Dear City Councilors,
Please do the right thing, and replace the hostile benches downtown that are clearly designed to prevent
people from laying or resting.
The new benches are a hateful demonstration of anti -homeless bias and hostile design and have no place in
our community.
I believe that the City officials who made such a cynical purchasing choice should be retrained. Staff's public
denial of the obvious intent behind their purchasing choice is frankly insulting. We, the taxpayers, are not
stupid. Ya'll messed up. Own it, please.
Do the right thing, and make our downtown inclusive, and compassionate, not cold and cynical. Get rid of
these benches, and install something worthy of the actual heart of our community.

Esteemed City Council of Iowa City, City Manager Geoff Fruin, and Iowa City Catholic Worker House,
I didn't attend the ped mall planning meetings so I won't go into detail about my ped mall bench opinions; but here we
are in the middle of a controversy so can we find a compromise? The new benches are uncomfortable for anyone who
wants to nap on them (including me on occasion) and for those who NEED to sleep on them it is an obvious problem.
City Manager Geoff Fruin estimates replacing them would cost tens of thousands of dollars. Replacing them is a waste
of money, resources, time, and effort. Not very environmentally or fiscally responsible.
In my late nights at the ped mall, I have never seen every single bench filled with a sleeping occupant. Is it possible to
leave the problematic benches that have already been replaced? As the rest of the renovations progress instead of
replacing, just keep the old benches? Or option two, keep the benches that have already been replaced, find extra room
to put back all or some of the old benches. If there are new benches not yet in place in storage somewhere, they could
be used in different park areas around town.
It would be irresponsible to waste the projected tens of thousands of dollars when there are feasible compromises. The
money saved could be donated to the Shelter House or other community organizations that assist the homeless..... or
not, because, think of it this way, by NOT replacing the new benches you are SAVING those organizations money by not
wasting further city money.

Sorry it was very late where I sent it and I forgot.
Anyway my point is you need both types, For mothers / fathers with young kids they want snug against them as well as
people who want to lounge on them you want some with out the middle armrest but for people using canes and walkers
you want some with the middle armrest. Instead of cut the middle armrest off I would spread them out around the city
because every public place that you have benches really should have both types just like public restrooms have both with
and without grab bars.
When Grandma takes the grand -kids to the public pool in the summer she needs some place to sit and watch the kids and
it needs to be some place that an old lady can get up and down from. Those lounge chairs around the pool for
sunning that are a foot or less off the ground absolutely no way, Other wise since most parents work if Grandma can't get
up and down those kids are not getting to the pool. The same goes with lots of parks during the day. Lots of
Grandparents watch the kids during the day while parents are at work. I have worked hard on physical therapy and
improved a lot in the last decade. However I still have lots of places I don't go because there is no place I can sit down.
Places where it's I could probably manage to sit down in one piece with out breaking anything but when it comes to
getting back up I have two choices crawling on my arms and legs until I can find a stairs railing or a fence to grab on to
and pull myself up or I call 911. So I just don't go there period.

Two armrest are to a bench as two grab bars are to a handicapped toilet. Could you explain to a court
room or a reporter that you had someone going around town and cutting all the grab bars off all public
toilets. They came with them. They all originally had arm rest/ grab bars and we had them all cut off.
Talk about a hostile message, cutting of grab bars/ arm rest.
Please remember all the elderly and disabled people with canes and walkers as well as the ADA law.
Think of all the people fighting to use a walker or canes, fighting to stay out of that wheel chair or to
learn to walk again. Do not get rid of all those armrest / grab bars on the benches. Iowa has a large
elderly population. They need 2 armrest close enough to grab one with each hand. As someone that
has struggled to manage to walk again struggled to go from a wheel chair to using a walker. As
someone with legs trembling with fatigue has struggled to find a chair or bench with two armrest
somewhere, so I can sit down. So I can hold on for dear life as I lower myself down before my legs
give out and I crash down on the hard cement. Trying to keep a walker steady enough to lower
yourself down to the bench or push yourself up is extremely difficult resulting in lots and lots of falls,
lots of tears, scraps, and a few fractures. A bench or chair with two armrest is so much more stable
and safer. Why do you think doctors' offices and hospitals always have plenty of them both with
armrest and without? Try getting up and down without an armrest if you NEED two canes to walk. I
could never do that. I think the Americans with Disability Act requires that you have at least some
benches with two arm rests. All public restrooms have to have some stalls with two grab bars that are
close enough to one another that you can grab on to one with each arm. Why wouldn't you need to
have some benches with two armrest close enough to grab one with each arm. I have repeatedly
fallen trying to use a restroom without grab bars as well as trying to get up and down in chairs without
armrest to grasp. In many ways the person struggling to walk is even more disabled then the one in
the wheel chair. If they can NOT find a place they can sit before their trembling legs give out they
could get seriously injured in the fall and landing. A bad landing at the wrong angle permeate spinal
damage. Compression fractions of my L1 and L2 vertebra. It's not like any other fracture it will not
going to heal. Imagine a walnut is your vertebra and someone took a sledge hammer and started
smashing one walnut then the next walnut. When do you think those smashed pieces are going to
turn back in to a healthy new walnut or vertebra? Never! Constant back pain. It's been over 10 years
and I have constant pain because of it. I landed on my upstairs wooden bedroom floor which has a
lot more give then that hard pavement. They take wooden boards and bend them into violins, harps,
and tennis rackets. Wood boards have a lot more give and bounce then that pavement. Ask yourself
in the next 20 years are you sure neither you, your parents, and anyone you know isn't going to Need
a cane and two armrest. When some disabled person gets hurt do you want to be enplaning that you
received benches that were handicapped accessible and you cut all their grab bars/ arm rests off.
That sounds more hostel.
Surly you have another park or upcoming project which also needs benches. I submit they all need
some of each type.
One more thing since people come in different shapes and sizes a good doctors office that has a lot
of elderly patients also has arm chairs of a couple different heights. Those first 2 - 4 inches standing
up or last 2 - 4 inches sitting down are the hardest. All my living room chairs, couch, and love seat are
on 2 to 4 inch risers. I would never get up and down with out them is either risers or thousands of
dollars for a lift chair.

I'm writing about the possible replacement of the the new ped mall benches. I understand that the City is contemplating
replacing them with the costs exceeding $100,000. 1 find it concerning that one vocal group can oppose the benches,
after the fact, and we tax payers will be forced to pay.
The purpose of the benches should be to sit. I personally do not want to see anyone sleeping on the benches
downtown, and certainly do not support the benches being changed out so the homeless population can sleep on
them. I would think the majority of the IC residents would not be in favor of replacement of the benches. 1 believe the
Iowa City area does a good job of offering many services for the homeless. The replacement of the benches is
irresponsible and shouldn't even be considered.

I am an older lady who lives in Iowa City and usually don't say very much, even about things I don't
like. I am not a protester. But I do get aggravated when a few people protest to get what they want
and the city council or government goes along with it. When you compare the number of people
protesting with all of those who live in Iowa City who are not protesting there are a whole lot more.
What I am saying is that many of us like the new benches in the Ped Mall, but don't think that the
homeless need them to sleep upon. They should sleep at night in the prepared places, as the Shelter.
Why do they have to sleep all day? Why don't they go to work in the day? And I don't like the fact that
we, the citizens, will have to pay more money to change these benches. Give them 2 benches, off the
main Ped Mall area and don't just give in to these people. While they are sleeping they take up a
whole bench. A bench can hold at least 4 people sitting. Many of these people are just activists who
are trying to get they want and not what is best for the whole population.

I have lived in downtown Iowa City since moving here 8.5 years ago. I have seen many minor and 1 major
renovation to the Ped Mall in that time. I have also seen and experienced first hand the actions of our city's
homeless and impoverished population. While I understand and sympathize with their plight, I do not believe
that the Ped Mall should be looked at as a proxy -hotel for these, or any other, people. Spending any money to
change park benches so that anyone can sleep on them, or spending money to put in benches or other seating
simply to allow the homeless to sleep on them, is a waste of public resources and not only serves to infuriate
those who pay taxes and live and work downtown, but also encourages the homeless and others to loiter in
the Ped Mall. This in turn leads to more commonplace public intoxication, harassment, urination and
defecation, drug use, etc all of which I've seen with my own eyes.
Whether the Ped Mall needed new benches I do not know. But the City should do the right thing and not give
in to those demanding what is essentially free living/sleeping quarters for the indigent. They need help, I get
that. But there are plenty of other resources for them to tap instead of turning our Ped Mall into a filthy,
unsafe, and unpleasant transient motel.
Please do what's right and clean up the Ped Mall, don't waste more money kow-towing to the protesters, help
the indigents get access to appropriate resources, and don't let the Ped Mall continue to be a homeless -hostel
eye sore.

I would like to express my thoughts on this `controversy'. I like the new benches and I like the old decorated
ones as well. Why can't we have both, without further expense to the City. I would point out that after talking
with another retired friend, that the new benches with the center arm rests are easier to get out of for the many
people and provide a small barrier between folks sitting on the benches. The fact that the public was not asked
to weigh to in on the minor beautification issue, is just that, minor. We elect officials and pay City Department
personnel to make these day to day decisions. I say compromise may be the solution without spending more
money.

I appreciate your efforts on behalf of the ADA community, the homeless and the community as a whole.
I want to encourage you to not be held hostage by a few who protest against the benches you have in place on
the ped mall.
I am on two board related to housing in the community. The Shelter House and The Housing Fellowship.
We both know how much real work the city is doing to accommodate and help those in need.
"Sleeping benches" are not a solution or even an accommodation. They are a perpetuation of bandaids and
stereo types that serve no ones real needs.
The present protest are misguided sentiments without the will to understand or solve the real issues.
Arms on the benches are helpful to those with mobility issues.
No one ca argue that the city should put beds in the Ped -mall as a solution to homelessness.
Just say no to being held hostage over a publicity campaign that will not solve anything.

To the Honorable Mayor and City Council:
This old Irishman can't help seeing the sound and the fury on the
benches at the Ped Mall.
Question? Who is the Ped Mall for? The community or the
homeless. Families coming downtown? My recollection is that the Ped
Mall was designed and built to enhance downtown Iowa City and bring
people downtown. That should still be the goal.
As Jim pointed out, the City does spend a lot of money for the
homeless with the shelters and the other things the City and some
charitable organizations provide. And that Jim is right about what he
said about the 2013 plans and the problem. As a commission member at
that time, I had problem getting to see Terry Dickens at his shop because
a homeless guy tried to get me to give him money. He was smoking so I
knew where it would go.
Just a thought on the arm rests. Folks my age including myself use
arm rests on chairs to get up by pushing on the arm rests. Progressive
rehab advised me after I fell once to be sure and do that.
Finally, I know the circle of people that I am a member of is different
than the 20 or so members shouting about this and demanding
things. Their mothers should be ashamed. My friends think that benches
for the homeless is wrong.
I often tilt at windmills, I hope this isn't one of them. Thanks to all of
you for willing to serve in my crazy adopted town. Came here in 1960
and have no regrets.

I am one for leaving the benches as is. Homeless people do deter other people from bringing their families
downtown. As the person from the Shelter House said we should be looking for ways to help them instead
putting a lot of time in park benches. This would be a waste of the tax payers money to replace them. If the
Catholic House wants to pay for it, then go for it. I believe the City of Iowa City gives in to much to people like
this and it is mostly a small majority that makes a lot of noise. Do not give in!!!!!

Please do not remove new benches.
I am writing a brief note to express my strong opinion to not remove the new benches from the ped mall. I
have read many editorials in local newspapers, seen many posts on social media, and heard people
interviewed on t.v. These all included both sides, keep and remove. The reasons for keeping the new
benches far outweigh those for removing them.
The purpose of the benches is to provide a place for brief respite, not a place to sleep or camp. The city, as
well as numerous organizations, are providing shelters and homes for those in need.
Please stick to your original plan, for the good of Iowa City, and keep the new benches.

I have recently seen on the news the issue of the ped mall benches in downtown
Iowa City. I would like to give my view of the problem of the homeless people in
the downtown area.
I am a senior citizen who has lived in IC for over 24 years. I am a retired registered
nurse who now has health issues that make me feel less able to defend myself out
in the world --I can no longer outrun anyone. When I go downtown, I do not feel
safe. To give you an example, during the IC Book Festival in October, I was on the
ped mall with great excitement about pitching a novel to a publisher there. There
was a homeless man there as I approached from the street who was ranting,
waving his arms, looking pointedly at the people walking by, walking with big
strides towards these people as he did so. To me, as a former psychiatric nurse,
this man's behavior seemed threatening,te-wR. I bypassed him by walking into the
library where I told the staff about him. I was in a hurry to get to my destination,
so I didn't stick around to see what was done. The library staff did look out the
window when I pointed out who I was referring to, and she said,"Oh, yeah, we
know him." An hour later when I walked back that way, that man was still there. I
don't know if anyone spoke to him about his behavior.
It seems I can't walk even a half a block to the library, Prairie Lights, etc, without
encountering some homeless person asking me for money. I know that mental
illness is rampant in this group of people, and because of my career, I know how
quickly things can go bad. It is heartbreaking to see these people on the street with
nowhere else to go. But I also know some of them have been offered services and
have refused them.
Also, my observations as I drive through downtown are that these people seem to
live in the ped mall, and like anyone else living anywhere, they seem to have a
sense of ownership. I see it in their body language, the way they walk, the way
they hang out and talk to their friends. They look like they own the place.
So, back to the benches. If they can sleep there, it is one more reason they would
feel ownership of the space of the ped mall. And to be honest, knowing that they
sleep there, in order to avoid catching something I don't want, I wouldn't sit on one
of those benches unless I was having a serious health incident --it would be better
than sitting on the ground, a place that I imagine gets used as a toilet.
I don't mean to sound heartless, but I pretty much avoid downtown. I'm even
considering using the Coralville library instead of the nice IC library.
I don't know what the solution is. More homeless shelters? A park of their own with
comfy benches, heated and airconditioned toilets with showers and the works? I'm
not being sarcastic here. But I do resent feeling like I need to take a body guard
with me when I go downtown (that was meant to be sarcastic).

Dear Council members,
Please, please do not spend addtional tax -payer dollars to re -design the new Ped Mall benches. As you are well aware,
public input was sought on this matter in the pre -design phase. Those protesting the current bench design had an
opportunity to weigh in and they didn't.
I consider myself to be fairly liberal - a Crisis Center volunteer and advocate for many social justice causes. However, I
wonder - do we really need to provide "beds" for whomever may wish to lie down on the three primary blocks of our
central business district? Personally, I think not. What about everyone else who may wish to sit, but are unable to find
spots because of those taking up entire benches? What next - will we place mattresses on the benches? This is getting
beyond ridiculous. When I see protesters with our City Manager's face on posters with the question,"Geoff, what would
Jesus do?" my response is - certainly not have homeless folks sleep outside on benches! We can to better than that. We
have Crosspark Place opening, the protesters and others can invite the homeless into their homes, etc. Obviously, the
optics of not compromising on this issue aren't great for the City, but let's be rational and good stewards of taxpayer
monies.

My wife and I are senior citizens. We live in Cedar Rapids. However, we have visited your Ped Mall and as
senior citizens would find your new park benches much easier and more safe to sit in and get out of with the
armrest in the middle of the bench. If both of us sit in a bench without the middle armrest, the older adult not
sitting next to the end armrest would have a difficult time getting in and out of the bench.
I urge you to consider the safety of senior citizens visiting your Ped Mall, spending their dollars at your
businesses, and do not take away a safety feature of your new benches.

I am repeating myself I know but I did want to emphasize that the Council
should not bow to the objectors who want the city to remove all of the

Progressive Rehab, I was told people my age and many of the disabled
when getting up from a chair they need to push themselves up using the
arm rests to help avoid falling.
I believe the Ped Mall was to attract people to downtown and to enhance
the area for the community

I am not in favor of paying $150,000 to change the bench seats in the pedestrian mall. I suggest you use the money to
find a more reasonable solution than providing an uncovered bench, which is unsuitable in the rain, snow or cold. You
might also survey what homeless population is being to served by park benches.
Helping people who are alcoholics is very difficult. You have to weigh both trade offs of encouraging people to sleep
downtown against the rest of the population who want to also benefit from that area. My experience of being downtown
for example during a music event, is seeing inebriated individuals dancing in the midst of families, publicly urinating, and
changing their clothes in public (e.g. public nudity).
I feel sorry for those people but public sleeping benches is not the solution.

I wish I could adequately explain how displeased I am about the Ped Mall benches. Not only are they
unattractive with no personality of design and unable to be decorated by local artists, they are clearly
designed to deter homeless people from coming downtown.
After banning panhandling and then putting up and then having to remove the parking meters for
spare change, I thought the Council/manager would have know better than to put in hostile benches unless
the intent was to deter sleeping. And of course I and many others now believe that this was the intent. I
cannot tell you strongly enough that it feels rotten to have been deceived by people I was having faith in.
Yes, it will be on the taxpayers' backs, but the new benches should be removed and more people -
friendly benches installed. Just like I cannot figure why you want up to 2,000 more people living in a
concentrated area in the downtown I also cannot figure out why the Ped Mall, already small in size relative to
the number of people who come downtown, should be filled with up to 84 benches, some of the placed to
resemble pews. Few people are going to the Ped Mall for daily devotions.
Please openly admit your mistake, remove the benches, and install new ones, fewer in number and
ones that are not only welcoming, but can be decorated with local artistic expression for the enjoyment of
others.

My name is David Goodner with the Iowa City Catholic Worker House.
Before I begin I want to thank all of the area service providers for the incredible front-line work you do day in
and day out to serve poor and homeless people in our community. The Catholic Worker House stands on your
shoulders and by your side. We appreciate the relationships we have working closely with all of you to
coordinate care for our friends, neighbors, and guests.
Thanks also to the Iowa City City Council and staff for all you do to promote good government that works for
everyday people. The Catholic Worker House supports the resolution before you later tonight calling for full
funding for the University of Iowa Labor Center. It is a great example of city government promoting justice for
all. Thank you.
City leaders did not have to deny the new Ped Mall benches were intentionally designed to prevent people
from laying down on them.
I have to read for the record excerpts from the 2013 transcripts which prove otherwise, but before I do, this
issue has to be put in the historical context of homeless politics in Iowa City. In the early 1990s, homeless
people slept in the steam tunnels underneath downtown.
The 2013 ordinance, which banned daytime sleeping on downtown benches and the storing of personal
belongings on ledges, was not the first time this has been a hotly debated topic. In 2010, the city council
passed a panhandling ordinance that was later repealed because of concerns about its constitutionality. The
2013 law didn't completely push everyone out of sight. The day after last Thanksgiving I saw a homeless man
lying down on a bench during the daytime. I watched a police officer ask the man to get up and move on.
During a work session before the first reading of the 2013 law, on August 20, 2013, city councilor and now
Mayor Jim Throgmorton said: "A friend also suggested the possibility of inserting, in order to deal with the
sleeping on benches challenge, this person suggested inserting a new arm rail in the middle of the benches.
You know, that makes it pretty hard to stretch out and sleep ... so that's a possibility as well."
The assistant city manager at the time and the current manager now Geoff Fruin said: "Regulations are not the
only way to address this, and it's not the only way that we want to address this. Physical design, Jim, as you
alluded to with the benches plays a large role, and not just the design of the benches but how you design the
public spaces, how you design the planters, the walkways, the lighting, all those things come into it. So we
want to continue down that path as well."
A month later during the third reading, on September 17, 2013, then and current city councilor Susan Mims
said: "I think we need to look very carefully at the design elements of the ped mall. You know, we design the
placement of the benches. We design benches in certain locations that have arms so if we don't want people
sleeping in those particular locations, you can't, but maybe there's other benches in other locations that don't
have arms in the middle of them, and that's fine if people sleep there at night or during the day. "
Those comments speak for themselves. The history of hostile design around the world tells us that benches
with bars through the middle of them serve only one purpose. If there was ever any confusion about why they
were installed here in Iowa City, these statements clear them up beyond a shadow of a doubt.
The real purpose of these benches should have been explained in the public Ped Mall Renovation Plan
documents but it wasn't. The omissions prevented the public from having meaningful public input before the
bad benches were put in. The repeated denials only reinforced the fact that there was never a real public
process.
We shouldn't pass laws or design public space to discriminate against homeless people. Funding service
providers does not make up for it.
This isn't a social service issue. It's a social justice issue. People are living in their cars, under bridges, or in
parks, sleeping in gas stations, McDonalds and Wal-Mart, or walking around all night long, even in these
temperatures. I know because they come into my house everyday and tell me. Many of them have also spoken
out publicly in the last two months about this issue.
It is written, the poor will always be with us. Public policy must have a preferential option for the poor otherwise
it is not just. So put poor people first. Every time. Not half the time. Not half the way. Not 10 percent, or 20
percent of the time, or 10 percent, or 20 percent of the way. All of the time and all of the way.
Everyone has a right to sleep in public. Everyone deserves a city that is open and welcoming to them. That
shouldn't be too much to ask for.

On Thursday, January 17 a statewide community organization named Iowa CCI Action Fund sent an email action alert to
300 members in the Iowa City metro area. The alert contained information on the new anti -homeless Ped Mall benches
and asked CCI Action Fund members to write a personalized letter to the city council.

No Hostile Design in the Ped Mall!
According to the international monitoring organization
HostileDesign: Hostile designs are designs against
humanity. They are made specifically to exclude, harm or
otherwise hinder the freedom of a human being. Quite
often they aim to remove a certain section of a community
from a public space.
Two months ago a group of Iowa City citizens first noticed
the problem with the new Ped Mall benches, but top city
officials insisted the middle bar was meant to increase
seating, not discriminate against homeless people. Then
archived transcripts from 2013 were released that proved
otherwise.
The documents caught city managers and councilors red-
handed, openly talking about installing new benches with
bars through the middle of them in order to advance their
long-term agenda of removing visible homelessness from
the downtown public space. Now the city is still refusing to
do the right thing and reverse course.
Iowa CCI members in Johnson County have decided to
join the fight and several attended a recent
demonstration. We are now calling on all local -area CCI
members to consider taking urgent action on this issue.

While I agree with the sentiments of the canned letter I just sent, I wanted to add a few more
comments.
This past Mondaywhile I was lying on an old bench as partof the protest against the new benches,
a woman passed me and yelled "you should support Crass Park Placel It's going to solve all these

What disheartens me so much about the new benches is how deliberately they were chosen to
make homelessness inconvenient. I have often seen cities pass laws that make it Illegal to be
homeless--anti-panhandling measures, anti -sleeping in public places measures. When people run
out of ways to make something illegal, they seek ways to make it impossible, or at least highly
inconvenient.
Every time I look around downtown Iowa City these days I see that it's more and more meant for
only a very few demographics. That's not the city I grew up in, where you could still buy hardware
downtown, or eat for cheap, or buy affordable women's clothing above a size 10.
Maybe that's the Iowa City you want: an Iowa City that only serves a certain kind of person. But It's

Hostile Design
The new Ped Mall benches in Iowa City with a barthrough the middle are anti -homeless "hostile
architecture" and should be removed. I hope this letter still means something to you even though
It comes from Cedar Rapids.
I am disappointed to learn that city leaders hid the truth about this issue from the public for so
long. That's not how public officials should act.
Most people loved the beautiful hand -painted benches and the Ped Mall should be an open and
Inclusive place for everybody, Including poor and homeless people.
The insidious part of designing public space with these hostile elements might not be listed in Item
descriptions. I know it is tempting to blame the previous people in your possession or the system
that made these benches easily available to you but that kind of ignorance belongs In the past.
Please say No to Hostile Design and agree to remove all the offending benches right away.

Please consider all of your community instead of a portion next time you build a project for all.
Please consider if this was your brother or sister trying to live their life, a part of a community.

Dear City Council members,
I was a member of the Chamber of Commerce Art Committee in 1998. We studied models elsewhere and drafted a
proposal to the City Council to adopt an ordinance providing for public art. We wanted Iowa City to follow the state's
example by requiring a percentage of each government building under contsruction to go to public art. The Council at
that time chose not to do that but instead allocated $100,000 from the capital improvements budget. Each year that
amount has dwindled. I suggest that that amount be restored as the budget is adopted. Possible source might be the
Hotel Motel tax which has grown with all the extensive new construction. Public art creates a wonderful ambience that
attracts visitors and enriches those who come anyway for other reasons.

Pursuant to Section IV of the existing Fringe Area Agreement (FAA) between Iowa City and
Johnson County, initially adopted in 2006, please accept this as notice that the Johnson County
Board of Supervisors requests leadership of the City of Iowa City to review and jointly undertake
consideration of needed modifications to the FAA.
In May of 2018, the Board adopted the Johnson County 2018 Comprehensive Plan. This is the
second iteration of a comprehensive plan for unincorporated Johnson County since we agreed
to the FAA. The 2018 plan includes a Future Land Use Map which anticipates non-agricultural
development in areas of the county that were not designated as growth areas over a decade
ago.
This has caused—and will likely continue to cause—conflict in reviewing development requests
within the Fringe Area. The language in the current FAA references land use documents in
effect in 2006 and does not allow the necessary flexibility to account for evolution in
comprehensive planning overtime.
It is important to the Board that this process be initiated in the near future and progress to
completion in a timely manner. Please direct City staff to take appropriate steps to review the
current Fringe Area Agreement and the City's future land use plans with a goal of both City and
County staff meeting to begin initial work on a new Fringe Area Agreement no later than
March 1, 2019.

To Members of the City Council:
We are Northside neighbors and property owners who have watched with growing concern as older buildings
in and adjacent to the eastern and northern edges of downtown Iowa City have been torn down and replaced
by multi -story condos, hotels, and apartment buildings.
In general we are not opposed to such development, and we fully understand and support Iowa City's need for
affordable rental housing, in particular. However, we also cherish the historic character of downtown Iowa
City and, more specifically, the area known as the Northside Marketplace, bounded by Jefferson, Gilbert,
Bloomington, and Linn, and including small businesses on both sides of those streets.
With the demolition of the old Pearson's Drug Store on the corner of Market and Linn, and construction under
way on a new condo building there, our concerns have only intensified.
What will happen if other long-time property owners on that particular block — home to George's Buffet,
Hamburg Inn, Riverside Theatre, and the Haunted Bookshop, to name a few — cannot withstand the pressure
to sell to developers with seemingly unlimited resources? We can imagine a worst-case scenario in which
many of those older buildings and their adjacent parking lots disappear beneath monolithic apartment
buildings, totally out of keeping with the scope and character of the neighborhood.
We can also envision a best -case scenario, however, in which the historic charm of that block and its
surroundings are preserved, even as the Northside Marketplace evolves to meet the demands of the future.
We can envision new buildings — whether residential, retail, or public use — designed to mirror the 19th_
century flavor of the neighborhood in both appearance and scale. We can envision more trees and benches,
perhaps a "pocket park" and/or other amenities that would support a walkable streetscape where visitors are
encouraged to meet and linger. After all, it is not only the existing businesses that draw visitors (and revenue)
to the Northside; it is the warmth and charm of the architectural ambience as well.
The City's recent purchase of the two older homes on the southwest corner of Gilbert and Bloomington, and
the subsequent invitation to the public to suggest creative uses for those houses, seems to us a positive and
enlightened step in the right direction. But we must do more.
We believe that developing a form -based code for the Northside Marketplace is absolutely essential to
addressing these concerns, thereby preserving the quality of this highly attractive and historically significant
area of downtown, and ensuring its thoughtful and appropriate future development.
As the Form -Based Codes Institute puts it, "Form -based codes address the relationship between building
facades and the public realm, the form and mass of buildings in relation to one another, and the scale and
types of streets and blocks. The regulations and standards in form -based codes are presented in both words
and clearly drawn diagrams and other visuals. They are keyed to a regulating plan that designates the
appropriate form and scale (and therefore, character) of development [emphasis added], rather than only
distinctions in land -use types."

Hello Council Members,
I support developing a form -based code for the Northside neighborhood and the Northside Marketplace. Please allocate the
necessary funding to support this initiative.
In addition, it is very disappointing to see that the council did not designate the property at 410-412 Clinton as historic. We
need to protect properties like this Civil -War era home to insure that we preserve at least some of the historical character of
our neighborhoods. That is part of what makes Iowa City interesting.
The development of every piece of property in Iowa City into apartments with retail below seems absolutely out of control.
Who is going to move into all these apartments? And I walk by empty retail spaces every day on my way downtown. Some on
the Northside have never been rented at all! Please balance new development with its resulting disruption and overbuilding,
with the need to keep our neighborhoods livable.

I am writing due to concerns about the roadwork that was completed this past fall on Riverside Drive across from the
Red Pepper. This seems to be a dangerous area of the road as the road crews didn't cover the old lines and it is difficult
to see the center lane line of the road. When the road is wet, it looks like you are in the correct lane, but then you find
yourself either about to hit the median or in the other lane of traffic.
Please consider repainting the yellow lines in this area to indicate where the edge of the road is and the white line in the
center to define the lanes.

Hi,
I am sorry I can't be with all of you tonight but I did want to give you some information from a union point of view.
First let's call these employees what they are in the contract (AFSCME) Hourly employees.
From Pg 4 Article 7 Section 1
Hourly Employees- Recognizing that Non- Permanent Employees fill needs required for the day to day operation of Iowa
City, Non- Permanent shall be known as Hourly Employees. Said employees will be able to work up to but not exceed,
1300 hours in a given fiscal year, and up to 1500 in a given fiscal year if they participate in rotating weekend schedules.
Up to ten hours on an average, per pay period of rotating weekend shifts will not be counted as part of a regular
assignment. If any Hourly Employee exceeds these hours in a given fiscal year they will be considered a Permanent
Employee and entitled to wages and benefits as provided in the contract.
Hourly Employees will not replace, but may supplement the work done by Permanent Employees, or perform tasks not
routinely assigned to Permanent Employees. Hourly Employees will not be lead workers nor will they have the same job
descriptions as Permanent Employees. Hourly Employees will receive the specified training in the department in which
the employee is working.
That is the contract language. How does it work? A few times a year I will ask for a list of employee numbers from
specific departments and check the hours to make sure there is no run over. This has happened twice since our contract
has been. Once the City caught a problem at the Parks and Rec and I caught one at the Library. Both were solved.
Don't get me wrong I would love to have hundreds of potential new members, but I know this won't be the case. Many
of the jobs would be consolidated or eliminated. Another factor that isn't being taken into effect is the number of
permanent jobs all over the city that have in their descriptions supervising of hourly employees. Pretty hard to defend
the validity of your job as a page supervisor when you have no pages to supervise. What happens to those employees? I
would love to see all Permanent employees be full time but there isn't money for that. We have many y2 time and'/.
time employees who know theirjobs should have more hours yet the budget can only stretch so wide. Will their
motivation for reclassification be dashed because all the budget is utilized on Hourly Employees?
It is maddening to see all these Hourly jobs when we know there are Permanent jobs that could be created or expanded
for some tasks. A lot of the Hourly jobs are seasonal, the turnover rate is pretty high regardless of where the job is. I
don't like this system. I wish that Hourly workers worked enough to be eligible for the Affordable Care Act. But the job
pool is small and it does not have an endless source of revenue.

Background Information
The applicants, Claude and Adam Greiner, are requesting a rezoning from County
Agricultural (A) to County Residential (R) for approximately 11.34 acres of property
located in Johnson County South of American Legion Road and West of Wapsie Avenue
SE in Fringe Area B — Outside of Iowa City's Growth Area. Because the property is within
Iowa City's two-mile Fringe Area, the Fringe Area Agreement specifies that the City will
make a recommendation to the County Planning and Zoning Commission before the
County Commission considers the application. The final decision on the rezoning falls
within the County's jurisdiction.
If this rezoning is approved, Claude and Adam Greiner intend to develop a county
subdivision, and divide the land into seven single family residential lots and one outlot.
As proposed, each buildable lot is slightly larger than one acre and each lot will have its
own septic system. There will also be a private well installed to service all seven lots. The
proposed outlot would serve as an area for storm water management. City approval will
be required if the property is subdivided as proposed.
Analysis
Existing Land Use and Zoning
The subject property is currently zoned County Agricultural (A) and has two grain bins
located on the site. Properties to the north, east, and west are zoned County Agricultural
(A) and County Residential (R), with residential properties lining American Legion Road.
Properties to the south are zoned County Agricultural (A) and are being used for row
crops.
Proposed Zoning & Surrounding Area
The applicant is requesting a rezoning to County Residential (R) which allows for single
family homes on lots at least 40,000 square feet. The area along American Legion Road
currently has many residential properties to the northwest. Areas to the east and south
remain in agricultural production.
Compliance with the County's Comprehensive Plan
The County recently updated its Comprehensive Plan and the Future Land Use Map of
the comprehensive plan designates this area Residential. The Residential land use
category allows for, "single-family detached dwellings with a preferred density of one unit
per acre or denser." Although the density shown on the concept plan is less than one
dwelling unit per acre, the proposed rezoning is generally consistent with the County's
Comprehensive Plan.

In reviewing proposed rezonings in the Fringe Area, staff relies on the policies outlined in
the Fringe Area Agreement. The Fringe Area Agreement is a component of the City's
Comprehensive Plan and applies to areas not specifically planned for in the City's
Comprehensive Plan. The Fringe Area Agreement is intended to provide guidance
regarding the development of land located within two miles of Iowa City's corporate limits.
The agreement's slated purposed is to provide for orderly and efficient development
patterns appropriate to non -urbanized areas, protect and preserve the fringe area's
natural resources and environmentally sensitive features, direct development to areas
with physical characteristics which can accommodate development, and effectively and
economically provide services for future growth and development.
This property is located in Fringe Area B — Outside the City's Growth Area. For this area,
the agreement states that agricultural uses are preferred. Specifically, the agreement
states:
"Until otherwise changed by amending this agreement, this area shall be
restricted to those uses consistent with a Rural/Agricultural area as
indicated in the Johnson County Land Use Plan, and as designated for a
Rural/Agriculture area in Chapter 8:1.6 Class A District of the Johnson
County Unified Development Ordinance, as amended."
According to the Johnson County Comprehensive Plan, the Agricultural land use category
envisions agricultural uses, such as row crops and animal husbandry, with "very limited
residential development." According to the Johnson County Zoning Code, Agricultural
uses are defined as farms, nurseries and greenhouses, orchards and tree farms, with
residential uses to be restricted to two single-family dwellings on a farm 40 acres or larger.
Staff recognizes the conflict that exists between the County's updated Comprehensive
Plan and the adopted Fringe Area Agreement. The County's Comprehensive Plan also
outlines a goal to work with local jurisdictions on updating Fringe Area Agreement. Staff
is willing to coordinate with County staff to update the Fringe Area Agreement to address
these conflicts.
Staff Recommendation
Based on the policies outlined in the Fringe Area Agreement, which is
Comprehensive Plan, staff does not recommend approval of this

FRINGE AREA REZONING ITEM (CZ18-00002):
Discussion of an application submitted by Claude and Adam Greiner for a rezoning from County
Agriculture (A) to County Single Family Residential (R) for approximately 11.34 acres of
property located south of American Legion Road and west of Wapsie Avenue SE.
Russett noted this item is located in Johnson County, not in Iowa City limits, but is in fringe area
B, outside the City's growth area. She showed on a map where the proposed rezoning is
located, and noted the current County zoning for this area is agricultural. The applicant is
proposing dividing the parcel into seven single family residential lots and one outlot. Russett
noted the City is required to look at rezonings in the fringe area per the Fringe Area Agreement.
The County's future land use map indicates this area as residential, the residential land use
category allows single family detached dwellings with a preferred density of one dwelling unit
per acre or more. Although the density shown on the concept plan is less than one dwelling unit
per acre, the proposed rezoning is generally consistent with the County's Comprehensive Plan.

Hensch asked that since the Fringe Area Agreement hasn't been updated since the County's
Comprehensive Plan was updated perhaps the recommendation is the Fringe Area Agreement
should be updated. Parsons agreed and said they should be updated together. Russett said
that could be passed along to the City Council.
Signs asked that the rezoning application does fit within the County's Plan but not the Fringe
Area Agreement. Russett confirmed that was correct.
Hensch opened the public meeting
Gina Landau (MMS Consultants) represents the applicants, Claude and Adam Greiner, and
wanted to address the Fringe Area Agreement. She has spoken with the County and was told
that at any time the County or the City can request an update to the Fringe Area Agreement and
it is the County's intention to request an update as well. The County has also told Landau they
are in the process of working with some of the smaller towns to update fringe area agreements
and were working their way up to Iowa City. The current Fringe Area Agreement is 12 years old
and that is why it doesn't reflect what the County's current objectives are. The application
however does follow all the County rules regarding density, acres of correct size, street
locations, and stormwater management. Landau requests the Commission recommend that

yes, this area is good for residential use. The County has the ultimate say and Landau believes
they will recommend approval.
Victoria Sharp (5124 American Legion Rd, SE) noted some concerns regarding changing from
agricultural to residential based on a number of issues. First is the heavy traffic already on
American Legion Rd, speeds are quite fast, and multiple accidents have happened very close to
this area.
Hensch asked what the speed limit was along American Legion Rd. Sharp said it is 55 mph but
often people go much faster as well as there is heavy truck traffic on the road. Another concern
is the number of driveways onto the road, right now there is one, adding two additional
driveways (as seen in the plan) would increase the traffic. Another concern is location for
emergency services such as fire, where West Branch responds because Iowa City will not.
Sharp wonders if West Branch has been consulted as they would have to have additional
people available if there was a fire. Finally she noted a concern about how much overall
agricultural land will be rezoned to residential, there is the new school going up and it has a lot
of agricultural land around it and it would make more sense to rezone that area closer to the
school. Sharp also commented on the drainage, currently there is drainage that goes into that
area and there may be difficulties due to that drainage.
John Sharp (5124 American Legion Rd, SE) added that the American Legion Road is a very
recreational road, there is a bike path out there to Scott Park, and people do drive 70 mph down
the road and to have a residential development where there are these reckless speeds and
truck traffic from the propane place down the road is risky to the families that may live in this
residential area without addressing some of the safety concerns. Sharp also wanted to
acknowledge the concept of a good neighbor meeting would have helped a lot in this situation,
they found out about the rezoning by a sign across the street.
Hensch noted the Commission is a proponent of good neighbor meetings however this is a
county rezoning. Parsons also acknowledged the Sharp's concerns will have much more
meaning at the County level.
Hensch closed the public hearing.
Parson moved to recommend Council update the Fringe Area Agreement with Johnson
County.
Townsend seconded the motion.
Hensch agrees and hopes it can be done soon.
A vote was taken and the motion passed 6-0 (Baker absent).
Parsons moved to not approve CZ18-00002 an application submitted by Claude and
Adam Greiner for a rezoning from County Agriculture (A) to County Single Family
Residential (R) for approximately 11.34 acres of property located south of American
Legion Road and west of Wapsie Avenue SE.

Parsons stated he made the recommendation because while he believes the application
probably does conform with the County, it does not comply with the current Fringe Area
Agreement.
Signs noted this may become a bigger issue as he is aware of two other large open green
spaces nearby are destined for development so there is the potential of a rather large rural
residential area here.
A vote was taken and the motion passed 6-0 (Baker absent).
ZONING CODE AMENDMENT ITEM (ZCA18-00003):
Discussion of Amendments to Title 14, Zoning of the Iowa City Code related to transfer of
development rights for historic properties.
Russett began by providing the Commission with background as to why staff is working on this
ordinance, she will then talk about the existing transfer rights provisions which exist in Riverfront
Crossings, and finally will get into the specifics of the amendment proposed tonight.
At the City Council's May 29, 2018 meeting the Council considered the local landmark
designation of the property at 410-412 North Clinton Street. Council deferred action on the local
landmark designation until January 2019 while staff reviews and analyzes the establishment of
a city-wide transfer of development rights (TDR) program for historic properties. On August 7,
2018, Council discussed a city-wide TDR program at a work session and then on September 4,
2018, provided direction to staff on some key policy issues. Staff has been given a timeline by
Council, in June and August staff conducted a lot of research analysis of TDR around the
country, on September 4 they presented that research to Council and they directed staff to
move forward with drafting an ordinance. Last week staff presented the draft to the Historic
Preservation Commission and tonight are before the Planning & Zoning Commission for review
and discussion of this ordinance. Staff would like to present a draft to City Council next month,
the deadline for adoption of this ordinance, should the Council decide to adopt the ordinance, is
January 29, 2019, because that is when the expiration of the deferral for the local landmark
designation on the North Clinton Street property happens.
Russett provided some background as to why the City is perusing this ordinance. National
Register Districts are an honorary designation, it does not provide any protection for listed
resources, it does not limit a property owner from making modifications on a building or
demolishing a building, but it does offer incentives. On the flip side Iowa City's local historic
districts and local landmarks provide protection to historic resources and any changes to the
exterior of those buildings need to either be reviewed and approved by the Historic Preservation
Planner or the Historic Preservation Commission. The idea behind the transfer of development
rights ordinance is to provide an incentive to property owners to landmark their historic
buildings. Transfer of development rights is meant to protect historic resources by giving
property owners of those historic resources the ability to sell or transfer development rights to
another property. The areas that may receive the transfer of development rights are in areas
where the City wants to see more development. Russett acknowledged the goal is to preserve
historic landmark designations and buildings, right now it is uncertain the effectiveness of an
ordinance like this, there has been no market analysis to determine a market for these transfer
rights, and if people will actually utilize it.
