positive impact on groundwater in the vicinity of the unlined areas of the landfill, as extraction of leachate acts as a form of leachate source control. This project involved construction of a dual extraction system to meet these objectives. Recommendations: Staff: Approval Commission: N/A Attachments: Resolution Executive Summary: This agenda item awards the contract for the City Hall MPOJC Renovation Project to TD Builders of Swisher, Iowa. The base bid scope of work for this project includes painting and removal and replacement of flooring, ceiling tile, and lighting in the areas to be renovated. Additionally, the project will construct a large conference room, additional office space, an isolated storage area, and an entry counter. Electrical and HVAC infrastructure will be updated to current code requirements. There are four alternates in addition to the base bid. The alternates are as follows: • Alternate #1 — Renovation of north offices • Alternate #2 — Replacement of flooring in all areas not covered by the base bid • Alternate #3 — Replacement of ceiling in all areas not covered by the base bid • Alternate #4 — Painting of areas not covered by the base bid Background /Analysis: As part of ongoing restorations to City Hall, this project will reconstruct the MPOJC office to better serve the department's needs. The current MPOJC office has an inadequate number of offices and desk space. Many of the finishes are worn and are nearing the end of their useful life. This project will address those needs as well as the need for additional conference room space in City Hall. Sealed proposals will be opened immediately thereafter. Bids submitted by fax machine shall not be deemed a "sealed bid" for purposes of this Project. Background /Analysis: A Master Plan was completed for Hickory Hill Park in 2016. Creation of this Master Plan included input from members of the Friends of Hickory Hill, along with public comment at a series of public meetings and on-line comments. The Hickory Hill Park Improvements Project implemented the highest priorities of this plan and included clearing and grubbing; aggregate trail construction; stormwater drainage improvements including water bars, subdrain and rip -rap; three new pedestrian bridges including one (1) timber and two (2) pre-engineered steel bridges and concrete abutments; ADA sidewalk improvements; and new signage and wayfinding throughout the park. Project Plans and Specifications for the Hickory Hill Trail Bridge Replacement Project were approved at the September 4th Council Meeting. Two (2) bids were submitted prior to the September 27th deadline. Both bids were rejected at the October 2nd Council meeting because the low base bid exceeded the Engineer's Estimate by 47%. Based on the budgetary constraints and contractor comments received at the pre-bid meeting, the decision was made to break the Hickory Hill Project into two phases. Staff has worked with the Consultant to revise the project documents to better reflect available funding and contractor availability. The current project (Phase 1) includes removal and replacement of aggregate trail, installation of water bars and drainage improvements, construction of one new steel pedestrian bridge and installation of signage improvements on the east side of Hickory Hill Park. A future project (Phase 2) will include the remaining high priority trail, bridge, drainage, and signage improvements on the west side of Hickory Hill Park. Depending on funding available following bidding of Phase 1, final design of the Phase 2 project could begin as soon as early 2019. Due to Taft Avenue's status as a future arterial road, lots adjacent to Taft Avenue must be a minimum of 140 feet deep. The trail on Outlot "F" is located in Stone Bridge Estates -Part 7 and is unrelated to this subdivision. We typically wouldn't agree to construct improvements in a neighboring subdivision as a part of public improvements in a later subdivision, but in this instance it is acceptable. There was an escrow fee of $4,700 previously paid to the City for this work in connection with SBE 7 that the Subdivider will want released once the work is completed. 2. Please confirm the effective date of when the water main extension fee increased from $435 per acre to $456.75 per acre. 3. The value that has historically been used in connection with the fee in lieu for neighborhood open space is $15,000 per acre. This is based on an appraisal previously done by Casey Cook. To use the value Rollins Pass paid for its land along LWB is not an appropriate measure of valuation because it is development land and vertical construction is permitted. The value of .58 acres of unimproved and unusable (except for open space) land is much different. For what it's worth, Arlington paid Lindemann's $15,000 per acre for the SBE Part 10 property. 4. John Moreland will be reviewing with City Engineers the lineal s.f. costs specified for Taft Avenue. These costs appear extraordinary based on the per square costs of constructing other arterial streets in Iowa City, as well as North Liberty and Coralville. I did add LOC language which I understand is acceptable to the City Engineer. The Building Change program focuses resources on these priorities. The Building Change program has two parts, a loan program and a grant program, both explained in this memo. Only the loan program requires Council approval of a resolution for an agreement with the funders of the loans — Hills Bank and Trust, MidWestOne Bank and the University of Iowa Community Credit Union. Eligible projects include fagade renovations, which can include historic preservation and non - historic building improvements, signage within larger fagade improvements, entryway modifications, elevators or other accessibility improvements, and renovation of underutilized space, such as unused upper stories. Background /Analysis: The Loan Program As in 2013, staff has worked with Hills Bank and Trust, MidWestOne Bank and the University of Iowa Community Credit Union to create a special loan program. In this program, each lender agrees to contribute equally, up to $50,000 making up to $150,000 in loans funds available. The resolution for this agenda item memorializes the agreement between the City and the participating lenders. Loans will be 2% interest, no fee, 5 -year terms, for up to 50% of project costs. A project must be a minimum of $10,000 and the maximum loan amount is $30,000. Banks will fund each loan equally with a check to the City. The City will cut the check to the loan recipient and will repay the lending institutions once each year. It is important to note the City is neither a funder, nor a guarantor of these loans and is under no obligation to incur costs or expenses in attempt to collect on a default loan. Loan applications will be reviewed on a first come, first served basis by a committee consisting of staff and a representative from each of the lender organizations. Upon approval, project designs must be approved by the Design Review Committee prior to issuance of a building permit. The Grant Program As in 2013, the $150,000 Building Change Grant Program is intended to assist in projects requiring larger investments. The source of the grant funds is the Economic Development Opportunity Fund line (10210510-448070). This is a competitive grant program whereby applicants will submit project proposals and a Review Committee will evaluate and determine grant awardees. Grants will be available for up to 50% of project costs, with a $50,000 maximum grant. To ensure projects are competitive and impactful, the minimum project cost must be $50,000. Applications will be accepted until Friday, February 15, 2019. Since this is a competitive program, all applications will be evaluated together. If funds are not depleted after the first round, the City will keep the application period open and evaluate later applications on a first come, first served basis. Grant awards will be based on the type of improvement, total investment, project impact, and other sources of funding. History In FY13, the City awarded $155,000 in grant funds for projects that totaled $500,000. Those projects included Active Endeavor, Bo James, Quintons, GrossSix building, Pancheros, Chait Galleries and the Yacht Club. In FY14, the City granted $47,700 to a $119,000 project at Atlas (now, St. Burch Tavern). In FY15, the City granted $104,000 for projects that totaled $284,000 and included Cold Stone, Sports Column, Martinis, Yotopia and the Airliner. The City of Iowa City's $307,000 in grant awards included CDBG funding and Economic Development Opportunity funds, and resulted in project spending of more than $917,000. With this round of Building Change, there will not be any CDBG funding source. In FY15, The Building Change Loan program loaned $67,800 for projects totaling $182,200. Combined, the two Building Change programs of FY13-15 incentivized a total of $1,143,296 in investments in downtown Iowa City. City and Iowa City Downtown District (ICDD) Incentives It is important to note that ICDD will also be running two of their own small grant programs which could be paired with either of the City's two programs. ICDD will employ a two-tiered grant program as follows: Tier 1 (CoSign): a 50/50 match, up to $3,000 for creative signage, applications accepted in Feb, 2019, and Tier 2 (CoSign Plus): a 50/50 match, up to $1,000. Applications will be accepted in March, 2019 and October, 2019. Promotion of the programs will begin immediately and in late January, before the first deadlines for competitive grants, the City and the ICDD will conduct a workshop to promote and provide information on all funding opportunities. Collect payments on the loans and transfer to each Recipient all loan payments in one - lump sum annually beginning on July 15, 2019 for the preceding city fiscal year until final loan repayment (5 years of repayment). If an approved applicant defaults on a loan the City will not guarantee the loan. The City is under no obligation to incur costs or expenses in attempting to collect on a defaulted ban, but may, in its sole discretion, make reasonable attempts to collect on the defaulted loan. 3. The loan terms and requirements are: A. 2% interest, 5 -year loans for up to 50% of total eligible costs, with a maximum loan of $30,000 to each approved applicant. B. All approved applicants must agree to repay their loans through direct deposit. 4. This agreement will terminate on June 30, 2020. Prior to this date, the Recipients and the City will review the Building Loan Change Program and decide whether to extend the term.
