Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:00 p.m. on the 19'' of February 2019, in Emma
J. Harvat Hall, 410 E. Washington Street, Iowa
City, Iowa, or if said meeting is cancelled, at the
next meeting of the City Council thereafter as
posted by the City Clerk; at which hearing the
Council will consider:
An ordinance conditionally rezoning
approximately 0.155 acres from

Density Single Family Residential (RS -

Whereas, the applice , Anderson Construction, LLC, has requested a rez ing of property located at
2130 Muscatine Avenue fro Community Commercial (CC -2) to High Density S' gle-Family Residential (RS -
12); and
Whereas, the ComprehensiveNPlan indicates that appropriate infill de/elopment that is compatible and
complementary to the neighborhoodX desirable, and that there should transitions between high- and low-
density development as well as transitibQs between commercial and resili4ential areas; and
Whereas, staff recommends the follovNQg condition to be attach9d to the rezoning: the developer installs
a 5 -foot sidewalk along the Muscatine Aven and 2n° Avenue front ges of the property upon redevelopment
of the site or renovation of the existing building, nd
Whereas, the Planning and Zoning Commissi has/te
ended denial; and
Whereas, Iowa Code §414.5 (2019) provides hCity of Iowa City may impose reasonable

Conditional Zoning Agreement
This agreement is ade between the City of Iowa City, Iowa, a municipal corporation
(hereinafter "City"), iversity of Iowa Community Credit Union (hereinafter "Owner"), and
Anderson Construction, LC (hereinafter "Applicant").
Whereas, Owner is a legal title holder of approximately 0 155 acres of property located
at 2130 Muscatine Avenue; a
Whereas, the Applicant s requested the rezoning f said property from community
Commercial (CC -2) to High Densit Single -Family Residential (RS -12); and
Whereas, the Planning and Z ing Commission he recommended denial; and
Whereas, Iowa Code §414.5 ( 19) provides at the City of Iowa City may impose
reasonable conditions on granting a rez ing request over and above existing regulations, in
order to satisfy public needs caused by the equested hange; and
Whereas; the condition in this ag em#t addresses a public need, specifically
increased pedestrian connectivity through pede t an infrastructure improvements; and
Whereas, the Owner & Applicant ack o dge that certain conditions and restrictions
are reasonable to ensure the development of hep perty is consistent with the Comprehensive
Plan and the need to accommodate pedestr' n/bike y connections; and
Whereas, the Applicant agrees t develop thi property in accordance with the terms
and conditions of a Conditional Zoning A reement.
Now, therefore, in consideration of th mutual promises c tained herein, the parties agree as
follows:
1. The University of Iowa Co munity Credit Union is thlegal title holder of the property

2. The Owner acknowled es that the City wishes to ensure c nformance to the principles
of the Comprehens a Plan and the Central District Ian. Further, the parties
acknowledge that to a Code §414.5 (2019) provides that t e City of Iowa City may
impose reasonable conditions on granting a rezoning requ st, over and above the
existing regulation Vin order to satisfy public needs caused byte requested change.
3. In consideratiop' of the City's rezoning the subject property,'i Owner and Applicant
agree(s) that development of the subject property will conform to all other requirements
of the zoning chapter, as well as the following conditions:
a. Prior to the issuance of a certificate of occupancy, the developer will be required to
install 5 -foot sidewalks along the Muscatine Avenue and 2"d Avenue frontages upon
redevelopment of the site or renovation of the existing building.

4. The Owner and Applicant, and City acknowledge that the conditions contained herein
are reasonable conditions to impose on the land under Iowa Code §414.5 (2019), and
that said conditions satisfy public needs that are caused by the requested zoning
change.
5. The Owner and Applicant and City acknowledge that in the event the subject property is
transferred, sold, redeveloped, or subdivided, all redevelopment will conform with the
terms of this Conditional Zoning Agreement.
6. The partie acknowledge that this Conditional Zoning Agreement shall be deemed to be
a covenant n4pning with the land and with title to the land, and shall remain in full force
and effect as c1tcovenant with title to the land, unless or until released of record by the
City of Iowa City. /

Public notice is hereby given that the City Council of the

and estimated cost for the construction of the Gilbert Street
Intersection Improvements in said city at 7:00 p.m. on the

Public notice is hereby given that the City Council of the
City of Iowa City, Iowa, will conduct a public hearing on the
Project Manual, including the plans, specifications, contract,
and estimated cost for the construction of the Willow Creek
Park Improvements in said city at 7:00 p.m. on the 19th day of

playground installation, trails, plantings and associated work.
Add Alternate No. 1 includes the additional work and cost for
providing split face block along the base of the restroom and
open shelter structure as shown on the plans. Add Alternate
No. 2 includes the additional work and cost associated for
installing the play equipment as shown on the plans. Add
Alternate No. 3 includes the additional work and cost for
providing site amenities of grills, benches, bike parking, bike
repair station, dog liter receptacle, trash/recycling receptacles,
and associated work as shown on the plans; and is located at
1117 Teg Drive.
Said Project Manual and estimated cost are now on file in
the office of the City Clerk in the City Hall in Iowa City, Iowa,
and may be inspected by any interested persons.
